Korth and Fennie S. Korth and Laurin P. Korth and Fennie S. Korth grant Doris O. Cassan and James T. Cassan a perpetual easement across its property for existing underground storm drainage lines connecting the J & L Automotive building to the storm drain running north and south across the two properties. Each party does grants to the other an easement 5 feet wide for repair of the underground storm drainage lines. If either party should require a change in the configuration of the property, Doris O. and James T. Cassan and Laurin P. and Fennie S. Korth grant each other the right to move the drainage line at the expense of the party wishing the change. The cost of maintenance, repair or reconstruction of that portion of the sewer used in common shall be borne in equal shares, except that the owners of any lower parcel shall not be responsible for the part of the sewer above their connection; and when necessary to repair, clean or reconstruct the sewer, the parties to this agreement shall have a right of entry for that purpose. This agreement shall be a covenant running with the land and shall be binding upon all parties, their heirs and assigns forever. Modular structure: The modular structure currently g412-- located at the back (east side) of Lot A must be removed. The survey must be revised to show that the structure exists and will be removed. A note to this effect on the survey is acceptable. . Dollar Development landscaping: The proposal includes shifting the southeast corner of Lot A southward approximately 1.24 feet. This conflicts with the landscape plan approved by the Board of Architectural Review for Dollar Development. That approved plan requires Dollar Development to install at least a 5' wide landscape buffer along the entire property line. Although, J & L Auto has been using the parking shown on the sketch provided with your letter, it is an undesirable arrangement. To allow vehicles to back out onto International Blvd is not consistent with the City's parking regulations, nor King County's before us. Also, the frontage improvements for the Dollar Development Parking Lot on International Blvd, directly south of the J & L Auto property, have recently been installed. As a result of this change, there is increased potential for accidents associated with the use of the parking as it is currently configured. Therefore, it is my recommendation that J & L Auto be required to relocate their parking, as outlined in your letter. This change would eliminate the hazardous situation which currently exists. In reviewing the J & L property in its present configuration, there is no way to provide legal access to the area in the rear of the building. This shows that should the non - conforming parking along the street -side of J & L be eliminated for any reason, J & L would not be able to provide off - street parking on the east side of the building. Their only options would be to provide parking inside the building, or to make arrangements with adjacent property owners for Cross-access parking. Because J & L would have to take this action whether the lot line stayed or moved, it should not be necessary for Dollar to make special provisions via easement in order to complete the lot line adjustment. Regardless of whether the lot stays as it is, or if it moves as proposed, J & L does not have the ability to provide on -site parking anywhere but in the current street -side spaces. Therefore, Dollar will provide the easement for the storm drainage line, but strongly feels that solving a possible future parking dilemma is beyond its responsibilities, and urges reconsideration and elimination the this request. I recommend that a proposed 31.8 foot rear set -back and the 10 foot side set -back are appropriate for yard requirements of the previously denied Dollar canopies and the set -back needs of the existing J & L building. This recommendation is based on the following information. 1. A ten foot set -back for the J & L's building, (B -1 occupancy and 1 -Hour construction type), has previously been submitted by Mr. Merrick Lentz, Dollars's Architect and was found to be acceptable. 2. The corrected 31.8 foot rear yard required for parking by my calculation will provide Dollar an additional 15.02 feet of yard on the south and an additional 28.8 feet on the north. Because of the decreased angle of the of the proposed lot line, the actual set -back from the previously proposed east canopy location will conservatively add 19 feet. 3. Assuming an additional 19 foot set -back plus 15 feet from the construction documents of permit # 6663, a 34 foot total set- back would be provided. The following allowable area calculation is made by using U.B.C. Section 505(a) #2. a) (34ft min. yard - 20ft) X 1.25% = 17.5% area increase. b) V -N sprinklered building, B -1 occupancy 24,000 sq.ft. allowed by U.B.C. table 5 -C and Section 506(c). c) 24,000 X 1.175 (increase) = 28,200 sq.ft. allowed. d) 23,900 sq.ft. This application has been rejected due to setbacks narrower than necessary to allow the total building area shown. • In order to provide adequate setbacks for the addition of the canopies, Dollar Development is negotiating with the owner of the J & L Auto property to purchase a portion of property\adjacent to one of the canopies. The completion of this transaction will result in an application for lot line adjustment. The current negotiations place the potential new lot line parallel to and 10' east of the existing J & L Auto Building. The building can be classified as a type V -1 hr. building, which requires one -hour construction for walls within 20' of the property line, and protected openings if closer than 10'. Since the walls of the existing building are brick, this should satisfy the one -hour requirement. The procedure for this application will be as follows: • A B.A.R. hearing will be held to determine compliance of the project with city design standards. • Upon approval of the B.A.R., the property purchase will be consummated, and the lot line adjustment application will be made. No building revisions should be needed for the lot line adjustment to be approved as submitted. • Upon the approval of the lot line adjustment, the permit application for the canopies will be resubmitted with the revisions necessary to permit their reconsideration. VanDusen, dlayor RE: DOLLAR DEVELOPMENT -- Boundary Line Adjustment Issues We have completed a preliminary review of your Boundary Line Adjustment (BLA) proposal. Prior to submitting your BLA application for approval, revisions should be made as noted below. Building setbacks (per TMC 18.50.020, Table 1): 1. The building setback (from proposed property line to the J & L Auto building) must be at least 10 feet on the south side. The existing setback on the south does not conform to this code requirement, as it is only approximately 8 feet. Therefore, the south property line cannot be moved any closer to the J & L building. 2. The east (rear) property line must be at least 10 feet from any structure - -- including the mobile structure in the rear. However, this 10 -foot setback may be increased to as much as 20 feet, depending upon the type of construction used in the J & L building. This increased setback may be required in order to meet Building Code requirements. 3. To determine what the exact setback should be, you will need to provide an analysis of building setbacks per UBC Chapter 5. Dollar Development's architect may wish to work with our Building Division regarding this analysis. Results should be submitted to Ken Nelsen, Building Division (431- 3677). 4. Your plan must show the location of all existing structures on J & L Auto's property and the Dollar property. In your configuration of lot lines, you may wish to leave room for additional parking and access, should the need arise in the future.
