Dear Mr. Aliagas:
On February 4, 1991, the Tukwila City Council approved your waiver
request to complete the environmental and design review processes for
your project located at 14638 Pacific Highway South. As a condition
of this approval, you must read and sign the attached agreement.
As discussed at the Council hearing, this waiver does not apply to
building permit applications or approvals. No building. permit
applications for this project will be accepted until after the final
Critical Area Sensitive Areas Ordinance is adopted. This may not occur for two or
three months. Your project will have to meet all of the requirements
of the final Ordinance before any building permits can be• issued.
You may submit your applications for environmental and design reviews
after the waiver Agreement is signed. However, if your applications
are approved before the final Ordinance is adopted, your project may
have to be re- designed. For instance, the final Ordinance. may
require additional setbacks from slopes. If your original proposal
does not meet these setbacks, it would have to be re- designed. If
there are substantial revisions, you may be required to go through
the design review process a second time. This could involve time
delays and additional fees.
Attached is the waiver agreement. Please read and sign the form, and
return it to me. This must be returned before your applications can
be accepted and before a. design review hearing can be scheduled. New
applications for design review are currently being scheduled for
April 1991. If space is not available when your application is
received, you will be scheduled for a later month. Please call me if
you have any questions regarding your waiver or applications.

AGREEMENT TO BE SUBJECT TO
A SENSITIVE AREAS ORDINANCE
I, Spiro Aliagas, the undersigned owner(s), hereinafter referred to as
Owner, of the property located at 14638 Pacific Highway South,
Tukwila, Washington, and further described in Attachment A hereby
acknowledges that such property is subject to the moratorium imposed
by Tukwila Ordinance Nos. 1544, 1550, 1566 and 1582, also known as the
"Sensitive Areas Moratorium."
The owner has petitioned for a waiver from the provisions of the
Moratorium. Having considered this petition, the City of Tukwila has
granted a waiver to allow the owner to take the following action(s):
To submit an environmental review (SEPA) application and
obtain a SEPA determination, and to submit a design review
(BAR) application and obtain a BAR decision.
The owner acknowledges that the waiver is solely for the purpose of
completing the SEPA review and design review processes. In addition,
the owner agrees as follows:
1. The waiver applies only to the processes described above and does
not apply to building permit applications or approvals, and no
building permit applications or any other actions subject to the
Moratorium will be accepted or processed before expiration of the
Moratorium, unless a further petition for waiver is approved.
2. That the waiver is not assurance that the project will be
approved as originally proposed, or that any of the actions
described above will be approved at all.
3. As part of the environmental review process, the owner will
provide geotechnical information and reports for Class 3
Landslide Hazard Areas as detailed in "Geologic Hazards
Evaluation" report prepared in 1990 by GeoEngineers for the
City of Tukwila and on file with the Department of Community
Development.
4. The above action(s) and any future land use actions associated
with the property will be subject to all of the provisions of the
Sensitive Areas Ordinance as finally passed by the City Council,
as may apply to the property or land use action.

5. Applications for the above land use action(s) will be
accepted and processed solely at the risk of the owner. The
owner acknowledges that any revisions which may be necessary
to meet the Ordinance provisions may be subject to
additional review and approval through the environmental and
design review processes. The owner further acknowledges that
he may incur additional expense or time delays in the
process of revising the project or providing additional
studies as may be required by the final Ordinance.
6. The granting of a waiver to allow the above action(s) does not
mean that any other land use application for the project or
property will be accepted or processed while the Moratorium is in
effect, unless the City Council approves a petition therefor.
7. The undersigned owner specifically agrees that since the
waiver is based upon a personal hardship for him, it is
personal to him and is dependent upon his acquisition of
title to the property. The waiver and right to process the
above action(s) will be lost if the applicant loses his
rights to the property or the rights to the project are sold
or assigned prior to completion of the action.
The undersigned owner acknowledges that the covenants and agreements
herein run with the land described in Attachment A, and that this
document will be recorded with the King County Department of Records
and Elections and that these covenants and agreements cannot be
released without the written consen)of the City of Tukwila.

,Police Chief Ron Waldner introduced five new police officers to .
Council. Mayor VanDusen administered the Oath of Office to
Jeff Early, Carl Johnston, Teresa Mars all, Eric Murphy, and Eric
Hines and welcomed them to the City.

Mayor\VanDusen commented that th the changes that have
occurred during the last few years t e City has been challenged in the
way we provide services to citizens He noted decision making,
interdep ental cooperation, c mmunication between departments,
initiative, ac ountability, high a ectations, commitment to the
community, p'rpduction and lea ership as key principles to be stressed
to staff in 1991\ He challenge Council to take care in fiscal planning
and effectively d' ecting hums� services to Tukwila residents.
Transportation re ains a c 'fical issue, especially ingress and egress to
the central busines district /The proposed sensitive areas ordinance
has been a controversial issue. Upon final adoption it will continue to
be a challenge in its ad ni}{istration as it was in its development.
Regarding facilities, M y or VanDusen explained that we currently
have limited facilities to-hhouse some of the services the City wishes to
provide. In investigating the options we must balance cost, land
availability, and public access to our public facilities. Organizationally,
the administration has inculcated the City's mission statement into its
development program. Currently, leadership and management
enhancement programs are be g presented to staff with positive
results. Fiscally, tile City is in go , d shape; however, in the next few
years, growth maybe limited due decrease in tax revenue. Along
with this we have h somewhat leveling of taxing but an ever increasing
demand for service. He asked Council to deal with this issue very
carefully in the heft year.

would be h )d on the Rabanco transfer s tion on February 6th at
7:30 p.m. t Renton City Hall. She urged e City to write a letter

reg Nickels and Paul Barton have offered t eir help. Paul Barton
indicated he would investigate the specifics re arding the contract.
Rants noted he had suggested to the administr Lion that a meeting be
arfanged with Black River Coalition, South Cen al School Board,
interested citizens and City Council to discuss the oject with Greg
/Nickels. Rhonda Berry, Assistant to the City Administrator, will be
coordinating the meeting date.
Connie Hoffman, 3924 So. 114th St., boardmember of he Duwamish
Improvement Club, spoke from a draft letter from the and
about the club's concern for the community's future. Bu ' ess is
beginning to encroach upon their residential area. Board tubers
would like to keep the area residential in the future and req est that
commercial areas be rezoned residential with an emphasis set"on
renovating/rebuilding single family homes. (The entire text is on file in

The proposed development will be located adjacent to the slopes on
the site and will require structural 51l in several areas.
Councilmember Duffie questioned whether the applicant understands
that there is a risk involved if he chooses to proceed with the permit
process when the design may be subject to changes at a later date
based upon the final SAO or the decision of the BAR. Ms.
Siegenthaler responded that the process had been explained to the
applicant and he has indicated he does understand the implications.
Applicant Spiro Aliagas briefly outlined his request. Due to a
language barrier, Council asked for assurance that Mr. Aliagas
understood what the waiver would or would not allow him to do. Mr.
Aliagas voiced his understanding of the process.
Councilmember Duffie asked Ms. Siegenthaler how staff
communicated with the applicant (because of the language barrier).
Ms. Siegenthaler responded that the initial request for waiver came
from the applicant's architect who has been staffs main contact
person for this project. It is assumed that the applicant and architect
had an understanding of what the architect was applying for. Mr.
Duffle again voiced his concern about the communication problem.
MOVED BY ROBERTSON, SECONDED BY RANTS, TO
GRANT THE WAIVER SUBJECT TO THE APPLICANT FILING
AN AGREEMENT TO CONFORM TO THE ADOPTED
SENSITIVE AREAS ORDINANCE.*
Councilmember Robertson commented that the applicant's request
for a SEPA process and BAR are reasonable activities and do not
harm the environment. Mr. Ekberg agreed.
*MOTION CARRIED WITH DUFFIE VOTING NO. Waiver is
granted with conditions.
Mayor VanDusen opened the hearing at 8:05 p.m. Doug Micheau,
Public Works Coordinator, gave a brief overview of the ordinance.
Bill Arthur, representative for M.A. Segale, 18010 Southcenter
Parkway, presented a list of suggestions for revisions /clarifications to
the draft ordinance. Copies were distributed to the Council and
administration. Of major concern to M.A. Segale is a paragraph in the
ordinance that does not differentiate between the stockpiling and
movement of a product on land and the permanent alteration of land
that occurs during construction activities. He submitted a proposed
addition to Section II 2.9 Exemptions. (Copies of all documents are
on file in the City Clerk's office.)
Paul Seeley, The Boeing Co., commented on several sections of the
draft ordinance and offered suggestions for revision /clarification.

Catherine Harris, resident, reviewed the contents of the draft
ordinance and offered suggestions for modification to the document.
Mrs. Harris questioned the involvement of the Council in hearing
requests for variances. She recommended that variances be heard by
the Board of Adjustment.
A letter written by Cheryl Brown, Sterling Recreation Organization
was recognized. Copies were distributed to Council and
administration. (Copies of the text are available in the City Clerk's
office.)

PROPOSAL
DESCRIPTION: Petitioner requests approval to proceed with the
environmental (SEPA) and design (BAR) reviews fora 7200
square -foot addition to an existing retail building.

EFFECT OF MORATORIUMS
The Moratorium (Ord. 1544 -1582) precludes filing of new land -use
applications in sensitive areas. As the project site contains slopes
in excess of 15 %, the applicant cannot proceed with environmental and
design reviews.
This project is an extension of an existing retail structure, which is
currently being renovated. The applicant requests a waiver of the
Moratorium in order to stay on schedule for development of the entire
site.
IMPACT OF THE SENSITIVE AREAS ORDINANCE:
The interior of the site is mostly flat. However, there are steep
slopes along the perimeter of the site, at the north, east and south
property lines. The proposed development will be adjacent to these
slopes, which will require fill in several areas of the site.
The maximum height of any of these sensitive slopes is approximately
ten to fifteen feet.
DECISION CRITERIA:
Ordinance No. 1550 states that the City Council shall use the following
criteria to review waiver requests:

- Site Plan: noting current /proposed uses, square footage
parking and adjacent uses;
- Existing Conditions /Topo: showing proposed building and
parking areas overlay, and grades of existing slopes;
- Site Sections: a cross - section through each end of the
building, from Pacific Highway through parking areas, to the
bottom of the slope;
- Building Elevation;
- Landscape Plan: showing required landscape buffers and
general treatment. May be included on site plan.
Should you anticipate any difficulty in meeting the deadline, please
let me know as soon as possible, so that the project may be moved to
