Until that time, this Guarantee is not in force and has no effect. The Parties agree that any controversy or claims relating to this Guarantee shall be first submitted to mediation under the Construction Industry Arbitration and Mediation Rules of the American Arbitration Association (Regular Track Procedures) or to such other mediation arrangement as the parties mutually agree. No court or other tribunal shall have jurisdiction until the mediation is completed. No one is authorized to change, alter, or modify the provision of this Guarantee other than the Manager, Guarantee Services Unit or authorized delegate. JM's delay or failure in enforcing the terms and conditions contained in this Guarantee shall not operate as a waiver of such terms and conditions. This Guarantee is solely for the benefit of the Building Owner identified above and Building Owner's rights hereunder are not assignable. Upon sale or other transfer of the Building, Building Owner may request transfer of this Guarantee to the new owner, arid JM may transfer this Guarantee, in its sole discretion only after receiving satisfactory information and payment of a transfer fee, which must be paid no later than 30 days after the date of Building ownership transfer. In the event JM pays for repairs which are required due to the acts or omissions of others. JM shall be subrogated to all rights of recovery of the Building Owner to the extent of the amount or the repairs. Because .IM does not practice Engineering or Architecture, neither the issuance of this Guarantee nor any review of the Building's construction or inspection of roof plans (or the Building's roof deck) by JM representatives shall constitute any warranty by JM of such plans, specifications, and construction or in any way constitute an extension of the terms and conditions of this Guarantee. REVIEWED FOR CODE COMPLIANCE AP PROVED JUL 15 2009 City of Tu BUILD Cascade Crest Consulting Engineers, Inc. performed a brief site visit to Building 9 at Gateway Corporate Center in Tukwila, Washington on March 6, 2009 to gather information for a proposed roofing overlay to the building. Subsequent to our site visit partial structural drawings for the roof framing systems of the building were provided for our review. This letter summarizes our observations and findings. The existing building is a one -story concrete tilt -up structure with a panelized wood roof framing system. According to the available drawings, oriented strand board roof sheathing is supported by 2x6 subpurlins and 4x or glu- laminated wood puffins at 8' on- center, which are in turn supported by glu- laminated wood beams. Per notes on the structural drawings, the material utilized for the subpurlins consists of Hem Fir No. 2 wood members. Steel tube columns and the perimeter concrete wall panels support the roof framing. The ground floor is a concrete slab -on- grade. The foundation system consists of conventional concrete spread footings with continuous strip footings at the perimeter walls and square pad footings at the columns. The existing roofing system consists of a built -up roofing system which, according to Westcoast Roof Consulting, weighs approximately 2.0 pounds per square foot. The proposed overlay system weighs approximately 1.6 pounds per square foot. Our calculations, based upon the drawings provided and our observations in the field indicate that the existing roof framing has the strength to support the proposed roofing overlay system.
