This report has been prepared to define the wetland boundary, and determine the wetland type, and required buffers and setbacks. 1.1 Scope of Services The scope of work for this study was limited to the following tasks: • A review of documents readily available, including local wetland inventory maps, U.S. Fish and Wildlife Service National Wetland Inventory Maps, aerial photographs, previous wetland review completed by others, and Washington State Department of Natural Resources (DNR) and Washington Department of Fish and Wildlife (WDFW) databases. • A visual assessment to observe existing site conditions and to identify wetland located on or within 300 feet of the site. Methods defined in the Washington State Wetland Identification and Delineation Manual (1997), and the U.S. Army Corps of Engineers Wetland Delineation Manual (1987) were used to determine the presence and extent of wetlands on the site. Only onsite wetlands nearest the residence were flagged and surveyed. • Review federal, state, and local regulations pertaining to wetland identified on the site. • An assessment of onsite wetland functions and values. • A report documenting the process, findings, and conclusions for this project. 1.2 Site Location and Description The proposed project site is comprised of one parcel (1523049044) totaling approximately 1.02 acres, located at 14251 MacAdam Road South in Tukwila, Washington (Section 15, Township 23 North, Range 04 East, W.M.). Onsite are a single - family residential building, bird coop, and abandoned cisterns and drain tile system. The aba n doned cistern and drain pipe located on the site were damaged about 6 or 7 years ago when the Department of Agriculture accessed the slope to remove trees due to an invasive beetle that was located in the local area. The concrete cistern was removed and the pipe system was repaired according to the property owner. North, south, an wd es� f fthe site are residences and undeveloped land. East of the site is MacAdam Road South. 2.0 DOCUMENT REVIEW A review of readily available documents was conducted to characterize the site. 2.1 U.S. Fish and Wildlife Service National Wetland Inventory Map The U.S. Fish and Wildlife Service National Wetland Inventory (NWI) Map of the Tukwila area does not show wetland on or within 300 feet of the site. Wetland Delineation Report Hakimi Deck 210289.70 1 000 2.2 Soil Survey of King County Area, Washington The Soil Survey of King County Area, Washington as depicted by the Web Soil Survey was reviewed to determine the general nature of soils on the subject site. Soils for the site are not mapped for the site, and the surrounding area is mapped as urban soils. The Tukwila Sensitive Areas Inventory Map identifies the site as containing a Type 2 Wetland requiring an 80 -foot buffer. The wetland delineation identified a wetland that meets the City of Tukwila Type 3 standards, and not Type 2 standards, because it is less than 1 acre in size and contains two wetland vegetation classes, does not contain nesting sites for priority species as listed by the WDFW, and is connected via underground pipes to the City storm system along MacAdam Road South. On June 1, 2010, Theresa Dusek visited the property to evaluate the site and surrounding area, and flag onsite wetlands nearest the residence. The flags were surveyed by AHBL. One onsite wetland was identified in the central portion of the site (Appendix A, Exhibit WE -1). Offsite wetland appears to be present north and south of the site along the same elevation. Wetland boundary flags were pink pin flags with "Wetland Delineation" stamped on the flags. The flags were marked with sequential numbers from 1 to 16 and wetland identifiers (W -1 indicates wetland boundary flag 1). The sampling point locations were marked with black and orange ribbon flag tied onto vegetation and marked with a numeric identifier (DP -1 indicates Data Point 1). The approximate location, size, and rating of the wetland were also determined. The site visit included visual observation of the project site and, where possible, the surrounding area within 300 feet of the site for wetland. The site wetland was characterized by data gathered at three data points (Appendix B). Additional soil pits were excavated within and surrounding the wetland to verify soil conditions. The topography of the project site and surrounding areas has been historically manipulated by historic construction of cisterns on the slopes, a road on the slope, the residence, an addition to the residence, an accessory building that has since been removed, and the existing bird coop. Overall, the site slopes down from the west to the east. Marsh wrens (Cistothorus palustris), chickadees (Poecile atricapilla), nuthatch (Sitta canadensis), robin (Turdus migratorius), and sparrows were observed during the site visit. Based on the use of the triple - parameter approach (defined within the 1987 and 1997 manuals) and current site conditions, one wetland was identified on the subject site. Additional wetlands may be located onsite on the slopes located west of the flagged system, but only wetlands closest to the residence were flagged and surveyed. The wetland appears to extend to the south 2 000 between Flags 15 and 16. Although blackberry is the dominant vegetation, hydric soils continue to the property line. The onsite portion of the wetland is 2,145 square feet (0.06 acre) in size. The estimated total wetland size, based on the worst case scenario using an aerial photograph and visual observation from road rights -of -way, is 0.90 acre (see Appendix A, WE -2). The western portion of the wetland was historically a concrete lined cistern that was abandoned in the historic past. Sand was present in this portion of the wetland. The hydrogeomorphic classification of the onsite wetland is Depressional /Slope. The Cowardin classification of the onsite wetland is Palustrine scrub - shrub /emergent, seasonally flooded. Vegetation species were identified and classified with a Wetland Indicator Status (WIS) assigned by the U.S. Fish and Wildlife Service (1988 and 1993); soil conditions were identified using the National Technical Committee for Hydric Soils Field Indicators of Hydric Soils in the United States; and observations of hydrologic conditions including inundation and soils saturation were made by hand, excavated with a shovel 18 to 20 inches deep at three representative data points on the site. Additionally, hand excavated test pits were completed to determine if there were differences in soil or hydrologic conditions from the marked sample plots. The wetlands were identified as such because all three wetland parameters were present under current site conditions. The wetlands have been classified using the Classification of Wetlands and Deepwater Habitats of the United States (Cowardin et al, 1979). The wetland was rated using Tukwila Municipal Code 18.45.080, Vegetation. Representative sampling points were established to document plant species and dominance of vegetation on the subject property (Appendix A, Exhibit WE -1). The dominant vegetative species composition within the onsite wetland varied from scrub -shrub wetland dominated by red alder (Alnus rubra) and willow (Salix sp.), to emergent wetland dominated by cattail (Typha latifolia), stinging nettle (Urtica dioica), horsetail (Equisetum telmatiea), and sedges (Carex spp.). Red alder saplings had been cut on the site in and near the wetland within the last few years. The stumps from the saplings were sprouting during the site visit. Vegetation within the wetland edge is dominated by Himalayan blackberry, which is encroaching into the wetland system. Onsite upland habitat adjacent to the wetland is dominated by Himalayan blackberry, domestic plum trees, and red alder. Plant species listed federally or by the state as threatened or endangered have not been observed on the site. Data forms detailing observations for vegetation are included in Appendix B. During the site evaluation, soil conditions (including color, texture, and relative moisture content) were observed and recorded at sampling points on the project site. The indicators used to identify hydric soils can be found in the field Indicators of Hydric Soils of the United States. Soil types observed on the site ranged from silt loam to sandy loam to clay loam. The sandy loam soil was located in the historic cistern area, and the clay loam is located in the east portion of the wetland. Data forms detailing observations for soils are included in Appendix B. Hydrologic conditions, including saturated soils and indicators of wetland hydrology as defined by the 1987 and 1997 manuals, were observed at the onsite wetland (Appendix B). Generally, the onsite wetlands contained saturated soils near the surface (within 12 inches). Hydrology in the wetlands is provided by groundwater seepage and local runoff. The pipe and drain tile system is still present within the wetland and surrounding area, and discharges at the southeast property corner into the City stormwater system in MacAdam Road South. Some of the drain tiles have been damaged, as one was observed broken and lying on the surface of the ground near Flag 10. Detailed scientific knowledge of wetland functions is limited, so that evaluation of the functions of individual wetlands is qualitative and dependent upon professional judgment. The wetland was Wetland Delineation Report Hakimi Deck 210289.70 3 0000 evaluated for the following wetland functions and values: (1) flood and stormwater control; (2) base flow and groundwater support; (3) water quality improvement; (4) natural biological support; (5) overall habitat function; and (6) specific habitat functions. The wetland generally has moderate biologic functions due to its size, highly disturbed condition, seasonal condition, lack of long term ponded water, lack of snags and large woody debris, and presence of two wetland plant communities. Habitat within the wetland system provides for a broad range of species that use the adjacent forested slopes, existing wetland shrub, and emergent habitats throughout different stages of their life cycle. The wetland provides suitable feeding, breeding, and refuge for a suite of different fauna including invertebrates, terrestrial birds, and terrestrial mammals. Use of the site by aquatic animals is limited by long term lack of ponded water. Habitat diversity is provided by a range of structures, vegetation, and interspersion of "habitat" types within the wetland and adjacent habitats. The wetland buffer is well developed and contains forested habitat on the slopes, although it is surrounded by residential and road development. The wetland and buffer contain non - native invasive plant species, including Himalayan blackberry, English ivy, and holly. In general, the wetland has moderate hydrologic functions. The wetland is a slope with depressions, which provides water quality treatment, removal of sediments and retains a limited amount of water. The wetlands provide a discharge of groundwater that is routed by pipes to the City storm system. 5.0 WETLAND REGULATIONS Based on the information derived through site reconnaissance and readily available documents, one wetland is located on the site and extends offsite to the south. Federal and state agencies with jurisdiction over impacts to wetland on and near the site include the U.S. Army Corps of Engineers, and the Washington State Department of Ecology. Alterations to the wetlands, including clearing, draining, filling, dredging, and replacement or repair of pipes, would require permits from these agencies. In addition, the City of Tukwila regulates wetlands in Tukwila Municipal Code 18.45. Although the City inventory maps identify the onsite wetland as a Type 2 system, our review (including flagging and surveying of the onsite wetland, and determining the worst case scenario for the total size of the wetland on and offsite) determined the wetland to be a Type 3 system requiring a 50 -foot buffer and a 10 -foot building setback. Tukwila Municipal Code 18.45.080.B indicates the following, with our analysis following. Code: 1. Type 1 wetlands are those wetlands that meet any of the following criteria: a. The wetland is characterized by the presence of species listed by the federal government or state as endangered or threatened, or the presence of critical or outstanding habitat for those species; b. The wetland has 40 to 60 percent permanent open water in dispersed patches with two or more classes of vegetation; c. The wetland is equal to or greater than 5 acres in size and has three or more wetland classes, one of which may be substituted by permanent or open water; or d. The wetland is documented as regionally significant waterfowl or shorebird areas by the State Department of Fish and Wildlife. Wetland Delineation Report Hakimi Deck 210289.70 4 Analysis: The on and offsite wetland system is not characterized by the presence of species or habitats listed by federal or state agencies as endangered or threatened, and is not documented as regionally significant waterfowl or shorebird areas based WDFW habitat and species maps. The wetland does not have 40 to 60 percent permanent open water in one area or dispersed patches based on aerial photograph review. The wetland is less than 1 acre in size, on and off the site, based on survey and the offsite wetland worst case scenario map located in Appendix A. The on and offsite wetland system is not a Type 1 wetland. Code: 2. Type 2 wetlands are those wetlands that meet any of the following criteria: a. The wetland is equal to or greater than 1 acre in size; b. The wetland has three or more wetland classes and is less than 5 acres; c. The wetland is characterized by the presence of nesting sites for priority species as listed by the Washington State Department of Fish and Wildlife; or d. The wetland is hydrologically connected (non - isolated) to a Type 1 or Type 2 watercourse. Analysis: The wetland is not greater than or equal to 1 acre in size based on observation from 144 Street, MacAdam Road, and the site boundary, and review of aerial photographs and the offsite wetland worst case scenario map located in Appendix A. The wetland has two vegetation classes where species are rooted in the wetland scrub -shrub and emergent. The wetland is not characterized by the presence of nesting sites for priority species as listed by the WDFW based on WDFW habitat and species maps. The wetland is hydrologically connected via pipes to the City storm system in MacAdam Road and does not discharge directly into a Type I and Type 2 watercourse. The on and offsite wetland system is not a Type 2 wetland. Code: 3. Type 3 wetlands are those wetlands that are greater than 1,000 square feet and less than 1 acre in size with two or fewer wetland classes. Analysis: The wetland is greater than 1,000 square feet in size and has two wetland classes, scrub -shrub and emergent. The on and offsite wetland system is a Type 3 wetland. The project does not propose to impact wetland directly. The project is a deck that was constructed without a permit from the City of Tukwila. AHBL flagged and surveyed (a) the onsite wetland boundary nearest the residence, (b) the location of the bird coo located in the buffer between the wetland and the deck that was added onto the existing residence in 07, (c) the deck overhang corners, and (d) the corners of the main residence addition. Note the existing residence that was added onto was not surveyed because the issue was the deck on the larger portion of the residence. Based on the survey, the deck is not located within the 50 -foot code required buffer or the 10 -foot building setback. 6.0 CONCLUSION Based on the 1987 and 1997 manuals, vegetation, soils, and hydrologic conditions necessary for an area to be considered a wetland were found on the site and extended offsite to the south. The wetland was determined to be a Type 3 system requiring a 50 -foot buffer with a 10 -foot building setback based on Tukwila Municipal Code 18.45. The proposed project, a deck added onto the residence, is not located within the wetland, the code required buffer, or the building setback. Wetland Delineation Report Hakimi Deck 210289.70 5 D 7.0 CLOSURE The findings and conclusions documented in this report have been prepared for specific application to this site. They have been developed in a manner consistent with that level of care and skill normally exercised by members of the environmental science profession currently practicing under similar conditions in the area. Our work was also performed in accordance with the terms and conditions set forth in our proposal. The conclusions and recommendations presented in this report are professional opinions based on an interpretation of information currently available to us, and are made within the operation scope, budget, and schedule of this project. No warranty, expressed or implied, is made. Wetland boundaries identified by AHBL, Inc. are considered preliminary until the flagged wetland boundaries are validated by a jurisdictional agency. Validation of the wetland boundaries by the regulating agencies provides a certification, usually written, that the wetland boundaries verified are the boundaries that will be regulated by each agency until a specific date or until the regulations are modified. Only the regulating agencies can provide this certification. Because wetlands are dynamic communities affected by both natural and human activities, changes in wetland boundaries may be expected; therefore, wetland delineations cannot remain valid for an indefinite period of time. The U.S. Army Corps of Engineers typically recognizes the validity of wetland delineations for a period of 5 years after completion of a wetland delineation report. Development activities on a site 5 years after the completion of this wetland delineation report may require revision of the wetland delineation. In addition, changes in government codes, regulations, or laws may occur. Because of such changes, our observations and conclusions applicable to this site may need to be revised wholly or in part. The plans do not clearly show how the roof ledger is connected to the existing building. The side over hang framing shown does not make sense and shall require clarification with details. The roof details and specifications shall identifr sheathing, roofing and spacing for all fasteners. Show lateral seismic bracing of the front post to beams. Sped hurricane hardware for rafter to beam connections. The rafter sizing still has not been changed to meet the spans indicated. This shall be revised to meet the spans indicated. 4. Plans shall require complete details for the stairs with all dimensions shown. Provide those details. 5. Show on the plan access from the house or identify exterior door accessing the deck. Provide this information with details and show on the plans. 6. The deck rafters extend over to the outside beam. However it is not clear as to how the rafters set on the exterior beam or how they are fastened. All connections shall be identified and shall continue down to the footing. A clear detail to show how the upper post shall be connected to show connectivity down to the supports below to resist wind uplift. Provide clear details as requested. 7. Front view of deck shows pier blocks used, where side view shows concrete footings. Please clarify plans for consistency. Include dimensions for spacing of all supporting post and footings. Pier blocks are not allowed for a structure attached to a building. Revise plan to show the above as requested. 8. Water from the cisterns and drain tiles enters a pipe that discharges into the stormwater ditch along MacAdam Road South. Some of the water flows over the surface and likely meets the definition of a wetland. • A wetland delineation and survey of the wetland flags is required by the City of Tukwila. We will set the flags; however, you will need to hire a surveyor to locate the flags. • The Tukwila Municipal Code has provisions to allow for reduction of buffers if the area of the buffer reduction is not on a 15 percent slope. Given that the existing bird -coop, an old building that has since been removed, and mowed grass are located between the potential wetland area and the deck location, it is anticipated that this area has a slope of less than 15 percent. • If we need to request a wetland buffer reduction, the City will require enhancement of the buffer by planting native vegetation. Any construction, alteration, improvement, or repair carried on within the limits and boundaries of any site or reservation under the legal jurisdiction of the federal government; 8. Any person who only furnished materials, supplies, or equipment without fabricating them into, or consuming them in the performance of, the work of the contractor; 9. Any work or operation on one undertaking or project by one or more contracts, the aggregate contract price of which for labor and materials and all other items is less than five hundred dollars, such work or operations being considered as of a casual, minor, or inconsequential nature. The exemption prescribed in this subsection does not apply in any instance wherein the work or construction is only a part of a larger or major operation, whether undertaken by the same or a different contractor, or in which a division of the operation is made into contracts of amounts less than five hundred dollars for the purpose of evasion of this chapter or otherwise. The exemption prescribed in this subsection does not apply to a person who advertises or puts out any sign or card or other device which might indicate to the public that he or she is a contractor, or that he or she is qualified to engage in the business of contractor; 10. Any person working on his or her own property, whether occupied by him or her or not, and any person working on his or her personal residence, whether owned by him or her or not but this exemption shall not apply to any person who performs the activities of a contractor on his or her own property for the purpose of selling, demolishing, or leasing the property; 13. An owner* who performs maintenance, repair, and alteration work in or upon his or her own properties, or who uses his or her own employees to do such work; 14. A licensed architect or civil or professional engineer acting solely in his or her professional capacity, an electrician certified under the laws of the state of Washington, or a plumber certified under the laws of the state of Washington or licensed by a political subdivision of the state of Washington while operating within the boundaries of such political subdivision. The exemption provided in this subsection is applicable only when the person certified is operating within the scope of his or her certification; 15. Any person who engages in the activities herein regulated as an employee of a registered contractor with wages as his or her sole compensation or as an employee with wages as his or her sole compensation; 16. Contractors on highway projects who have been prequalified as required by RCW 47.28.070, with the department of transportation to perform highway construction, reconstruction, or maintenance work; 17. A mobile /manufactured home dealer or manufacturer who subcontracts the installation, set -up, or repair work to actively registered contractors. This exemption only applies to the installation, set -up, or repair of the mobile /manufactured homes that were manufactured or sold by the mobile /manufactured home dealer or manufacturer; 18. An entity who holds a valid electrical contractor's license under chapter 19.28 RCWthat employs a certified journeyman electrician, a certified "residential specialty electrician, or an electrical trainee meeting the requirements of chapter 19.28 RCWto perform plumbing work that is incidentally, directly, and immediately appropriate to the like -in -kind replacement of a household appliance or other small household utilization equipment that requires limited• electric power and,limited waste and /or water connections.
