Thank o u, Ma h 15, 1990 STAFF REPORT To The City Council PETIONER: Joanne Poirier PROPERTY LOCATION: 13413 -43rd Avenue South, .Tukwila PROPOSAL DESCRIPTION: To undertake required actions to bring property into compliance with . zoning and building codes according to ongoing enforcement action. EFFECT OF MORATORIUM: APPENDIX 2 While the property was in King county, MB. Poirier moved two or three buildings onto the lots in question, undertook considerable improvements and rented out units without permits and in violation of King County code. Once the property was annexed to Tukwila, Tukwila Staff took over the enforcement action. Tukwila staff has been working for several months with the applicant to spell out the required compliance measures. The moratorium prevents corrective actions without a waiver, even those needed for code compliance, because the property exceeds 15% slope and has a wetland. If granted the waiver should expressly allow MB. Poirier to take only those actions needed to bring her buildings into conformance with existing codes per her ongoing discussions with DCD Staff. DCD Staff is requiring that Ms. Poirier undertake the following to meet code requirements: 1) Adjust the boundary line between lots One and Two; 2) Either remove Building Two entirely via a demolition permit or remove a portion of Building One or Building Two to meet setback requirements; 3) Either remove Building Three via a demolition permit or short plat Lot Two. If Lot Two is shortplatted, all code requirements (i.e.sidewalks, curbs and gutters) must be met. Staff Report Pg. 2 IMPACT OF SENSITIVE AREAS ORDINANCE: The draft Sensitive Areas Ordinance establishes performance standards for hillsides and wetlands. The standard are stricter as the slopes of the property increase and as proximity to wetlands increases. Ordinance 1550 requires the applicant to file an agreement to conform to the final version of the Sensitive Areas Ordinance and to accept and associated risk and expense. DECISION CRITERIA: Ordinance 1550 states the City Council must use the following criteria to review waiver request: 1. Intent of the moratorium. 2. Best interests of City weighed against the interests of the individual. 3. Circumstances and hardship caused by the moratorium. 4. Damage that could result from strict adherence to the moratorium.
