Ross Earnst, Public Works Director, explained why the bids on
the overlay project were so high. The report from the con-
sultant shows that the curb lane on Tukwila Parkway along
with others needs to be reconstructed. The original project
was to add an overlay of 2" of asphalt. As a result of the
study done by the consultant, they will be recommending that
the scope of work and cost be increased to• include
reconstruction and overlay. They will need between $500,000
and $750,000 per year to bring the streets back to their ori-
ginal condition using todays traffic as the design criteria.
The three streets on the 1989 overlay project are: (1)
Tukwila Parkway from the S -Line Bridge to Andover Park West;
(2) Andover Park East from 180th north 1,200 feet; (3) South
180th from Andover Park East going west.
The budget for this project is $300,000. Half of the work
will be done this year and half next, but the total contract
will be awarded this year.

Alan Doerschel explained that the overage for the project
will come from the funds budgeted for projects, but not
spent.

Tow truck operations are defined as an unclassified use in
all zones. Approval must be obtained from the Planning
Commission and the City Council. The Planning Commission
recommended approval of this request by a vote of three to
two subject to certain conditions.
Mayor Van Dusen declared the Public Hearing open on the
request by Dick's Towing for,permission to develop a site for
a towed vehicle storage f aci'lity and truck towing operation
at the S.E. corner of South 134th Street and vacated 44th
Place South.
Ken Chin, architect, representing Melvin Dickey, potential
owner of the subject property explained that this is a rela-
tively simple application. They are requesting an unclassi-
fied use permit to assist Mr. Dickey in obtaining this site
for a storage yard for his towing operation. They have been
working with civil engineers, landscape architects and staff
to make this project a high quality development. Mr. Dickey
needs more storage area because of Tukwila's annexations.
This yard will be used for impounds by the State Patrol and
the City of Tukwila Police Department. Towing operations are
only allowed in M -1 and M -2 zones. This is not a wrecking
yard; it is strictly for storage of vehicles only.

Melvin Dickey, president of a small corporation doing busi-
ness in Tukwila, explained that by State Law, they can only
charge storage on a car up to 15 days after they receive the
registered owner information from Olympia. The cars stored
there are impounds generated by the Police Department, aban-
doned cars and cars involved in an accident. Cars that move
out the fastest are those involved in accidents where an in-
surance company is involved. They have about a three day
holding period. The site plan shows trees every four feet
around the area. They are doing everything possible to make
this a good facility. Yards such as this are governed by
State Law. They will probably bring around three cars to the
site every day. Since the annexations, they have seen an
increase of one per day. The site will hold about 45 cars.
At an extremely busy time they might have two calls at night
and a maximum of five in the day time. Currently staff is
requiring evergreen trees eight feet high, four feet on
center.
Brad Collins, 365 Erickson Ave. N.E., Suite #326, Bainbridge
Island, Wa., said he is representing Normed which is the pro-
perty owner immediately to the northwest of the subject pro-
perty. He distributed Council a copy of a letter with
recommendations for this project. If you review the Planning
Commission's minutes on July 27,1989, the initial motion was
to deny the application and was defeated two to three. By no
means was the decision of the Planning Commission unanimous.
This operation is not large scale; it is an accessory use to
towing. In this case, the underlying zoning requirement is
for M -1 type uses. The nearest operation would be a wrecking
operation; under M -1 the wrecking yard is required to be
enclosed with a building. If it were a wrecking yard, cars
would be stored for an indefinite period of time. If you
have 20 to 28 vehicles stored there, part of them will be
wrecks. Their concern is that it would be difficult for City
staff to monitor and regulate this operation.
Other concerns connected with this type of operation are
noise, visual and crime impacts. This is a 24 hour per
day operation. If the traveled route to this site is through
a residential area, it will not be welcome. The proposed
screening will not protect the residential views; it is pro-
posed to protect the view from SR -599 and from the Normed
property. The screening will not be very effective because
of the topography of the site. It will take up to 10 years
before the trees will screen the site from 599. The primary
view at the entrance to Tukwila will be junk cars. The other
visual impact will be from the glare of the lights that will
be on this lot 24 hours per day. Essentially, a vehicle
storage yard is an attractive nuisance. The reason for the
eight foot fence topped by barbed wire is to keep the people
out that want to steal things. They are concerned that
someone that doesn't care to scale the fence will find the
local cars an easier target. For these reasons the City has
been wise in requiring this kind of use to have an unclassi-
fied use permit. There is no recommendation for something
that is related to the unclassified use itself. In closing,
Mr. Collins reviewed the criteria via his findings. This is
a highly visible site to the residential neighborhood. The
proposed use will be a detriment to the public welfare. At
the Planning Commission the property owners in the vicinity -
testified that the project is injurious to their property and
does not serve other developments in the area. The only way
to satisfactorily screen this lot from view and to eliminate

the need for lights and to prevent people from breakino in is
to enclose this operation in a building. The surrounding
property owners do not feel this is a compatible use. The
staff report identifies three policies that speak to t e fact
the proposal does not comply with the Comprehensiv- Plan
Goals and Policies. There are other policies that re not
mentioned in the staff report. They contend that th re are
only two mitigating measures: (1) Enclose it in a bu lding;
(2) Find a better site in Tukwila.
Larry Shaw, President of Normed, explained that they .re the
property owners that are northwest of the proposed p oject.
They have been here since the late seventies. Whe they
built their building, they went through Board of Archi-
tectural Review hearings and were encouraged to develop a
very high quality building.
They were required to do many additional things to their
building such as enclosing trash bins, increasing the amount
of landscaping, and requiring that the building be of ighest
quality. This proposed project is not consistent w th the
quality of the warehouse they were requested to put in They
want to see the neighborhood improve. Compatibility is a
crucial issue. Is this proposed project compatible w th the
neighborhood. Any way you attempt to screen this dhvelop-
ment, it is going to be difficult. The freeway is s'gnifi-
cantly higher than their building and the proposed .torage
yard. You are under no obligation to allow this busi ess at
this location; there are better locations. The whol° point
in the Unclassified Use Permit is so the project can be
reviewed. If this. project is allowed, it is going o stay
for a very long time. Let's find somebody that will mprove
the area.
Kathy Stetson, 13258 40th Ave. So., is a resident why lives
within 3 or 4 blocks of the site. A vehicle storage and is
not compatible with surrounding uses. This area is one of
the only M -1 uses adjacent to residential. We nee to be
careful about the impact on this area. She is co cerned
about the noise and the fact that it is a 24 hour operation.
Traffic on the streets is a concern. The view from the
freeway is extensive and this is a gateway from the north to
our City. She is concerned about, the light glare nd the
crime issue. She encouraged Council to deny the use or
require the construction of a building for this use.
Council Member Moriwaki read a memo from Elizabeth S ringer.
She is concerned about traffic, noise pollution nd the
adverse impact on the neighborhood.

Ken Chin noted that you look down on this property when
entering the City from the north and are going 55 miles per
hour. Mr. Dickey has never had any problem with vandalism on
his property and they don't anticipate any. This will be a
quality project with landscaping, fencing, and lighting. The
better the project, the less attraction for vandals. The
question of enclosing the storage yard in a building was
never brought up in any meeting with the Planning Department.
The small office building proposed for the site will have to
go to the Board of Architectural Review. They will do what
ever is required to make it acceptable.
Melvin Dickey made the point that a junk yard is not a tow
outfit. In the State of Washington, a junk yard requires a
separate license.
Brad Collins commented that there are properties in the north
part of Tukwila that may be suitable for storage yard without
enclosing them in a building. He asked Council to please not
put their worst foot forward and put this business at the
door step of Tukwila. They are not suggesting that Mr.
Dickey is not a good business man or a desirable member of
the community. Mr. Collins urged Council to take a look at
the site and see how visible this property is. He urged
Council to follow the direction of Mr. Kirsop and Mr.
Hamilton on the Planning Commission and deny this permit of
make it meet the M -1 development standard of enclosing it
within a building.
There being no further comments, Mayor Van Dusen closed the
Public Hearing.
It was stated that Council Members Harris, Hernandez, and
Stoknes all attended the Planning Commission meeting where
this was discussed. There were no further comments on this
matter.
MOVED BY ROBERTSON, SECONDED DUFFIE, THAT COUNCIL DENY THE
REQUEST OF DICK'S TOWING FOR AN UNCLASSIFIED USE PERMIT. *
Councilmember Robertson said he does not challenge Mr.
Dickey's intentions, this is an attractive proposal. There
are several things to discuss -- the location is not well
suited for this, it is visible from the freeway and the
surrounding area. Eight -foot trees are not going to provide
a barrier. Lighting the area at night is really going to
make it show up. He said there are probably other areas,
outside of the City if not inside where the property is less
visible. He made the motion because of the visible location
and the lights at night will make it stand out.
Councilmember Harris spoke against the motion because she has
driven around it several times since this has come up. What
is there now is an eye -sore. An acre of parked cars is not
bad; we have acres and acres of parking lots in the City and
they are not eye- sores. They serve a purpose and this would
serve a purpose. An acre of parked cars is so normal in this
area that, if it is taken care of, it would not be an
eye -sore.
Councilmember Moriwaki said Councilmember Harris' comments
are well taken. The single family dwellings are just a short
distance away.

The service is very necessary service and has was impressed
with Mr. Dickey's plan. It doesn't sound like they
researched other available sites very thoroughly.
Councilmember Hernandez said she understands there is a need
for this type of service but this plan is not compatible with
either the neighborhood or the adjoining business. The
information furnished by Mr. Shaw was persuasive. The single
family residential area would look down on this site. If
this business operates 24 hours a day the noise could bother
the residents.

John Hunt, Planning Consultant for the Sunwood Homeowners Assoc.
stressed that the effectiveness of the landscaping should be an
important consideration of approval, as well as the type of
landscaping itself. He was also concerned with the surface and
subsurface drainage which runs off into Sunwood; that the land-
scaping on the narrow rocky ridge may not survive; and adequate
screening from the Heatherwood Parking lot be provided. He
distributed photos of the areas of concern which were entered
into the record as Exhibit B - E.
Discussion ensued on the proposal.
MR. CAGLE MOVED AND RIRSOP SECONDED A MOTION TO APPROVE 86- 52 -DR,
HEATHERWOOD APARTMENTS AND THE CONSTRUCTION OF THE GARAGES AND
CARPORTS, PROVIDED THEY MEET CONDITIONS 1, 2a and 2b AND THAT THE
BUILDING AND PLANNING STAFF BE INSTRUCTED THAT ALL THESE STIPULA-
TIONS BE MET BEFORE A CERTIFICATION OF OCCUPANCY IS ISSUED.
THE CONDITIONS READ AS FOLLOWS:
1. Project drawings shall be modified to show pitched carport
roofs.
2. The current landscape plan shall be modified to reflect:
a. Increased shrub density along the Sunwood /Heatherwood
boundary from 60 plants at 6 ft. spacing, to 90 plants
at 4 ft spacing, as agreed to by the applicant.
b. Maximize natural ground cover and minimize barking to

result in 90 percent ground coverage in three years.

89 -1 -UCU - DICK'S TOUTING - Request for approval to develop a
site for a towed vehicle storage facility and truck towing
operation.
Molly Headley, Assistant Planner, reviewed the staff report
recommending approval with conditions as stated in the staff
report.
A letter was received by the Planning Department from John
Hamilton expressing his opposition to the development. This
letter was entered into the record as Exhibit "A ".

Lawrence Shaw, President of Normed, owns property to the north of
the site under consideration and expressed his concern with the
potential impacts a towing and storage yard will have on his
operation. He felt it would deter from the niceness of his
operation and feels this site is not appropriate for this type of
business. Another type of business might be a better blend with
existing development. He submitted photos into the record as
Exhibit "B" and "C" depicting other uses in the area.
Mr. Becker, owner of adjoining property to the south expressed
his concern regarding the impacts of this use to the values of
surrounding property, lack of quality landscaping, and traffic
impacts from ingress and egress from this operation.
Ken Chin, architect for the potential owner, assured the Commis-
sion that the owner intends to maintain it in a aesthetically
pleasing manner, and appropriate screening will be added. He
pointed out that 2.5 days is the average storage time for im-
pounded vehicles, and traffic flow will be an average of four
trips a day by the tow trucks.
Melvin Dickey, potential owner of the property, stated that he
intends to make it a first class operation, and at his present
location, there have been no complaints. He assured the
Commission that this is a towing company, not a parts exchange
nor a wrecking yard. He suggested that the Commission put a
"watch dog" type of control to ensure their intent is carried
out.
Matt Little, Western Pacific Properties, pointed out that illegal
outside storage of 14 - 15 vehicles, which are not screened nor
fenced, are currently allowed to go on at a location to the south
of this site. He was in favor of the request.
Discussion ensued on the proposal.
MR. HAMILTON MOVED AND MR KIRSOP SECONDED A MOTION TO DENY 89-1 -
UCU. MOTION WAS DEFEATED WITH KIRSOP AND HAMILTON VOTING YES AND
CAGLE, KNUDSON AND HAMILTON VOTING NO.
MR. CAGLE MOVED AND MR. KNUDSON SECONDED A MOTION TO APPROVE 89-
1-UCU, DICK'S TOWING, SUBJECT TO ALL CONDITIONS AS SET FORTH BY

Mr. Hamilton asked that staff follow up on all areas where
regulations have not been followed, (i.e., black plastic used as
screening, illegal vehicle storage, etc.).
89 -6 -DR - BURGER RING - Request for approval of design review for
3,600 sq. ft. Burger King one -story building with drive -thru.
Molly Headley, Assistant Planner, reviewed the staff report,
pointing out the location on a site plan. She stated that
approval is recommended subject to conditions as stated in the
staff report.
Mr. Hamilton felt that in order to adequately review a site
design, staff should also include the sign design in the mater-
ials supplied to the Planning Commission for their review.
Mr. Cagle felt that SEPA conditions also be incorporated in the
staff report for consideration by the Planning Commission.
Mr. Vincent Verrese, 2000 - 112th Avenue, Bellevue, the architect
for the project described the sign design, landscaping, ingress
and egress features, as well as design of the wall separating the
proposal from Tukwila Pond.
Joe Miles, Seattle Audubon Society, addressed a number of issues
of concern which included adequate screening of Tukwila Pond from
the glare, sound and movement created by the business activity.
He felt the first choice should be windows looking out at the
pond from Burger King and the second choice being a masonry wall.
Because of the many questions posed and concerns expressed, Mr.
Hamilton felt that a decision on this project should be delayed.

FINDINGS
1
1. Project Description: Develop site for truck and automobile tow and storage
operation.
2. Existing Development: The site is being used as a storage yard for contractors'
materials and vehicles.
3. Surrounding Land Use: Office /Warehouse development to the north; vacant
land to the west; SR-599 to the east; and construction contractor to the south.
4. Terrain: Generally, the slope does not exceed 1.7% with the exception of the
drainage swale bank.
BACKGROUND
An unclassified use is defined in the Tukwila Municipal Code as a use that possesses
"characteristics of such unusual, large- scale, unique or special form as to make
impractical their being included automatically in any class of use as set forth in the
various use districts previously defined ".
The site that is proposed for development is currently being used as a contractors'
storage yard for materials and equipment. The location is highly visible from the
adjacent freeway and to single family homes to the northwest which overlook the
site. As a result, the aesthetic quality of the proposed development should be a
prime consideration.
The proposal is for storage lot only at this time. The applicant has stated future
intentions of constructing an office structure similar to the type pictured in
Attachment C.
DECISION CRITERIA
In evaluating the appropriate placement of an unclassified use the Planning
Commission and City Council will use the following criteria typed in bold in
granting an unclassified use permit:
1. The proposed use will not be materially detrimental to the public welfare or
injurious to property or improvements in the vicinity.
The proposal as presented consists of a gravel storage area surrounded by an 8'
high cyclone fence of which 2' will be a barbed -wire extension. Thirty foot high

light poles will illuminate the lot at night for yard security reasons. As
presented, the proposal could negatively impact adjacent development. The
current office /warehouse development to the north is attractive and well -
maintained.
2. The proposed use shall meet or exceed the same standards for parking,
landscaping, yards and other development regulations that are required in the
district it will occupy.
The proposal is located on a "through lot" which is defined in the Tukwila
Municipal code as "a lot fronting on two streets that do not intersect on the
parcel's lot lines ". Under the Zoning Code, the applicant has two front yards
and is required to provide 15 feet of landscaping. The applicant has provided 15
feet along South 134th Street and none along Highway 599. The street frontage
along South 134th Street is shown planted with'fu red maples with an
underlying groundcover. Both sides of the lot, to the fence, will be planted
with low shrubs. The remainder of the side yards do not show landscaping.
The proposed 8' high fence will enhance the security of the lot for the owner.
No design detail of the fence has been submitted by the applicant.
3. The proposed development shall be compatible generally with the surrounding
land uses.
The proposal is a passive use of the lot as presented and is similar in type of
use to the existing adjacent contractors' office. It is, however, dissimilar to all
other adjacent uses including residential and office /warehouse development.
4. The proposed use shall be in keeping with the goals, objectives, and policies of
the Comprehensive Land Use Policy Plan.
APPLICABLE POLICIES — COMMERCE /INDUSTRY
Policy 1. Encourage the grouping of uses which will mutually and
economically benefit each other or provide necessary services.
Most business land uses, when grouped, complement one another since the
clientele drawn to one will generally frequent others. Advantages are also
present for the grouping of warehouse or industrial areas. This policy is
intended to encourage this planned grouping of complementary uses and
thereby maximize the drawing power or reputation or each grouping. This
concept could minimize business failures and promote prosperity in the
business community.
Policy 3. Encourage aesthetic building and site design in working and trading
areas.

How an individual property is developed has some influence on how other
properties develop and the quality of development in the City as well. In
essence, the cumulative development of all lands in the City is how the City's
image is created. The encouragement and attainment of this policy has a
significant value to private land owners in terms of protecting their
investment over the long -term and for the local citizenry in feeling they live in
a City they can be proud of. The use of setbacks, height and landscaping
requirements can encourage this policy.
Policy 5. Promote renovation of areas which are not aesthetically pleasing.
Although the City has large, well - developed business areas, there also exist
other business areas that need face - lifting. Although it is difficult to legislate
improvements to structurall}'adequate buildings, other economically
reasonable tools can be used to minimize the visual impact by sign code
enforcement, screening of outdoor storage and encouraging landscaping and
other exterior improvements such as painting.
5. All measures shall be taken to minimize the potential adverse impacts which
the proposed use may have on the area in which it is located.
As part of the environmental review process, the SEPA official has approved
the proposal with conditions. The conditions of approval are:
a. Storage vehicle lot will be coated with an impermeable sealed surface to be
approved by the City Engineer.
b. All additional requirements that are deemed necessary by the Department
of Ecology concerning sewer and water elements will be fulfilled.
Applicant may be required to obtain additional permits from the D.O.E.
c. Applicant agreed to a No Protest Agreement to the formation of an L.I.D.
for widening and improving South 134th Street to accommodate a 60 -foot
road width and construction of sidewalk and street lighting.
CONCLUSIONS
1. The adverse impacts on abutting property can be diminished by improving the
aesthetic quality of the development.
2. The landscaping plan should be revised to provide a dense evergreen screen
around the perimeter of the lot. The type of fence could be redesigned to
provide a more attractive presentation to adjacent property owners.

3. The location is highly visible to users of the freeway ramp on Highway 599,
which is one of the main entry points into the City, as well as surrounding
residential development. Based on the preceding points, it is important that the
aesthetic quality of this development be as high as possible.
4. As shown in Attachment B, the applicant has offered inadequate compliance
with code requirements in regard to landscape areas. The quality of this
development could be improved by appropriate landscaping.
RECOMMENDATIONS
The Planning Staff recommends approval of the Unclassified Use Permit with the
following conditions:
1. Landscape . Plan revised to include the following:
a. Provide 15 feet of landscaping along SR-599 consisting of trees and /or tall
shrubs.
b. Move the fence along the existing private road back five feet and provide
landscaping.
c. Irrigation plan for all landscaped areas.
d. Applicant will provide specifics on type, height and design of fence to
Planning Director for approval.
Applicant will be required to submit plans for future buildings /structures on
this site through the design review process.

Describe the manner in which you believe that your request for an unclassified
use permit will satisfy each of the following criteria as specified in Tukwila
Municipal Code 18.66.060 (attach additional sheets, if necessary).
8. The proposed use will not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity.
RESPONSE: The proposed improvements and development of the site for the proposed
use shall conform to zoning, land use, and construction codes. Operations
shall conform with the City of Tukwila Ordinance No. 1482, Chapter 5.44
of the Tukwila Municipal Code, titled Tow Truck Business, as well as
other state regulations.
9. The proposed use shall meet or exceed the same standards for parking,
landscaping, yards and other development regulations that are required in
the district it will occupy.
RESPONSE: Please refer to drawings and plans submitted for approval.
10. The proposed development shall be compatible generally
