AGREEMENT FOR USE OF REAL PROPERTY
This agreement is entered into between Thomas 0. Presleigh, as Seller, and Robert
W. Hillstead, as Purchaser, as a part of the sale of real property from Presleigh to
Hillstead.
Hillstead is purchasing from Presleigh a building and the following described real
property on which it is located:
That portion of Lots 8, 9 and 10, Block 2, First addition to Adams Home
Tracts, according to Plat recorded in Volume 12 of Plats, page 50, records
of King County, Washington, described as follows:
Beginning at the northeast corner of said Lot 10; thence S1- 05 -55W along
the East line of said Lot 10 a distance of 129.75 feet; thence N88- 51 -15W
147.45 feet; thence N70- 39 -43W 111.00 feet; thence N76- 59 -24W 54.19 feet
to the easterly margin of State Highway No. 1; thence N20- 06 -26E along
said easterly margin 93.69 feet to the southerly margin of South 148th
Street; thence S87- 53 -09E along said margin 275.42 feet to the point of
beginning.
Presleigh will continue to own the following described real property containing a
building located adjacent to the property purchased by Hillstead and containing an
area used as a parking lot.
That portion of Lots 8, 9 and 10, Block 2, First Addition to Adams Home
Tracts, according to Plat recorded in Volume 12 of Plats, page 50, records
of King County, Washington, described as follows:
Beginning at the northeast corner of said Lot 10; thence S1 -05 -55W along
the East line of said Lot 10 a distance of 129.75 feet to the true point of
beginning; thence N88- 51 -15W 147.45 feet; thence N70 -39 -43W 111.00
feet; thence N76- 59 -44W 54.19 feet to the easterly margin of State
Highway No. 1; thence S20- 06 -26W along said easterly margin 99.51 feet;
thence S76- 24 -25E 56.39 feet; thence S70- 35 -04E 73.84 feet; thence
S87- 57 -33E 213.18 feet to the east line of said Lot 10; thence N1- 05 -55E
along said east line 86.94 feet to the true point of beginning.
There is an area between the two buildings that is used by the occupants of the
buildings as an access between the parking lot area being purchased by Hillstead,
located in front of his building, and the parking lot area located behind the Presleigh
building. The parties have agreed that under the terms and conditions provided
below the access area may continue to be used by the occupants of the buildings and

that the occupants of the Presleigh building may continue to cross the Hillstead
parking lot to reach the rear of the Presleigh building and may continue to use the
Hillstead parking lot for reasonable overflow customer parking. Such use shall not
interfere with Hillstead's parking requirements. The areas shall also continue to be
used for delivery purposes provided such use does not damage the parking lot
surface.
The areas of the Hillstead lot and the Presleigh lot located adjacent to the building
located on the Presleigh lot and consisting of a strip ten (10) feet wide on each side of
the boundary line between the lots shall be used as a parking area by customers of
the businesses conducted on each of the lots.
It is the purpose of this agreement to provide the terms and conditions under which
the access area and the parking area will continue to be used by the parties to this
agreement, their tenants, assigns and successors in interest.
To accomplish the above purposes, the parties, in consideration of the benefits to be
received by each party, agree as follows:
1. The access area and twenty (20) foot parking area will continue to be available
for use by both parties during the term of this agreement and any renewal or
continuation of the term for the purposes described above. Except as provided
in paragraphs 4 and 5 neither party shall cause, directly or indirectly, any
obstructions to be placed in the access area that would impair the flow of traffic
through such area.
2. In the event that repairs to the access area shall be required, the parties agree
that Presleigh shall be responsible for twenty percent (20 %) of the cost of such
repairs and Hillstead for eighty percent (80 %) of the cost.
3. Except as provided below, this agreement shall remain in full force and effect
for a period of seven (7) years and shall be automatically renewed for successive
periods of seven (7) years each unless either party gives to the other party
written notice of intent to renegotiate thirty (30) days prior to the expiration of
the seven year term or any renewal of the term. The terms and conditions of
the use of the access area and twenty (20) foot parking area shall be subject to
renegotiation by the parties at each renewal or extension of the term of this
agreement.

4. Hillstead shall have the right, in the event he determines it reasonable and
necessary, to enlarge the building being purchased by Hillstead, even though
such enlargement or extension of the building may block the access area that is
the subject of this agreement. In the event of the blockage of the access area by
the extension of the building, this agreement relative to access area only shall
terminate.
5. Hillstead shall have the right, in his reasonable discretion, to determine load
limits and to otherwise control reasonable access through the access area and
over the Hillstead lot.
6. In the event is shall be necessary for either party to temporarily block the access
provided for above, the party desiring to temporarily block the access shall
notify; in writing, the other party prior to such time as the blocking shall occur.
The notification shall indicate the time at which the access will be blocked, the
reason for the blockage and the length of time that the temporary blockage of
the access will remain in effect.
7. This agreement shall be binding on the heirs, assigns and successors in interest
of each of the parties.
8. The exhibit attached to this agreement is a surveyor's map of the property
showing the areas referred to in this agreement.

conversation, I am enclosing for you review the following documents:
1. Surveyor's plat showing lot line adjustments, existing buildings, sewer lines,
ingress and egress easements, reciprocal parking areas and emergency access area
prepared by my client's surveyor.
2. Copy of proposed Agreement For Use of Real Property to be entered into
between Mr. Presleigh and the current occupant, the prospective purchaser of a
portion of the property. This agreement will be executed at the time of the sale
of the portion of the property to Mr. Hillstead.
A review of the prior submissions made by my client, together with the additional
requirements established by your July 27, 1990, letter, indicate that we have now
fully complied with the filing requirements to obtain approval of the boundary line

Second Follow -up on Original Request
Per our meeting of 7/17/90 with Mr. Presleigh (present at the meeting
was Phil Fraser,Ross Heller, Darren Wilson and Mr. Presleigh) issues
that were raised at that meeting are as follows:
1. Mr. Presleigh identified that Lot C would be provided by a
separate access to Pacific Highway South to the west. No
mutual access through Lot C to Lots A or B is needed.
2. Mr. Presleigh proposed that Lots A and B at the back (east side)
to be provided with an access /utilities easement across Lots A
and B to South 148th Street to the benefit of Lots A, B and C
(easement would include drainage for Lots B and C to South
148th Street).
3. City staff requested that a recriprocal ingress /egress and
parking agreement (or easement) between Lots A and B fronting
Pacific Highway South for the westerly portions of the properties
to be provided to allow continuation of current use.
4. Mr. Presleigh proposed, per his understanding with Fire
Department, that an emergency access across Lot A to Lot B
between the existing buildings was also necessary.
5. Mr. Presleigh showed a drawing at the meeting. He indicated
Lots A, B and C were all served off of Pacific Highway
South for water and do not require any special water easements.
6. Mr. Presleigh was requested to show both lines for the sewer
easement (existing) rather than the center line of the easement.
This is my recollection of what occurred at the meeting on 7/17/90.
Although I did not keep minutes of this meeting, it was my
understanding that Mr. Presleigh was going to go back to his office
and put this information on the plan so that this short plat could be
completed as quickly as possible.

This firm represents Thomas O. Presleigh and is writing to your office in regard
to the above numbered file. Our client originally filed for a lot consolidation and
boundary line adjustment on May 23, 1990. Subsequent to such time, he had
meetings with various representatives of the Public Works Department and
Engineering Office and submitted all information and documentation required
of him. On July 2, 1990, based on information furnished to him by the Public
Works Department, he contacted the City expecting the application processing to
be complete and anticipating an approval of his request. At that time, he was
advised that the Department was evidently reclassifying the application to an
application for a short -plat subdivision and was advised of new requirements
and additional material that would be needed. Our client is concerned over the
length of time that has elapsed since the filing of the original application and the
continuing changes in requirements and documentation that have occurred
since that time.
We request that you provide this office with a written explanation of why the
City evidently changed the classification of the application from a lot
consolidation and boundary line adjustment to a short -plat subdivision, why the
City has periodically changed the conditions that my client is required to comply
with and why the Public Works Department has been unable to determine what
information and documentation is required. We would also appreciate
receiving appropriate citations to the City code showing the basis for the
additional and changing requirements.
The length of time that the City has taken in processing the original application
has imposed an economic burden on our client and is delaying a possible sale of
a portion of the property. Any further delays in obtaining approval of the
application will continue to increase the costs to our client. Our client has

Hillstead is purchasing from Presleigh a building and the following described real

used for delivery purposes provided such use does not damage the parking lot
surface.
The areas of the Hillstead lot and the Presleigh lot located adjacent to the building
located on the Presleigh lot and consisting of a strip ten (10) feet wide on each side of
the boundary Iine between the lots shall be used as a parking area by customers of
the businesses conducted on each of the lots.
It is the purpose of this agreement to provide the terms and conditions under which
the access area and the parking area will continue to be used by the parties to this
agreement, their tenants, assigns and successors in interest.
To accomplish the above purposes, the parties, in consideration of the benefits to be
received by each party, agree as follows:
1. The access area and twenty (20) foot parking area will continue to be available
for use by both parties during the term of this agreement and any renewal or
continuation of the term for the purposes described above. Except as provided
in paragraphs 4 and 5 neither party shall cause, directly or indirectly, any
obstructions to be placed in the access area that would impair the flow of traffic
through such area.
2. In the event that repairs to the access area shall be required, the parties agree
that Presleigh shall be responsible for twenty percent (20%) of the cost of such
repairs and Hillstead for eighty percent (80 %) of the cost.
3. Except as pr vided below, this agreement shall remain in full force and effect
for a period o seven (7) yeas and shall be automatically renewed for successive
periods of seven (7) years each unless either party gives to the other party
written notice of intent to renegotiate thirty (30) days prior to the expiration of
the seven year term or any renewal of the term. The terms and conditions of
the use of the access area and twenty (20) foot parking area shall be subject to
renegotiation by the parties at each renewal or extension of the term of this
agreemen t.

4. Hillstead shall have the right, in the event he determines it reasonable and
necessary, to enlarge the building being purchased by Hillstead, even though
such enlargement or extension of the building may block the access area that is
the subject of this agreement. In the event of the blockage of the access area by
the extension of the building, this agreement relative to access area only shall
terminate.
5. Hillstead shall have the right, in his reasonable discretion, to determine load
limits and to otherwise control reasonable access through the access area and
over the Hillstead lot.
6. In the event is shall be necessary for either party to temporarily block the access
provided for above, the party desiring to temporarily block the access shall
notify, in writing, the other party prior to such time as the blocking shall occur.
The notification shall indicate the time at which the access will be blocked, the
reason for the blockage and the length of time that the temporary blockage of
the access will remain in effect.
7. This agreement shall be binding on the heirs, assigns and successors in interest
of each of the parties.

showing the areas referred to in this agreement.
