COMMITMENT
Conditions and Stipulations
1. The term "mortgage," when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other
matter affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown
in Schedule B hereof, and shall fail to disclose such knowledge to the Company in writing, the Company shall be
relieved from liability for any loss or damage resulting from any act of reliance hereon to the extent the Company
is prejudiced by failure to so disclose such knowledge. If the proposed Insured shall disclose such knowledge to
the Company, or if the Company otherwise acquires actual knowledge of any such defect, lien, encumbrance,
adverse claim or other matter, the Company at its option may amend Schedule B of this Commitment accordingly,
but such amendment shall not relieve the Company from liability previously incurred pursuant to paragraph 3 of
these Conditions and Stipulations.
3. Liability of the Company under this Commitment shall be only to the named proposed Insured and such parties
included under the definition of Insured in the form of policy or policies committed for and only for actual loss
incurred in reliance hereon in undertaking in good faith (a) to comply with the requirements hereof, or (b) to
eliminate exceptions shown in Schedule B, or (c) to acquire or create the estate of interest or mortgage thereon
covered by this Commitment. In no event shall such liability exceed the amount stated in Schedule A for the
policy or policies committed for and such liability is subject to the Insuring provisions, exclusion from coverage,
and the Conditions and Stipulations of the form of policy or policies committed for in favor of the proposed
Insured which are hereby incorporated by reference and are made a part of this Commitment except as expressly
modified herein.
4. Any claim of loss or damage, whether or not based on negligence, and which arises out of the status of the title
to the estate or interest or the lien of the insured mortgage covered hereby or any action asserting such claim,
shall be restricted to the provisions and conditions and stipulations of this Commitment.

Attached is a letter from Ann Siegenthaler outlining the Short Plat
procedure for Gateway Lot #3. All of the departments provided a
preliminary review of our proposal in an effort to streamline the
process.
We ask that you do everything you can to complete the approval and
recording prior to December 20th of this year. We have entered
into a contract with a buyer to purchase approximately 13 acres
that includes the existing easement. Both we and the buyer have
a strong desire to close the transaction prior to year end. The
transaction also affects five tenants whose leases expire December
30, 1991. Completion of Short Plat is required before closing .

Attached is a site plan which depicts a proposed short plat of Lot
"3" at Gateway Corporate Center. In May of this year, Boundary
Line Adjustments were made which created the three lots shown on
the site plan. Our plans for Lot 3 now require a division into two
separate lots.
Per our phone conversation, this letter is to request an informal

CITY OF TUKWILA
WHEREAS, the City Council of the City of Tukwila has adopted a river site plan as '=
part of the King County Green River Trail Master Plan for the urban area which identifies a
pedestrian/bicycle pathway on the Green River in the northern portion of the City, and
WHEREAS, under the provisions of the Marine Recreation Land act, state and
federal funding assistance has been authorized and made available to aid in financing the
cost of land for parks and the construction of outdoor recreational facilities of local public
bodies, and
WHEREAS, the City Council of the City of Tukwila considers it in the best public
interest to develop a pedestrian/bicycle pathway along the shores of the Green/Duwamish
River along its entire length within the City.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO HEREBY RESOLVE AS FOLLOWS:
Section 1. That the Mayor be authorized to make formal application to . the
Interagency Committee for Outdoor Recreation for funding assistance.
Section 2. That any funding assistance so received be used to construct a
pedestrian/bicycle trail and associated improvements along the shores of the
Green/Duwamish River or in close proximity.
Section 3. That this resolution become part of a formal application to the
Interagency Committee for Outdoor Recreation.
Section 4. That the City of Tukwila funds be budgeted in the 1991 Annual Budget
identifying the Land Acquisition, Building and Development Fund as the source for any
required matching funds.
