On behalf of the Petrolane Company, we are submitting this letter and
related information to obtain an exemption from a Shoreline
Substantial Development Permit. The basis for seeking the exemption
is discussed in WAC 173 -14 -055 "Nonconforming Development Standards"
and WAC 173 -14 -040 "Developments Exempt from Substantial Development
Permit Requirement ".
The subject building is a nonconforming structure relative to the 50'
setback requirement in Urban Shoreline zones. Under the provision of
WAC 173 -14 -055, a nonconforming development may be "continued,
provided that it is not enlarged, intensified, increased or altered
in any way which increases its nonconformity ". The work that is to
be done to the structure falls within these guidelines and does not
violate the intent of nonconforming development standards.
The scope of the project consists of three main elements; 1) New
metal roofing, siding and roll -up doors on existing steel frames and
columns; 2) New interior partitions; 3) Sewer and water service. The
subject building is approximately 27 years old. As a result of the '1
structure's age, the metal roofing and siding has deteriorated and is 11
in need of replacing. The Petrolane Company, which has occupied the/
site next to the building for 31 years, wants to provide these f-
repairs and occupy the building. /

The proposed project is located at 10655 Pacific Highway South near
the intersection of Highway 99, West Marginal Way and the South
Boeing Access Road. The site is bounded on the west by the Duwamish
River and on the east by Pacific Highway South and is located in a
heavy manufacturing Urban Shoreline zone.
Topography at the site is relatively flat, except where the grade
slopes down in a 15' strip at the river bank. Approximately 95% of
the site is covered by asphalt paving or buildings. The remaining
area, which is primarily the river bank, is comprised of rip rap,
native grasses, and weeds. The area between the subject building and

the river is currently piled high with old pallets, trash and debris.
This will be removed as part of the project.
As mentioned before, the age of the building has caused the roofing
and siding to deteriorate. As stated in WAC 173 -14 -040, normal
repair can be undertaken on structures without triggering the need
for a substantial development permit. The work that is to be done,
although it is substantial, does not involve total building
replacement. The entire structural frame and foundations are to be
reused. It is only the roofing and siding that are to be replaced.
As further discussed in Section 25.32.060 of Title Twenty -five,
Shoreline Management, Paragraph A provides the avenue to modify
nonconforming structures or uses if "The modifications will not make
the use or the development more nonconforming ". In addition,
Paragraph B states that if the use or development is destroyed or
deteriorated more than 50% of its value, it must be reconstructed
within existing standards. The scope of repair work that is to be
accomplished on this structure will constitute less- than 50% of its
fair:: market value, and the improvements ; will not make the structure
"more" nonconforming:
It is acknowledged that the project includes the construction of a
few partitions and lighting fixtures, as well as the addition of a
new water and sewer connection. These additions, however, do not
contribute to, or place the structure in a greater nonconforming
condition.
Please find the accompanying site plan, vicinity map, floor plans,
photographs, and cost estimates that further describe the project
scope.
