ORDINANCE NO.
39 3 AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON,
REPEALING ORDINANCE NO. 849 AND TMC CHAPTER 16.30,
RELATING TO DANGEROUS BUILDING CODE,IN ITS EN-
TIRETY AND REPLACING WITH NEW LANGUAGE.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Ordinance No. 849 (TMC Chapter 16.30, Dangerous Building
Code) is hereby repealed and replaced by the following:
16.30.010 The City adopts the 1982 edition of the Uniform
Code for the Abatement of Dangerous Buildings, excluding Section
802. Three copies of the new 1982 edition for the Uniform Code for the
Abatement of Dangerous Buildings shall be filed in the office of the City
Clerk.
16.30.20 Duties of City Attorney. The City Attorney shall:
(a) Prosecute all persons failing to comply with the terms of
the notices provided for herein and any final order issued by the Planning
Director or designated representative and /or the Board of Appeals and as
may be directed by the Mayor and City Council;
(b) Appear when requested to do so at hearings before the Board
of Appeals in regard to dangerous buildings;
(c) Initiate appropriate action to collect costs incurred by the
City as provided in Section 16.30.030.
(d) Provide such additional legal services as may be requested
by the Board of Appeals and the Mayor and City Council.
16.30.030 Abatement by City.
(a) The City Council may, upon approval and passage of an ap-
p ropri ate resoI uti on or ordi nance, d i r e c t the M a y o r -o r d e s i g.-
nated representative to abate a public nuisance as determined by the pro-
visions of this chapter and such public nuisance may be abated by City per-
sonnel or by private contractor under the direction and pursuant to the
order of the Planning Director or designated representative.
(b) The City Council shall appropriate sufficient funds to
cover the cost of such repair or demolition work. The costs incurred by
the City in any such abatement proceedings shall be recovered by special
assessment against the real property involved and shall constitute a lien
as provided by law, and particular reference being made to Chapter 82 of
the Session Laws of 1959.
16.03.040 Emergency Cases. In cases where it reasonably ap-
pears that there is immediate danger to the life or safety of any person
unless a dangerous building as defined herein is immediately repaired,
vacated or demolished, the M a yo r o r h ies designated representa-
tive shall cause the immediate repair, vacation or demolition of such
dangerous building. The costs of such emergency repair, vacation or
demolition of such dangerous building shall be collected in the same man-
ner as provided for hereinabove.
16.30.050 Act Not Exclusive. Nothing in this chapter shall be
construed to abrogate or impair the power of the City or any department
thereof to enforce any provision of its chapter or its ordinances or regu-
lations, nor to prevent or punish violations thereof, and any powers con-
ferred by this chapter shall be in addition to and supplemental to powers
conferred by other laws, not shall this chapter be construed to impair or
limit in any way the power of the City to define and declare nuisance and
to cause their removal or abatement by summary proceedings, or in any manner
provided by law.
16.30.060 Administrative Liability. No officer, agent or em-
ployee of the City shall render himself personally liable for any damage
that may accrue to persons or property as a result of any act required or
permitted in the discharge of his duties under this chapter. Any suit
brought against any officer, agent or employee of the City, as a result of
any act required or permitted in the discharge of his duties under this
section shall be defended by the City until the final'determination
of the proceedings therein.
16.30.070 Violations Penalties. Every person violating any
of the provisions of this chapter shall be punishable by a fine not ex-
ceeding three hundred dollars or by imprisonment not exceeding ninety days
or by both such fine and imprisonment, and each day's violation shall con-
stitute a separate offense punishable under this chapter.
16.30.080 Severability. If any provision of this chapter or
its application to any person or circumstance shall be held invalid the
remainder of this chapter or the application of the provision to other
persons or circumstance shall not be affected thereby.
