Pursuant to our telephone conversation on Tuesday afternoon, October 10, 1989, I would like to
respond to each of the comments which you verbally dictated to me over the telephone regarding the
concerns of the Tukwila Engineering Department on the proposed Gateway North short plats. The
following discussion addresses each of your items in the same numbered sequenced.
1. You stated that the dike /trail casement for in`.tintcnance and construction of the trail,
dike, and riverbank stabilization needs to be identified on a plan for your review. In
response to this comment, I have highlighted a copy of the Horizontal Control Plan
indicating the location of the dike /trail casement which was required by King County as
a condition of the development. I am also forwarding one copy of the legal description
prepared by our office for this casement and one copy of the King County Hearing
Examiner's Report which outlines the requirements and provisions for the improvements
and casement. The enclosed plan and casement document, together with the King
County Hearing Examiner's Report should provide the necessary information to satii;fy
your concerns on this issue. Please note that the easement has.not yet been recorded,
however, once you have had a chance to review' and provide your comments, we will
proceed to record the maintenance easement. The casement has also been shown on
the Boundary Line Adjustment Map and Short Plat Maps as a proposed river
protection, access, and maintenance road casement.
2. In response to your comment no. 2, 1 would like to briefly discuss the requirements
which were set forth at the beginning of this project by the King County Water
Resources Department, the King County Drainage Review Department, and the
Washington State Department of Fisheries. The King County Water Resources
Department became involved in.,the project's requirements, ,because of the proximity of
the site with relationship to the Duwamish River.• King County requires that all
projects abutting major water bodies provide hank stabilization programs to help
improve the stability of the riverbanks and provide shade trees which will help reduce
the water temperature to Netter accommodate fish habitat. This program consists of
cutting back the existing riverbank to a minimum slope of 2:1 and stabilizing the bank
with vegetation conducive to this type of environment. Fish habitat logs bpd large rocks
are also placed along the riverbank and a 16- foot -wide path is constructed for access of
maintenance vehicles. Although King County normally requires stormwater detention
for projects- of this type, they will waive the requirement if the developer agrees to

remove enough bank material to increase the riverbank storage adjacent to the property.
King County waived stormwater detention requirements for this project because of the
bank stabilization program and additional storage volume which was proposed as part of
the excavation work for this project.
The King County Surface Water Management Department currently requires a minimum
of 200 lineal feet of grass -lined swales or equivalent to provide biofiltration of
stormwater prior to discharging into any sensitive arca, such as a stream, river, lake or
wetland. This requirement has easily been satisfied with the design of the on -site
stormwater conveyance system, which was approved by King County and has already
been constructed for Phase I of the project.
The Washington State Department of Fisheries has jurisdiction of this project for both
the bank stabilization program and the stormwater outfalls to the Duwamish River. A
hydraulics project approval (F-IPA) was required prior to construction of the stormwater
discharge system and the hank stabilization program. One of the requirements of
Fisheries Department was to provide as many lint:al "fect of grass -Ifned swales as possible
for stormwater flows prior to discharging into the Duwamish River. Throughout the
design of the master storm drainage system for this project, several meetings were held
with Mr. Andy Levesque of the King County \Vatcr Resources Department and Mr. Joe
Robcl of the Washington State Department of Fisheries to review preliminary
stormwater designs and obtain their comments. The final Storm Drainage Plans, which
were approved by King County under Phase 1 has incorporated comments provided by
Mr. Levesque and Mr. Rohcl, An FHA was issued for the project, based on the ,final
approved Master Storm Drainage Plan design. Approximately 3,000 lineal feet of grass -
lined swales were provided within the project boundaries for biofiltration of stormwatcr
flows prior to entering the Duwamish River.
The open channel drainage ditch designed along the.east. property line of the project,
adjacent to East Marginal Way, was also a requirement of the Washington State
Fisheries Department. Whenever stormwatcr flows can be conveyed via open channel
ditches in lieu of a tightlincd pipe system, they are better filtered by the vegetation and.
gravels within the ditch. During the design phase of this project, the King•County
Public Works Department was completing the Interurban hridie replacement project.
The project included full - street improvements from the south end of the new bridge to
the intersection of South 116th Street. A requirement of the King County Project from
the Fisheries Department was to provide biofiltration of stormwater flows from East
Marginal Way prior to discharging into the Duwamish River. To satisfy this require-
ment, King County designed an open channel ditch within the King County right -of -way
from the intersection of East Marginal Way and South 116th Street to the discharge
point of the Duwamish River. Enclosed is a reduced copy of the design plans for the
Interurban bridge replacement project showing the open channel ditches which were
provided by King County.

As part of the development of the Gateway North project, we have extended the open
channel ditch, originally designed by King County from the South 116th Street • '
intersection to the south side of the project. As can be seen by the original
topographic survey for the project, an open channel ditch had already existed prior to
the development of the project. This ditch has been slightly relocated to the cast and
regraded to provide additional biofiltration of stormwater flows from the project.
Once the vegetation has been planted along the bottom and side slopes of the roadside
ditches, maintenance should be very minimal, if any. The Washington State Fisheries,
Department recommends that the vegetation be allowed to grow to lengths of between 6
to 12 inches minimum, in order to provide maximum biofiltration of .stormwater flows.
The designed maximum water depth within the ditches along East Marginal Way will be
approximately 8 to 10 inches. There should be no maintenance required within this
arca. The tops and side slopes of the ditches, do not affect the ,function of biofiltration
and will be maintained the same as any other open channel drainage ditch within the
city of Tukwila. Please note that even if the ditch was located on the project site, there
would still need to he an open channel drainage ditch constructed within the right -of- •
way to collect and convey stormwater flows from East Marginal Way and the remaining
right -of -way areas. The system, as now designed and constructed these
flows into one ditch which is more practical and should not require any additional main-
tenance from the City of Tukwila. The grass -lined swales, which were designed within
the project boundaries will be maintained by Bedford Properties, similar to other on -site
landscape areas.
3. As requested by your comment no. 3, 1 am submitting copies of both the Certificate of
Water and Sewer Availability letters issued for the project by King County Water
District No. 125 and the Val-Vue Sewer District, respectively. Please note that the
sanitary sewer lift station. as shown on our design plans, as future development, has
already been installed by the Val -Vue Sewer District, and the on -site sanitary sewer
main line extension, including mahouts to the future lots have been constructed by the
developer's contractor. All of the on -site S -inch sewer main line extension will be
included within a 15 -foot sanitary sewer easement to the Val -Vue Sewer District, as
required by the district for final approval of:the plans. The Phase I portion of the
Water Line Extension Plan has also been constructed, as shown on the approved plans,
and in accordance with the requirements of King County Water District No. 125, the
on -site main line system was required to be a private system owned and maintained by
the developer. Future extension of the main Lline system will be constructed as needed
for the phased development.
4. Comment no. 4 indicates that street fights may be required along East Marginal Way, as
part of the development of this project. This'siatem6nt clods not require any direct
response from our office, and if it is required as .part of.the development, .1 am
assuming that it will be either a condition of the preliminary short plat or a condition
of approval for one of the future phases. ..

5. In response to your comment no. 5, we are providing a copy of the Trip Generation
Study and Traffic Analysis completed by TDA Consultants to assist the City in
determining if any roadway improvements will be needed in the future along East
Marginal Way. Please note that this study was also submitted to .King County for their
use in determining the required mitigation to be included in the determination of
nonsignificance (DNS) for the project. A copy of the DNS is also being submitted for
your review and files.
I believe that the above information and attached plans and documentation should adequately
address each of the comments which you provided to me during our telephone conversation. Please
proceed to review the enclosed submittal as soon as possible, and contact me if you have any more
questions or would like to discuss the project in further detail. It is critical that the boundary line
adjustment and short plats are completed in a timely manner, so that processing of the Phase II building

After reviewing the Building and Land Development
Division's Report, examining available information on file
with the applications and visiting the property and
surrounding'area, the Examiner conducted a public hearing
on the subjects as follows:
The hearing on Item Nos. 207 -88 -R and 075 -87 -SH was opened by
the Examiner at 1:30 p.m.-, April 28, 1988, Hearing Room No. 1,
3600 - 136th Place S.E., Suite A, Bellevue, Washington and was
'administratively continued until 4:30 p.m. April 29, 1988 and
closed at that time. Participants at the public hearing and
the exhibits offered and entered are listed in the attached
minutes. A verbatim recording of the hearing is available in
the office of the Zoning and Subdivision Examiner.
FINDINGS, CONCLUSIONS & RECOMMENDATION: Having reviewed the
record in these matter, the Examiner now makes and enters the
following:

2. The subject property is classified RS -7200, SR, and MP.
Each of these classification on this property are also
designated "potential M -H ". The applicant seeks to
implement that potential classification by reclassifying
this property M -H. At the same time, the applicant
intends to develop.this 27.72 acre property for industrial
and warehousing purposes,. and therefore seeks a shoreline
substantial development permit.
The proposed development is described in Exhibit No. 7,
and includes nine buildings, together with parking, truck
loading, driveways, perimeter and internal landscaping,
bank stablization along the Duwamish River, grass -lined
storm drainage swale..s,.and establishment of a public
easement along the Duwamish River frontage (See Finding
No. 4.C., below).
3. KCC 20.24.190.A. authorizes an Examiner recommendation to
reclassify a property when that property is
...potentially zoned for the reclassification being
requested and conditions have been met which indicate the
reclassification is appropriate• " In this case, the
H.i.ghline Community Plan does not reveal its rationale for
designating the property "potential M -H' rather than '
actual M -H. The property history suggests, however, that
there may have been water, sewer, and access difficulties
in the past. These potential development constraints no

longer exist.... Sewer service is readily available from the
Val -Vue Sewer District. Water service is available in
sufficient quantity to accommodate industrial development
(per King County Fire Marshal standards) from King County
Water District No. 125, provided that the applicant
annexes to that water district. The appropriate
annexation request is pending.
4. A few development issues require resolution:
A. An off -site WSDOT drainage detention area exists near
the northwest corner of the subject property. The
Division asks for a 15 foot building setback line
(BSBL) from the perimeter of that retention basin,
which the Division calls a "wetland ". The facility
was developed to accommodate drainage from Pacific
Highway South and includes a flood control gate to
prevent Duwamish River highwater from entering the
basin.
B. A couple of significant trees are located within the
KCC Title 25 required shoreline setback area in the
vicinity of the required "shoreline protection." The
Division seeks to retain these trees, a measure
considered generally consistent with both the
shoreline master program and "River of Green" plan
policy. The applicant questions whether this tree
retention is feasible, consistent with the shoreline
protection measures which are required.
C. The .Division recommends establishment of a public
easement within the 30 foot wide shoreline setback
area, to be developed for joint use by King County
Department of Public Works for floodway management
purposes and by .King County Parks and Recreation for
public pedestrian bicycle pathway use. The applicant
agrees to provide the necessary easement and to
develop that easement consistent with Public Works
river protection access maintenance road standards.
However, the applicant opposes the recommended
requirement to improve this facility to satisfy public
pedestrian /bicycle trail standards of the King County
Parks Department,_contending that such improvement
should be a King County responsibility. See, also,
Finding No. 5, following.
5. The proposal• to develop a recreational trail along the
Green /Duwamish shoreline'is set forth in the'1971 King
County Urban Trail Plan, 1975 Bicycle Trail Plan, and the
1 -979 multi - jurisdictional "River of Green Report,' adopted
by King County.
The Green /Duwamish River Recreational Trail does not
presently exist either immediately east or west of the
subject property. Development of such a public
pedestrian /bicycle trail would therefore be isolated on '
this subject property only, between Pacific Highway South
and East Marginal Way South.
6. Except as noted above, the facts, analysis and
recommendation presented in the Division of Building and
Land Development Preliminary Report dated April 28, 1988
(published April 11, 1988) are uncontested and they are
incorporated here by reference. A copy of the Division of
Building and Land De.velopment.report will be attached to
the copies of the examiner's report which are submitted to
the King County Council.

1. Tree retention along the shoreline is cdnsistent with King
County Comprehensive Plan, Shoreline Master Plan, Highline
Community Plan, and "River of Green" policies. However,
such tree retention should not be required if it will
undermine or sabotage shoreline bank protection measures.
Otherwise, the bank protection measures, also a legitimate
public purpose, will have been taken for naught.
Therefore, the tree retention should be required only if
determined by the appropriate Public Works engineering
review that the tree retention will not interfer with
final bank profile stability.
2. The storm retention area developed by WSDOT near the
northwest corner of the property does not receive back
flows from the Duwamish River and is not a wetland.
Therefore, n� building setback line should be required..
In this case, the issue is probably not significant since
the applicant does not propose any buildings within 25
feet of that storm drainage retention basin.
The industrial development of the subject property does
not create an impact which requires pedestrian /bicycle
facilities, does not create a demand for such facilities,
and does not adversely affect any such existing
facilities. The improvement of the shoreline access
easement to King County pedestrian /bicycle trail standards
cannot be required.
The facts in this case are remarkably similar to Nollan v.
California Coastal Commission, in which the U.S. Supreme
Court denied California the right to require a pedestrian
easement crossing the Nollan's coastal shoreline
frontage. In that case, the Court ruled that even though
the Commission was pursuing a legitimate public interest
expressed in an adopted plan,
...that does not establish that the Nollans (and other
coastal residents) alone can be compelled to
contribute to its realization. Rather, California is
free to advance its "comprehensive program" if it
wishes, by using its power of eminent domain for this
'public purpose,' See U.S. Constitution, Amendment V;
but if it wants an easement across the Nollan's
property,.it must pay for it.
In this case, no development impact has been identified
which would.require the pedestrian/bicycle facility as a
mitigating measure. Further, there is no public demand or
need created by the proposed development which the
requested pedestrian /bicycle facility would serve.
Regardless of the legitimacy of the public purpose
(providing public recreational facilities) and regardless
of the formal legal declaration of that public purpose
(KCC Title 25, Urban Trail Plan, "River of Green" plan,
County Bicycle Plan, etc.) 1- hc'exaction sought here
cannot be granted when it violates the principles of the
Nollan decision.
•
4. The analysis contained in preceding Conclusion No. 3 does
not apply to the Public Works floodway access easement and
road improvement requirement, for at least two reasons.
First, the applicant agreed to grant this easement to the
County, and agreed to make improvements consistent with
Public Works requirements, prior to the public hearing on
this matter. Second,' the nexus between urban development
and river maintenance requirements is clear and long
established. The continuing urban development in the

Green /Duwamish River basin has created significant impacts
and demands upon the river which require maintenance
access. The easement and maintenance road, unlike the
bicycle /pedestrian improvements, are necessary mitigation
measures directly related to the individual and cumulative
impact of ubran.development in. and this
development in particular. For this reason, the access
road should be developed by the applicant, consistent with
King County Department of Public Works standards for river
protection maintenance roads. If that design also
accommodates future improvement by King County to
accommodate pedestrian /bicycle trail purposes, then . that
will be fortunate. However, for the reasons cited in
Conclusion No. 3, above, specific improvements related to
the pedestrian /bicycle trail plans cannot be required in
this case.
5. If granted subject to the conditions set forth below, the
requested substantial - development permit will be
consistent with the King County Shoreline Master Program
and KCC Title 25.
6. The proposed reclassification will comply with the goals
and objectives of the Comprehensive Plan, the Zoning Code,
and other official land use controls and policies of King
County. The subject property is potentially zoned for the
reclassification requested . ,and conditions have been met
which indicate that the change is appropriate. The
reclassification will not be unreasonably incompatible
with nor detrimental to surrounding properties and /or the
general public. Reclassification of this property as
requested is consistent with KCC 20.24.190.A.
7. Based upon the whole record, and according substantial
weight to the determination of environmental significance
made by the Division of Building and Land Development, it
is concluded that approval of the subject action as
recommended below, would not constitute a major action
significantly affecting the quality of the environment.
All evidence of environmental impact relating to the
proposed action and reasonable alternatives to the
proposed action have_been included in the review and
consideration of the subject action.
The requested shoreline substantial development permit,
described in BALD File No. 075- 87 -SH, is APPROVED subject to
the following conditions:

This approval is contingent upon King County Council
approval of zone reclassification File No. 207 -88 -R
(proposed Ordinance No. 88 -164). Development pursuant to
this permit shall not commence prior to expiration of the
appeal period following Council approval of the requested
zone reclassification. This substantial development
permit shall be null and void if for any reason the King
County Council does not grant the requested zone
reclassification.
2. The applicant shall comply with post- effective Condition
Nos. 1, 3, 5, and 7, of BALD File No. 207 -88 -R.
3. Submit a detailed bank stabilizati,on plan for the review
and approval of the Building and Land Development Division
and Surface Water Management Division. A construction
bond shall be submitted for said work.

In addition to P- suffix Condition Nos. 5 and 6, below,
submit a detailed landscaping plan for that area abutting
the Duwamish River, incorporating shade trees and riparian
- vegetation. The plan shall be subject to the review and
approval of the Building and Land Development 'Division and
Surface Water Management Division. The landscape plan
will incorporate existing trees wherever possible,
consistent with sound engineering bank stabilization
practice. A landscape bond shall be required for
installation and maintenance. The landscape bond shall
run for a period not less than three years.
An erosion /sedimentation control plan shall be submitted
for the review and approval of the Building and Land
Development Division.
(6. Any future revisions to the site plan submitted by the
applicant are subject to WAC 173 -14 -064.

Hydraulic Project Approval (HPA) is required from the
Department of Fisheries for installation of outfalls. The
approved HPA shall be submitted to the Building and Land
Development Division.
J 9. The storm sewer'system should be equipped with oil /water
separators and siltation detention ponds to prevent
overloading grass swales and preclude discharge of oils
and sediment'to the Duwamish River. Swales•should be
adequate to ensure filtration of effluent from the storm
drain system during a 24 -hour, 100 -year storm. Provisions
for the storm sewer system should include:

A water quality certification approval from the Department
of Ecology is required to allow bank stabilization and
stormwater outfalls into the Duwamish River. Obtain this
approval and submit verification of certification to the
Building and Land Development Division.
A. Regular maintenance of catch basins, separators,
detention ponds, and swales.
B. Provisions for dewatering materials removed from the
_.. catch basins and ponds, with water discharged to the
sanitary sewer. Solids disposal should be in a lined
landfill which complies with Chapter 173 -304 WAC.
. Storm drainage facilities shall be designed and
.constructed pursuant to KCC 9.04.
The proposed storm water system may require a storm water
discharge permit from the Department 'of Ecology under the
National Pollutant Discharge Elimination System (NPDES')
Program (WAC 173 -220).
\L11. Consistent with WAC 1173 -14 -060, construction or
substantial progress toward construction shall be
undertaken within two years following this permit
approval. Time limitations establisheo oy wr+L ii3-14 -060
shall not include any time required for appeals or
litigation related to the issuance of this permit or the
conditions contained herein.
12. All standard shoreline management conditions contained in
the shoreline management permit issued by the Building and
Land Development Division are incorporated here.
13. Comply with the conditions of the MDNS, stipulated in
Attachment 1, of the BALD staff report, dated April 28,
1988.

NOTICE OF RIGHT TO APPEAL
Rezone
In order to appeal the recommendation of the Examiner, written
notice of appeal must be filed with the Clerk of the King
County Council with a fee of $50.00 (check payable to King
County Office of ,Finance) on or before JUNE 1, 1988. If a
notice of appeal is filed, the original and 6 copies of a
written appeal statement specifying the basis for the appeal
and argument in support of the appeal must be filed with the
Clerk of the King County Council on or before JUNE 8, 1988. If
a written notice of appeal and filing fee are not filed within
14 calendar days of the date of this report, or if a written
appeal statement and argument are not filed within 21 calendar
days of the date of this report, the Clerk of the Council shall
place a proposed ordinance which implements the Examiner's
recommended action on the agenda of the next available Council
meeting.
Filing requires actual delivery to the Office of the Clerk of
the Council, Room 403, King County Courthouse, prior to the
close'of business (4:30 p.m.) on the date due. Prior mailing
is not sufficient if actual receipt by the Clerk does not occur
within the applicable time period. The Examiner does not have
authority to extend the time period unless the Office of the
Clerk is not open on the specified closing date, in which event
delivery prior to the close of business on the next business
day is sufficient to meet the filing requirement.
Action of the Council Final. The action of the Council
approving or adopting a recommendation of the Examiner shall be
final and conclusive unless within twenty (20) days from the
date of the action an agrieved party or person applies for a
writ of certiorari from the Superior Court in and for the
County of King, State of Washington, for the purpose of review
of the action taken.
Shoreline Development Permit
The decision of the Shoreline Hearing Examiner may be appealed
to the State Shoreline Hearings Board. Information on appeal
procedure may be obtained from Washington State Department of
Ecology, Redmond Office - telephone 885- 1900. Requests for
review by the Hearings Board must be received by the State
Department of Ecology and' State Attorney General's Office
within thirty (30) days of receipt by the Department of Ecology
of the permit or letter of denial.'

As requested, I am forwarding four additional sets of the Gateway North Phase II Development
Plan$ for your use in processing the two new short plats and Boundary Line Adjustment. I am also
forwarding one copy of the riverbank maintenance casement which was required by King County as part
of the hearing examiner's report. Attached to the easement is a copy of the hearing examiner's
condition requiring the maintenance easement.
You also requested documentation indicating that King County has approved the access roadway
widths into the project which ranges between 32 feet and 40 feet wide. I have contacted Mr. Chuck
Shields of the King County Traffic Department. He indicated that King County approved copies of the
plan showing the roadway widths can be obtained from BALD. If you would like me to obtain a copy
for you, please contact me. I am enclosing, however, copies of documentation from our office to King
County discussing the roadway widths which were determined acceptable by King County.
As I indicated to you during our telephone conversation, the entrance roadway is currently
under construction, and it is critical that we be informed immediately if the City of Tukwila has any
concerns with the roadway sections which were approved by King County as part of the Phase I
development. Thank you for your assistance.

In accordance with our telephone conversation this morning, we have revised the South 116th
Street Section to incorporate the following items.
1. The pavement width from East Marginal Way to the first access to the site has been
revised from 36 feet to 40 feet (approximately 120 feet).
2. The pavement width from the first access to the second access will remain at 36 feet
wide as originally designed (approximately 175 feet).
• 3. The pavement width for the roadway section from the second access to the cul -de -sac
will remain at 32 feet as originally designed (approximately 400 feet).
4. The truck access widths from South 116th Street into the site have been revised from 30
feet to 35 feet to better accommodate turning movements for truck access.
Plcase.complete your review as soon as possible and forward your approval to the Building and
Land Development so that the building permits can be issued for this project. Thank you for your
cooperation and assistance.
