AN ORDINANCE limiting the scope of all existing utility
francises relating to future areas of annexation.
BE IT ORDAINED by the City Council of the City of Tukwila
as follows:
WHEREAS, franchises have been granted to establish public
service facilities within the Town limits and,
WHEREAS, advancement to status as a City of the third
class renders future annexation of areas possible, which areas are
in some instances different in togopgraphy, geography, development,
use and established facilities, and
WHEREAS, question has arisen as to the scope, purpose and
intent of said franchises in their application to areas which may
be annexed in the future,
NOW, THEREFORE, be it resolved:
(1) That it is the stated purpose and intent of the
City Council of the City of Tukwila that the said
franchises apply to the presently existing area
of the City, but not otherwise.
(2) That no public utility franchise of any type or
nature shall be deemed to extend to or exist
within any area hereafter annexed or otherwise
added to the present limits of the City as a matter
of rights.
(3) Public utility franchises shall, in each instance
of annexation or other addition of territory, be
granted for such additional area upon an indivi-
dual basis, in each instance to depend upon the
facts and unique considerations of the area in-
volved including but not limited to development,
land use, planned and established facilities,
geography and topography.
