MOVED BY MORIWAKI, SECONDED BY EKBERG, THAT THE CONSENT AGENDA BE APPROVED AS SUBMITTED.* Councilman Robertson requested that Item fl be withdrawn from the Consent agenda and discussed under Old Business. *MOTION CARRIED The Public Hearing was opened at 8:48 p.m. Rick Beeler, DCD Director, reported that earlier this year a waiver had been granted to permit the applicant to proceed with the SEPA process for his project. At this time the applicant is requesting a waiver so, that4mmay. ,,.. lwith alltthelipp rabrpermits, etc., that are necessary for to begin the "actual construction of the improvements. The applicant has done some additional work identifying the wetland on the very south part of the property. There may also be a wetland on the northern portion of the property. The applicant is requesting a waiver to allow all of the permits and construction to proceed unhindered by the moratorium. If a wetland is identified on the northern portion of the property along I-405, the appropriate mitigation, per the finally adopted Critical Area Sensitive Area Overlay, would automatically occur. The applicant feels that delays in the processing of permits will cause a delay in the anticipated openino of the facility. The applicant has submitted an environmental checklist for the project. Minutes - Regular Meeting November 5, 1990 Page 3 Public Hearings (con't) Public Hearing Closed 9:26 p.m. If it is determined that there are significant adverse environmental impacts, either an EIS or a mitigated DNS would be done. It is possible that the SEPA process could be completed before the EIS is required. Councilmember Ekberg commented that if grading was allowed on the north portion of the property prior to identifying any wetlands, it might be hard to recapture it as a wetland. He added that he would not hesitate to allow any permit processing up to that grading of the land. Mr. Beeler responded that the grading permit would not be approved until the SEPA was completed. Don Miles, project engineer for McLeod Development, summarized the project status to the present time. They are_currently working on issues requested by the City. Those issues mclude: 1) Re- analysis of storm drainage (accomplished); 2) Traffic /transportation (currently developing scope of work for traffic engineer). Mr. Miles expressed his concern for being able to meet the projected timelines for opening the facility. Councilmember Rants clarified that this iece of property falls under the moratorium because it has a wetland(s) on it. Most of the proposed work is not affecting the wetland(s). Councilmember Moriwaki added that earlier this year Council had granted a waiver to allow the applicant to proceed with the SEPA review; however, the environmental impacts are still not known. There is now the possibility of a wetland on the northern portion of the property. He suggested denying the permits because the environmental information requested of the applicant two months ago has not been received. Councilmember Rants responded that a multitude of work could proceed as long as the wet were protected. MOVED BY MORIWAKI, SECONDED BY DUFFIE, TO DENY THE PERMITS AND CONTINUE WITH THE PROCESS UNTIL THE SEPA QUESTIONS ARE RESOLVED.* Councilmember Robertson commented that the purpose of the moratorium was not to allow Council to analyze people's _projects, but to stop things from occurring that would violate the final SAO. If the waiver is granted, the applicant would still have to sign the normal contract agreeing to conform to the finally adopted SAO. Councilmember Hernandez responded she would like to be able to allow the applicant to proceed with some of the permits he needs. Hernandez noted that if voting for the motion would mean denying the applicant the opportunity to proceed with the permits, up to actual construction, she would probably vote against it. Councilmember Lawrence agreed, adding he saw no problem as long as there was no construction until the SAO is adopted. Councilmember Duffle voiced his concern for the possible damage done to the applicant if he is allowed to proceed under the draft SAO standards and the finally adopted SAO standards come back different. REPORTS ADJOURNMENT 10:26 p.m. Rick Beeler responded that the applicant is providing information requested of him for the checklist. He does not expect the environmental review will produce anything unusual. *MOTION CARRIED WITH MORIWAKI AND DUFFLE VOTING NO. A resolution accepting the donation of a certain easement to the City by Helen Nelsen, releasing a previous easement, and authorizing the Mayor to accept the easement on behalf of the City. Councilmember Robertson asked if this item had been reviewed by the Utilities Committee. Councilmember Duffle responded that the issued had been discussed at tonight's committee meeting and approved unanimously. City Engineer Ron Cameron explained that the easement was approved in the last year. Mayor VanDusen reported he had attended the. joint meeting of the SeaTac, Federal Way, Normandy Park, and DesMoines Councils last Monday evening along with Councilmembers Lawrence and Rants. The King County's Jail Siting Committee held a public hearing at the Tukwila Community Center last week. Greg Nickels also hosted a meeting in council chambers. Councilmember Duffle commented he would be reporting for jury duty on November 23rd. Councilmember Hernandez reported she attended a meeting re ding the Puget Sound Council on Government (PSCO Councilmember Moriwaki attended meetings with the Southwest King County Chamber of Commerce, the South Central 2000 Advisory Task Force, and the Executive Committee of Human Services Roundtable. Councilmember Lawrence attended a meeting of local human services at which John McFarland was a speaker. Regarding the joint meeting reported by Mayor VanDusen, Councilmember Rants commented he felt there were many issues that could be addressed by meeting together as small cities. The project scope was presented to the City Council on Sept- ember 4, 1990 under a previous request. At that time McLeod was granted a waiver allowing the filing of the SEPA Checklist and supporting documents. McLeod was was further advised that the Sensitive Areas Moratorium would culminate on approx- imately the 1st. of October, . eliminating need for waivers of additional project actions. We have been informed that the moratorium has been extended for an in- definate period. This delay in proceeding with certain portions of the Exhibition Facility will place extreme hardship on the McLeod Development Company and will cause a delay in the anticipated opening of the facility. We are requesting that the filing of a rezone on the southerly 9.5 acres be allowed, that the submittal and approval of the Union Pacific Railroad Bridge; the South 158th Street improvements and the extension of Strander Blvd. be accepted for per- mitting; and that the proposed parking lot north of South 158th Street be allowed to be completed so that present parking might be relocated. We have identified those areas of designated Sensitive Area #12 which are determined to be wet lands by the methods and criteria setforth by the US Corp of Engineers. Any improvements requested in the above waiver are a minimum of 700 ft from the above wetland boundry. We have also prepared our project plans to exclude this wetland area including suggested buffers and setbacks for the class wetland det- ermined by the consultants retained by McLeod. A copy of the study previously sub- mitted is again attached for your review. A copy of reduced project plans pointing out the phases of work proposed under the waiver request is also attached. 66 • PROPERTY LOCATION: CITY HI: 717■117L.A. Ally o tqrtkijoA -,•/••• STAFF REPORT TO THE CITY COUNCIL ( E '214 4 ' PETITIONER: McLeod Development Company Four tax parcels bounded by Longacres Racetrack and Burlington Northern R.R. I-405, Union Pacific R.R. and .750 feet south of a Strander Boulevard extension to the east. PROPOSAL DESCRIPTION: , The applicant proposes to proceed with filing a Comprehensive Plan Map Amendment and Rezone application for the southern portion of his property and all required to allow improvements to the Union Pacific Railroad Bridge, to South 158th Street, for a private road extension from West Valley Hwy. at Strander Boulevard, and for a parking lot north of South 158th Street. EFFECT OF MORATORIUM: The applicant requested a waiver for all permits and approvals necessary to build the proposed exhibition facility but received a waiver on September 4, 1990 to proceed only with environmental review (SEPA). Since that time, the moratorium was amended to allow environmental review on all projects and was extended until approximately February, 1991. The applicant feels that the delays in the processing of permits . imposed by Ordinance No. 1544 and its subsequent amendments constitute extreme hardship and will, cause a delay in the anticipated opening of the facility. IMPACT OF THE SENSITIVE AREAS ORDINANCE: Background The applicant has submitted a environmental checklist for the full scope of the project. The information has been reviewed by City staff and additional information was requested of the applicant. The environmental decision has not been made pending submittal of all the requested information. • Sensitive Areas The wetland #12 boundary is delineated and shown on the site plan of the south parking lot. A buffer analysis has been requested. A soils report will be required at the time of building submittal. The policy issue of appropriate zoning for the wetland will be decided by the Planning Commission and City Council during review of the comprehensive plan amendment and rezone. DECISION CRITERIA: Ordinance No. 1550 states the City Council must use the following criteria to review waiver requests: 1. Intent of the moratorium, 2. Best interests of the city weighted against the interests of the individual, 3. Circumstances and hardship caused by the moratorium, 4. Elevations ,PROJECT STATEMENT: McLEOD EXHIBITION CENTER The McLeod Exhibition Center offers 210,000 square feet of flexible flat floor display space which can be utilized as one continuous show hall or may be divided into 2 separate halls on the groud floor and a series of convertable show and meeting rooms on the mezzanine level. The gross building area is 233,640 square feet with a an actual foot print of 173,520 square feet. "The Center" main hail with its 55 foot ceiling height is completely column free through its 120,000 square feet of display area. Power, telephone, water, and drainage are made available on booth configuation standard grid. "The Center" provides 2100 standard parking spaces contiguous to the trade and show space. Easy access is provided for shuttle bus and public transportation drop off. The trade and exhibition center is located in the center of the Puget Sound hub. Access to the surrounding facilities is easy via Interstae 405.and 5. The Seattle - Tacoma Airport is a quick 15 minute direct route to the facility. Located in the City of,Tukwila, one can find shopping at a major shopping center, a complete complete cross- section of services, dinning and entertainment. There are numerous hotel rooms both within walking distance of the site and. acces•sable from shuttle service to nearby residences.
