plat requirements has expired (Attachment A). This means that a
new short plat application must be submitted with a complete set
of information.
The new application may use the existing information as modified
to reflect your current proposal, except where material is time
sensitive (e.g., the title certificate demonstrating ownership).
A new application form and fee will need to be submitted.

The purpose of this letter is to indicate the following shall occur
prior to final approval of your short plat and administrative
planned residential development application. Please excuse the
delay in producing this letter. The comments listed below are
based on our meeting in December 1991.
The conditions are divided into requirements that need to be met
prior to final approval of your Short Plat, Administrative Planned
Residential Development and Sensitive Area Ordinance.
SHORT PLAT CONDITION:
1. Revise the survey map and remove N.G.P.E.
2. The 20 -foot buffer area must be extended to edge of property
line.
3. All required improvements must be constructed by the applicant
and accepted by the City of Tukwila, or a bond may be posted
by the applicant for construction of same, prior to the short
plat being filed. Said bond assignment shall be in amount
equal to one hundred fifty percent of the estimated cost of
complete construction of such improvements as determined by
the Director of Public Works. (Refer to TMC Section
17.08.080).
4. Show the location of the fire hydrant on site plan.

SENSITIVE AREAS ORDINANCE:
5. The buffer area must be planted with native trees and shrubs
as part of the landscape plan requirement. This plan must be
completed prior to final approval of the short plat.
6. The landscape plan must be stamped by a Washington State
licensed landscape architect.

If the short plat is not filed within six months of date of
approval, the short plat shall be null and void. Upon written
request by the subdivider, the Short Subdivision Committee may
grant one extension of not more than six months.

letter, you have ten days from the date of this letter to submit a
written appeal. If you should have any further questions regarding

DEVELOPER'S AGREEMENT
THIS AGREEMENT is made and entered into on between the
CITY OF TUKWILA, a Washington municipal corporation (hereinafter
referred to as the "City "), and Dolores Malinak (hereinafter referred
to as the "Owner(s) ").
R E C I T A L S
WHEREAS, Owner(s) has an interest in certain real property
located generally at 13330 32nd Avenue South -which is legally
described in Exhibit A, and hereinafter referred to as the
"Property ", and
WHEREAS, Owner(s) has or anticipates making application for a
short plat on site at 13330 32nd Avenue South, Tukwila WA 98168, Lots
A, B, C and D; and
WHEREAS, the proposed development resulting from this short plat
will result in certain direct impacts on the existing infrastructure
of the City which will require the development of improvements on
City right -of -way or easements, whether dedicated pursuant to this
Agreement or previously held by the ' City; and
WHEREAS, the proposed development resulting from this short
plat of property into four (4) single family residential lots will
create certain identifiable adverse environmental impacts which can
be mitigated,

NOW, THEREFORE, Owner(s) and City agree as follows:
1. RESPONSIBILITIES OF OWNER(S)
A. Improvements to Infrastructure. The Owner(s) will pay the
City the actual costs of 165 lineal feet of frontal improvements
fronting their property at 13330 32nd Avenue South (address prior to
short plat). The frontal improvements will include a sidewalk, curb
and gutter, associated pavement widening to the new concrete curb,
associated utility relocations and storm drainage improvements
(hereinafter the "frontal improvements ").
2. RESPONSIBILITIES OF THE CITY
City will administrate the design and construction of frontal
improvements, and bill Owner(s) for their share as calculated in
Paragraph 3 of these improvements. Upon completion of plans for the
32nd Avenue South improvements but prior to bid request and award of
the street improvement construction project, the City, in writing,
will notify the then current Owner(s) for Lots B, C and D of plans
and current costs for said frontal improvements and give the Owner(s)
of Lots B, C and D the option to build.the frontal improvements
within 60 calendar days of the date of the notification letters.
Owner(s) for Lots B, C, and D shall respond in the affirmative to the
City in writing within 30 calendar days from the date of the City's
notification letter to jointly contract for said frontal improvements
built by Owner(s) own contractor, and, immediately apply, to the
City, for a street use permit, and, successfully carry out this work
to substantial completion within the 60 day period. If Owner(s) for
Lots B, C and D fail to carry out any part of the above within the

time limits stated above, they all forfeit the opportunity to have
any of the frontal improvements work done under their own contractor
and the City.may proceed with a Public Works contractor and bill the
property Owner(s).
3. METHOD OF PAYMENT
After construction, the City will bill the Owner(s) for
proportionate share(s) of actual cost of constructed or dedicated
facilities based on the following formulas:
A. Frontal Improvements. The Owner(s) will pay their
proportionate share of the frontal improvements fronting each
Development based on actual total project construction costs. The
costs will be divided equally among Lots B, C and D, based on the
total frontage of the original lot just prior to the short plat. New
Lot A has no obligation for reimbursement under this payment
schedule.
4. TIME FOR PAYMENT
Upon completion of the frontal improvements the Owner(s) shall
pay to the City those amounts as specified in No. 3 above within
thirty
(30) days after receipt of Owner(s) statement of billing costs from
the City.
5. TIME OF COMMENCEMENT AND COMPLETION
Construction of the frontal improvements provided by the City
under the terms of this Agreement shall commence within 5 years

after this Agreement has been signed by both parties.
6. NON - WAIVER - EXTENSIONS
Failure of either party to insist on the strict performance of
the terms of this Agreement shall not be construed as a waiver or
relinquishment of that party's right thereafter to strictly enforce
any such term, but the same shall continue in full force and effect.
7. BINDING EFFECT
This Agreement shall be binding upon the parties, their
respective heirs, legal representatives, assignees, transferees and
successors. This Agreement runs with the land.
8. RECORDING
This Agreement shall be recorded with the King County Department
of Records and Elections by the City after acceptance by the City
Council, and the cost of said recording shall be paid by the City.
9. LAW AND VENUE
Actions brought to enforce any provisions of this Agreement shall
be governed by Washington law and shall be brought in Washington
State Superior Court for King County.
10. ATTORNEY FEES
In the event that either party shall commence litigation against
the other in order to enforce any term or condition of this
Agreement, the prevailing party in such litigation shall be entitled

to recover its costs, including reasonable attorney fees.
11. EFFECTIVE DATE
The responsibilities of Owner under this Agreement are contingent
upon the issuance of the requested approvals for the project. No
obligation will arise until the issuance of such approvals. If Owner
elects to proceed with any of the improvements set forth herein
before the issuance of such approvals and after installation of the
improvements elects to abandon its development, Owner, its successors
and assigns are entitled to the benefits set forth in this Agreement
related to latecomer's agreements provided such improvements are
approved and accepted by the City. Except as set forth in this
section, this Agreement shall become null and void if the project is
abandoned by the Owner or if a completed development application is
not filed by ,19

A, S, C and D; and
WHEREAS, the proposed development resulting from this short plat
will result in certain direct impacts on the existing infrastructure
of the City which will require the development of improvements on
City right -of -way or easements, whether dedicated pursuant to this
Agreement or previously held by the City; and
WHEREAS, the proposed development resulting from this short
plat of property into four (4) single family residential lots will
create certain identifiable adverse environmental impacts which can
be mitigated,

NOW, THEREFORE, Owner(s) and City agree as follows:
1. RESPONSIBILITIES OF OWNER(S)
A. Improvements to Infrastructure. The Owner(s) will pay the
City the cost of 165 lineal feet of frontal improvements fronting
their property at 13330 32nd Avenue South (address prior to short
plat) for actual costs of these frontal improvements. The frontal
improvements will include a sidewalk, curb and gutter, associated
pavement widening to the new concrete curb, associated utility
relocations and storm drainage improvements.
2. RESPONSIBILITIES OF THE CITY
City will administrate the design and construction of frontal
improvements, and bill Owner(s) for their share of these
improvements. Upon completion of plans for the 32nd Avenue South
improvements but prior to bid /award of the street improvement
construction project, the City, in writing, will notify the current
Owner(s) for Lots B, C and D of plans and current costs for said
frontal improvements and give the Owner(s) of Lots B, C and D the
option to build the frontal improvements within 60 calendar days of
the date of the notification letters. Owner(s) for Lots B, C, and D
shall respond in the affirmative to the City in writing within 30
calendar days from the date of the City's notification letter to
jointly contract for said frontal improvements built by Owner(s) own
contractor, and, immediately apply, to the City, for a street use
permit, and, successfully carry out this work to substantial
completion within the 60 day period. If Owner(s) for Lots B, C and D
fail to carry out any part of the above within the time limits stated

above, they all forfeit the opportunity to have any of the frontal
improvements work done under their own contractor and the City may
proceed with a Public Works contractor and bill the property
Owner(s).
3. METHOD OF PAYMENT
After construction, the City will bill the Owner(s) for
proportionate share(s) of actual cost of constructed or dedicated
facilities based on the following formulas:
A. Frontal Improvements. The Owner(s) will pay its proportionate
share of the sidewalk, curb and gutter, associated road widening,
storm drains and utility relocations fronting its Development based
on actual total project construction costs. The costs will be
divided amongst Lots B, C and D in three (3) equal shares, based on
the total frontage of the original lot just prior to the short plat.
New Lot A has no obligation for reimbursement under this payment
schedule.
4. TIME FOR PAYMENT
Upon completion of the installations the Owner(s) shall pay to
the City those amounts as specified in No. 3 above within thirty
(30) days after receipt of Owner(s) statement of billing costs from
the City.
5. TIME OF COMMENCEMENT AND COMPLETION
Construction of the street frontal improvements, provided by the
City under the terms of this Agreement shall commence within 5 years

after this Agreement has been signed by both parties.
6. NON - WAIVER - EXTENSIONS
Failure of either party to insist on the strict performance of
the terms of this Agreement shall not be construed as a waiver or
relinquishment of that party's right thereafter to strictly enforce
any such term, but the same shall continue in full force and effect.
7. BINDING EFFECT
This Agreement shall be binding upon the parties, their
respective heirs, legal representatives, assignees, transferees and
successors. This Agreement runs with the land.
8. RECORDING
This Agreement shall be recorded with the King County Department
of Records and Elections by the City after acceptance through the
City Council, and the cost of said recording shall be paid by the
City.
9. LAW AND VENUE
Actions brought to enforce any provisions of this Agreement shall
be governed by Washington law and shall be brought in Washington
State Superior Court for King County.
10. ATTORNEY FEES
In the event that either party shall commence litigation against
the other in order to enforce any term or condition of this

Agreement, the prevailing party in such litigation shall be entitled
to recover its costs, including reasonable attorney fees.
11. EFFECTIVE DATE
The responsibilities of Owner under this Agreement are contingent
upon the issuance of the requested approvals for the project. No
obligation will arise until the issuance of such approvals. If Owner
elects to proceed with any of the improvements set forth herein
before the issuance of such approvals and after installation of the
improvements elects to abandon its development, Owner, its successors
and assigns are entitled to the benefits set forth in this Agreement
related to latecomer's agreements provided such improvements are
approved and accepted by the City. Except as set forth in this
section, this Agreement shall become null and void if the project is
abandoned by the Owner or if a completed development application is
not filed by ,19

Public Works Department has reviewed your proposed short plat and
alternatives as identified in your October 7, 1991 letter with
Easement Exhibit No. 3 alternative being the one proposed.
Public Works will recommend approval of this short plat to the
Department of Community Development conditioned on frontal
improvements required and all four lots participating in their
proportionate share at time of reconstruction of 32nd Avenue South
with frontal improvements including public sidewalks.

When a Checklist is Required:
Property owners who wish to develop or remodel a home on a parcel mapped as a
sensitive area must complete and submit an environmental checklist.
Sensitive areas are lands which slope 15% or more, have a watercourse or wetland on
them or are in a coal mine or seismic hazard area.
Purpose of Checklist:
The State Environmental Policy Act (SEPA), chapter 43.21C RCW, requires Tukwila to
consider the environmental impacts of your proposal before making decisions. The
purpose of this checklist is to provide information to help you and Tukwila identify
impacts from your proposal and to reduce or avoid those impacts.
Instruction for Applicants:
A determination of nonsignificance must be made by the Director of Community
Development before you may apply for a building or land altering permit. A fee of
$225.00, a completed environmental checklist and a site plan, and any additional
information that will help describe your proposal or its environmental effects, must
be submitted to the Department of Community Development in order for the
determination to be made.
This environmental checklist asks you to describe some basic information about your
proposal. Answer each question briefly, accurately, with the most precise information
known, or give the best description you can to the best of your knowledge.
