Mayor VanDusen opened the hearing at 7:35 p.m. Rick Beeler explained that on May 21 1990,Council granted a waiver to proceed with the submittal of a SEPA checklist subject to the redesign of the project. The Public Works Department is now requesting to proceed with applying for and securing the necessary permits for the improvements to the Interurban Avenue from 42nd Avenue to 52nd Avenue and South 133rd from Interurban to South 134th. The project needs to proceed in a timely manner in order not to jeopardize the TIB funding grant. Ross Earnst, Public Works Director, noted that the sensitive area to be modified by construction is the area to the west of Interurban flowing into the Green River. Design criteria for minimizing the impact in this area includes an arched pipe culvert, rather than a pipe with weirs in it, which will allow fish passage back through the 66 mch pipe that exists there. Public Works also proposes putting a retaining wall along the embankment rather than a side slope which would require going further into the stream. Councilmember Lawrence questioned the damage done by flooding in the area. Mr. Earnst responded that flooding has not caused damage to buildings or structures in the area as they are all built above the 100 year flood plain; however, flooding does require the roadway to be closed. Councilmember Lawrence asked if there would be a cost to the City. Mr. Earnst responded that the drainage would be a total City project and costing $1.9 million. The road project will consist The TIB grant of $2.28 million plus the City's contribution. There is also a developer's contribution of approximately $250,000 for the 133rd Street project. Councilmember Lawrence noted that his biggest complain was the cost to the City of $3.2 million for the total project when the only real need appears to be that the City will receive some grant money. The flooding has never been demonstrated to be a serious problem other than the standing water on the roadway. Mr. Earnst responded that there are two projects: one to build the pipe, the other to build the stream. The reason to do them together is to not have to comeback after the street is built and then try to put a pipe in. STAFF REPORT TO THE CITY COUNCIL PETITIONER: City of Tukwila PROPERTY LOCATION: Generally the northeast edge of the existing Interurban Avenue S. roadway. Construct storm drain lines from 133rd Avenue S. in the Fostoria Park area out to Interurban and along the right -of -way to Southgate Creek and then widen and install curb, gutter, sidewalk and landscaping along the northeast side of Interurban Avenue S. IMPACT OF SENSITIVE. AREAS ORDINANCE : .• The proposal is to install a storm drain pipe and underground concrete vault on the northeast side of Interurban Avenue S. where storm drainage currently runs along a deep ditch on City Light right -of -way. The drainage then enters the terminus of the Southgate Creek system just prior to where it outfalls into the Duwamish River. Anew pipe will also be installed along 133rd Avenue S. to pick up storm water from the Fostoria Park section and tie into the new storm line. A second project will replace the wooden Interurban Avenue S. bridge over the.creek just southwest of the 42nd Avenue S. intersection with a pipe for the creek and then fill for an expanded road section and landscaping and sidewalk. Approximately $110,000 was spent on design in 1986 and 1987. Construction of the storm drainage improvements is scheduled for the summer of 1990 and the road project is scheduled for winter /spring 1991. Avenue. Approval of this waiver request would allow the City to proceed with submittal of a SEPA checklist and construction of drainage and street improvements in Interurban Avenue and S. 133rd Street which will alleviate severe flooding . problems and provide traffic and pedestrian safety improvements. VanIasen, Mayor November 16, 1990 City Of Tukwila Interurban Avenue from 42nd Avenue to 52nd Avenue and South 133rd from Interurban to South 134th PROPOSAL DESCRIPTION: The applicant proposes to proceed with submitting Shoreline Permit, Flood Zone Control Permit, and other permits required for approval to construct storm drain lines from South 133rd Street in the Fostoria Park area out to Interurban and along the right -of -way to Southgate Creek and then widen and install curb and gutter, sidewalk, and landscaping in Interurban Avenue. The applicant requested a waiver to proceed with submittal of a SEPA Checklist and construction of the street and drainage improvements in Interurban Avenue and South 133rd Street but received a waiver on May 21, 1990 to proceed with the SEPA process subject to a redesign of the project to minimize and /or eliminate the impact of the project to the streambed. Since that time, the moratorium was amended to allow environmental review on all projects and was extended until approximately February 1991. Additionally, a project redesign was developed which will create continuity of the stream from the SR -599 culvert crossing to the existing streambed. The redesign includes use of weirs in the streambed and an arch plate culvert under the roadway. The culvert will terminate at a retaining wall located at the northeasterly edge of the sidewalk. IMPACT OF THE SENSITIVE AREAS ORDINANCE: The Draft Sensitive Area Overlay District allows essential utilities and essential right -of -way improvements subject to conditions. Essential right - of -way or utility is defined as a system where no feasible alternative location exists based on an analysis of technology and system efficiency. The existing street alignment cannot be relocated to avoid the sensitive area due to proximity of SR -599 and the Green River. The street widening provides capacity, safety, and landscaping improvements. The alternatives would not provide one or more of the following: 1. Sidewalk for pedestrians 2. Landscaping 3. Additional travel lanes STAFF REPORT November 16, 1990 Page 2 Without these capacity improvements, traffic will seek alternative routes such as 42nd Avenue through residential area. The Fostoria area storm water currently drains through various pipes and ditches to the subject sensitive area and the Green River. The proposed drainage trunkline provides improved collection and conveyance of major storm water flows for the Fostoria basin and maintains quantity and improves the quality of the water discharged to the creek. The new project design meets the standards of the draft Sensitive Areas Ordinance by: 1. Converting the existing asphalt lined swale along the north side of SR -599 to a grass lined swale; 2. Directing surface drainage from Interurban and the northeasterly portion of SR -599 north of South 133rd to the grass lined swale; 3. Utilizing an arch plate culvert and weirs under the roadway to provide streambed continuity from the Green River through the existing culvert under SR -599. 4. Utilizing construction specifications and requirements which will protect the watercourse from erosion or pollution. DECISION CRITERIA: 1. Intent of the moratorium 2. Best interests of the City weighed against the interests of the individual. a. The project will help reduce flooding in public right -of -way. b. The project will improve traffic safety for vehicles and pedestrians. 3. Circumstances and hardship caused by the moratorium. a. City Council authorized a waiver for the SEPA Checklist by motion and requested that creek alternatives be investigated. Several alternatives for the Southgate Creek have been investigated. The alternatives were developed from Council suggestions, Department of Fisheries meetings and work by our design engineers. The result is to proceed with the design and construction of the South 133rd Street and Interurban drain system, and continue with design and construction of Southgate Creek on the west (upstream) side of SR -599. Plan Ordinance No. 1572 - Vacating a Portion of Unopened 35th Ave. So. Instead, streams have been regarded as a problem. He feels it is time to take a closer look at this issue. Councilman Duffle left the meeting at 9:03 p.m. MOVED BY MORIWAKI, SECONDED BY ROBERTSON, TO EXCUSE COUNCILMAN DUFFLE FROM THE MEETING DUE TO A FAMILY EMERGENCY. MOTION CARRIED. Councilman Lawrence stated he feels the larger issue is the water quality entering the Green River. If we take a portion of this stream, a tributary to the Green River, and pipe it, we somewhat remove the possibility for a natural cleansing that a ditch or watercourse would provide. Councilman Ekberg stated the need to consider the flood control in that area. He is in favor of allowing the design review and the SEPA checklist and waiving the sensitive areas requirements for that portion of the project. He added that he has no major concern about the installation of the pipes because the stream that runs adjacent to 134th at this time will not run into it. Council will have an opportunity to ascertain the best way to handle the overflow from the stream at a later date. .
