This letter is written because your proposed project in the City of
Tukwila was affected by the Critical Area Sensitive Areas Moratorium. A waiver
to the Moratorium, which prohibited any development on sensitive
area property, was denied by the City Council. Since Sensitive
Areas Ordinance No. 1599 was adopted on June 10, 1991, the
Moratorium for development within sensitive areas has not been in
effect. Proposed development affected by sensitive areas will be
reviewed according to the standards set forth in this Ordinance.
If you choose to pursue your project, a State Environmental Policy
Act (SEPA) checklist will be required along with the application
for appropriate permits. The Department of Community Development
planning staff has been working on procedures to help with the
implementation of the Ordinance. The complexity or feasibility of
the project may warrant a pre- application meeting in order for City
staff to help resolve significant issues.

PROPOSAL
DESCRIPTION: Petitioner requests a waiver to process and issue all required
permits for the development of 18 existing platted lots in the
Hellwig Addition.
The Moratorium (Ordinance No. 1544 - 1582) precludes filing of new land -use applica-
tions in sensitive areas. As the project site contains slopes that are 15% and greater and
potential wetland habitat, the applicant cannot proceed with engineering, site design, and
environmental review for permitting the development of 18 existing undeveloped lots.
The subject property is currently zoned single- family residential (R -1 7.2). Existing lots
as depicted on the Pac -Tech Engineering - Conceptual Grading Plan (2/91) range in area
size from approximately 4,000 to 6,100 square feet. The road to serve the
subdivision is not constructed, but was graded prior to annexation to Tukwila.
During the first week of March, 1991, brush was cleared across the entire upper sloped
portion of the project site. It appears that only a few immature trees were removed. To
mitigate this violation of the Moratorium the Planning Division will be requesting that the
applicant revegetate the slope during development of the project site.
Additional information will need to be provided in the SEPA process: reliable
topographic mapping, geotechnical/hydrological studies, wetland analysis, and erosion
control plans.
The applicant requests a waiver of the Moratorium in order to complete SEPA review,
to prepare and file engineering plans for roads and utilities, and to receive approval of
all permits to construct the single - family residences.

IMPACT OF THE SENSITIVE AREAS ORDINANCE:
The site area is comprised of slopes that range from 15 to 40 percent and steeper slope
areas exceeding 40 percent in gradient. These slopes are identified as Class 2 and 3
Landslide Hazard areas.
Watercourses or wetlands are not identified on the site by the City's sensitive areas
inventory maps. Staff visited the site several times and investigated the central bench
area for potential wetland occurrence. This area is relatively small but contains
vegetative cover dominated by hydrophytes, and saturated soils that appear hydric
including some area that is inundated with water. The saturation and standing water in
this area of the site appears to be collecting from surface water runoff and localized
groundwater discharge from the adjacent slope. In addition to slope stability and
drainage studies, ,City staff is requiring a wetland delineation study be conducted as part
of the engineering review process.
The proposal to develop the site for residential use would require extensive grading and
clearing for constructing building pads and associated homesite needs. According to
preliminary site plan drawings an extension of S. 139th Street would be constructed for
public use and access into the residential development. The construction of 46th Avenue
S. between S. 139th and S. 140th Streets may also be required for development of this
site.
DESIGN CRITERIA:
Ordinance No. 1550 states that the City Council shall use the following criteria to review
waiver requests:
1. Intent of the Moratorium;
2. Best interests of the City weighed against the interests of the individual;
3. Circumstances and hardship caused by the Moratorium; and
4. Damage that could result from strict adherence to the Moratorium.

We are requesting a Sensitive Areas Moratorium Waiver to allow for filing, and review, of
engineering plans and approval of permits for the development of existing single family lots
in the Hellwig Addition. This request would apply for all permits processed and construction
required for this development including street vacations (if required), land altering permits,
curb cut access, channelization permit, road and utility installation, building permits,
boundary line adjustments (if required), and environmental checklist.
The proposal is for the development of 18 existing platted lots in the Hellwig Addition,
which is located between 46th Avenue South and Macadam Road South, at the westerly
terminus of South 139th Street. The development activity would consist of the installation
of utilities and the construction of an access road to the existing platted lots. The applicant
proposes to construct affordable housing. The lots will be developed consistent with
conditions and regulations established for the sensitive areas ordinance and the conditions
recommended by a geotechnical study of the site.
The project has been reviewed through the pre - application process and several alternative
approaches for road access and circulation have been considered by the Department of
Public Works. Pursuant to the conditions which have been identified through the pre -
application process and subject to the approval of the waiver, the applicant would file
engineering plans for review by the City.
As part of the pre - application process, considerable consultation has occurred with the City
regarding the issues which will need to be addressed in the engineering plans. These include
water supply, topography and cross sections, roadway grades, storm drainage, homesite
grading, pedestrian access, traffic circulation and sewer service. Standards to be met or
improvement requirements have been identified which will address each issue and minimize
possible impacts.

Public Works staff has reviewed the request for waiver for Hellwig
Addition and provide the following comments:
1. A geotechnical /hydrological analysis of the entire hillside needs
to be provided with final development site plans.
2. Topography shown on initial plans needs to be verified through
your licensed land surveyor.
3. A review of the storm drainage design by a geotech (Soils
Engineer of Record) for slope stability, and a Geotech Review of
permanent drain facilities, infrastructure, utilities and temporary
erosion control needs be provided and included in Soils Report.
4. Input from City meetings to date, Department of Community
Development and Public Works initially favor public roadway extension
of South 139th (alternate plan A) has a public street along with that
portion of alternate B providing 46th Avenue South between 139th and
140th Street as a public roadway. Additional input necessary to
confirm this combination is most appropriate including future profile
of roadway extension to Macadam Road and verification of file
topography, roadway grades, access and utilities.
5. Public Works does not recommend public pump /lift stations for
sewer and storm drainage and taking flows to west; but rather
requests design provide gravity storm and sewers to east to macadam
Road through right -of -way and /or easements whichever is feasible.
6. Erosion control (temporary and permanent) facilities to be
analyzed /designed by civil engineer along with soils engineer to
assure no excessive drainage and /or siltation to downstream
properties /public right -of -ways occurs during construction phase and
from permanent development.
7. Public roadways to be built and turned over to the City. Final

1. Intent of Moratorium.

In support of our petition we have provided the following information to address the
moratorium waiver criteria:
The intent of the moratorium is to allow the City to identify sensitive areas and
establish procedures to address particular concerns or characteristics of the site
through special studies and evaluations. In this case, the site is designated as a
sensitive area because of the existing topography on -site. The majority of the site has
0 to 15 or 15 to 30 percent slopes.
A geotechnical report will be prepared which will analyze the landslide, erosion
control, and slope stability characteristics of the site. Recommendations for buffers,
setbacks, and restrictions on construction will need to be incorporated into the
proposed development plan. This process will meet the intent of the moratorium in
that, a geotechnical report will be prepared and evaluated, and conditions placed on
the site as part of the review process.
2. The Best Interests of the City Weighed Against the Interest of the Individual.
The interest of the City in the development of the Sensitive Area Ordinance zone
overlay and the moratorium, is to prevent development from occurring without
appropriate study and review. The geotechnical study will provide protective
measures which will protect the interests of the City. These interests include the
prevention of hazards, losses, and environmental impacts from landslides or erosion
while protecting the natural functions and values of steep slope areas. •
The City will also receive, as part of the development of this site, additional right -of-
way and paved streets which will provide for circulation in the neighborhood area.

3 -4. Circumstances and Hardship Created by the Moratorium and Damage that would
result from Strict Adherence to the Moratorium.
The response to these two criteria are very similar as the hardship or damage created
by the moratorium is the time involved waiting for final adoption of the Sensitive
Areas Ordinance. This wait would be unnecessary when the requirements of the
ordinance, as presently constituted, can be complied with through the provision of
geotechnical evaluation of the site and placement of appropriate conditions and
limitations on the development. The lots are existing lots, and could be developed
in an expeditious manner to provide affordable single family housing.
In summary, the proposed action will include studies, recommendations and conditions that
will meet the intent of the moratorium and the SAO as if it were in effect today. The
approach would assume protection of City interests while allowing progress on this
development. (The applicant concurs with the requirement to record an agreement to
conform the project to the adopted Sensitive Areas Ordinance (SAO) and to process the
application at his own risk and expense.)
Again, we would ask for your approval of the Sensitive Areas Moratorium Waiver in order
that we might prepare and file engineering plans for roads and utilities and receive approval
of permits to construct for access to these existing single family lots. Thank you for your
consideration of this petition request.

after receiving a complaint from a city resident that
there was some clearing ongoing.
Upon on arriving at the site, two individuals were
observed at the east end of the property . One
individual was operating a backhoe doing some excavating.
I immediately posted a stop -work notice on an existing
real estate post located at the west end of the property.
I took a photo of the posted stop -work notice for the
file and proceeded to where the two individuals were
working.
I identified myself to an individual, later identified
as Curtis Koger a geologist with Associated Earth
Sciences. I handed Mr. Koger a copy of Ordinance 1544
and indicated to him that the property had been cleared
in violation of this ordinance. I asked his purpose on
the property and he indicated it was to dig five test
holes to allow for required soils tests for submittal to
the city. A discussion involving Darren, Gary, Mr. Kogen
and myself occurred whereby it was discovered that three
test holes had already been completed.
Upon completion of the discussion it was decided that
they would be allowed to continue to dig the remaining
two - three test holes necessary to complete their
studies. I indicated to Mr. Koger that if any further
excavation was required at a later date, they would need
to contact our office prior to initiation of this work.
We remained to watch them dig the fourth hole and photos
were taken to include into the file.

The following letter and attached drawings are being submitted for
your review and approval in response to City concerns regarding
traffic circulation and road grading for the above referenced
parcel.
The drawings attached are for conceptual use only and should be
regarded as a means for the City to identify a preferred alignment.
Further detailed design including field verification of off- and
on -site topography and any additional public works road
requirements will be required for the preparation of construction
drawings. Actual engineering plans may vary considerably from
conceptual drawings; however, the roadway intent will remain as
practicable.
We have included three separate concepts which we feel will address
City concerns and which portray feasible road alignments. The
following narratives will describe the rational of the layouts. In
addition, we have included some minor lot modifications which, if
agreed upon by the City, can further enhance the proposed project
and limit the disturbed areas.
PLAN A - In order to stay in conformance with the intentions of the
original approved subdivision of Hellwigs Addition, our first
alternative would be the extension of 139th Street to the western
property boundary for future extension toward Macadam Road South.
To afford proper access for emergency vehicles, a temporary turn-
around easement and paved surface has been provided at less than
150 feet from the end of construction. No major construction is
proposed on 140th Street. Minor improvements to enhance emergency� i
vehicle turning availability could also be included. ; QL�

The vacation of the adjacent 46th Avenue and /or 140th Street right -
of -way could significantly add to lot areas and reduce building
setback encroachments. Access and /or utility easements would be
provided as determined necessary during engineering design.
PLAN B - If the City considers that future extension is not
probable through the private property on the southeast, option "B"
proposes a permanent cul -de -sac at a length of 600 feet. This
length is per City Standards and would have minimal impact on the
existing Lots 2, 3, and 23. To provide access to lots 1, 25, 26
and 27, vacation of 139th Street right -of -way would be required
creating a Tract including private road construction. Again, the
road would be constructed in accordance with City Standards to a
maximum length of 150 feet.
As was discussed in Option "A ", the vacation of existing right -of-
way or improvements to 148th Street could enhance the existing
lots. Because the proposed 139th Street extension is now a
permanent cul -de -sac, an additional reduction to the 40 foot right -
of -way specified for that classification could also reduce setbacks
and disturbed areas.
PLAN C - The construction of the roadways depicted in Plan "C"
would provide additional circulation East of 45th Avenue South. No
future extension beyond the property is included in the design.

All three options for the access road meet the City's standard for
a maximum 15% grade. We have also provided some finish contour
information and potential finish floor elevations for proposed
homes.
Approximate finish floors have been provided on Plan "A ". Similar
grading and home construction should be assumed on each drawing.
Where finish floors have not been specified, grades will be
determined based on vacation and driveway alignments allowed by the
City. To minimize grading on steep slopes, joint- access driveways
may be a desirable option.
In all cases, roadway widths and alignment as well as utility
requirements will be designed under the direction of the City of
Tukwila. Please contact Jeffrey Mann or myself at 243 -7112

Pedestrian Path
City of Tukwila engineering staff have suggested that a
pedestrian path be constructed as part of the proposed
development. This path would extend from the project site along
one side of South 139th Street to 45th Avenue South and then
continue out to the intersections of South 140th Street /42nd
Avenue South and South 137th Street /Macadam Road. The path is
envisioned to be in the form of a widened, paved shoulder on the
street with appropriate markings to indicate pedestrian travel.
Based on the low volume of observed pedestrian traffic in this
area, a pedestrian path does not appear to be warranted. It is
suggested that the project sponsor meet with the City to discuss
the need for such a path.
