Dear Phil:
While the Fort Dent Three building site (BLA -90 -2, parcel B
on the enclosed map) is under the Radovich ownership, we
agree to grant permission to the City of Tukwila to cross
over this parcel to obtain access to the bank of the Green
River. The City's purpose in reaching the river bank will
M be to provide general maintenance to the bank, dike and
H recreational trail areas.
H As the property currently undeveloped, the land can be
ap '4 crossed at any point. At such time as the property becomes
developed and the City continues to require access, the

sedimentation control facilities are in place and functional.
4. All disturbed river bank areas shall be planted with trees,
brush and grasses a$ shown on the landscape plana sent to the
Department of Fisheries, Habitat Management Division on
March 30, 1990 via FAX.
5. The river bank shall be reassessed one ear after planting to
ensure that the trees and brush that were planted have survived.
Additional plantings shall be made if necessary.

In response to your letter dated June 4, 1990 and in review through
the Public Works Director, I provide the following:
The Development is allowed to add storage capacity for their runoff
(7 day /100 year) which can be accomplished in either of two ways (1)
detain on site, (2) or, make available additional river capacity.
If you choose to detain on site, the detention pond shall be
constructed so that for high river flows (i.e. 9,000 CFS or higher)
that no flows from said detention pond will enter the river for the
100 year return frequency /7 day duration storm event. The final
configuration of this on site detention pond including setbacks,
landscaping, recreation trail, etc. will of course have to be
reviewed by other departments including the Department of Community
Development and the Recreation Department. I look forward to
receiving your detention pond plans for City review, if you so choose
it.
On another issue, the property ownership just west of your
development per our surface water billing records indicates that
Duane Wells, Evergreen Building, 15 South Grady Way, Renton Wa. 98055
is the owner of said property. The only City facility is our
existing storm line in Southcenter Boulevard fronting your property.
Again as expressed in earlier correspondence the City does not have
staff to determine the ownerships of other private properties and we
rely on your own surveyor and engineers to research this information.
Moving the storm line outfall into the river /elimination of the bench
will require going through the Department of Fisheries for a
new /revised Hydraulic Permit.

Per our conversation at our May 30, 1990 meeting, there is another
possibility for Storm Water Detention to make up for the capacity of
river flow we were required to provide. This appears to be an
on -site detention facility from all that we were able to understand
of your needs, here.
With such a large piece of undeveloped property to the Southwest of
the building we would, we assume, be able to provide this storage at
that location. However, we are still unsure if we are detaining
storm water or if we are to add to river storage capacity. We have
not had that question adequately answered. However, we would be
interested in a second choice.
After reviewing options, it appears that the Owner would like to
pursue the option of open on -site detention. In this scenario, we
would provide a very large but shallow detention pond at the
Southwest end of the property, higher in elevation than the existing
storm detention pond and outfall to City facilities or to where the
outfall would not violate private property, and pipe the new system
to existing City facility - much as in the attached diagram. This,
of course would be fully engineered should the Owner pursue such an
arrangement. However, please review the concept and advise us if we
are on the right track or not.

I. have been asked to respond to your letter of May 25, 1990,
addressed to Ross Earnst, Director of Public Works at Tukwila.
The City of Tukwila acquired a 20 foot strip of property for
a pathway inside of property that was platted in 1979. It is the
City's understanding and belief that any construction of a
jogging path presently under way lies within the 20 foot strip
owned by Tukwila or on property that is even further from the
property claimed by your clients. If your clients have a survey,
stamped and recorded as required by RCW 58.09, that indicates to
the contrary, please make it available to Mr. Earnst at your
earliest possible convenience. The City has no desire to have
its path constructed on property owned by others without their
permission.
All permits which have been granted are a matter of public
record and are available for inspection and copying by you or
your clients. These permits have been based upon surveys
supplied by the developer and his architect. The City has
advised the architect of the claims made by Mr. Dunne and
supplied him with the materials left by Mr. Dunne.
The City suggests that if there is a real problem, it is one
to be resolved between your clients and the developing property
owner.

The purpose of this letter is to call to your attention the
jogging path and other improvements presently being constructed
along the Green River on portions of Vacated Blocks 9, 12, 13,
14, 15, 16 and 17 of Gundaker's Interurban Addition to Seattle,
recorded in Volume 14 at page 46, are at least in part being
constructed upon property owned by Michael Goldfarb, D. Michael
Dunne and Jane Dunne and no permission or easement has been
obtained from these owners. We do not know what permits have
been granted and /or what permits you anticipate granting in the
future for the construction of these improvements, but we
believe no further construction should take place until proper
ownership has been established and arrangements made with the
appropriate owners. It is my understanding this matter has
previously been brought to your attention by Mike Dunne and the
purpose of this letter is simply to reconfirm the facts set
forth above.
Enclosed you will find a copy of the deed and a copy of the
survey relating to the subject property.
I suggest you have the appropriate official in your office
and /or the adjoining property owners contact the undersigned

On May 22, 1990 the City received information from Mr. Mike Dunn which
appears to support his claim that he is the owner of property
affecting your development. The property is between the City's
twenty -foot right -of -way adjacent to your property and the river. Mr.
Dunn acquired this property on March 15, 1990. Copies of his title
report, survey drawing highlighting the area in question, Tukwila Short
Sub - Division King County Assessor No. 7908210370 and the tax statement
are enclosed. The City does not have the means to verify or refute Mr.
Dunn's claims. The survey provided by Mr. Dunn may or may not be
accurate.
To date the City has relied on your plans showing property ownership
with regards to your development and associated improvements. The bench
and storm outfall shown on your plans (approved November 30, 1989) may
be on Mr. Dunn's property. I suggest that you resolved this matter
in a timely fashion.
You must recognize that if you and your clients continue construction
of the above - described portion of the development on what turns out to
be property owned by others, you do so at your own risk.

The meeting was called to order at 8:30 p.m. by Chairman Jim
Haggerton. Members present were Messrs. Haggerton, Hamilton,
Cagle, Flesher, Kirsop, Knudson and Gomez.
Representing the staff were Jack Pace and Joanne Johnson.
APPROVAL OF MINUTES - MR. HAMILTON MOVED AND MR. KNUDSON SECONDED
A MOTION TO APPROVE THE AUGUST 24, 1989 MINUTES AS CORRECTED.
UNANIMOUSLY APPROVED.
89 -9 -DR FT. DENT II - Request for design approval of an office
park development, Phase I, Fort Dent II, 60,000 sq. ft.
Jack Pace, Senior Planner, distributed Attachment "C" (revised)
and Attachment "E" (revised). He reviewed the staff report and
the site design. He pointed out that the applicant has agreed to
all conditions as stated in the staff report. He proposed the
following as modification to Condition 3.(b):
"The amount and type of landscaping for the eastern side of
the project may be modified based upon the approved plan for
Homewood Suites."
Katie Greif, - John Radovich Development Co, 2000 - 124th N.E.
(B -103), Bellevue, WA represented the applicant. She added
further clarification of the project and concluded that they
would comply to each of the conditions and recommendations of the
staff report.
Public Hearing was closed at 9:00.
Discussion ensued on the proposal.
MR. KNUDSON MOVED AND MR. CAGLE SECONDED A MOTION TO APPROVE THE
REQUEST FOR DESIGN REVIEW OF FT DENT II, WITH THE STAFF'S RECOM-
MENDATIONS AND INCLUDING THE MODIFICATION OF CONDITION 3.(8), AS
DISCUSSED EARLIER, AND BASED UPON THE FINDINGS AND CONCLUSIONS
PRESENTED BY THE STAFF IN THE STAFF REPORT.

Conditions read as follows:
CONDITIONS OF APPROVAL
1. Substantial work for Fort Dent II (and Fort Dent III) must
be started by November 21, 1990. All work proposed for
Phase II (and III) must be completed by November 21, 1993
unless an extension is granted by the City. (Shoreline
Permit Conditions).
Prior to the issuance of a Building Permit, the applicant
must submit for review and approval the following:
2. The applicant shall submit for review and approval by the
Director of Community Development and the Director of Public
Works, the revised site plan which provides the following:
a. Revised configuration of access road on shared easement
from Southcenter Boulevard which accommodate adjacent
development.
b. Revised entry to site from shared access and parking
layout.
c. Provision of differentiated walking /driving surface
which can include slight elevation of and contrasting
paving materials for walking surface for pedestrian
crossing of parking lot between Southcenter BOulevard
and the south end of Fort Dent II building.
3. The applicant shall submit for review and approval by the
Director of Community Development, a revised landscape plan
which provides the following:
a. The planting of London Plane trees, spaced 30 to 35
feet on- center along the east property line (the
property line common to the Homewood Suites project and
the State Farm office project [File: 87- 14 -DR]) for a
distance of approximately 370 feet as measured along
the property line from the edge of the Southcenter
Boulevard public right -of -way. The trees to be planted
shall be similar in size to those approved during the
BAR design review for the State Farm office project.
b. The planting evergreen shrubs a minimum of 36 inches in
height at planting and spaced so as to form a dense
landscaping screen to buffer the impact of parking on
the adjoining development. A combination of earth -
mounding and shrubs to produce a visual barrier 36
inches in height at planting would be acceptable.

DIRECTORS REPORT
The amount and type of landscaping for the eastern side
of the project may be modified based upon the approved
plan for Homewood Suites.
4. A sign plan for Fort Dent II which is similar in size and
materials to Fort Dent I.
5. The applicant shall complete a lot line adjustment so that
Building II does not straddle a lot line and provide the
City with recorded easements granting reciprocal access and
use of parking between Lots 1 and 2, or the applicant shall
complete lot consolidation (for lots 1 and 2).
Prior to the issuance of a Grading Permit, the applicant
must submit for review and approval the following:
6. A re- vegetation plan which includes native landscape materi-
als common to a riverbank habitat for the portions of the
bank of the Green River which will be disturbed during the
construction of the trail and other site work.
Prior to the issuance of a Certificate of Occupancy, the
applicant must submit for review and approval the following:
7. Approval for Fort Dent III has both been completed . An
alternative landscaping plan must be submitted, reviewed and
approved with the alternative landscaping installed on the
north side of the Fort Dent II portion of the site. The
landscaping materials shall be of similar size and species
and shall include a minimum of five trees and a 10 -foot
width.
Jack Pace discussed the schedule for Planning Commission meetings
for the coming months. It was established that the meeting dates
are November 16, 1989 and December 14, 1989. The October 26th
meeting will begin with a work session at 7:00 pm.
He reviewed the SEPA process and design review process for the
Commission.
