Rants, Mayor NOTICE OF DECISION Phone: (206) 433 -1800 • City Hall Fax (206) 433 -1833 Planning Commission Minutes Page 7 March 26, 1992 Mr. Clark stated that he agreed that a study needed to be completed, but the way the Ordinance is written, Mr. Lowe will not be allowed to get rid of the wetland once it is delineated. Jack Pace clarified that Mr. Lowe has five lots of record and if he does the delineation study, then he can request a reasonable use exception to those criteria as stated in the Sensitive Areas Ordinance. If the wetland affects the lots then the applicant can decide what changes or exceptions he would like to request, however, the staff needs to document that a wetland study has been completed before this can occur. Mr. Meryhew asked if it is indeed true that the study may determine that this is a Type 3 wetland. Jack Pace stated that it very well could turn out to be a Type 3 wetland, however, it will not be knowri until the study has been completed. During Mr. Lowe's rebuttal, he noted that staff did have the revised plans which were handed out this evening, and have had them since September 8, 1991. He went on to say that although staff indicates that the Public Works Dept. has stated that Slade Way is stable, Geo Engineers, a firm used by the City, states that there is some instability with regard to Slade Way. Mr. Lowe turned in a report by Geo Engineers which was labeled Exhibit E. Mr. Knudson stated that he felt Mr. Lowe had a unique situation where the wetland can be preserved, as well as having a viable project. During Mr. Pace's rebuttal, he stated that the Engineering Department has stated that there have been some slides on Slade Way, however, it does not pose an immediate safety hazard. In addition, the Public Works Department will be hiring a geologist to look at the public right -of -way further. The staff's responsibility is to follow the requirements of the Sensitive Areas Ordinance. Mr. Malina closed the public hearing at 10:30 p.m. MR. MERYHEW MOVED TO DENY THE APPEAL UNTIL THE APPLICANT HAS COMPLETED THE WETLAND DELINEATION STUDY AS REQUESTED BY '1 STAFF. MR. HAGGERTON SECONDED THE MOTION AND THE MOTION WAS UNANIMOUSLY APPROVED. L92 -0014: Toys -R -Us Jack Pace presented the staff report. He stated that the Sign Code allows a wall sign to be 150 sq. ft., however, the Planning Commission can approve a sign up to 308 sq. ft. and the applicant is requesting a sign of 250 sq. ft. The rationale for the larger sign is the setback Planning Commission Minutes Page 6 March 26, 1992 Gary Schulz, Urban Environmentalist, stated that Jack Pace handed out a set of criteria for studies of wetlands that staff has worked up They are based on other jurisdictions and supported by the SAO. He noted that the applicant had received a copy of this handout. He noted that the letter that was submitted by the applicant's consultant for wetlands, was not intended to be a study, but it was a review of the site. The Ordinance is clear in that a study needs to be completed and a waiver cannot be issued because it is already known that there will be impacts. Mr. Schulz stated that he reviewed the site and in his opinion it would be considered a Type 2 wetland. The site has mature trees and the cover is significant to call it a forested wetland. The wetland study should include an accurately mapped wetland boundary, a wetland rating type, and it should include data of the vegetation, soils and hydrology on the site. This would be a standard wetland delineation report. The Ordinance does not rate wetlands based on value, that's a judgmental call, but there are many different functions of wetlands and the Ordinance does not allow one to evaluate that. This wetland is a discharge wetland, however, to remove vegetation from the site would create more water because much of the water is being taken up by the vegetation. In conclusion, Mr. Schulz stated that staff is following the regulations of the ordinance in requiring a wetland delineation study, therefore staff would recommend that the appeal be denied. Mr. Clark asked why it was a Type 2 wetland versus Type 3. Mr. Schulz stated that the Type 2 wetland rating allows a greater value or consideration for forested wetlands. Forested wetlands are defined as having at least 20% cover, and this wetland meets that description. He went on to say that this wetland has emergent plants, shrubs and trees and therefore has three classes, although which is more dominant is unclear. The tree cover is greater than 20 %. Mr. Haggerton asked if there was a specific form or format that the City requires for a wetland delineation study, and does it have to be provided by a certain professional title. Mr. Schulz stated that issue is not covered clearly in the Ordinance and that is why the criteria were handed out. This list of criteria follows closely with what King County and Pierce County is using. The study should be completed by a wetland biologist. Mr. Clark stated that he could understand Mr. Lowe's hesitation in completing a wetland delineation study because if you admit that this is a wetland then implicit in that is the fact that the wetland cannot be destroyed. • Mr. Schulz stated that if we don't know enough about the wetland it's hard to say that there's even a possibility of getting a home in there with some variance on buffer. We cannot decide that right now without the study. Planning Commission Minutes March 26, 1992 distance from Southcenter Parkway, which is approximately 330 feet. The applicant is doing some improvements to their building and would . like to put up a new sign. Given the setback distance from Southcenter Pkwy., and the size of the building, staff feels that it would be appropriate to grant the increase in the size of the sign. The applicant is not in conflict with the Comprehensive Plan or the Sign Code. Staff recommends that the sign request be approved. Surrounding Land Uses BACKGROUND FINDINGS L92 -0014: Toys -R -Us 1. Project Description The applicant proposes to install a 256 square -foot (s.f.) sign on the Toys -R -Us retail building (see Attachment A). The sign would exceed the Sign Code limit of 150 s.f. Under special provisions in the Code, the Planning Commission may approve the size increase, as this is a commercial building with a setback several times greater than the required setback (per TMC 19.32.140). The proposed sign consists of colored acrylic panels which are internally illuminated. Colors of the proposed sign will be similar to those of the existing sign: red, orange, green and yellow. The existing orange giraffe -head logo will also be used (see Attachment B). The project is surrounded by commercial uses. The proposed sign would face retail areas along Southcenter Parkway (see Attachment C). The applicant is planning to construct a new west facade for the Toys -R -Us building (see Attachment C), which would include refurbishing and replacement of the existing sign. However, the existing sign does not conform to the Sign Code's size limit (see Attachment D). Under the Sign Code, non - conforming signs must be brought into compliance when "there are substantial alterations or enlargements to the site or building exterior upon which the nonconforming sign is located requiring issuance of a license or permit from the City of Tukwila" (TMC 19.28.030). Due to the fact that the project involves substantial alterations to the building, the Toys -R -Us sign must be brought into conformance with the current Sign Code. To conform to code, any sign installed on the west facade cannot exceed 150 s.f. in area. However, the Code has a special provision by which the Planning Commission can approve an increase, based on the building's setback distance. The Code requirements and special approval provisions related to the proposal are further discussed below. Staff Report to Planning Commission L92 -0014: Toys -R -Us Page 3 DECISION CRITERIA The Planning Commission review criteria are shown below in bold, along with staff's summary of relevant facts. 1. Sign Code Regulations for Commercial Zones (TMC 19.32.140). a. "The area of all signs on an exposed building face for each business shall be as provided in Table 1." For building facades over 5000 square feet in area, Table 1 given in the Sign Code allows a maximum sign size of 150 square feet. The exposed building face at Toys -R -Us is 5,133 square feet (29.33' high by 175' long). Therefore, the Code allows outright a maximum sign size of 150 s.f. for the Toys -R -Us building. b. "Upon application to and approval by the Planning Commission, the permitted sign areas provided in Table 1 may be increased no more than fifty percent for each doubling of the required minimum setback distance for the wall upon which a particular sign is to be placed, but in no case shall sign area exceed that permitted in Section 1932.150 [...six percent of the exposed building face area, up to a 'maximum of 500 square feet...(TMC 19.32.150. Planned Shopping Centers)]." The chart below shows the sign size which would be allowed for each doubling of the setback. The size limit for planned shopping centers is also given. The required minimum setback for Toys -R -Us is 29 feet; (TMC 18.50.020); the new building addition will have a setback of 330 feet (see Attachment C). Thus, as shown in the chart, the proposed building setback doubles the required setback five times. If the size were based on setback alone, the sign area could be increased in 75' increments up to 525 s.f. However, the sign cannot exceed the maximum allowed for a planned shopping center. This maximum is 308 s.f. (5,133 s.f. multiplied by 6 %). Therefore, the Planning Commission has the authority to approve a Toys -R -Us sign up to 308 s.f. The Comprehensive Plan (Policy 6, pg. 61) states that "all signs should be generally attractive and to scale in size and height with the buildings and premises to which it is related." The intent of the Sign Code (TMC 19.04.020 (A) is to "establish standards....so that the streets of Tukwila may appear orderly and safety may be increased by minimizing clutter and distraction." The style of the proposed Toys -R -Us sign reflects the store's orientation to children and toys. The sign's "rainbow" color scheme is reflected in multi - colored borders around the entry of the new facade (see Attachment B). The project is located in a commercial setting, in the vicinity of several shopping complexes. The building has a setback many times greater than other buildings in the immediate vicinity. Due to this unusually large setback, along with a large front parking lot, the Toys -R -Us complex has a large -scale appearance. Staff Report to Planning Commission L92 -0014: Toys -R -Us Page 5 CONCLUSIONS 1. Sign Code Regulations for Commercial Zones (TMC 19.32.140): The proposed sign is approximately 100 s.f. larger than that permitted outright by Code. However, at 256 s.f., it is smaller than the maximum 308 s.f. which could be approved by the Planning Commission. Therefore, the Toys -R -Us sign meets the criteria specified by the Sign Code's special review provisions. 2. Tukwila Comprehensive Plan and Intent of Sign Code: Due to the large size of the proposed sign, is important to evaluate the effect of its size relative to the building face and to surrounding areas. As noted in the Findings, the sign has been designed to be harmonious with the theme of a toy store and with the architectural theme of the new facade. The sign is large, but, at less than 6% of the building face, it is not out of scale with the large -scale building and premises. As a result, the proposal complies with the Comprehensive Plan policies for sign attractiveness and appropriate scale. Due to the project's location in a busy commercial area, the sign is consistent with its surroundings. The sign will also have a substantial setback from Southcenter Parkway. These two factors greatly reduce the potential impact of a large sign. The colors of the sign are bright; however, based on field inspections, they do not cause unsafe distraction. Based on this, staff concludes that the Toys -R -Us proposal is consistent with the Sign Code's intent to avoid distraction and clutter. RECOMMENDATIONS The Planning Staff recommends that the Planning Commission approve the Toys -R -Us sign as proposed. It is the intent of Toys "R" Us to add an addition to the front of the store that is approximately 10' x 100' 8" long. This is approximately a 1,007 Sq. Ft. addition to the existing store. The full length of the front of the building is 175'. The two lower areas of wall encompass 74' 4" x 24' 8" inches high for a total of 1,833.5 sq. ft. The center of the front wall is 100' 8" long x 29' 4" high for a total of 2,952.9 Sq. Ft. This makes the total square footage on the front approximately 4,787 sq. ft. The front of the building sits approximately 350' from the set back on South Center Pkwy. (See Site Plan attached). According to the Tukwila Sign Code Guide and using the formula of 0.02 x (EBF- 3000) + 110 = Sign Area. This allows us 146 sq. ft. of sign. The bottom of the Sign Code Guide Sheet states that a wall area may be increased up to 50% with each doubling of the required building set back distance. The required set back is 29'. When we double that, that equals 58 ft. According to our calculations, we would be allowed 6% of the building face. This would mean we're allowed approximately 287 sq. ft. of signage. At present the existing letter sign is 5' x 40' for a total of 200 sq. ft. The existing face sign is 7' wide x 8' tall for a total of 56 sq. ft. The existing signage is 256 sq. ft.. In our plan to remodel the front of the store, we would like to take down the existing sign, have it cleaned, re- tamped and install new acrylic panels. Some of the existing panels are cracked. We would then install the existing sign on the new vestibule. At the same time we would install new wiring and mounting brackets, which would be part of the process. I have enclosed a copy of the existing as -built elevation, pictures of the existing store elevation, pictures of the other new store fronts to give you a general idea of what the sign will look like, color renderings, and the building and lot layout. To replace the existing sign would cost about $15,000.00 to $20,000.00. The proposed budget has already been substantially exceeded. Toys "R" Us has requested that the existing bathrooms be completely demolished and new bathrooms be installed to meet the current ADA and Barrier Free Codes. An additional expenditure of $15,000.00 to $20,000.00 for a new sign could cause the termination of the proposed project. I have enclosed a copy of the existing as -built elevation, pictures of the existing store elevation, pictures of the other new store fronts to give you a general idea of what the sign will look like, color renderings, and the building and lot layout. To replace the existing sign would cost about $15,000.00 to $20,000.00. The proposed budget has already been substantially exceeded. Toys "R" Us has requested that the existing bathrooms be completely demolished and new bathrooms be installed to meet the current ADA and Barrier Free Codes. We have been asked to pursue selective renovation at the Tukwilla, Washington store, located at 16700 South Center Parkway. One of the items is to put a new 10'x 108' vestibule on the front of the store. Item 1 (one) shows the existing store front and Item 2 (two) shows, in general, what the new proposed store front will look like. I need your help in the interpretation of the sign code: Tank 1. We would like to take down the existing sign, have it cleaned, relamped, and new acrylic panels installed. Some of the existing acrylic panels are cracked. We would then re- install the existing sign on the new vestibule. Is this considered maintenance? New wiring and mounting brackets would be part of the process. A new sign would cost us about 15 to 20 thousand dollars. We have already substantially exceeded our budget by up grading to meet the new ADA requirements. Thank you for your help.
