The BAR also adopted the findings and conclusions contained in the Staff Report Supplemental Memorandum dated July 8, 1991. Any changes to the specific design approved by the BAR will require further BAR approval. Minor, incidental changes may be administratively approved by the Director of Community Development. 1 The decision of the BAR is not final until the appeal period has elasped, which is ten calendar days after the above date of the decision. Appeals must be filed in writing to the City Clerk by 5:00 p.m. on the final day of the appeal period. Where the final day of an appeal period falls on a weekend or holiday the appeal period will be extended to 5:00 p.m. on the next work day. You will note that windows were enlarged along the lower west band of windows and that similar windows were added to the south elevation. In addition several truck doors were added to the south side of the building. We are proceeding under the assumption that these small modifications are not of sufficient impact to require second review by the Architectural Review Board. Between the new SE parking area and the tower structure. Vernon Umetsu, Associate Planner, reviewed the application, recommending approval with conditions. Mr. Mike O'Donin, 1517 S.W. 16th Street, requested that permis- sion be granted for a shared directional sign (with Longacres). He was instructed to submit a sign application directly to Tukwila Department of Community Development. Robert Losey, owner of the adjacent property, Renton Auction, expressed a concern with the delay he is experiencing in obtain- ing a date of sale from the purchaser. Mr. O'Danin explained the purchase process and the legal process they must go through to obtain Mr. Losey's property and the time elements involved. MR HAMILTON MOVED AND CAGLE SECONDED A MOTION TO ACCEPT 88 -7 -DR EMBASSY SUITES, SUBJECT TO STAFF RECOMMENDATIONS AS FOLLOWS: A. Dear Nick, The remaining Planning Division permit process for your project is for a Shoreline Substantial Development Permit. City issuance of a shoreline permit is usually done immediately after B.A.R: review. However, your accelerated B.A.R. review does not allow for this immediate issuance. The schedule to complete the shoreline permit process is as follows: March 21st: Tukwila to issue a Shoreline Substantial Development Permit. This is the State's required minimum 30 day comment period after the last public notice was published. April 25th: State shoreline permit 30 day appeal period ends. This assumes 4 days are required for the mail to reach State Ecology offices; with the appeal period beginning on the date of receipt. The Public Works Department has agreed to begin its review during the shoreline permit appeal period. Once the shoreline permit appeal period ends, Public Works has also agreed to issue a grade and fill permit prior to issuing a building permit. The Building Division will also accept a building permit application for review during the shoreline permit appeal period. Sincerel I have reviewed the State regulations for provisions for an abbreviated review period in cases such as yours, but can find no such exceptions and my calls to the State. Dept. of Ecology have not been returned. At this time I conclude that the schedule shown above is required in all cases. Please feel free to contact me at 433 -1858 if you have any further questions. Conditions to Board of Architectural Review Approval for 89- 18 -DR: Hartung - Temperline Building 1. The Staff Report dated February 15, 1990 is adopted except for Staff Recommendation No.1 regarding building architectural quality and those associated findings and conclusions. The Board concludes that the design for the building's western face, as represented in the Architect's model presented at the Board's February 22nd meeting, satisfies building architectural criteria. 2. Landscaping is adopted as modified and presented at the B.A.R. public meeting of February 22, 1990. Modifications were agreed to by both staff and applicant representative. These modifications are shown on the attached landscape plan. 3. Color and materials selection shall be finalized at or after an on -site evaluation of materials by the B.A.R. per the applicant's request. Planning Staff requires that this be accomplished prior to approval of the building shell since shell approval requires that all windows be installed and water - tight. It is the applicant's responsibility to ensure that B.A.R. approval is done in a timely manner to minimize construction schedule impacts. 4. The specific location shall be approved by the ublic Works Director. 3. The property's fair share cost of the W. Valley Hwy. (SR- 181)/So. 180th Street intersection improvement shall be deposited with the City of Tukwila prior to issuance of a building permit. This fair share amount is $22,269, based on the proportion of new project traffic entering the intersection. The 47 P.M. peak hr. trips generated from the project (per TPE traffic appendix to the environmental checklist) divided by the increased traffic between 1989 and 2010 which is 3,208 trips ( = 8,222 - 5014) (per CH2M Hill), and multiplying this percentage by the improvement cost of $1,520,000. This intersection improvement is necessary in order to allow the proposed project to proceed per the Tukwila Public Works Dept. since the highway segment is now at LOS F. This payment is in lieu of charging the property for frontage improvements which would normally be required were the highway segment designs completed at this time. The Public Works Dept. anticipates $22,269 to be well below the minimum cost of road improvements to the project site. The owner shall not be responsible for the cost of frontage improvements associated with the SR181 /So. 180th St. intersection improvement (84 -RW40) other than this one time cash payment. Improvements are anticipated to include a retaining wall, sidewalk, and actual road construction. 4. The owner shall work with the City on the design and construction of West Valley Hwy. widening. This shall include modifying the existing utility, sidewalk, and road slope easement to allow its use for future road widening at no cost to the City for this easement change, prior to issuing a building permit. Surface Water Drainage 5. Biofiltration shall be provided for storm runoff from vehicular parking and circulation areas prior to discharge to the wetlands located east of the Renton sewer main to satisfy Federal Clean Water Act and RCW 90.48 requirements as approved by the Public Works Director. 6. The easement necessary from the Howard Cooper or Ryder property to accommodate the proposed biofiltration swale shall be established prior to issuance of a building permit. 7. The applicant shall fund $7,500 in a letter of credit or interest bearing account, of a $30,000 drainage study to establish the long -term design solution for drainage and agree to participate in a local improvement district (LID) to provide surface water capacity for the 2, 10 and 100 year storm events to connect to the P -1 drainage channel. This funding shall be credited against the future LID if, and only if, the LID includes the study costs. This is to provide long -term mitigation for the cumulative impacts of developments discharging into a very marginal storm drainage system. This system is anticipated to become overloaded in the mid -term future due to the cumulative impacts of other developments in Renton and is in lieu of the Renton requirement for detention of seven days of the 100 year storm, for projects discharging into their storm drainage facility. The $7,500 payment shall release the property from any further monetary obligation to support a basin drainage study. However, property owner shall continue to be responsible for fair share participation in the long -term solution for drainage. This participation shall include PS & E, right of way acquisition, environmental mitigation (for the system), and construction /engineering /administrative costs. This money shall be returned to the property owner if not contractually obligated within five years of assignment or deposit with the City. A bond will not be an acceptable substitute. Sewer and Water Availability 8. Certificates of sewer and water service from the City of Renton shall be submitted to the Public Works Dept. prior to issuance of a building permit. Easements 9. Project Description: The applicant proposes to construct a 2 story mixed use building with 136 parking spaces. The proposed project is as shown in attachments A through D. The project site and the site immediately to the south are owned by the same business man who plans to expand his operations into the new building (Attachment E). 2. Existing Development: The site is currently vacant. 3. Surrounding Land Use: The site is surrounded by light industrial operations on the north and south, West Valley Hwy. and the Green River on the west and a wetland /power lines /railroad lines to the east. 4. Terrain: The site is relatively flat and lies approximately 5 feet below W. Valley Highway. 5. Vegetation: Vegetation is largely scrub shrub, grasses with a few imported trees. There is some emergent wetland vegetation around seasonal ponds, but a wetland biologist certified that there are no wetlands on site as part of the environmental review process. 6. Access: Site access is via two driveways which are shared with adjacent properties on the north and south. No additional driveways will be established on W. Valley Highway. 7. Utilities: Provision of adequate sewer, water and storm drainage facilities are in the process of being verified pursuant to the conditions of the environmental review. Any significant changes to the site plan resulting from satisfying these provisions will require additional Board review. Staff Report 89- 18 -DR: Hartung to B.A.R. Page 3 DECISION CRITERIA This project is subject to Board review due to its location within 200 feet of the Green River; which lies approximately 75 ft. across the highway from the western property line. Board review criteria are shown below in bold, along with a staff discussion of relevant facts. 18.60.050: General Review Criteria. (1) Relationship of Structure to Site. The proposed development is approximately 4 ft. lower than the highway (Attachment D). Transition is comprised of a grassed slope with dense shrubs at the toe, a separated sidewalk and large stature maple trees at each end (Attachment B). Front parking areas are visually moderated from the highway by the grade change and perimeter landscaping on the west and east. This eastern perimeter landscaping also helps to moderate the bulk of this large building's western face. (2) Relationship of Structure and Site to Adjoining Area. Both the project site and the lot immediately to the south are owned by the same person. The proposed development is being designed for functional integration with the existing southern building for glass distribution. The proposed structure is sited with a building line and height which is compatible with adjacent north and south structures. All landscaping is at the front as is typical of this industrial area. Transition with other properties is found in the common industrial nature of side yard activities and spaces. Vehicular access has been coordinated with north and south developments to result in no new driveways onto the highway. Emergency access easements will be coordinated with both adjacent north and south developments. (3) Landscaping and Site Treatment The proposed landscape plan maples with smaller stature the building, accenting the face. The landscaping also site users from the highway provides for larger stature perimeter (15 -20 ft.) pear trees adjacent to central third of the western building provides enclosure and buffering for above and large scale building mass. The landscape plan must be modified to eliminate the trees between the proposed and southern building due to Building Code C Staff Report 89- 18 -DR: Hartung to B.A.R. Page 4 requirements. Removal of all southern trees also removes the element moderating the effects of this paved truck loading and parking corridor. A possible option is to place large stature evergreen trees at the west end of this corridor at the building corners, and place dense evergreen shrubs in the interior landscape islands. Widening of West Valley Highway by the City may affect the amount of front yard landscaping provided and cause the property to become legally non - conforming at some later date. The City anticipates this widening in 1991, but has not yet completed road design to determine how much, if any, area will be required in the existing slope easement area. Wall mounted area lights are shown at 24 ft. high, just above the reveal strips. The applicant must still submit illumination plans to demonstrate no off -site glare spill over. No landscape irrigation plans have as yet been submitted. (4) Building Design The project site is prominently located on West Valley Highway, a strong visual corridor through Tukwila. The large building mass of the proposed structure will be very visible and should be of an architectural quality commensurate with its mass and visibility. Architectural quality could be most effectively enhanced by improvements to the building's western face. Architecture on the proposed western face is characterized by a single plane divided into thirds by 5 ft. wide vertical concrete strips (Attachment A). The central third is the building's visual focus. It is dominated by a 5 ft. glass extruded vestibule with a blue colored band for accent. It is flanked by concrete walls with two glass strips on either side as shown in Attachment C. Please note that Attachment C, West Elevation is drawn at twice the size of the other elevations to show building detail. Building colors are clear glass with powder blue bands and a warm gray concrete. No roof -top equipment or equipment screening have as yet been shown. Planning staff, the project architect, and land owner's representative met on the date of final staff report (2/15/90) to discuss building design issues. Various options were discussed, but the extremely short time available did not allow the applicant to submit revised drawings. CONCLUSIONS RECOMMENDATIONS Staff Report 89- 18 -DR: Hartung to B.A.R. Page 5 (5) Miscellaneous Structures and Street Furniture No miscellaneous structures or street furniture have been proposed. The proposed project generally satisfies the Zoning Code's Design Review Criteria with the following exceptions: 1. Architectural quality at the western building face should be enhanced with variety of color, detail, and form to provide additional visual interest (See Criteria No. 5). 2. Large stature evergreen trees should be placed at the corners of each building which form the central truck loading and parking corridor along the southern boundary; with dense shrubs to approximately 4 ft. in height substituting for trees at the interior islands in this area. This landscaping is necessary in order to screen and moderate the effects of this intense utility corridor in the absence of previously proposed trees (see Criteria No. 3). 3. Provision of an automatic irrigation system for all planting areas, glare diagrams to demonstrate no off -site light spill over, and screening of all heating, ventilation, and cooling equipment. The Planning Division recommends approval of the proposed project with the following conditions: 1. The architectural quality at the western building face shall be enhanced with variety of color, detail, and form to provide additional visual interest. Board has the option of requiring revisions to be presented at the special March 8th meeting or establishing site specific guidelines for an administrative approval. Where existing topographic patterns contribute to beauty and utility of a development, they should be recognized and preserved and enhanced. B. Grades of walks, parking spaces, terraces, and other paved areas should promote safety and provide an inviting and stable appearance. C. Landscape treatment should enhance architectural features, strengthen vistas and important axis, and provide shade. 0. In locations where plants will be susceptible to injury by pedestrian or motor traffic, mitigating steps should be taken. E. Where building sites limit planting, the placement of trees or shrubs in paved areas is encouraged. F. RESPONSE: BUILDING DESIGN IS A FORTHRIGHT EXPRESSION OF THE RETAIL ASPECT OF THE WEST END EXPOSURE TO THE WEST VALLEY HIGHWAY WHERE THE MAIN ENTRANCE AND PROJECTING SHOW WINDOWS ARE EVIDENT. THESE ELEMENTS PROVIDE MOnUI ATFD RFI IFF TO THE RIIII DING FRONTAGE AND THE PROPOSED BLUE GLASS WILL ADD SOME QUIET COLOR VARIATION. GLASS THROUGHOUT SHALL BE OF LOW - REFLECTANCE TYPE. THE CONCRETE PANELS SHALL BE PAINTED A WARM GREY WITH BLUE DOORS AND TRIM. THE BUILDING FRONT IS SYMMETRICAL AND WELL - PROPORTIONED.
