The exhibits submitted are a Statutory Warranty Deed and vicinity map. The basis for your request is the presence of all utilities and a public street, that the property was once used for a residence and that the property is surrounded by single family development. My review of your request is constrained to only what discretion the City Council gave me in Ordinances Nos'. 1550 and 1566. These ordinances specifically require a specific development proposal included in to any waiver request. Also required is that any clearing be for avoiding hazards or threats to safety of people and property. Based upon the constraints of these ordinances, your stated basis of the request and your submitted exhibits, I can not approve your waiver request. A specific development proposal was not submitted. No hazard to public safety exists. Should you have a specific development proposal and any evidence of threat to public safety for the requested clearing, I'll be happy to review this information and reconsider my decision.
