nothing in this permit shall excuse the applicant from compliance with any other
federal, state or local statutes, ordinances or regulations applicable to this
project, but not inconsistent with the Shoreline Management Act (Chapter 90.58
RCW).
This permit may be rescinded pursuant to RCW 90.58.140(8) in the event the per -
mittee fails to comply with the terms or conditions hereof.
CONSTUCTION PURSUANT TO THIS PERMIT WILL NOT BEGIN OR IS NOT AUTHORIZED
UNTIL THIRTY (30) DAYS FROM THE DATE OF FILING WITH THE DEPARTMENT OF

Re: Homewood Suites / Shoreline Permit
This letter will confirm our telephone conversation of
July 30, 1990 in which we discussed the status of the above -
referenced matter. I advised you that our client, together
with State Farm Insurance, has reached an agreement with the
Dunne ownership ("Dunne") regarding the acquisition of its
property and /or the use of it for storm drainage purposes by
our client, Horizon Hotel Partnership, dba Homewood Suites.
As a result, no change to the storm drainage portion of the
plans pending before the City will be necessitated.
In order to finalize the agreement and close the
transaction with Dunne, it will be necessary to complete a
certain amount of paperwork. Due to the number of parties
and legal counsel involved, it may take as long as thirty
days to bring this matter fully to a close. In order to
prevent any undue delay in the processing of our client's
Shoreline permit, it is our request that the permit be
issued by the City and forwarded to the Department of
Ecology ("DOE") at this time in order to commence the DOE
thirty -day review. By making this request, we understand
that the permit would be proceeding fully at the risk of the
applicant and that in the event the Dunne transaction is not
completed within a prescribed period of time, the City would
have the option of withdrawing or terminating the Shoreline
permit. This is agreeable to Homewood Suites.
In summary, it is our understanding that the City will
proceed to forward the Shoreline permit to DOE provided that
the finalization of the Dunne transaction closes no later
than September 4, 1990. In the event that it does not close
by that date, the City of Tukwila will have the option of
terminating or withdrawing the Shoreline permit with the
full understanding and agreement of Homewood Suites.

I received your letter dated April 24, 1990 regarding your
decision to withdraw the revised lodge plan and maintain the
previous design and notified the plans reviewer.
I spoke with Ed McHugh today regarding the specific requirements
still outstanding regarding the Shoreline submittal. Mr. McHugh
indicated the engineering drawings had been completed. I
referred him to Phil Fraser in the Public Works department for
review of the engineering plans before submitting them to me.
We also discussed the cross - sections required by the Shoreline
Department. They will show a typical section along the shoreline
and will indicate the relationships between the various elements
as well as the plant materials and their typical placement which
will be used to revegetate the bench and shoreline area on the
river side of the trail. He indicated I can expect them next
week.
A lighting (luminaire) plan will be submitted in approximately
two weeks since it is not required by the Shoreline.
As soon as the above items are received I will submit the
Shoreline application and will notify you of that action.

be utilizing the alternate lodge building plan and will revert to
building the original lodge building plan as previously approved by
the City of Tukwila Planning Department
I have asked the members of our design team, specifically Messrs.
McHugh, Touma and Roper to finalize any remaining issues related to
the Shoreline Permit as soon as possible. Please advise me when
this is accomplished.

SUBJECT: Homewood Suites - Response to DOE Letter of
January 31, 1990 Per Our Discussions Today
In review of the January 31, 1990 letter of Bruce T. Smith of
Shorelands and Coastal Zone Management Program, DOE's review of
the shoreline permit indicates there is a significance to the
location to the designated shoreline area and buffer zone by
placement of the bench at exactly the 9000 CFS mark (recognized
as the high water mark) for the Homewood Suites Development.
Therefore, I would recommend that the bench be placed at a
slightly higher elevation (no greater that 1 ft. and preferably
at 1/2 ft.) to avoid this legal requirement through the
Shoreline Act. By raising the bench slightly higher than the
9000 CFS mark there will be no significant impact to the
storage capacity requirement for the river adjacent to this
Development.

Thank you for your comments regarding the Shoreline Substantial
Development Permit application for Homewood suites Hotel project
in Tukwila, WA. I am responding for Rick Beeler.
In your letter you stated that the project may require a
shoreline variance permit based on your concern that it may be
exceeding the height limit in the low impact zone. The applicant
has revised the buildings to meet the shoreline regulation using
the state's definition of height.
Your comment regarding parking located in the 40' zone is being
researched with the City and Project engineer. If it is
determined that the situation does exist we will inform applicant
of the requirement for a variance or revise the site plan to
eliminate the situation. The public access trail will be built as
a part of the project.
The City has similar concerns in regard to the potential impact
of this project on the shoreline environment and will be
addressing them in the staff report and presentation to the Board
of Architectural review. This project'is scheduled for February
22, 1990. Please be aware that this project has not been approved
yet and that we will notify you of the terms of approval, if any,
in addition to a revised set of plans.
