Dear Ann: C & M PROPERTIES, INC. 5190 SOUTH 166TH STREET TUKWILA WA 98188 (206) 243 -0900 July 16, 1993, `'i` '' Ann Siegenthaler \` `2 City of Tukwila `` i Department of Community Development 6300 Southcenter Boulevard v Tukwila WA 98188 As David discussed with you recently, we wish to request an extension for our assignment of account for street paving in the amount of $10,425. The paving deadline on our original assignment is July 31st. We wish to defer paving until the end of our project, or about September 30th. Because of the wet spring, we were unable to pour slabs until June. Therefore, the gas, cable TV, telephone, water, and electrical hookups are not ready for installation. The utility handholes for most of these are next to the street; however, the gas line is under the street. It is simply not prudent to pave the street until every last detail regarding the underground utilities is handled. We believe the main reason for the City to request the paving assignment was because of a concern about fire truck access and possible damage to the storm system. However, our concrete trucks, lumber delivery trucks, etc., are easily able to negotiate the road in its unpaved condition, so we do not believe there should be a concern for this, at least until wet weather arrives. The storm system is holding up fine. Give me a call if you have any questions or if I need to come down and sign another document. Thanks in advance for your help, Ann. We hope you will be able to stop by and look at the development when it's done. We are really proud of how it is turning out. Very truly yours, Nadine C. Building permit applications Your four building permit applications for the above address have been forwarded to me for review. However, I have recently been informed by the King County Assessor's office that it cannot record your short plat. The legal description of Lot 4 is apparently inaccurate. The description refers to Tract 59 as "21 feet west of the southeast corner thereof;" while your survey map shows this dimension as 15 feet. Your building permit applications will not be processed until the legal descriptions for your short plat are corrected and recorded. To proceed, you will need to: a) replace Page 3 of your short plat document (legals for Lots 3 and 4) with a revised page, stamped by your surveyor; b) have the original recorded with the King County Department of Records, and approved by the King County Assessor's office; and c) provide me with a copy of the recorded document, and have the Assessor's office call me with their approval. Once the legal description is corrected as noted above, we can proceed with the release of your Assignment of Account for the storm drainage funds, subject to the conditions noted below. John W. Rants, Mayor 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • (206) 431-3670 • Fax (206) 431-3665 Ms. Nadine Morgan Short Plat, 3/16/93 Page 2 2. Assignment of Account I have received your written request (of March 3, 1993) for release of your assigned account for storm drainage improvements at the above address. As we discussed on. March 4, 1993, our Public Works Department must give its final approval on storm drainage work before I can release the account funds. However, our City Engineer, Ron Cameron, and the inspector for your project, Greg Villanueva, cannot approve your storm drainage work until all roadway work, including paving, is complete. To release your funds, Public Works needs assurance that any damage the storm drain system will not be damaged by subsequent roadway work. As I mentioned to you, I have proposed a possible solution to address this concern. I' have drafted an Agreement in which you would agree to repair any damage to the storm drainage system by July 31, 1993, and prior to the issuance of any building permits.. In return, Public Works would give final approval to your storm drainage work, and I would authorize release of your assigned account. A copy of this proposed Agreement is attached. Please review the document, obtain the necessary signatures, notarization and King County Records recording number, and return it to me. Upon receipt of the recorded Agreement and approval of the revised legal description from King County, I will then authorize release of your funds. Please let me know if you have any questions regarding these two items. Sincerely Ann Siegenthaler cc: File John Pierog, Public Works Denise Millard, Permit Center / ree cee 08 3 Ann Siegenthaler City of Tukwila Department of Community Development 6300 Southcenter Boulevard Tukwila WA 98188 Dear Ann: This is our formal request for release of our first assignment of account in favor of the City of Tukwila for $20,325. As you recall, this assignment was made to guarantee installation of the storm drain system and related excavation at 13041 40th Avenue South. We request you forward the release to us at the above address rather than directly to our bank so we can coordinate the paperwork with them ourselves. Please be advised that the storm drain system has been completely installed with the exception of an asphalt "bump" on the private road. Also, we have not yet seeded the banks adjacent to the road as the weather does not permit it yet. As we have discussed earlier, since it is not appropriate for us to pave the road at this time, we assume this will be handled under our separate assignment which guarantees installation of paving on the private street. Please be advised that I spoke to Greg Villanueva, the utilities inspector, and I understand that everything looks OK to him as installed to this point. He has advised me, however, that he cannot sign off on the permits yet since other parts of the utility installation are not complete and it is possible some sort of damage could occur to the system when heavy trucks are brought in. However, since the potential financial burden contemplated by this bond is now handled, we assume no problem in releasing the assignment. Any problem contemplated by Greg should be covered by our insurance policy or performance bond. Please give me a call if you have any questions. Very truly yours, Nadine C. Morgan C & M PROPERTIES? February 8, 1993 As you probably know, we have installed the conduit and handhole per your diagram for our project at 13041 40th Avenue South in Tukwila- your project #3466. Our contractor has advised us that the conduit has been inspected and approved by City Light. Your letter specifies that we are to make written request of you to grant us permission to have a licensed private contractor make the installation of all but the distribution lines crossing the street to the new pole. We hereby request such permission. In addition, we hereby request installation of a pole on the right of way to the north of the entry to our private street. We understand you are waiting for a letter from the City of Tukwila and will have to apply for a permit for the installation before you can do this. Please be advised that we hand carried the information you faxed us on February 3rd to John Pierog in the Public Works Department at the City. We understand he has forwarded it to the Planning Department. However, the last we heard from the Planning Department when we tried to follow up on f its whereabouts is that Public Works should be responsible for it. Please give us a call if you need further information from us. I assume you will let us know when you will be installing a pole and what the costs of that pole might be. Morgan applied for a 4 -lot short plat ( #L92 -0039) in May 1992. In August 1992, the plat was still being reviewed by the City. To expedite completion of 4 single family homes on the lots, Morgan applied for a building permit for construction on the existing lot. Morgan probably anticipated that her short plat would be completed (including approval, recording and parcel number assignment) prior to the expiration of her permit application (January 1993). Usually, this is a reasonable expectation, since most short plats take 60 -90 days. However, Morgan's plat required many more revisions than anyone anticipated. The plat was delayed because we had to wait for Morgan to submit revisions - -and re- revisions, and because each revision had to be reviewed /routed /copied /coordinated with different departments. In some cases, the timing of Morgan's re- submittals coincided with huge backlogs in Planning and Public Works. Most of the plat revisions related to Public Works /utilities issues. John Pierog can give you more information on requested revisions and timing of re- submittals. cc: File Duane Griffin City of Tukwila 6300 S.outhcenter Boulevard Tukwila WA 98188 Dear Mr.•Griffin: Very truly yours, Nadine C. The Permit is #B- 92 -0265 at address 13041 40th Avenue South. We hereby request you give us an extension for the building permit. The permit relates to an application we made to have the City review at least one set of building plans for a 4 -lot short plat we are attempting to complete through Ann Siegenthaler. At the time we made application, we anticipated a utilities permit release in August.' However because of an easement consideration with the neighboring property owner and a subsequent backlog in the Engineering Department, we did not get our utilities permit until January 6, 1993 to install services to each of the lots. Therefore, the City has not yet begun review of our plans at this time and we have obviously made no progress on our buildings. Ann Siegenthaler has also advised us that review of the plans is impossible without an assigned parcel number for each lot. We are planning to post a bond with Ann next week for storm detention and paving related to the four lots. In addition, construction is scheduled to begin on the utilities next week. We are hoping that we will be able to have you look at all .4 sets of plans shortly after the Planning Department receives these items. Thank you for your consideration in granting us an extension.. If you have any questions, please feel free to call me at 243- 0900. Roberta Bradley Superintendent Seattle City Light 1015 Third Ave. Seattle WA 98104 Dear Ms. Bradley: 5190 South 166th St. Tukwila WA 98188 October 19, 1992 RECEIVED O C T .2 fl 1992 COMMUNITY DEV ELOPMENT I am writing to you about a problem which has caused me an incredible amount of time and frustration over the last several months. I will appreciate your looking into this situation so that I and other applicants for new service can obtain a solution to what seems to be an impasse. Last year, we bought a run -down piece of property in an older neighborhood of Tukwila which consists primarily of smaller, older residences in what we perceive to be an area of affordable homes for people of modest incomes. We started the process of short- platting it in February and are getting ready to build homes on it which will probably be the first new houses in the area in quite a long time. The area we are building in was annexed into the City of Tukwila just a few years ago. When we bought the property, we fully expected to underground the utilities, especially since the street the property is on is scheduled to be improved and undergrounded within the next five years. The City provided us with a copy of their ordinance which states as follows: "The cost and expense of relocating the existing facility, or installing new facilities underground, shall be borne by the serving utilities, except that service line removal and installation, disconnection from existing overhead facilities and connection of the undergrounding facilities from the edge of the right -of -way to the abutting users shall be borne by the abutting users..." (Chapter 13.08.050) As requested by Seattle City Light, we then provided City Light with a copy of the Utilities Plan to be reviewed by your engineering staff. In July, we were advised that we would be responsible for paying installation costs across the street to the nearest utility pole for a fee of approximately $17,000. This gets us power to the lot lines, but not to the individual homes, which would cost another $1000 or so each. We expected to pay for installation to the street only, per the ordinance. We offered to put a power pole on the corner of our property next to the street so City Light would have no liability problems, pending installation of the street improvements in the next few years. In contrast, we were advised that if we did not underground the power, the cost of getting power to our homes would be nominal. f: t Because of this, we requested a waiver from the City of Tukwila from the undergrounding ordinance, which they readily granted. (A copy of our letter requesting the waiver is enclosed.) Since we are building homes for persons of modest income, we simply cannot expend an addition $5 -6000 per home for power. The resolution we have come to in solving our problem by getting a waiver is fine for the short term, but I do not think it is very satisfactory policy on your part. We have been told that City Light wants to keep its rates low by not incurring the costs of undergrounding at other ratepayers expense. However, keeping in mind that we are in a construction mode right now and that the City of Tukwila is planning to underground the abutting street in a few years anyway, it is far more efficient in the long term to underground the homes now. The alternative is to tear up our new private road in a few years and reinstall the underground power. This costs more effort and money than if it were done now. Furthermore, if you would let us hire our own electrical contractor to do the installation to your specifications, Cost would be far less than the charge we were quoted to have you do it. We have been advised that we cannot even install underground conduit in preparation for the future undergrounding, since City Light must do its own work. We think you should follow the same policy that Puget Power and other utilities have. That is, City Light should be responsible to provide power to the lot line whether it be overhead or underground; the homeowner or builder should pay the costs of hookup to the water, sewer, or other utility from that point. Why should you be different? Your staff has been courteous and somewhat helpful to us, but ineffective because their hands seem to be tied. This is a policy problem that needs to be dealt with between you and the City of Tukwila in a fair and economically sensible manner. We will appreciate your attention to solving this difference between your policy and the Tukwila ordinance. Thank you very much for reading this. Very truly yours, Nadine C. Phil Fraser FROM: Ann Siegenthaler DATE: August 13, 1992 cc: File John Pierog RE: MORGAN b(C & M PROPERTIES) UTILITY PERMIT Sensitive Areas issues - 13041 40th Avenue South According to Nadine Morgan, Public Works will not approve her utilities permit for the above project until DCD approves for compliance with environmental regulations. DCD gave preliminary environmental approval in the short plat process. I have again reviewed the project with Gary Schulz. Below is a summary of our review. A. SEPA Single - family development up to four lots is exempt from SEPA review. Therefore, no Environmental Checklist is required. B. SENSITIVE AREAS ORDINANCE (SAO) Morgan's lot is subject to the SAO. There is a steep slope on her property adjacent to 40th Ave. South. However, Morgan's proposal has no significant impact on the slope. Morgan's lot was previously developed with two residences. The "steep slope" was apparently created by the original 40th Ave. roadway cut. Morgan's new driveway has approximately the same centerline as the old driveway. The side slopes created by the new driveway have the same slope as the old. No significant vegetation is being removed on the slopes. A notation on Morgan's most recent "storm drainage plan" (by Barghausen, received 8/3/92), calls for hydroseeding /jute matting on slopes. This notation adequately responds to my earlier request (7/6/92) for provison of erosion control on driveway slopes. Based on this, no additional environmental review is required, and the project as proposed complies with the SAO. July 15, 1992 We request the Department of Community Development accept these Building Permit Applications pending final approval of our short plat application #L92 -0039. We have been working with Ann Siegenthaler on the short plat process and she has given us a list of conditions to be completed for final approval. We have agreed to all of these conditions, with the possible exception of two which we are discussing today with Phil Fraser and Ross Heller. Because we desire to get these buildings well under way before the weather becomes inclement and we lose our financing options, we will appreciate your reviewing these before we get final approval of the short plat application, subject to us meeting the conditions listed by Ann. We will forward to you the necessary information regarding parcel numbers and addresses when they are available. Please do not hesitate to contact us if you have any questions. You may reach me at the above number or Harold Chase regarding plan questions at 546 -0994. July 6, 1992 Ms. Nadine Morgan C & M PROPERTIES, INC. 5190 South 166th Tukwila, WA 98188 City of Tukwila Department of Community Development Rick Beeler, Director RE: Short Plat Application #L92 -0039 Streets /access: Dear Ms. Morgan: The Department of Community Development (DCD) has completed its initial review of your short plat (subdivision) application. Your property appears on our maps and in your survey as having a steep slope near 40th Avenue South. Under our Sensitive Areas Ordinance, development of property with a steep slope requires additional permits (PRD, SEPA Checklist). However, we have waived this requirement. This is based on the fact. that proposed Lot 1 has an existing single - family home, and that the proposed driveway is the only development which will occur in a steep slope area. On your behalf, I have requested a refund of all fees paid by you related to your PRD application (see memo copy attached). A refund of $225 will be sent separately by mail. Prior to final approval, your short plat must meet the requirements of the Tukwila's Short Subdivision Ordinance. Below are the additional items which need to be completed for final approval of your short plat. 1. According to the Subdivision Code, your private access drive requires a minimum easement width of 30 feet. Therefore, we cannot approve a waiver to this minimum, as requested in your letter of'May 13, 1992. You already have identified a "20' access and utilities easement" and a "10' utility easement." Both your storm drainage plan and survey must be revised to show a "30' access easement," or a "30' access and utilities A2nn cn„th,antor Rnulnvard. Side sewers may not your storm drainage each proposed home requirement. easement." The legal descriptions must also be revised to reflect the 30' easement. Note that the paved portion of your drive need only be 20 feet wide. 2. Your topographic survey indicates that the proposed driveway will require a "slope easement" across the adjacent property to the south. Submit a document which describes the easement, and authorization from the owner of the adjacent property. 3. Your storm drainage plan shows that the proposed driveway creates a newly exposed, side slope of approximately 66% within the 40th Avenue right -of -way. Submit a soil study demonstrating the stability of this new slope, or show on the plan how the slope will be stabilized. Any structural solutions (e.g. rockery) must be located outside of the right -of -way. Also, please note that your driveway currently has the maximum slope allowed for a driveway (15 %). 4. The water system which serves your proposed lots has been identified as deficient in Water District 125's Comprehensive Water Plan. In addition, the cumulative effect of subdivisions in your area will result in future supply deficiencies for your property and others. Consequently, you are required to sign a Water System No Protest Agreement for future upgrading of the water system. The form is attached. 5. Your storm drain plan must be revised to show how side storm drains for each lot will be connected to the common bioswale (ditch). Either a bioswale system or pipe system is acceptable. have I than a 2% slope. Show on plan a finished floor elevation for which will meet the minimum slope 7. Revise easement descriptions to identify which properties have responsibility for maintaining common storm drainage, water and sewer facilities, and common access road. 8. Private sanitary sewer main requires a manhole, rather than a cleanout. Show this as a manhole on the storm drainage plan. Ms. Nadine Morgan , Short Plat, 7/6/92 Page 3 For your information, the Tukwila "undergrounding ordinance" requires that all utilities be placed underground. This requirement will have to be met at the time of building permit application. For more information on utilities and street requirements, please contact Phil Fraser of our Public Works Department at 433 -0179. Fire protection /service: 9. Tukwila codes require a fire hydrant within 250' of all buildings. Your survey indicates that proposed homes on Lots 2, 3 and 4 exceed this distance. Therefore, you will be required to install a hydrant. Alternatively, the hydrant requirement may be waived if the homes are sprinkled. To have the hydrant requirement waived, you must do the following: add a notation to the survey which states that all future homes will be required to have sprinkler systems, per Tukwila codes, prior to issuance of building permits. Please contact Nick Olivas at our Fire Department (575 -4404) for specific information on fire hydrant requirements. The items listed above must be completed within six months from the date of this letter. If not completed, the current application will expire and a new application would be required. In order to forward your application to the Short Subdivision Committee for final approval, you must complete the following conditions: 1) complete the 9 items listed in this letter; and 2) install any required site improvements which have yet to be constructed (e.g. roads, utilities). Alternatively, you may provide assurances for future construction of these improvements by signing the attached Agreement(s) with the City, or through posting of a bond for 150% of the construction cost. When these conditions have been met, your application will be forwarded to the Short Subdivision Committee. Review by the Committee requires approximately one week. After the Committee decision, you will need to submit the approved application to the cc: Ms. Nadine Morgan Short Plat, 7/6/92 Page 4 Sincerely, Ann Siegent aler Assistant Planner File. According to the functional classification system for City streets, 40th Avenue South is a collector arterial. Therefore, the existing 60' of R/W is adequate for this class of road. 2. A water availability letter needs to be resubmitted identifying minimum gallons per minute (not approximate); also identify associate residual pressure. If minimum 1000 GPM /20 PSI is not available then sprinkler plan that meets with the approval of the Fire Marshall's office is needed. Show location of nearest hydrant and distance adding road- ways /private drives to nearest corners of all proposed structures. 250 ft. is the maximum distance of hydrant to single family residence. Ross A. Earnst, P. E., Director Identify side drains /biofiltration and swales to the common storm and detention system. 4. Provide a maintenance agreement to maintain common: 1) private storm detention /private storm mains, 2) private sanitary sewer main, 3) private access road agreement (to be recorded with short plat). 5. Current Public Works policy is four units or less are not re- quired to provide frontal improvements. 6. The City's Subdivision Code requires widening the access easement over the 10' utility easement to achieve the 30' required for a private road. The 20' shown for ingress and egress needs to be widened 10'. 10' utility easement is acceptable. John W. L PLANNING GE@MET 5 136 -M S? 2V ti" Short Plat Committee City of Tukwila 6300 Southcenter Boulevard Tukwila WA 98188 We are requesting waiver from Section 17.24.030 of the City of Tukwila Subdivision Code regarding private access road width of 30 feet. The reasons for this are several. Because the lot has a long narrow shape, it is undesirable from a design viewpoint to pave over a significant portion of the total property, particularly in this neighborhood, because of it's very rural character. Besides the undesirable aesthetics of a large quantity of pavement on the property and the unnecessary additional impervious surface it would create, it will be very well served for fire access purposes with the addition of a "hammerhead" turnaround. A 20 foot road is very adequate to serve the needs of only 4 homes and allows adequate space for vehicles to pass each other when moving on it in opposite directions. Lastly, it is our intention to request waiver from the Tukwila sidewalk ordinance because of the planned future improvement planned by the City for 40th and 42nd Avenue South. Any sidewalk installed by us would very likely have to be redone in a very short period of time when the contemplated street improvements are made by the City. We assume you will contact us if you have any questions. Very truly yours, 77(ceet.),Le_ ' 171(ii r e " Nadine C.
