REFUND FOR LOT CONSOLIDATION -- Vern Meryhew
November 4, 1991
In the City's fee schedule for land use permits (Ordinance #1576),
there is no fee for a lot consolidation. Unfortunately, some confusion
over the application and fee schedule resulted in an applicant being
charged a fee for a lot consolidation.
Therefore, we are requesting that a refund be given to the applicant
below for the $200 fee paid.

1991 I request that the subject application be put on hold
until further notice. As discussed, the sewer lines,
scheduled to be installed on the property, are expected to
be completed in the fall of this year and it would be better
to hold off on the lot consolidation until that time
I will contact you when Val -Vue Sewer has completed the
installation and request re-opening the file at that time.

RE: Sensitive Areas Moratorium Lot Consolidation Exemption
DATE: January 10, 1991
Under the Sensitive Areas Moratorium, land use applications for
properties with "sensitive areas" may not be accepted or reviewed.
However, the Moratorium is not clear as to whether a Lot
Consolidation is considered exempt. Staff has reviewed the
Moratorium ordinances and draft Sensitive Areas Ordinance regarding
this issue.
The Moratorium applies to "applications for development," and
specifically includes applications for rezones, plats (Ord. 1550),
and new permits, including clearing, grading /filling and building
permits, and "any similar or related land use activity whether or not
any permit or prior approval is required" (Ord. 1544).
The Moratorium would not apply to a Lot Consolidation for the
following reasons:
1. No permit or approval is required under the Zoning Code or
Subdivision Code. The review process is an administrative
review only, which allows us to maintain current maps and
property information.
2. No development or lard- altering activity is associated with a
Lot Consolidation. It is exempt from SEPA review. Since Lot
Consolidation is essentially the recording of property line
removal, it does not result in any action which might
conflict with or subvert the intent of the Moratorium.
Similarly, the action is unlikely to have any impact on the
future implementation of the Sensitive Areas Ordinance.
For these reasons, staff considers a Lot Consolidation, exempt: from
the Moratorium, and we will continue accepting and processing these
documents. If you feel that this interpretation of the Ordinances is
in error, please let me know by 1/11/91.

SUBJ: Your lot consolidation memo of January 10
I have reviewed your referenced memo and the authority
cited therein. Due to the response deadline of today requested in
your memo, however, I have not attempted any independent review of
your authorities.
Nonethless, we agree with your conclusion (at the
paragraph numbered two) that lot consolidations, as "essentially
the recording of property line removal," are outside the
moratorium.
You may wish to review the conclusion in the paragraph
numbered one, at least so far as you consider it support for a
decision that lot consolidations are outside the moratorium. I
base this on the portion of Ord. 1544 cited in your memo that the
moratorium applies to " . . . land use activity whether or not any
permit or prior approval is required." If this provision was not
amended by Ord. 1550 (I have not checked), then your paragraph
numbered one probably should not be relied upon to support a policy
exempting lot consolidations from the moratorium.
