Subject: Shoreline Permit
It is my understanding from Terry Bennett that the City
of Tukwila is willing to approve our Shoreline Permit
application, without public waterfront access; if Boeing
will commit to providing connecting links between a pro-
posed County footbridge across the Duwamish and our
existing Oxbow walking /running track, and between the
track and the planned County trail at West Marginal Way.
These connecting links would be built to the same speci-
fications as the existing Boeing track, and would be
provided in time for the opening of the proposed foot
bridge.
Boeing will commit to this plan in return for timely
action on our Shoreline Permit request.

Boeing 9 -08 Site Improvements & Cafeteria
Shoreline Permit Conditions
1. Staff approval of a detailed irrigated landscape plan which
provides the following:
a. A riparian environment along the riverbank and a*
minimum five feet of landscaping between the B.E. & C.
building and the river.
b. The inclusion of alternating trees which will provide
significant landscape relief along the west side of the
9 -08 building.
c. Benches located throughout the landscape areas.
2. Submittal of a building material more harmonious than the
concrete proposed or tint concrete and landscape around
structure to soften and minimize significant concrete walls.
3. Submittal of earth tone colors which complement the color on
the 9 -08 and 9 -77 structures for the canopies, light
fixtures and painted components of the cafeteria.
4. Revision of Cafeteria Elevations to more harmoniously
incorporate the tower into the overall design and
incorporate the steel element into the design of the east
elevation.
5. Provision of a gate on the fourth side of the trash
enclosure.
6. Submittal of pedestrian light fixtures that are harmonious
with proposed parking lot fixture and cafeteria design.
7. Improve and dedicate for public trail purposes a 12 foot
crushed rock surface (use existing surface, base & edging)
from pedestrian bridge crossing along west bank of Duwamish
Riverto 102nd Ave. and out to W. Marginal Place S.
providing a continuous loop extension of public trail. (See
attached). An 8 -foot trail may be constructed to preserve
existing significant landscaping subject to approval of the
Director of DCD.

SEPA checklist and Shoreline permit plane must be completed
by applicant, by March 1, 1991 for County processing with
Regional Trail improvements.
Trail completion will be required within six months of
issuance of Shoreline permit for trail.

Subject: Connection of Oxbow Property to King County
Trail
Boeing Military Airplanes is very anxious to avoid any
permit delays for our site improvement work, 9 -12 Cafe-
teria and other construction jobs. You originally
requested public access to the riverfront at the T -128
site as a condition for permitting the 9 -12 building and
T -128 site improvements. Subsequently, you requested a
trail connection between our Oxbow walking /jogging trail
and the King County trail at West Marginal Way in lieu of
the public access.
I would like to reiterate that the Boeing Developmental
Center is an industrial site primarily housing Boeing
Military Airplanes operations. As such, public access is
not possible. Due to safety considerations, our
insurance underwriters will not accept these risks.
Additionally, Boeing Military Airplanes is a contractor
to the United States Government. The U. S. Government is
The Boeing Company's largest single customer. Our
customer's security regulations clearly prohibit such
access.
Boeing Military Airplanes does not believe it is appro-
priate to consider specific mitigation projects on a
"piecemeal" basis tied to specific building permit
requests. Mitigations must be considered in the broader
context of a Duwamish Valley Masterplan. As you know,
such a plan has been under discussion by Boeing with
Tukwila and other municipal governments and agencies.
Tukwila has agreed to be the lead agency for this effort.
We view the current planning activities as a continuation
of our past work.

Our previous efforts have included the following:
1. Cooperatively studied with King County Airport
the feasibility of routing a bicycle trail around
the perimeter of Boeing Field International.
2. Constructed an in -plant bridge across the Duwamish
River at the Developmental Center.
3. Included provisions for a future bicycle trail ad-
jacent to our South Parking Lot that would connect
the West Marginal Trail to the Museum of Flight
(approved by the Friends of the Duwamish).
4. Constructed sidewalks, planting strips and other
landscaped areas.
5. Expended substantial resources studying traffic
improvements, a number of which have been
implemented.
6. Developed commuter plans with Metro.
Therefore, we request that all Boeing Military Airplanes
building permit applications be processed in a timely
manner and that considerations for any potential future
mitigations be included in the on -going master planning
activities. Following this approach will allow us to
conduct our business in an efficient manner while insur-

In lieu of such a request, we would accept improvement and
dedication of a public trail along the shoreline around the Ox-
Bow site linking the proposed Green /Duwamish River Trail at the
proposed bridged river crossing and at the intersection of 102nd
Avenue South and West Marginal Place S. The. trail would be a
continuous loop connected at the above two points.
The existing crushed rock surface, base and edging are acceptable
materials; however, the width would need to be widened to twelve
feet, where feasible, per the current trail standard. Because of
lack of shoulder or other area on 102nd, a separated trail on the
south side of the road would be necessary.
SEPA and shoreline application materials for the construction of
the project will need to be completed by the Boeing Company by
March 1, 1991 in order for the project to be included in the
County's application for the adjacent phase of the trail plan.
Construction will be required within six months of permit
issuance. Any revisions or conditions of the permitting agency
will be the responsibility of Boeing.

This letter guarantees that The Boeing Company will
complete construction of the parking area, located on the
east side of the Duwamish River between the north bounda-
ry of the Cambridge Corridor (existing linear park) and
the south bulkhead at Slip No. 6, by December 31, 1991.
This letter of commitment is written to amend the letter
of January 31, 1990. This commitment is per BAR and
Shoreline approved site plan. All other conditions of
the referenced letter remain as prerequisites to water-
front park construction.

Dear Peter:
This letter is to clarify remaining questions regarding the
planned improvements and occupancy of the site.
The Boeing Company received a King County permit to construct the
9 -08 building and its accessory parking and landscaping.
(Attachment Al The area was then annexed into the City of
Tukwila. An agreement between the two jurisdictions stipulated
that the inspection process and occupancy certificate for the
structure would be completed by the County.
The Boeing Company has also received permits from the City of
Tukwila to improve the interior of the 9 -08 building. We will be
inspecting and issuing occupancy certificates for these
improvements.
As you can see on attachment A, the required site improvements
for the building permit avoided the shoreline area. At some
point, the Boeing Company decided to address site redevelopment
comprehensively, upgrade the entire site and place the employees
cafeteria adjacent to the waterfront. Since Tukwila is
processing the shoreline permit for the site improvements, we
were asked to assume responsibility for approval of the required
• site improvements for the building rather than Ring County.
Now the building is ready for occupancy but the site
improvements, a normal requirement for occupancy, are not done.
In January 1990, I received several letters from R.D. Ormsby
guaranteeing the timing and completion of the site improvements
in lieu of a cash assignment. (Attachment B)
• The attached letters from Boeing need to be'amended'to refer to
approved site plans and not "per the attached site plan." When
this is resolved the final approval for occupancy may. be given
. for the 9 -08 building.

VICINITY /SITE INFORMATION
BACKGROUND
FINDINGS
1. Project Description: The proposal is to seal coat and
restripe the parking lot, install landscaping, fencing, and
covered walkways; and construct a 9,000 square foot
cafeteria.
2. Existing Development: The site is completely paved and
developed with seven buildings of varying sizes and a water
tank and pump house.
3. Surrounding Land Use: Rhone Poulenc chemical processing
plant is located north, the Museum of Flight and Boeing
Field are located east of the site, City Light right of way
and additional Boeing Advanced Systems facilities are
located south, the Duwamish River, City Light sub - station
and a marina are located west of the site.
4. Terrain: Flat except for the river bank which generally
slopes down at a 2:1 slope and is covered with rip rap.
5. Vegetation: No vegetation on site except for the trees
around the 9 -77 building.
6. Access: One access drive is proposed at a new signaled
intersection to be called 93rd Place S. and E. Marginal Way
S.
The subject site was annexed into the City of Tukwila as part of
the Fire District #1 Annexation on March 1, 1989. The City's
Shoreline Master Program does not encompass any shoreline north
of the 42nd Avenue Bridge. Washington Administrative Code (WAC)
173 -19 -044 states that "Until a new or amended program is adopted
by the department, any ruling on an application for permit in the
annexed shoreline area shall be based on compliance with the
preexisting master program adopted for the area."

A building permit application for the 9 -08 building was underway
with the County prior to the effective date of annexation and was
issued by the County under the authority of an interlocal
agreement with Tukwila. At the time of application with the
County, Boeing was not planning any improvements within the
shoreline environment. Since then, the site improvements
described above have been proposed and require a shoreline
substantial development permit.
1. Shoreline Substantial Development Permit: Because the
proposed improvements are substantial in scope and cost and
within two hundred feet of the shoreline, the applicant must
receive a shoreline substantial development permit. The
Planning Director must approve, approve with conditions or
deny the application and shall use the policies and
regulations of the King County Shoreline Master Program.
The notice and comment period of shoreline application will
expire on the 15th of May, at which time any conditions of
the Board of Architectural Review will be folded into the
decision of the Director.
On April 11, 1990, the City received a letter from a member
of the Friends of the Duwamish regarding the subject
proposal. Their concerns were that the Boeing Company is
not water dependent or water related and therefore there
ought to be public access and fish habitat improvements as
part of the project.
The goals of the shoreline act are generally to preserve the
natural character of the shoreline; result in long term over
short term benefit; and to protect the resources and ecology
of the shoreline. The act is intended to plan for the use,
protection, restoration, and preservation of shorelines.
The purpose of the County's urban environment, as this area
is designated, is to ensure optimum utilization of
shorelines and to enhance and maintain the shoreline for a
multiplicity of urban uses. It is expected that urban
shorelines would be redeveloped with a higher intensity of
use. The following are the specific policies relating to
this environment:
1. Emphasis should be given to development within already
developed areas.

2. Priority should be given to shoreline dependent
and water oriented uses over other uses. Uses
which are neither shoreline dependent or water
oriented should be discouraged except for
residential.
3. Emphasis should be given to developing visual and
physical access to the shoreline in the Urban
Environment.
4. To enhance the waterfront and insure maximum public
use, industrial and commercial facilities should be
designed to permit pedestrian waterfront activities
consistent with public safety and security.
5. Multiple use of the shoreline should be encouraged.
6. Redevelopment and renewal of substandard areas should
be encouraged in order to accommodate future users and
make maximum use of the shoreline resource.
7. Aesthetic considerations should be actively promoted by
means of sign control regulations, architectural design
standards, planned unit development standards,
landscaping requirements and other such means.
8. Development should not significantly degrade the
quality of the environment. , including water quality
and air quality, nor create conditions which would
accentuate erosion, drainage problems or other adverse
impacts on adjacent Environments.
Based on the above policies, the Planning Director, as part of
the permit, will require that the fence be setback from top of
bank beyond the park. The relocation of the fence out of the
river environment will improve the waterfront and serve in the
restoration of the character of the shoreline.

18.60.050: General Review Criteria.
Transition
Screening
(1) Relationship of Structure to Site.
a. The site should be planned to accomplish a desirable
transition with streetscape and to provide for adequate
landscaping and pedestrian movements
b. Parking and service areas should be located, designed and
screened to moderate the visual impact of large paved
areas.
c. The height and scale of each building should be considered
in relation to the site.
Landscaping, sidewalks and connections into the site are provided
from E. Marginal Way and form the Developmental Center into the
subject site. A complete sidewalk along E. Marginal Way S. and
the minimum 15 foot front yard landscaping is not indicated but
will be installed as a minimum requirement.
Sidewalks from the various parking areas are indicated on the
site plan. Boeing uses a lighted pedestrian canopy to provide
weather cover over many of its sidewalks as well as along E.
Marginal Way S. at a proposed future transit stop.
The 31.5 acre site has numerous buildings, separated by vast
areas of parking.
The County shoreline code requires the perimeter of outdoor
parking areas to have a minimum of width five feet landscaping.
The majority of the site is shown with the minimum landscaping
required. However, the parking area in the north half of the
site does not meet this requirement. Currently trees are shown
planted in the rip rap of the shoreline bank.
The service area associated with the cafeteria is located on the
east side of the structure towards the parking lot and away from
the riverfront. A pedestrian entrance is located on this east
side as well. As the site is currently completely paved, the
landscaping proposed will be an improvement.

Height /Scale
The heights of the structures are disparate around this
industrial district, therefore no attempt is made to review the
relationship of height and size of buildings on site. The
cafeteria however is scaled for its pedestrian environment in the
river front park.
(2) Relationship of Structure and Site to Adjoining Area.
a. Harmony in texture, lines and masses is encouraged.
b. Appropriate landscape transition to adjoining properties
should be provided.
c. Public buildings and structures should be consistent with
the established neighborhood character.
d. Compatibility of vehicular pedestrian circulation
patterns and loading facilities in terms of safety,
efficiency and convenience should be encouraged.
e. Compatibility of on -site vehicular circulation with street
circulation should be encouraged.
Texture /Line /Mass
The criteria relating to harmony in lines and masses is
inappropriate in this neighborhood. The adjoining sites are a
jumble of structures indicative of an industrial area. There are
tanks and piped conveyance systems to the north, towers for
navigation and radar systems, and an odd assortment of buildings
to accommodate the cyclical flow of employees and services for
the employees and plant to the south.
The relative low scale of the cafeteria, twenty five feet, is
however well suited to the pedestrian environment being created
along the shoreline and that continues east along Cambridge
Court.
Landscape Transition
The south side of the site is a City Light right -of -way which
Boeing has leased and improved with a linear park called
Cambridge Court. The west or river side of the site will be
improved with a riverfront park that averages about 70 feet in
depth. The north side of the site has riverbank and shared
property line with Rhone Poulenc, a chemical plant. The
landscaping is sporadic and minimal along this side of the site.
The north riverfront is a former slip for ships and has piers
extending out over the riverbank. (See Attachment F) A helistop
is conceptually planned for one of the piers but is not part of

this application.
The west, north and east perimeter of the site are fenced with an
8 foot chain link topped with three strands of barbed wire which
is antithetical to use and structures appropriate to a shoreline.
As was mentioned in Background, the Planning Director will
request the fence be relocated as part of the shoreline permit
process.
Circulation Compatibility
A special loading and service area is planned for the cafeteria
and is accessible from the driveway. The loading dock is
perpendicular to a vehicular aisle which will ease backing or
maneuvering for service /delivery trucks and is recessed twenty
feet from the edge of curb. The minimum size required by code
is twelve by thirty feet.
The applicant is proposing one vehicular entrance and a new
traffic signal on E. Marginal Way S. that will be labeled S. 93rd
Place.
(3) Landscaping and Site Treatment
a. Where existing topographic patterns contribute to beauty and
utility of a development, they should be recognized,
preserved and enhanced.
b. Grades of walks, parking spaces, terraces and other paved
areas should promote safety and provide an inviting and
stable appearance.
c. Landscape treatment should enhance architectural features,
strengthen vistas and important axis, and provide
shade.
d. In locations where plants will be susceptible to injury by
pedestrian or motor traffic, mitigating steps should be
taken.
e. Where building sites limit planting, the placement of trees
or shrubs in paved areas is encouraged.
f. Screening of service yards, and other places which tend to
be unsightly, should be accomplished by use of walls,
fencing, planting or combination.
g. In areas where general planting will not prosper, other
materials such as fences, walls and pavings of wood,
brick, stone or gravel may be used.
h. Exterior lighting, when used, should enhance the building
design and the adjoining landscape. Lighting standards
and fiztures should be of a design and size compatible
with the building and adjacent area. Lighting should be '
shielded, and restrained in design. Excessive
brightness and brilliant colors should be avoided.

Existing Topography
The most significant and important topographic and landscape
feature of the site is the Duwamish River, which is designated a
river of statewide significance.
The site is paved to the edge of top of bank where one foot
square creosote posts are bolted to the ground. The eight foot
tall chain link fence with three strand barbed wire atop the
fence separates the site from the water. The bank, which is
covered with rock boulders, then descends at an approximate 2:1
slope into the water along all waterfronts. The north river area
has a series of concrete platforms that extend out over the river
on piers.
Grades
Exterior Lighting
The grades of the parking area will remain level and therefore
safe. The grades in the liner waterfront park will be changed to
create berms and some variation in the landscaping which will
facilitate pedestrian views along the river.
Landscape Enhancement Features and Protection
Trees line the major access drives and pedestrian corridors and
will be used in all planting areas and curbing is proposed around
the edges of the landscape areas, which will protect the plant
material.
The west wall of the existing 9 -08 is approximately eighty -four
by three hundred and forty feet tall which is equal to 28,560
square feet of flat unrelieved wall facing the shoreline and
park. A row of trees is proposed along the wall adjacent to the
pedestrian canopy and walkway. A tall pyramidal tree alternating
with a contrasting tree would add variety and interest and would
help soften the appearance of the massive building.
The dumpster is located in the southwest corner of the site and
is shown screened on three sides by a concrete wall and
landscaping on two sides.
The plant material does not indicate whether it will be effective
in summer and winter. The applicant's written response indicates
evergreen planting around the dumpster area.

The applicant is proposing two types of light fixtures for the
site. The standard parking lot fixture is a sixteen foot tall
concrete aggregate pole with a brown anodized aluminum square
fixture which duplicates the lights that are currently installed
around the Developmental Center.
Nothing has been chosen for the pedestrian fixture around the
cafeteria and waterfront park.
(4) Building Design
a. Architectural style is not restricted, evaluation of a
project should be based on quality of its design and
relationship to its surroundings.
b. Buildings should be to appropriate scale and in harmony with
permanent neighboring developments.
c. Building components- such as windows, doors, eaves, and
parapets should have good proportions and relationship
to one another. Building components and ancillary parts
shall be consistent with anticipated life of the
structure.
d. Colors should be harmonious, with bright or brilliant colors
used only for accent.
e. Mechanical equipment or other utility hardware on roof,
ground or buildings should be screened from view.
f. Exterior lighting should be part of the architectural
concept. Fixtures, standards, and all exposed
accessories should be harmonious with building design.
g. Monotony of design in single or multiple buildings projects
should be avoided. Variety of detail, form and siting
should be used to provide visual interest.
Architectural Quality and Detail
The cafeteria will consist of painted steel support structure,
concrete and glass walls, and painted metal roof. The architect
and landscape architect have collaborated to integrate the
structure with the landscape. The structure extends out into the
landscape with concrete retaining walls and with earth berming.
The wing -like retaining walls will be conveniently sized to allow
pedestrian seating and provide enclosure and transition between
the outdoor plaza and the pedestrian environment of the park.
The structure will have a steeply sloping roof from west to east.
At the roof's high point of twenty -five feet along the river
front will slope to fourteen feet on the bottom of the eave on
the east side.

On the west side of the structure, the painted steel tubular
element with its geometric pattern combined with the glass wall
will have a light, airy expansive character that will be visually
interesting. In contrast the east side will be composed of
geometric squares and rectangles that are juxtaposed in a three -
dimensional pattern that's sculpturally interesting and fairly
well balanced.
From the north or south elevation, the tower extending from the
mechanical enclosure does not fit with the downward transition of
height from west to east. From east elevation, the tower does
not relate to the blocky, low, horizontal pattern.
Ancillary Equipment
The mechanical equipment will be enclosed in the east portion of
the building inside concrete walls with the narrower tower that
extends above the enclosure discussed above.
Color
Earth tone color is proposed for the building which is compatible
with the color used throughout much of the Developmental Center
but could contrast with the color of the dominate 9 -08 and 9 -77
buildings and new radar tower which are a Sea Foam green. The Sea
Foam is light but with a warm tone that could be matched with an
earth tone.
(5) Miscellaneous Structures and Street Furniture
There is no miscellaneous furniture shown.
Lighted pedestrian canopies used throughout the Developmental
Center will be included in the site improvements. The metal
supports are painted the chocolate brown and have a milky concave
plexi -glass or plastic cap.
The three sided enclosure for the dumpster is proposed to be of
concrete duplicative of the cafeteria. The open side will be to
the north facing the pedestrian entrance.

2. The steel element is a dominate feature of the cafeteria's
design on the east side of the structure. If you look at
the west side and then the east side, they could be two
completely different buildings. Some attempt to carry the
steel girder system through to the other major entry way
would provide a continuity of building identity.
3. The tower element sticks up, is out of scale, and at odds
with the general side view and front view of the cafeteria.
The tower element should therefore be scaled or enclosed to
relate to the proportions and lines of the dominate building
lines and pattern.
4. The concrete used in the cafeteria is a new element on site
and not consistent with the dominate building skins of the
9 -08 and 9 -77. Because the area is industrial, the
proposed architectural concrete may not be out -of- character;
however, a more harmonious, higher quality material
consistent with the smooth, slightly shiny skin of the 9 -08
and 9 -77 buildings may be more appropriate for an employee
cafeteria.
5. The Duwamish River although heavily altered by man still
provides interest and amazement because of nature coexisting
with industrial activity along a heavily developed
shoreline. The applicant takes advantage of this
environment by locating their employees cafeteria and a
pedestrian pathway and park along the shoreline. The design
of the landscaping however should be more reflective of a
riparian environment rather than a park -like one. The plant
palette is proposed to be trees, sod and shrubs. In order to
satisfy the criteria relating to Landscape and Site
Treatment, choice of materials should be more indicative of
the water environment and a river shoreline. The berming
will enhance the view potential from the site, but benches
with backs should be installed in numerous locations along
the riverfront for pedestrian enjoyment.

6. To provide greater harmony on the site, in an district which
has many competing design elements, the pedestrian lighting
proposed by the applicant should be of a scale, a material
and a design that complement the industrial nature of the
site and project.
7. The two dominate colors at the Boeing Development Center are
the traditional cream and chocolate brown and the newer Sea
Foam Green used on the new massive structures that have been
built. These two colors contrast and the "earth tone"
colors proposed by the applicant for the subject project
should attempt to complement them.
8. The open side to the dumpster enclosure faces the pedestrian
entrance to the cafeteria. A gate would allow personnel to
dump trash as well as haul it off but would screen the
facility during the times when access is unnecessary.
RECOMMENDATIONS
The Planning Division Staff recommends approval subject to the
following conditions:
1. Staff approval of a detailed irrigated landscape plan which
provides the following:
a. A riparian environment along the riverbank and an
minimum five feet of landscaping between the B.E. & C.
building and the river,
b. The inclusion of alternating trees which will provide
significant landscape relief along the west side of the
9 -08 building.
c. Benches located throughout the landscape areas.
2. Submittal of a building material more harmonious than the
concrete proposed or tint concrete and landscape around
structure to soften and minimize significant concrete walls.

3. Submittal of earth tone colors which complement the color .
on the 9-08 and 9 -77 structures for the canopies, light
fixtures and painted components of the cafeteria.
4. Revision of Cafeteria Elevations to more harmoniously
incorporate tower into the overall design and incorporate
the steel element into the design of the east elevation.
5. Provision of a gate on the fourth side of the trash
enclosure.
6. Submittal pedestrian light fixtures that are harmonious with
proposed parking lot fixture and cafeteria design.

SUBJECT: Boeing 9 -08 Building - Land Use (Shoreline) Review
Public Works Department has reviewed the subject plan and the
following comments need be addressed in a site plan submittal
to the City Public Works Department.
1. Provide a letter of availability for sewer and water from
the City of Seattle.
2. Provide a Developer's Agreement to Ron Cameron for F.E.I.S.
traffic mitigation, as identified in January letter.
3. Relocate fire line 10 ft. away from building. No structures
shall be placed over utilities, including fire lines.
4. Identify the type of materials for new hydrants (per City of
Tukwila Water Development Standards).
5. Review fire loop /hydrant additions with the Tukwila Fire
Marshall (Nick Olivas) and the Rating Bureau for compliance.
6. Identify storm roof drains and identify undergrounding these
roof drains into the parking lot drainage system.
7. Identify landscape irrigation and provide an O.C.P. approved
landscape irrigation plan. Swales are suggested for direct
runoff of storm drainage on parking lot into green areas
and transmitted into a storm system, if possible.
8. Provide lowest floor elevation of restaurant and reference
N.G.V.D. datum so the City may make appropriate

that Boeing dominates the shore line in that area and yet

This letter is intended to . summarize our telephone discussion on 3/13/90,
regarding the requirements for revising the . 9 -08 Building Shoreline
Application to include a cafeteria. We discussed the following items:
You requested a written notification that Boeing intends to
revise this application by March 15, 1990. Other information,
such as a revised site plan, will not be necessary until April 5,
1990. I explained that Boeing does intend to add the cafeteria
to the application and I have let them know that this written
request is needed.
You stated that you cannot continue processing the application
until you receive the revised information on April 5, 1990. You
stated that the notice to the public and certain government
agencies will be sent out April 13, 1990. You estimate that the
Shoreline Permit will be issued 7 -8 weeks later (this includes
the 30 -day DOE review and comment period). The building
permit application can be submitted during this . 7 -8 week
period. However, it is the applicant's responsibility to pay for
any additional building permit reviews resulting from the
Shoreline Permit. The building permit can be issued as soon as
the Shoreline Permit (including DOE review) is obtained.

colors, light fixtures, etc.), then a range of options can be
presented to the BAR.
For the Shoreline Permit, you stated that a section showing the
building's relationship to the river will be needed. On a related
matter, you informed me that the 14 -09 Building BAR will
probably be "bumped" to the following month (May) since the
9 -08 application is being revised.

Company's intent to revise the 9 -08 Building Shoreline Permit
application. We have been informed by Peter Hummel, of Bruce Dees &
Associates, that you have requested such written notification.
The revisions are necessary to include a cafeteria building within the
site's 200' low impact shoreline zone. This proposed building and
necessary site improvements need to be added to the Shoreline
Substantial Development and Board of Architectural Review (BAR)
applications.
Based on your discussion with Peter Hummel, it is our understanding that
the revised Shoreline /BAR application needs to be submitted by April 5,
1990 to allow the BAR to review it in April.

Dear Neal:
The 9 -08 shoreline application was put on hold one month ago
because you stated that you would be changing the proposal to
include a cafeteria adjacent to the shoreline.
Due to the urgency regarding improving the site around the 9 -08
building, which was conveyed by Boeing staff members at the
February 22nd meeting, we will restart the shoreline notice on
March 15th for the improvements as currently described in your
application. As you know, the notice process takes seven weeks
at the local level and then another five weeks at the state level
before improvements can begin.
The proposal will be scheduled before the Board of Architectural
Review on April 26, 1990, which is a requirement, prior to local
issuance of the shoreline permit. Any changes would have to be
in by April 9, 1990 in order to be included in that meeting.
If this begins immediately, work could possibly start at the end
of May, first of June of this year.
Any changes, such as for the cafeteria, would start the process
again or separately, depending on your needs.

A Tukwila shoreline permit application is being processed for the
proposed improvements as shown on the attached site plan.
We would agree to the applicant's desire to allow the site
improvements for the 9 -08 site to be pursued through the Tukwila
planning and permitting process.
As I understand, the County will therefore continue their

Moira Bradshaw explained that the purpose of the meeting was to
review Tukwila's staff comments on the 14 -09 and 9 -08 Building
Shoreline permit applications prior to review by the Board of
Architectural Review (BAR).
The following issues were raised by Tukwila:
14 - 09 Buildinq
1. Schedule and the status of construction of the building.
2. Drainage swale (for biofiltration).
3. Seawall.
4. Additional information.
5. Comments on design.
9 -08 Building

II. 14 -09 BUILDING
A. Schedule
Neal Tunison explained that the 14 -09 Building construction was
being put on hold for approximately one year. Jim Duffy also
explained that this building site is proposed to be used for parking
in the interim.
Moira Bradshaw explained that the shoreline permit will be good
for two years, from issuance to substantial completion. However, a
one -year extension can be issued. She also explained that several
issues are affecting the completion of the permit process (these
are covered below).
B. Swale for Storm Water
Moira explained that this swale is a condition of the shoreline
variance for the parking. The swale is proposed as a method of
filtering oils from the parking lot prior to discharge into the
Duwamish River. She explained that the Department of Fisheries
generally requires such swales for new storm water outfalls. She
also stated that Tukwila is adopting new storm water standards
that would have similar requirements. The engineering and cost of
such a swale was discussed. Ben Dunlap explained that depending
on how storm water is calculated, it may be possible to use the
existing outfall. Moira explained that if the existing outfall is
used, the requirement for swales could be reviewed for deletion.
She will coordinate with Ben on getting Tukwila's storm water
calculation standards.

C. Seawall
Moira stated that prior to processing the permit, a definite
decision needs to be made on whether or not replacement of an
existing seawall will be included in the permit application. If it is
included, drawings are needed showing the design of the wall. If it
is not included, Boeing can write a letter to Moira explaining that
the wall is to be deleted from the current shoreline , permit. She
also explained that another permit could be issued in two or three
years if the wall is built then.
Greg Mercier explained that a study had been done for Boeing by
Alpha Engineers to assess the condition of the existing sea wall
and the cost of replacing it. Their conclusion is that the existing
wall is structurally sound. However, tidal action will continue soil
erosion behind the wall.
D. Additional Information
Rebecca Fox stated that several pieces of information are needed to
adequately evaluate the design. The following items are needed:
1. Drawings for the covered walkways.
2. The entrance courtyard and dumpster screening at the cafeteria
entrance.
3. Guardpost architectural drawings.
4. Color samples for the building, covered walkways, and
guardpost.
5. Park furniture catalogue cuts (if included in the shoreline park).
Specific sheet numbers were coordinated between Rebecca and
Bruce Dees.
E. Comments on the Design
The following comments were made by staff on the site plan and
building design:
1. The fence between the shoreline park is a concern in terms of
both visual and physical separation from the river. Boeing
representatives stated that the physical separation is needed to
meet security requirements. Visual separation could be
mitigated by coloring the chainlink (for example, black or
green). Bruce Dees suggested that additional drawings
(sectional views) showing the relationship between the fence to
the river may be helpful.
2. Park furniture in the Linear Park was suggested by the Tukwila
Parks Director.
3. The dumpster location and screening at the building entrance is
a concern. Bruce and Greg Krape explained that this location is
needed for the close proximity to the cafeteria and service
access. Screening includes concrete walls and evergreen plant
material.
4. Building colors: The staff suggested using more color accents
for the building (as opposed to one color throughout). Other
suggestions included painting stairways a different color (as an
accent), and a mural on the building.

5. A pedestrian connection between the rear (river side) entrance
to the building and the shoreline park.
The question was raised as to whether or not these comments are
requirements or suggestions and how Boeing should respond to them.
Moira Bradshaw stated that they are suggestions and Boeing can
respond in writing as well as verbally at future meetings with the BAR
and staff.
111.9 -08 BUILDING
A. Cafeteria Building
Moira explained that the shoreline permit cannot be processed until
there is a decision from Boeing on whether or not a cafeteria will
be included in the permit application. She offered to look into the
possibility of processing the permit with only a building "footprint"
and cross section (showing the building's relationship to the river).
However, the BAR would still review the building design at a later
time.
B. Coordinating with King County
Greg Mercier stated that written verification of an agreement
between Tukwila and King County on transfer of parking layout
approval at the 9 -08 Building site is needed. Moira stated that she
needs Herb Haines' (of King County) address and phone number
before she writes a letter verifying the agreement. Bruce Dees
will get her this information.
IV. SCHEDULE FOR ADDITIONAL INFORMATION
Moira stated that additional drawings, any revisions to the drawings,
decisions on the seawall, and swale would be needed by March 5, 1990
for the BAR to review the project in March. If this information is not
received by this time, the next BAR meeting is the fourth Thursday in
April. The deadline to receive this information would be April 9, 1990.

Construction of our Building 9 -08 is nearing completion. Bruce Dees, our
Landscape Architect, has discussed with you our desire to transfer approval of
the parking layout from King County to the City of Tukwila. Following, is my
understanding and agreement for the transfer:
The City of Tukwila agrees to:
1. Coordinate and consumate an agreement with King County
for transfer of parking approval to Tukwila.
Boeing agrees to:
1. Obtain the necessary storm drainage, landscape irrigation
and building permit for development of parking and
landscape improvements.
2. Develop the parking and landscape improvements shown
within the limits or proposed improvements per the attached
North D.C. Site Plan.
3. Design and construct all parking and landscape improvements,
except the waterfront park by December 31, 1990. The
waterfront park will be designed in 1990 and a letter of
commitment will guarantee construction completion by December
31, 1991.

JANUARY 10, 1990
A new office structure at 9300 E. Marginal Way is under
construction for Boeing Advanced Systems. The site abuts the
Duwamish River and is completely paved and used for either
parking or various other structures existing on the site.
Attachment A
The new structure, called the 9 -08 building, was permitted by
King County and will be completed within the next two months.
The building is outside the 200 foot shoreline zone. The
applicant also demonstrated to the County that required parking
for the new building could be provided outside the shoreline
zone.
The applicant is proposing to make additional site improvements
that will reduce the degree of nonconformity on the site by
pulling the existing paved parking areas back from the river and
providing landscaping along the river and in linear strips within
the parking areas. Attachment B
Section 806 of King County Shoreline Master Program, Alteration
of Nonconforming Use or Developments, says that applications for
building permits to modify these nonconforming areas, may be
approved only if the modifications will make the use or
development less nonconforming or not make the use or development
more nonconforming. Review of applications for the modification
shall be subject to the guidelines enumerated in the County
Zoning section on Nonconforming buildings and uses.
My impression from the King County Program is that a shoreline
permit would not be required. I would appreciate your comments
on the proposal and I would be happy to arrange a meeting on site
if you would like a tour. If you have any suggestions for
improvements to the landscaping, I would appreciate those
comments as well.

B. Property Survey: It was agreed that the 4/14/90 meeting with Moira
Bradshaw that a property survey map of the Developmental Center will
be submitted prior to issuing the permit. The map will include
interior lot lines and building locations.
