OF TUKWILA, WASHINGTON, RELATING TO ZONING
CLASSIFICATION FOR "FOSTER , ISLAND"
NEIGHBORHOOD, AND AMENDING TUKWILA
MUNICIPAL CODE CHAPTER 18.08.030 (AMENDING
CERTAIN ?ROVISIONS OF ORDINANCE NO. 1247)
WHEREAS, the City Council has previously considered the adoption of a zoning
classification for the area k;iownas "Foster Island" neighborhood in Tukwila; and
WHEREAS, the proposed zoning complies with the Tukwila Comprehensive Plan
designation of low- density residential; and
WHEREAS, the City Council adopted the findings and conclusions contained in the
Staff Report dated Augt::;t 14, 1991, and approved a zoning classification of Single- Family
Residential with a 7,200 square -foot lot minimum (R- 1 -7.2) for Foster Island on October 7,
1991; and
WHEREAS, the amendments set forth below are necessary to correct the Tukwila
Zoning Map as originally adopted in Ordinance No. 1247(1982);
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO HEREBY ORDAIN AS FOLLOWS:
Section 1. Zoning Map Amendment. The Tukwila Zoning Map originally adopted in
Ordinance No. 1247 is herthy amended to include the area known as Foster Island, bounded by
53rd Avenue South, South 137th and South 139th, except that property currently containing the
Terrace Apartments (as shown on Attachment A). A zoning classification of Single - Family
Residential with a 7,20C square -foot lot minimum (R- 1 -7.2) is hereby adopted for the
aforementioned Foster Isla:id area.
s ection 2. Severa. ility. , If any section, sentence, clause or phrase of this ordinance
should be held to be invalid or unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this ordinance.
Section 3. Effective Date. This ordinance shall take effect and be in full force five (5)
days after publication of t attached summary which is hereby approved.

BACKGROUND

The "Foster Island" neighborhood, bound by 53rd Avenue South, South 139th and South 137th,
consists of five single - family residences. On September 22, 1989, Foster Island was annexed to the
City of Tukwila. However, the Sensitive Areas Moratorium prohibited the City from adopting a
zoning designation for the area at the time of annexation.
Now that the Moratorium is no longer in effect, a final zoning designation may be adopted for
Foster Island. The area's zoning classification prior to annexation was Single - Family Residential
with a minimum lot size of 7,200 s.f. The proposed zoning is also Single - Family Residential, with
the same minimum lot size of 7,200 s.f. (R- 1 -7.2).
DCD has contacted the five Foster Island property owners regarding the proposed zoning, and has
received comments from four of them. None of the property owners have expressed any
objections to the proposed zoning.
PLANNING COMMISSION HEARING & RECOMMENDATIONS
On August 22, 1991, the Planning Commission reviewed the zoning request and recommended
approval of the proposed R -1 -7.2 designation. The Planning Commission also adopted the findings
and conclusions contained in the Staff Report dated August 14, 1991.

The Department of Community Development (DCD) is requesting approval of a final
zoning designation for the area known as "Foster Island," for which formal zoning was not
adopted at the time of annexation. DCD requests approval of an R -1 -7.2 zoning
designation (Single - Family Residential, 7200 square foot lot minimum) for the five single -
family residential properties which make up the Foster Island area.
The Foster Island area is bound on the west by 53rd Avenue South, South 139th on the
south and South 137th to the north (see Attachment A). The area is approximately 2
acres in size, and consists of five single - family residences, with 5 -10 total residents. The
five lots range in size from approximately 6,600 square feet (s.f.), to approximately 37,000
e

East of the site is Foster Park/Playfield, which is zoned Single - Family Residential (8 -1-
20.0 and R -1- 12.0). To the south are single - family residential areas (R -1 -12.0 and R -1-
7.2). North of the site are apartments in an R -3 (Three and Four Family Residential)
zone (see Attachment B). The Tukwila Comprehensive Plan designation for Foster
Island is "Low Density Residential" (see Attachment C).
On September 22, 1989, "Foster Island" was annexed to the City of Tukwila. At the time
of annexation, Foster Island was affected by the Sensitive Areas Moratorium, which
prohibited the City from adopting a zoning designation for the area. Consequently, the
area was given a temporary zoning designation of Single Family Residential/12,000 s.f. lot
minimum (R -1- 12.0), the classification required for areas not designated according to the
Zoning Code and Zoning Map (TMC 18.08.020).
Now that the Moratorium is no longer in effect, DCD is proposing that a final zoning
designation be adopted for Foster Island. The zoning proposed is Single Family
Residential with a minimum lot size of 7,200 s.f. (R- 1 -7.2).
To help determine what impacts the proposed zoning may have, a letter was sent via
certified mail to each of the five property owners in the Foster Island neighborhood
asking for comments on the proposed zonin. To date, DCD has received comments
from two of the five residents. These comments were discussed by phone and in person.
One resident expressed concern that property taxes might increase due to the change
from a 12,000 s.f. lot minimum to the higher density allowed by a 7,200 s.f. minimum.
Other comments in response to the proposed zoning were positive.

DCD has proposed the R -1 -7.2 zoning designation for the following reasons:
1) Single - Family zoning is consistent with Foster Island's Low Density
Residential designation in Tukwila's Comprehensive Plan. It is also
consistent with the Comprehensive Plan designations for the
surrounding neighborhood (see Attachment C).
2) Foster Island is comprised of single - family residences, and is surrounded
by residential uses. Single -Family zoning is compatible with land uses
on site and in the neighborhood.
The proposed zoning is consistent with the area's zoning classification
under King County, which was Single- Family Residential with a
minimum lot size of 7,200 square feet (R-S 7200).
The proposed minimum lot size maintains the potential for future
subdivision which existed under the County. Therefore, the proposed
zoning provides some consistency in property values and use, while
minimizing the impacts of non - residential uses to the existing residences.
CONCLUSIONS
Given the existing land uses, lot patterns and zoning, the most appropriate zoning designation
for the Foster Island area is R- 1 -7.2. This zoning designation would provide _ consistency with
the Tukwila Comprehensive Plan and previous zoning under King County, would ensure .
future uses are compatible with existing land uses both on site and in the surrounding
neighborhood, and would minimize disruption to existing property values and uses.
RECOMMENDATIONS
Based on the above conclusions, the Department of Community Development recommends
an R -1 -7.2 zoning designation for the Foster Island area.

I BACKGROUND/MAPS
1.
This annexation is an island of unincorporated King County consisting of five
homes on approximately 2 acres. It was inadvertently omitted from the recent
Foster Annexation. The purpose of this annexation is to rectify this error and
establish rational boundaries for Tukwila. The area is being annexed by
resolution in keeping with RCW 35A.14.395 -299 ( "Annexation of
Unincorporated Island ").
2. Attachment A is a copy of the resolution accepting the proposal as officially
passed.
3. Attachment B is a copy of the Determination of Non - significance and current
SEPA checklist.
4. Attachment C is the legal description of the boundaries of the area involved in
the proposed action.

"FOSTER ISLAND" ANNEXATION
a. Attachment D is a King County Assessor's map with the area boundary,
size in acres, entity corporate limits and nearest service points.
b. Attachment E is a vicinity map with corporate entity limits and physical
features. Please note that the proposal lies entirely within the special
purpose districts having jurisdiction over it.

2. LAND USE:
Approximately 5 -10 individuals reside in the area proposed for
annexation. This is far less than 1% of Tukwila's total population of over
10,000.
a. The existing land use is single- family homes.
The territory is nearly 2 acres.
The population density is between 2.5 and 5 persons /acre.
The assessed valuation was $293,000 in 1989.

b. No immediate change is proposed.
3. COMPREHENSIVE PLANS /FRANCHISE:
a. King County Comprehensive Plan /Ordinances
(1) The Foster Island Annexation proposal relates to Section III Regional
Planning and Intergovernmental Cooperation, page 32 of the King
County Comprehensive Plan adopted 1985. The following plan .
policies would support approval of the subject annexation to
Tukwila. The area is designated as urban by the County and therefore
should be receiving urban services from a municipality capable of
providing the necessary level.
PI -302 King County should work with the cities to focus growth
within their boundaries and should support annexations
when consistent with the King County Comprehensive Plan.
King County should support incorporations when formation
of cities is appropriate to assure adequate facilities and
services for growth consistent with the Plan.
PI -303 King County should play an active role in municipal
annexations, supporting them when consistent with land use
plans, and opposing them when inconsistent.
A comparison of the King County and Tukwila Comprehensive Plan
maps shows them to be generally consistent with each other.
(2) The proposal lies within the Highline Community Plan.
(3) The zoning classification is Single Family, R -S 7200.
(4) The annexation area is not affected by these plans.
b. Proponents Comprehensive Plan /Franchise
(1) The proposal lies in Tukwila's adopted Comprehensive Plan area.
No plan amendment will be required.
(2) Tukwila's Comprehensive Plan was adopted by ordinance on
September 19, 1977.
(3) Tukwila has no franchise in the area. It does not anticipate
requesting a franchise amendment to cover the area in the near
future.

(4) The area has not been the subject of a Pre - annexation Zoning
Agreement.
(5) Tukwila's Comprehensive Plan designates the area as "Single Family
Residential." Proposed zoning regulations were adopted in 1982.
4. PLANNING DATA
a. Revenues /Expenditures
Any impacts on King County and Tukwila finances resulting from the
annexation are very slight since only five single - family residences are
involved in the annexation.

(1) Water — Water District #125 now provides the area with water. Per
the Skyway Critical Water Supply Area agreement, Tukwila is
scheduled to assume water service in late 1989.
(a) Water District #125 provides water directly to the area.
(b) N.A.
(c) A 4" main on 53rd Avenue South serves the area.
(d) None.
(e) Capacity is available.
(f) The Seattle Water Department provides water to the area.
(g) N.A.
(2) Sewer — Tukwila currently provides sewer service to the annexation
area.
(a) Tukwila currently provides sewer service directly to the
annexation area.
(b) Tukwila provides sewer via an 8 -inch line on 53rd Avenue S.
(c) No lift station is required.
(d) METRO disposes of the sewage.
(e) Capacity is available.
3. Fire Service — Tukwila currently provides fire service to the
annexation area.
(a) Station #52 (5900 S. 147th) provides primary service with Station
#54 (S. 144th & 42nd Ave. S.) as back -up.
(b) Response time is 2 to 2-1/2 minutes.
(c) Both stations will be fully staffed after mid - August, 1989. Station
#52 will have 3 full -time staff and Station #54 will have 4 full -
time staff.
(d) Station #52 has a pumper truck. Station #54 has a pumper and
an aerial ladder truck.

(e) Approximately 98% of personnel are EMT- certified and 95% are
D -fib certified.
(f) The area has a 4 fire rating.
(g) Valley Communications Center dispatches the units.
a. No annexation agreement is required for service extensions.
b. The annexation area is generally flat on top of a hilly rise.
c. There are approximately 5 -10 residents in the annexation area. The area's
projected population growth is small. The proposal lies within Census
Tract #262, which had a population of 3,505 in 1980. The estimated 1981,
1982 and 1983 population was 1911, 1948 and 1995 respectively (PSCOG).
On April 1, 1980 Tukwila's overall population was 4,760. By May 31, 1989
the population stood at 10,793 residents. This increase was due to four
major annexations in the preceding six months, rather than real
population growth. The figures were derived from an actual census of the
annexation areas.
d. The annexation area is surrounded by Tukwila territory and already
receives most of its municipal services from Tukwila. With the
annexation, residents will be able to participate fully in community life by
being able to vote for elected officials, serve on boards and commissions,
and run for office themselves, if they so desire.
e. No delay is expected in implementing service delivery to the area.
f. Service levels are adequate in the annexation area as currently provided or
as would be provided once the annexation is final. Future costs would
change consistent with the rest of the City.
