Upon City of Tukwila approval, your short must be recorded with the King
County Department of Records and Elections. The cost of recording is
$26.00 plus $5.00 for the first page and $1.00 for each subsequent page.
The applicant is required to submit to the City of Tukwila a check payable
to "King County Recorder" for the appropriate amount and the City, and
void after six months if it is not filed.

We understand that you would like to verify that the above - referenced project, consisting of
one (1) office building of approximately 66,270 square feet and three (3) office buildings
of approximately 52,003 square feet each, complies with the local zoning ordinance and
Comprehensive Plan.
Please be advised that the project is located in the Gateway Corporate Park within the City of
Tukwila, County of King, State of Washington.
The project is located in an M -1 "Light Industry" zoning district. The project has a Compre-
hensive Plan designation of Light Industrial. The zoning is therefore in conformance with the
Comprehensive Plan designation. Please see the attached Zoning Map.
The project is not situated within the boundaries of any existing redevelopment district.
There are no pending applications to rezone the parcel upon which the project is located.
Portions of the property, specifically Lot 4 of Tukwila Short Plat 85- 32 -SS, are located
within 200 feet of the Duwamish River and are therefore within the Shoreline Zone and
subject to development review by the Tukwila Board of Architectural Review.

Vice Chairman. Members present were Messrs. Cagle, Kirsop,
Verhalen, Haggerton, Knudson and Hamilton.
Mr. Coplen was absent.
Representing the staff were Jack Pace, Vernon Umetsu, and Joanne

MR. KNUDSON MOVED THAT THE JULY 28, 1988 AND AUGUST 2, 1988
MINUTES BE APPROVED AS WRITTEN. MR: HAMILTON SECONDED THE MOTION
WHICH PASSED UNANIMOUSLY.
Mr. Haggerton distributed a letter to each of the Commission from
Marilynn J. Van Hise which commented on the procedure followed at
the July 28, 1988 public hearing and offering suggestions for
improvement. She also commented on the Riverton annexation
proposal.
87 -1 -SUB GATEWAY CORPORATE CENTER Request for Final Plat
approval.
Mr. Jack Pace, Senior Planner reviewed the staff report recom-
mending approval of the Final Plat and that it be forwarded to
the City Council subject to conditions stated in the Staff
Report.
Mr. Paul Konrady represented the applicant and stated he concur-
red with the Staff's recommendations.
MR. KIRSOP MOVED THAT THE PLANNING COMMISSION ACCEPT THE KAISER
GATEWAY REQUEST AND FORWARD THE FINAL PLAT TO THE CITY COUNCIL
WITH THE RECOMMENDATION OF APPROVAL, SUBJECT TO THE CONDITIONS

necessary slopes for cuts and fills upon the lots and blocks

2. The lot line or fence in Lot 4 will need to be adjusted to
meet the setback requirements of the Tukwila Zoning Code
(TMC 18.50.020).
MR. KNUDSON SECONDED THE MOTION WHICH WAS UNANIMOUSLY. APPROVED.
88 -7 -DR EMBASSY SUITES HOTEL -- Request for design review
approval to construct an 8- story, 236 -room hotel and separate 3-
story parking structure on a 3.27 -acre site.
Vernon Umetsu, Associate Planner, reviewed the proposal using
slides of the site, as well as site plans depicting the design of
the proposal. He reviewed the Staff Report recommending denial
of the request and that guidance be provided to better satisfy
criteria as outlined in the recommendations on page 6 of the
staff report.
Mr. Dick Chapin, attorney representing the applicant did not
agree with the comments in the staff report.
Mr. Dean Powell, Mesa Az, also represented the applicant,
reviewed the proposal. He entered into the record the interior
design of the suites as Exhibit A. He commented on the outside
details of the proposal entering into the record the outside
elevations of the proposal as Exhibit B. Next,he reviewed the
site plan, entering it into the record as Exhibit C. He re-
quested that the Commission approve the proposal as presented.

BACKGROUND
Gateway Corporate Center received preliminary plat approval subject to condi-
tions from the City Council on March 21, 1988. The Planning Commission reviews
the Final Plat to insure conformance with the Preliminary Plat approval and any
conditions, and forwards the Final Plat with their recommendation to the City
Council.
The conditions of preliminary plat approval were as follows:
1. "56 -foot easement for future right -of -way" rather than 61 foot area building
setback.
2. Compliance with occupancy requirements of Chapter 5 of the Uniform Building
Code (Sections 5.505, 506 and Table 5C) per Attachment C.
3. The owner to show suitable access to Lot 8, subject to City of Tukwila's
approval prior to final plat approval.
4. Assignment of access to City of Tukwila of the City Light property to con-
nect the two public rights -of -way.
5. Revision of plat to show fence behind Lot 4.
DISCUSSION
FINDINGS
1. The applicant has complied with Condition Number 1 (see new wording on
Attachment C).
2. Condition Number 2 refers to the Uniform Building Code (UBC) and its re-
quirement of 60 foot yards adjacent to the types of buildings existing on
the lots. Interpretation of the UBC sections allows creating easements on
adjacent properties to meet the necessary yard requirements. The easements
and their descriptions are shown and described on Attachments B, C and D.
3. Condition Number 3 has been resolved by combining the proposed Lot 8 with
Lot 3 which has access to Gateway Drive (see Attachment B).
4. The property owners have assigned to the City their access easement with
City Light connecting Gateway Drive with Interurban Avenue South. The
assignment needs only to be executed by the City.
5. Attachment E shows that the fence existing behind the building on Lot 4
does not interfere with the proposed property line between Lots 4 and 5.
The required setback in the M -1 district is five feet. The fence is shown
at 2z feet, therefore the lot line or fence will need to be realigned to
meet the requirement.
6. The Department of Public Works reports that the applicant has completed the
required improvements in accordance with code specifications and standards
of the Department.

7. Water, sanitary sewer, storm sewer, and right -of -way will be turned over
to the City of Tukwila. The dedication section of the title page (Attach-
ment D) should reflect dedication of all public facilities to the City.
1. The applicant has consolidated Lot 8 with Lot 3 which satisfies the out-
standing access concern regarding Lot 8.
2. The final plat otherwise is consistent with the preliminary plat and condi-
tions of approval.
3. The Dedication Section of the Title Page (Attachment D) does not suffi-
ciently address all the facilities to be dedicated to the City.
4. Due to the location of the fence in Lot 4, approval as currently described
would be a violation of the City's Zoning Code setback requirements.
Based upon the above discussion, the Planning staff recommends that the Planning
Commission forward the Final Plat along with its recommendation of approval to
the City Council subject to the following conditions:

The meeting was called to order at 8:05 p.m. by Mr. Coplen,
Chairman. Members present were Messrs. Coplen, Larson, Kirsop,
Knudson, Hamilton and Haggerton.
Representing the staff were Moira Bradshaw, Rebecca Fox and
Joanne Johnson.
MR. HAMILTON MOVED TO ADOPT THE MINUTES OF THE JANUARY 28, 1988
MEETING AS CORRECTED. MR. LARSON SECONDED THE MOTION WHICH
PASSED UNANIMOUSLY.
Mr. Coplen directed the staff to write a letter expressing
appreciation for the years of service Mr. Sowinski put in with
the City.
88 -1 -DR: BUILDING 447 Request for design review to add 32
parking spaces to an existing parking lot located within the
shoreline zone.
Rebecca Fox, Planner, reviewed the staff report recommending
approval.
Dick Reeves, Wilsey and Ham, 1980 - 112th Avenue N.E., Bellevue,
WA., 98004, represented the property owners adjacent to the
subject property. He generally concurred with the staff report.
Discussion ensued on the proposal.
MR. LARSON MOVED AND MR. KNUDSON SECONDED A MOTION TO APPROVE THE
REQUEST INCLUDING RECOMMENDATIONS 1 AND 2, BASED ON THE STAFF'S
F:.NDINGS AND CONCLUSIONS. THE CONDITIONS READ AS FOLLOWS:
1. An additional landscape island.
2. Two additional trees be provided per Attachment B.

Moira Carr Bradshaw, Planner, reviewed the staff report, entering
it into the record as Exhibit 1. She pointed out the staff's
recommendation of approval with conditions and noted that
modifications to the conditions had been agreed upon by staff
with the applicant.
Randy Blair, Wilsey and Ham, 1980 - 112th Avenue N.E., Bellevue,
WA., 98004, represented the applicant and stated he concurred
with the staff report.
Discussion ensued on the proposal.
MR. LARSON MOVED AND MR. KNUDSON SECONDED A MOTION TO RECOMMEND
APPROVAL OF THE REQUEST AND ACCEPT THE STAFF'S RECOMMENDATIONS
WITH THE FOLLOWING CHANGES: CONDITION #1 CHANGED FROM 61 FOOT
EASEMENT TO 56 FEET; CONDITION #3 BE CHANGED FOR THE OWNER TO
SHOW ACCESS TO LOT 8 SUBJECT TO CITY OF TUKWILA'S APPROVAL PRIOR
TO FINAL PLAT APPROVAL; CONDITION #4 FROM "DEDICATION" TO "ASSI-
GNMENT" OF ACCESS; ELIMINATE CONDITION #5; AND ACCEPT THE STAFF'S
FINDINGS AND CONCLUSIONS. MOTION WAS UNANIMOUSLY APPROVED.
THE APPROVED CONDITIONS READ AS FOLLOWS:
1. "56 -foot easement for future right -of -way" rather than 61 foot
area building setback.
2. Compliance with UBC 5.505, 506 and Table 5C per Attachment C.
3. The owner to show suitable access to Lot 8, subject to City of
Tukwila's approval prior to final plat approval.
4. Assignment of access to City of Tukwila of the City. -Light
property to connect the two public rights -of -way.
5: Revision of plat to show fence behind Lot 4.
DIRECTOR'S REPORT
Moira Bradshaw reported on the Adult Business Ordinance and Sea -
Tac Incorporation proposal. She noted that a special Planning
Commission meeting on Fire District #1 Annexation DEIS needs to
be held on March 31, 1988. The APA Conference will be held in
April and any interested Commissioner should contact the Planning
Department.
