AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON,
VACATING THAT PORTION OF PUBLIC RIGHT -OF -WAY WITHIN
THE CITY OF TUKWILA, GENERALLY DESCRIBED AS UNOPENED
35TH AVENUE SOUTH LYING NORTHERLY OF SOUTH 124TH
STREET TO THE END OF 35TH AVENUE SOUTH TRAVELING NORTH
WHEREAS, all of the abutting property owners joined in a petition for
vacation of the unopened 35th Avenue right -of -way lying northerly of South
124th Street to the end of said right -of -way traveling north, and
WHEREAS, by resolution dated July 10, 1989, the Council set August 7,
1989, as the date for a public hearing, and
WHEREAS, a public hearing was held on said vacation petition before the
City Council on August 7, 1989, and
WHEREAS, notice of. the pendency of the street vacation and hearing were
given as prescribed by law, and
WHEREAS, the street vacation had been originally begun with King County
before annexation of the area to Tukwila, and
WHEREAS, due to unusual circumstances King County had agreed to vacate
said street for no compensation, and has requested that Tukwila do the same,
and
WHEREAS, the City of Tukwila desires, to the
King County's commitments, and
WHEREAS, one of the abutting property owners
to the City the real property, described in Exhibit
the widening of South 124th Street, which property
one -half of the value of the street being vacated, and
and
Section 2. That the street so vacated shall belong to the abutting
owners, as provided in RCW 35.79.040.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. That certain public right -of -way located within the City of
Tukwila, Washington and more particularly described on Exhibit A, and shown on
Exhibit B, both of which are attached hereto and hereby incorporated herein is
vacated subject to an easement in favor of Seattle City Light for existing
facilities and upon the terms and conditions set forth herein.
Section 3. That Inco Express, Inc., will dedicate that property
described in Exhibit C hereto and hereby incorporated herein, the full value
of which does not exceed one -half of the value of the vacated right -of -way,

and no further compensation shall be required of either abutting property
owner.
Section 4. That Inco Express, Inc., will consolidate lots 9 through 15
and Victor DiPietro will consolidate lots 1 through 8 and 16 all of Block 2,
Riverside Addition as recorded at Volume 13 of Plats, Page 36, records of King
County, Washington.
Section 5. The City Public Works Director is hereby instructed to amend
the City's Official Street Map to be consistent with this ordinance.
Section 6. If any section, sentence, clause or phrase of this ordinance
shall be held to be invalid or unconstitutional by a court of competent
jurisdiction, such invalidity or unconstitutionality shall not affect the
validity or constitutionality of any other section, sentence, clause or phrase
of this ordinance.
Section 7. The City Clerk is directed to record this ordinance and to
provide a certified copy thereof to the King County Department of Records and
Elections upon its effective date.
Section 8. This ordinance shall be in force and effect five days after
publication of the attached Summary which is hereby approved; provided,
however, this ordinance shall not be published until the City Clerk has the
deed to that real property described in Exhibit C hereto in hand and until the
lot consolidations proved for in Section 4 hereof have been completed and
further provided that this ordinance shall be null and void if said deed is
not received or said consolidations not completed within thirty days of the
date of this ordinance.

That the Grantor, for and in consideration of the sum of One Dollar
(51.00) and other valuable Considerations, receipt of Which is hereby
acknowledged, hereby conveys and grants to the Grantee, its successors and
assigns, the right, privilege and authority to inetall, construct, erect,
alter, improve, repair, energise, operate and maintain electric overhead
aud underground distribution facilities at depths not exceeding 15 feet,
which consist of poles with braces, guys and anchors, crossarms, transfor-
mers, ducts, vaults, manholes, cabinets, containers, conduits, wire. and
other neeessary or convenient appurtenances to make said underground and
overhead installations an integrated electric system. All such electric
system is to be located across, ever, upon and•under the following
described lend• and premises situated in the County of Kies, State of
Washington, to wits
Together with the right at all times to the Grantee, its successors
and assigns, of ingress to and egress from said lends across adjacent laude
of the Grantor for the purpose of installing, constructing, reconstructing,
repairing, renewing, altering, changing, patrolling, energising and
operating said electric system, and the right at any time to remove all or
any part of said electric system from said lands.
Also the right to the Grantee, its successors end assigns, at ell
times to cut end trim brush, trees or other plants 'tending or growing upon
said lauds which, in the opinion of the Grantee, interfere with the main-
tenance Or operation of the system, or constitute a menace or danger to
said electric system.
The Grantor, its hairs, executors, administrators, successors and
assigns, hereby covenant and agree that no structure or fire hazards will
be erected or permitted within the above described easement area without
prior written approval from the Grantee, its successors and assigns; that
no digging will be done or permitted within the easement area which will in
any manner disturb the facilities or their solidity or unearth any portion
thereof; and that no blasting or discharge of any explosives will be per-
mitted within fifty (50) feet of said lines and appurtenances.
It is understood and agreed that the City of Seattle, City Light
Department, may grant other utilities the right and privilege to occupy and
use jointly said distribution system and /or easement.
The City of Seattle and other utilities are to be responsible, as pro-
vided by law, for any damage to the Grantor through. their negligence in the
conetruotion, maintenance and operation of said electric end /or other uti-
lity eysteas across, aver, upon and under the property of Said Grantor.
The rights, title, privileges and authority hereby granted shall con-
tinue and be in force until such time as the Grantee, its ■uccea'ors,
assigns and other utilities shall permanently remove said poles, wires and
appurtenances from 'aid lands or shall otherwise permanently abandon said
electric and other utility systems, at which time all such rights, title,
privileges and authority hereby granted shall terminate.
