The land- scaping condition referred to continuation of landscaping around all sides of the scrubber. Since the rockery borders two sides, the laurel need only be placed on the north and northwest sides. This will require an addi- tional one foot between the proposed asphalt curb and fence. The drawings show the dimensions of the easement and the wood fence surrounding the above grade structures. The re- mainder of the property is needed for safe vehicular access. Four rhododendrons, matching the Ivy Hills landscaping plan, will be planted and maintained in a planter box in front of the fence along Interurban Avenue. I believe that the concerns have been adequately addressed. Please accept my apology for the delay in providing this in- formation to you. Installation of an eight -foot high wood fence around four sides of the scrubber, painted the same color as the Ivy Hills Apartments. 2. Continuation of Ivy Hills landscaping around remaining three sides of fence to consist of the following or acceptable substitutes: 3. Submittal of a site plan which accurately depicts the use of the entire easement, the screening, and the immediate parking and right -of -way improve- ments. Any party aggrieved by this decision may appeal the decision to the City Coun- cil by filing an appeal in writing with the City Clerk within ten (10) days of the above date and shall state the reasons for the appeal. Mr. Haggerton went on record saying he had reservations as to the traffic impacts of the development. 88 -4 -DR - PARKWAY RETAIL BUILDING - Request to construct a one - story, 14,143 square foot retail building on a 66,000 square foot parcel. Vernon Umetsu reviewed the proposal pointing out the modifica- tions to the original landscaping and building design. He entered the May 6, 1988 addendum to the April 7th staff report as Exhibit 1. Mr. Bob Schofield, 3806 130th Avenue N.E., Bellevue represented the applicant. He clarified the proposal. Lance Mueller, 130 Lakeside, Seattle, 98122, architect for the building explained the design and signing of the building. Mark Wiseman, 2329 E. Madison, Seattle, WA 98112 landscaped architect, clarified the landscaping design. MR. HAGGERTON MOVED THAT THE BOARD OF ARCHITECTURAL REVIEW ACCEPT THE DESIGN AS PRESENTED BY THE APPLICANT AND GIVE THE APPLICANT THE OPTION OF EITHER USING HANGING BASKETS OR AWNINGS IN THE DESIGN. MR. Project Description: Odor scrubber for an existing sewer pump station. 2. Existing Development: The site surrounding the easement is being developed with 104 apartment units (Ivy Hills Apartments) accessible from either Interurban Avenue or 56th Avenue South. 3. Surrounding Land Use: Interurban is characterized by offices, commercial stores, and the golf course. 4. Terrain: Flat. 5. Vegetation: When completed, front yard landscaping for Ivy Hills will be installed pine trees and laurel shrubs are proposed adjacent to subject easement. 6. Light /Noise /Air Quaility: Interurban Avenue is a principal arterial and a truck route; therefore, noise is a factor because of the traffic. 7. Access: An existing curb cut will remain onto Interurban Avenue for the pumping station. 8. Public Facilities: Foster Golf Course. BACKGROUND Odors emanate from the pipes extending above ground at the subject pump station. METRO is proposing an odor scrubber (Attachments B, C and D) to eliminate the odors. The pump station is owned by the City of Tukwila on an easement granted to the City for the use. METRO and the City have agreed to provide METRO's joint use and duty to maintain, operate and repair the trunk sewer, force main and pumping station. Development of the surrounding adjacent site for Ivy Hills Apartments necessi- tated resolution of the odor problem. DECISION CRITERIA The Board's review criteria are shown below in bold, followed by findings of fact. Because this property lies in the Interurban Special Review District, additional criteria also apply. 1. TMC 18.60.050(1) - Relationship of Structure to Site The structure proposed to eliminate the odors consists of duct work, an activated carbon tank and 2 hp fan. The maximum height of the structures STAFF REPORT w 88 -5 -DR: METRO to the BAR Page 3 is 9.5 feet (Attachment D). A 916- square foot easement exists for the structure, which has a 40 -foot frontage on Interurban Avenue with a curb cut to allow access to METRO maintenance vehicles (Attachment A). The siting of the scrubber is restricted by the location of the existing pump station. 2. TMC 18.60.050(2) - Relationship of Structure and Site to Adjoining Area No landscaping transition is proposed and the Ivy Hills landscape plan (Attachment E) does not show the sewer pump station. As the landscape plan for Ivy Hills demonstrates, the easement and its utilities are part of the development's front yard and parking lot. Views from the upper stories of the apartments will have clear views of the proposed scrubber. The golf course is located on the other side of Interurban Avenue. No change in pedestrian or vehicular circulation patterns on -site or off - site is proposed. 3. TMC 18.60.050(3) - Landscaping and Site Treatment No landscaping has been proposed by the applicant. Attachment E is a copy of the Ivy Hills landscape plan, which does not acknowledge the sewer ease- ment or existing curb cut. 4. TMC 18.60.050(4) - Building Design Criteria specifies that mechanical equipment or other utility hardware should be screened from view. 5. TMC 18.60.050(5) - Miscellaneous Structures and Street Furniture Not applicable. INTERURBAN SPECIAL REVIEW DISTRICT 6. TMC 18.60.060(4)(A) Proposed development design should be sensitive to the natural amenities of the area. The odor scrubber's design is utilitarian instead of similar to landscaping and buildings in the area. However, it will eliminate odors emanating from the existing pump station. 7. TMC 18.60.060(4)(B) Proposed development use should demonstrate due regard for the use and enjoyment of public recreational areas and facilities. The use will not inhibit the use of Foster Golf Course directly across Interurban Avenue from the property. Because golfers can see the equipment, as proposed, enjoyment of Foster Golf Course may be impacted. Screening, as recommended herein, will mitigate that impact. STAFF REPORT to the BAR Not applicable. 88 -5 -DR: METRO Page 4 8. TMC 18.60.060(4)(C) Proposed development should provide for safe and convenient on -site pedestrian circulation. 9. TMC 18.60.060(4)(D) Proposed property use should be compatible with neigh- boring uses and complementary to the district in which it is located. The proposal is accessory to the sewer trunk line and pumping station. The use is existing and the proposal is to eliminate an impact of the pump station. Because of the adjacent Ivy Hills Apartments and nearby Foster Golf Course, the proposal of the odor scrubber trades an odor incompati- bility for view and aesthetic incompatibility. The view impact could be mitigated with appropriate screening. 10. TMC 18.60.060(4)(E) Proposed development should seek to minimize signifi- cant adverse environmental impacts. The proposal is to eliminate the adverse impact of odor. The design of the odor scrubber combined with the prominent location of the existing pump station creates view and aesthetic impacts. 11. TMC 18.60.060(4)(F) Proposed development should demonstrate due regard for significant historical features in the area. None known at this time. CONCLUSIONS 1. In order to meet Criteria 3 and 4(e), screening must be installed around the proposal. 2. A minimum eight -foot solid wood fence painted the same color of the Ivy Hilts Apartments is needed to meet the criteria and safeguard the equipment from child's play. 3. Vegetation which duplicates the front yard landscaping of Ivy Hilts will create a continuous visual frontage along Interurban Avenue and soften the effect of a significant structure located so close to the right -of -way. 4. Coordination of site plans with inclusion of actual METRO needs and use of the site with the parking lot, landscaping and right -of -way need to be completed. With the application are three sets of the project plans and the $60 application fee (Warrant No. 1670). Also, attached are copies of the acquisition document (a sewer easement dated September 15, 1963) for the pumping station property, between the City and Carl and Hazel Brewer, grantors, and the agreement whereby METRO assumed the duties of mainte- nance, operation and repair of the pumping station, while the City retained its rights of ownership of the easement and the facility (Agreement for Sewage Disposal, dated October 1, 1966). Please note that this is not a typical METRO project. This project has been designed in response to an unanticipated immediate need. That immediate need is the development of the Ivy Hills Apartment complex adjacent to three sides of the pumping station easement. Currently, the pumping station discharges its exhaust directly from its wetwell to a standpipe located adjacent to the street. Nuisance complaints associated with odors emitting from the standpipe have not to date been significant because of the lack of surrounding residential or commercial development. This project was initiated to minimize the level of the exhaust odors for the remaining duration of the pumping station's operational life. I discussed the requirements with Mark Sakagami of your landscaping department and he indicated that the plants could be installed by March 16. This would take care of Areas A and B on the plan. Area C will require a fence extension to screen the view from Interurban. Ave into the odor scrubber area. It will also prevent trash accumulation occurring in the area. The wire mesh fence with wood slats which has been placed above the rockery to screen the area from Ivy Hills Apartments must be painted to match the apartments. I checked with the Ivy Hills contractor and he stated the Metro had put up the fence to protect the area from vehicles and to screen the view for the residents. You have two options: 1) Paint the fence on your own initiative. 2) Coordinate with Ivy Hills ownership on painting . It should be accomplished, weather permitting, by April 15. TUICWXLA, a municipal corporation of the State of Washington, hereinafter referred to as the "City ", and the MUNICIPALITY OF METROPOLITAN SEATTLE, a municipal corporation of the State of Washington, hereinafter referred to as "Metro ", W I T N E S S E T H: WHEREAS, the public health, welfare and safety of the residents of the City and the residents of Metro require the development of adequate systems of sewage collection and disposal, the elimination of water pollution and the preservation of the fresh and salt water resources of the area; and WHEREAS, Metro is engaged in developing and operating a Metropolitan Sewage Disposal System and the City is engaged in developing a sewage collection system for the City; and WHEREAS, the City desires to deliver sewage collected by the City to Metro for disposal; and WHEREAS, to provide for the disposal by Metro of sewage collected by the City it is necessary that a contract be now entered into establishing certain rights and duties of the parties incident thereto; NOW, THEREFORE, in consideration of the mutual covenants contained herein, it is hereby agreed as follows: • Section 8. Development of Metropolitan Sewerage System. It is contemplated that the Metropolitan Sewerage System will be developed in stages and the nature of all facilities of the Metro- politan Sewerage System to be constructed, acquired or used and the time of such construction, acquisition or use shall be deter- mined in the sole discretion of Metro, it being contemplated that Metro shall ultimately provide sewage disposal service for the entire Metropolitan Area and such adjacent areas as may feasibly be served into the Metropolitan Sewerage System. Section 9. Use, Maintenance and Rental of Existing City Sewerage Facilities. From and after October 1, 1966, and until December 31, 1967, Metro shall have the exclusive right to use and the duty to maintain, operate and repair the existing City sewage treatment plant (hereinafter called the "Sewage Treatment Plant ") subject to the continued availability of such facilities to receive and treat sewage delivered at the location thereof by the City. The height of the odor scrubber tank will be six feet above grade plus duct work for overall height of 9.8 feet. 6. RELATIONSHIP OF STRUCTURE AND SITE TO ADJOINING AREA A. Harmony in texture, lines, and masses is encouraged. B. Appropriate landscape transition to adjoining properties should be provided. C. Public buildings and structures should be consistent with the estab- lished neighborhood character. D. Compatibility of vehicular pedestrian circulation patterns and loading facilities in terms of safety, efficiency and convenience should be encouraged. E. Compatibility of on -site vehicular circulation with street circulation should be encouraged. RESPONSE: See #5 above. Driveway, curb and sidewalk constructed to vehicular and pedestrian safety st r rds. The facility is bounded on one side by an existing street and on sides by apartment complex parking areas. Where existing topographic patterns contribute to beauty and utility of a development, they should be recognized and preserved and enhanced. B. Grades of walks, parking spaces, terraces, and other paved areas should promote safety and provide an inviting and stable appearance. C. Landscape treatment should enhance architectural features, strengthen vistas and important axis, and provide shade. D. In locations where plants will be susceptible to injury by pedestrian or motor traffic, mitigating steps should be taken. E. Where building sites limit planting, the placement of trees or shrubs in paved areas is encouraged. F. Screening of service yards, and other places which tend to be un- sightly, should be accomplished by use of walls, fencing, planting or combinations of these. Screening should be effective in winter and summer. G. In areas where general planting will not prosper, other materials such as fences, walls, and pavings of wood, brick, stone, or gravel may be used. H. Exterior lighting, when used, should enhance the building design and the adjoining landscape. Lighting standards and fixtures should be of a design and size compatible with the building and adjacent area. Lighting should be shielded, and restrained in design. Excessive brightness and brilliant colors should be avoided. RESPONSE: Because the project is designed in response to ananantictp.ated condition, the development of the Ivy Hills complex, the available funds do not allow for landscaping or screening at this time. However, when the station is upgraded as scheduled in METRO's facilities plan within the next two to three years, appropriate landscaping and screening will be designed and constructed. There will be no exterior lighting at this time. 8. BUILDING DESIGN uESIGN REVIEW APPLICATION Page 4 A. Architectural style is not restricted, evaluation of a project should be based on quality of its design and relationship to surroundings. B. Buildings should be to appropriate scale and be in harmony with per- , manent neighboring developments. C. Building components - such as windows, doors, eaves, and parapets - should have good proportions and relationship to one another. Building components and ancillary parts shall be consistent with anticipated life of the structure. D. Colors should be harmonious, with bright or brilliant colors used only for accent. E. Mechanical equipment or other utility hardware on roof, ground or buildings should be screened from view. F. Exterior lighting should be part of the architectural concept. Fix- tures, standards and all exposed accessories should be harmonious with building design. G. Monotony of design in single or multiple buildings projects should be avoided. Variety of detail, form, and siting should be used to provide visual interest. RESPONSE: Current operations budget allows for only the development of adequate odor control. Screening of exposed equipment will be provided for the redesigned pumping station within three years. The currently proposed odor control equipment will be visually compatible with existing utility structures on the site, and will be small in size (covering an area of approximately 7' x 15' with the tallest structure being approximately 9.8' tall). 9. MISCELLANEOUS STRUCTURES AND STREET FURNITURE DESIGN REVIEW APPLICATION Page 5 A. Miscellaneous structures and street furniture should be designed to be part of the architectural concept of design and landscape. Materials should be compatible with buildings, scale should be appropriate, colors should be in harmony with buildings and surroundings, and pro- portions should be to scale. B. Lighting in connection with miscellaneous structures and street furni- ture should meet the guidelines applicable to site, landscape and buildings. RESPONSE: Not applicable due to the small size (915 sq.ft.) of the property. There will be no exterior lighting. INTERURBAN SPECIAL REVIEW DISTRICT The following six criteria are used in the special review of the Interurban area in order to manage the development of this area, to upgrade its general appear- ance, to provide incentives for compatible uses, to recognize and to capitalize on the benefits to the area of the amenities including the Green River and nearby recreational facilities, to encourage development of more people- oriented use, and to provide for development incentives that will help to spur growth. Please describe how your proposed development relates to the goals for this District. Use additional response space, if necessary. 10. The proposed development design should be sensitive to the natural amenities of the area. The only goal of this project is prevent the escape of offensive odors from this public facility. This should improve the aesthetic character of the area. 11. The proposed development use should demonstrate due regard for the use and enjoyment of public recreational areas and facilities. The project is small in scope and is being undertaken on an existing utility facility site. The project involves pouring concrete pads and installation /modification of equipment on these pads and in the adjacent pump station. (29 /DSGN.APP1 -3) Y EXTRA RESPONSE SPACE The project site is a utility easement purchased by the City of Tukwila from Carl and Hazel Brewer on September 25, 1963. On October 1, 1966, the City and METRO entered into an Agreement for Sewage Disposal whereby the City retained ownership of the Interurban Pumping Station and METRO assumed the duties of maintenance, operation and repair. This project was initiated by the development of a multi - family housing project - the Ivy Hills Development - on property surrounding the pumping station. The pumping station is scheduled for a complete upgrade in two to three years,-including new pumps and updated odor elimination system. The current odor scrubber project, which lacks any major site beautification elements, is the maximum allowable by METRO's 1988 operations budget. Due to the small scale of the proposed scrubber equipment, its installation will not substantially alter the sites current appearance. The project will be complimentary to the surrounding district in that it will eliminate offensive odors.
