Tukwila was going to allow Robison/Slaminko to move into their house. You will remember that this same
house was built in violation of Tukwila City Zoning Code, I am hereby putting you on notice that I am
adamantly o posed to the City of Tukwila allowing Robison /Slaminko to move in prior to these boundary
line issues being settled. The City of Tukwila must enforce its zoning ordinances. The law must treat people
the same. If not, where do you draw the line?

Since September 11, 1991, I have been attempting to convince the City of Tukwila Planning Department that
they should enforce the City of Tukwila Zoning Code (specifically, the six foot setback rule) with regard to a
house being built to the South of my property. My property is located at 5615 South 147th Street. The
address of the house that is built in violation of Tukwila Zoning Code is 14708 56th Avenue South.
Up to this point it appears as though I am fighting a losing battle,

During a telephone conversation with Jack Pace on January 2, 1992, Mr. Pace informed me that the City
Attorney advised him that this is a "civil matter," and that it was okay for the Planning Department to cancel
the pending Boundary Line Adjustment and issue an Occupancy Permit to Robison /Slaminko.
Mr. Pace mentioned that the boundary lines in this area are "messed up" (therefore, he is going to ignore the
results of the survey?). If the City is aware of incorrect boundary lines, then it is incumbent upon the City to
do what they can do to resolve this situation.
Mr. Pace ignored my questions as to why the Planning Department was failing to enforce the Tukwila
Zoning Code, I am hoping that the Tukwila City Council and the Mayor will take an interest in city
employees practicing selective enforcement of City Code.
Mr. Beeler, what I would like from you is a written reply explaining how the Planning Department can:
1) interpret a violation of City Code as a "civil matter" and
2) issue an Occupancy Permit for a house built in violation of City Code.
Should the Planning Department issue an Occupancy Permit to Robison /Slaminko, we shall hold the City
liable. The person(s) approving the Occupancy Permit shall be held individually liable.

RELEASE AND HOLD HARMLESS AGREEMENT
The undersigned is /are the owners of the property located at
, in the City of Tukwila, Washington.
The undersigned agrees that the City of Tukwila is prevented from
issuing a Certificate of Occupancy for the improvement
constructed on that property due to improper setbacks. For and
in consideration of the City of Tukwila issuing the certificate
of occupancy that it otherwise would be precluded from issuing,
the undersigned hereby agrees to release, defend, indemnify and
hold harmless the City of Tukwila and its agents, employees,
contractors and others from and against all claims and damages
that could be made by any person or entity against the City of
Tukwila arising in any manner, directly or indirectly, out of the
City's issuance of the Certificate of Occupancy or the subsequent
occupancy of the improvement on that property. This obligation
specifically includes the obligation of the undersigned to
reimburse the City for attorneys fees and costs if the City
becomes party to any litigation arising out of this agreement or
its underlying transaction.

As of this date I am not prepared to sign the Boundary Line. Adjustmen
the record shows that the reason I am not ready is due to delinquency
Tukwila, The City of 'Tukwila received the SadlerlBarnard survey on
receive my copy of that survey until December 7.
Once I had the opportunity to review the survey and legal descriptions
decided that we needed more information (e.g,, we wanted to review
Ingman and Chase, as well as the work done by Horton Dennis and As
which I think the City of Tukwila should have volunteered, thus saving

The purpose of this letter is to explain the sequence of events in
order to complete the boundary line adjustment between all three
residents.
Enclosed is the boundary line surveyed by Sadler Barnard & Assoc.
Inc. Should any of you have questions about the property lines
adjustment, please contact our office no later than Monday,
December 9, 1991.
If all residents are satisfied with the adjustment of all
properties, each of you shall schedule a time with our office
within ten days from December 9, 1991 to sign the Affidavit of
Ownership. This process is a requirement by the state for all
boundary line adjustments.

In my letter to you dated October 28, 1991, I requested that your office submit all documents to
me for my approval. I also requested a written reply to my letter. I now reiterate both those
requests. (As of November 16, 1991, I had not received any word from your office. Three
weeks is far too long for me to have to wait for a response from you.) Please FAX your
response to me today (Monday November 18, 1991). If I have not received your written response
by 3:00 p.m., I will be forced to take further action.
On Friday November 8, 1991, I met with my attorney. The first item that I discussed with him
was the validity of a Boundary Line Adjustment application that was not properly notarized. My
second item of concern was that the City of Tukwila would process the Boundary Line Adjustment
without first sending it to me for my approval. My attorney told me that, should that happen, he
would immediately take action.
The following are my minimum requirements;
1. Adjust my southern boundary line the minimum amount required sufficient to provide
Robison /Slaminko the six foot setback they require to meet Tukwila Zoning Code.
2. Provide me with an easement such that I will be allowed to keep my fence in its present
location.
3. I make no claim to own any property to the east of the chain link fence which runs along the
eastern boundary of my property.

Consent to Occupy House and Hold Harmless Agreement
This is provided and agreed to by us for and on the behalf of the
City of Tukwila. It is our understanding that at the time of the
final inspection of our new house located at 14708 56th Avenue
South, Tukwila, Washington, 98168 (hereinafter "the house "), an
issue remains outstanding regarding the legal property lines and
required setbacks as those relate to the Tukwila Zoning Code and
our house and the properties of the other landowners. We and the
two (2) other landowners have previously jointly submitted to the
City, and are currently requesting it to process, a Boundary Line
Adjustment application. The City has agreed that the Boundary '
Line Adjustment is a legally appropriate solution for us and the
other landowners regarding erroneous property lines identified in
a recent survey of the involved properties. The erroneous
property lines which need correction according to the City, were
shown and revealed on the site plans submitted to the City for
building permits on both our property and the properties abutting
ours (commonly described and identified as 14720 56th Avenue
South, Tukwila, Washington and 5615 South 147th Street, Tukwila
Washington).
It is our understanding that since the Boundary Line•Adjustment
application has been so submitted to the City, the timely
processing, approval and recording of documents regarding the
application is now within the control of the City and its
procedures.
Based on the above information, and upon the City's telling us
that they can in the normal course of City business process the
application within sixty (60) days, we are requesting the City to
grant us permission and allow us to immediately move into the
house. In return for such permission, given even though a final
Certificate of Occupancy has not been issued due to the property
line and setback confusion, we agree to be bound and abide by the
following conditions:
1. in the event the Boundary Line Adjustment application
is not timely processed and completed within sixty (60)
days from the date of this document due to a wrongful
act or omission to act by us, we will vacate the house
until such time as the property line and setback issues
are legally settled by written agreement between the
landowners and the City, or by court order or
judgement, or otherwise to the satisfaction of the
parties involved;
2. we agree to hold harmless and indemnify the City, its
agents, contractors and employees, against any claims
for damage or monetary loss, including property damage,
personal injury and death, that may arise directly or
indirectly from any wrongful act or omission to act on
our part, or from the City allowing us to occupy our
house prior to issuance of the Certificate of
Occupancy.
We specifically and expressly reserve any and all rights and
remedies we may have against third parties, including without
limitation the other two (2) landowners involved in the Boundary
Line Adjustment. We do not intend nor do we waive any rights and
remedies we may have against third parties, nor shall this
document be construed to do so. The purpose of and intent of
this document is between us and the City only.

Washington, hereinafter termed "Grantee" and Josephine Macri,
hereinafter termed the "Grantor ";
W I T N E S S E T H:
Grantor, for and in consideration of the sum of ten dollars
($10.00), does hereby grant unto a Grantee a perpetual right -of -way
easement for construction and maintenance of a public water main
extension with appurtenances. The Easement shall be through, over
and across the property described on Attachment A and shown on
Attachment B which property is situated in King County, Washington.
Grantee or its agents or contractors shall have the right,
without prior institution of any suit or proceeding at law, at times
as may be necessary, to enter upon said property, for the purpose of
constructing, repairing, altering, replacing or reconstructing said
public facilities deemed fit or necessary by the City of Tukwila for
development of said facilities.
The Grantor shall retain the right to use the surface of said
easement, so long as said use does not interfere with the
constructing, repairing, altering, replacing or reconstructing of the
p blic facility and so long as no permanent buildings, structures or
provements are placed on said easement. This easement shall be a
c•venant running with the land and shall be binding on the
s ccessors, heirs and assigns of both parties hereto.

THIS AGREEMENT, made this day of , 19 , by and between
Joseph F. and April M. Chanes, hereinafter termed "Grantees" and
Josephine Macri, hereinafter termed "Grantor ";
W I T N E S S E T H:
Grantor, for and in consideration of the sum of ten dollars
($10.00), does hereby grant and convey unto the Grantees a
right -of -way easement for construction and maintenance of a private
access drive. The Easement shall be through, over and across the
property described on Attachment A and on Attachment B which
property is situated in King County, Washington.
Grantees shall have the right to construct and maintain a
private access drive and to use it for ingress and egress for the
Grantees' property at 14720 56th Avenue South, Tukwila, Washington.
The Grantor shall retain the right to use the surface of said
easement, so long as said use does not interfere with the use of said
private access drive by Grantees.
This easement is subject to preservation of the existing 20 foot

ingress, egress and utilities easement benefitting 14720 56th Avenue
South for utilities and access from the South 147th Street public
right -of -way.
Furthermore if any land use action for the Grantor's property
(on which the easement is located as described in Attachments A and
B) can not be accomplished because of the existence or use of this
Easement, then the Grantor may terminate this Easement by notifying
the Grantees in writing (certified mail) giving 180 day Termination
of Easement Notification to vacate and abandon their access. In such
case, the Grantees will provide plans and permit applications to the
City of Tukwila for a new curb cut and private drive in the
aforementioned existing 20 foot ingress, egress and utilities
easement, and the Grantees will construct the same per City approvals
within 150 calendar days. Finally, the Grantees will vacate
abandon the access granted by this Easement within 180 calendar days
of receipt of said Notification. This Easement shall automatically
terminate 180 calendar days after the Grantees' receipt of a
Termination of Easement Notification.
This Easement shall be a covenant running with the land and
shall be binding on the successors, heirs and assigns of both parties
hereto.

THIS AGREEMENT, made this day of , 19 , by and between
Ronald Slaminko and Kathleen Robinson, hereinafter termed "Grantees"
and Josephine Macri, hereinafter termed "Grantor ";
Grantor, for and in consideration of the sum of ten dollars
010.00), does hereby grant and convey unto the Grantees a
right -of -way easement for construction and maintenance of a private
access drive. The Easement shall be through, over and across the
property described on Attachment A and shown on Attachment B which
property is situated in King County, Washington.
Grantees shall have the right to construct and maintain a
private access drive and to use it for ingress and egress for the
Grantees' property at 14708 56th Avenue South, Tukwila, Washington.
The Grantor shall retain the right to use the surface of said
easement, so long as said use 'does not interfere with the use of said
private access drive by Grantees.
This easement is subject to preservation of the existing 20 foot
ingress, egress and utilities easement benefitting 14708 56th Avenue
South for utilities and access from the South 147th Street public
right -of -way.
Furthermore if any land use action for the Grantor's property
(on which the easement is located as described in Attachments A and
B) can not be accomplished because of the existence or use of this
Easement, then the Grantor may terminate this Easement by notifying
the Grantees in writing (certified mail) giving 180 day Termination
of Easement Notification to vacate and abandon their access. In such
case, the Grantees will provide plans and permit applications to the
City of Tukwila for a new curb cut and private drive in the
aforementioned existing 20 foot ingress, egress and utilities
easement, and the Grantees will construct the same per City approvals
within 150 calendar days. Finally, the Grantees will vacate and
abandon the access granted by this Easement within 180 calendar days
of receipt of said Notification. This Easement shall automatically
terminate 180 calendar days after the Grantees' receipt of a
Termination of Easement Notification.
This Easement shall be a covenant running with the land and
shall be binding on the successors, heirs and assigns of both parties
hereto.
