WHEREAS, the real property commonly known as the Metro Park and Ride Lot and located on the northwest corner of Interurban Avenue South and 52nd Avenue South was annexed to the City of Tukwila by Ordinance No. 1392, passed by the City Council on June 2, 1986, and WHEREAS, the City's Comprehensive Land Use Policy Plan Map designates a portion of the property "Commercial" and the remainder of this property "Low Density Residential," and WHEREAS, the Tukwila Planning Commission held a public hearing on March 26, 1987 to consider amendment of the City's Comprehensive Land Use Policy Plan Map to extend the commercial designation on the site to cover the entire paved portion of the Park and Ride Lot and to also consider an amendment to the City's Official Zoning Map to establish initial zoning for the site of C -2 and R -1 -12.0, as recommended by the planning staff, and WHEREAS, at the conclusion of said public hearing, the Planning Commission adopted findings and conclusions and forwarded a recommendation to the City Council that the entire site be given a Comprehensive Land Use Policy Plan Map destination of commercial and that the entire site be zoned C -2, WHEREAS, the Tukwila City Council held a public hearing on May 4, 1987 to consider the Planning Commission's recommendation and heard testimony from all those present who indicated they -1- would like to speak, and WHEREAS, on the basis of the testimony taken at the public hearing, the City Council determined to reject the Planning Commission's recommendation and adopted findings and conclusions prepared by the planning staff in support of the original staff recommendation, and WHEREAS, the City's SEPA Responsible Official has issued a Determination of Nonsignificance (DNS) for the changes, now, therefore, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Comprehensive Land Use Policy Plan Map Amended. The Comprehensive Land Use Policy Plan Map of the City of Tukwila, as adopted by Ordinance No. 1039, is hereby amended by changing the designation of that certain real property commonly known as the Metro Park and Ride Lot, located on the northeast corner of Interurban Avenue South and 52nd Avenue South in the City of Tukwila to extend the commercial designation on the site to cover the entire paved area of the Metro Park and Ride Lot and to retain a designation of low density residential for the remainder of the site, all as shown on the map attached hereto as Exhibit A and incorporated herein by this reference as if fully set forth. Section 2. Zoning Map Amended. The Official Zoning Map of the City of Tukwila adopted pursuant to Section 18.08.030 of the Tukwila Municipal Code is hereby amended to establish zoning classifications of C -2 and R -1 -12.0 for the Metro Park and Ride Lot as shown on the map attached hereto as Exhibit H and incorporated herein by this reference as if fully set forth. Section 3. Duties of Planning Director. The Planning Director is hereby directed to make the necessary changes to the Comprehensive Land Use Policy Plan Map and the Official Zoning Map authorized in this ordinance. Section 4. Effective Date. This ordinance shall take effect and be in full force five (5) days after publication of the attached summary which is hereby approved. Re: Metro Park & Ride Lot As you know, at last Monday night's City Council meeting, the Council decided to adopt the staff recommendation on the Metro Park & Ride Lot and requested that appropriate documents be prepared to carry that recommendation into effect. Enclosed is one copy of an ordinance which would accomplish this purpose. As you will note, this ordinance differs from the one which was put before the Council on May 4 in that it retains a mixture of commerical /low density - `residential for a Comprehensive Plan designation and establishes zoning on the site of C -2 and R -1- 12.0. My recollection is that the City Council wanted this matter brought back before it at its next regular meeting i.e., on May 18, 1987. By copy of this letter, I am sending the original of the ordinance, together with an ordinance summary, to Maxine for placement on the City Council's agenda for May 18. Property Area: The rezone area is 3.6 acres. The area to be redesignated on the Comprehensive Plan Map is approximately 2.75 acres. 2. Existing Development: The rezone property includes Metro's Park and Ride lot as well as vacant surplus property owned by Metro. 3. Terrain: The actual Park and Ride facility which fronts along Interurban Avenue has been graded and paved. The unused back portion of the property slopes steeply up to the I -5 right -of -way. The steepest point is a 42% slope (Attachment A). 4. Surrounding Land Use: Surrounding uses include gas station /convenience store, single - family residences, furniture store, golf course and club house. The undeveloped I -5 right -of -way lies to the north. 5. Access: There is access along Interurban Avenue and 52nd Avenue South. A relatively unimproved route, 52nd Place South extends nearly to the edge of the unimproved portion of the property which Metro may surplus in the future. BACKGROUND The area was annexed to Tukwila in the summer of 1986 bringing the entire Park and Ride facility under Tukwila's jurisdiction. Previously, the property had been split between Tukwila and King County. The annexation ensured that the property would receive consistent emergency services. This staff report will first address the Comprehensive Plan Map Amendment and then the Rezone. COMPREHENSIVE PLAN AMENDMENT DECISION CRITERIA The applicable Comprehensive Plan Amendment criteria are listed below in bold, followed by pertinent findings of fact. A Comprehensive Plan Amendment is justified and proper when: 1. There is an error in the factual basis of the Plan. The proposed Comprehensive Plan Map amendment will extend the commercial area along Interurban Avenue South to include the Park and Ride facility. Presently the Comprehensive Plan Map shows the commercial area following specific property lines. The "Commercial" area currently covers a portion .iF "n:., .. -m... •. 3. ... _..u.. al$ .a...,..�.,..yva:^ .., 87 -1- CPA /87 -3 -R: Park and Ride Comprehensive Plan Map Amendment and Rezone Page 3 of the developed Park and Ride, as well as the neighboring gas station/ - convenience store. The remainder of the developed Park and Ride is designated "Low Density Residential ", as is the vacant portion of Metro's property (Attachment B). The Park and Ride was constructed prior to the entire property's annexation to Tukwila. As a result of the annexation, the Comprehensive Plan Map designation needs to be revised to show "commercial" for the improved Park and Ride lot, and "Low Density Residential" for the vacant area (Attach- ment C). 2. There is an unforeseen change in circumstances from the point at which the Plan was adopted. A Comprehensive Plan change is needed to reflect the construction and sub- sequent annexation of the Park and Ride facility. Construction of the Park and Ride lot began when part of the property was in King County and the remainder in Tukwila. The facility's construction and annexation was not foreseen at the time of the Comprehensive Plan adoption. Amending the Comprehensive Plan to show "Commercial" for the paved Park and Ride and "Low Density Residential" for the vacant portion will make the Comprehensive Plan consistent with the change in circumstances. 3. There is some unforeseen and demonstrated public need. Applicable Comprehensive Plan Policies: Transit Policy 1. Coordinate with Metro for the best and most useful transit service for local citizens within the Planning Area. Policy 2. Support efforts to increase transit use. Policy 4. Promote freeway transit stops in conjunction with local park and ride lots. The Park and Ride annexation accomplished for municipal purposes, and the facility construction comply with Comprehensive Plan policies for improved transit service. This should be reflected in the Comprehensive Plan Map by extending the "Commercial" designation to include the entire improved area, and leaving the undeveloped sloped portion of the Metro property as "Low - density Residential ". CONCLUSIONS 1. Extending the commercial designation to include the paved Park and Ride lot is consistent with existing land use and the Comprehensive Plan Policies. 2. Retaining low- density residential on the unpaved remainder of the property is consistent with the intent of the Comprehensive Land Use Plan by conform- ing with topography, surrounding land use, and limited available access. v 87 -1- CPA /87 -3 -R: Park and Ride Comprehensive Plan Map Amendment and Rezone Page 4 RECOMMENDATION Based on the Findings and Conclusions, the staff recommends that the Planning Commission approve the Comprehensive Plan Map amendment. REZONE DECISION CRITERIA Tukwila Municipal Code (TMC) 18.84.030 Criteria for Granting Zoning Map Reclas- sifications are listed below in bold, followed by pertinent findings of fact. The Planning Commission and City Council shall be guided by the following cri- teria in granting reclassification requests to the zoning map of this title: 1. The use or change in zoning requested shall be in conformity with the adopted land use policy plan, the provisions of this title, and the public interest. As noted in the Comprehensive Plan discussion, the amendment to the Com- prehensive Land Use Plan Map is needed to bring the Comprehensive Plan designations and rezone into conformity. The proposed C -2 and R -1.20 zoning classifications will be consistent with the Comprehensive Plan "Commercial" and "Low- density" residential designations. 2. The use of change in zoning requested in the zoning map or this title for the establishment of commercial, industrial or residential use shall be supported by an architectural site plan showing the proposed development and its relationship to surrounding areas as set forth in the application form. The Park and Ride site plan is shown as Attachment A. The site plan shows clearly that the flat, paved area of the property is located at the front of the property and is used for the Park and Ride lot. The undeveloped sloped (and less accessible) part of the property lies to the rear. 3. When the request is not in agreement with the Comprehensive Land Use Policy Plan, the applicant shall provide evidence to the City Council's satisfac- tion that there is an additional need for the requested classification. The proposed rezone will only be consistent with the Comprehensive Plan if the above Comprehensive Plan amendment application is approved. The rezone will be in the public interest to the extent that it is in conformance with the Comprehensive Plan. 2. A site plan with property boundaries and improvements has been shown on Attachment A. 3. The proposed C -2 and R -1.20 zoning designations comply with the amended Comprehensive Plan Map. Tukwila, commented that the area of the rezone located between the railroad tracks is being considered for mass - transit and this information may be of some consideration in making a zoning designation for this area. Ms. Fox briefly reviewed the proposal recommending that this request be approved. Discussion ensued on the proposal. Mr. Knudson questioned the advisability of having two different zoning designations on one piece of property. Mr. Larry Ellington, 821 2nd Avenue, Seattle, representing METRO, clarified the request. Mr. Lawrence Hopper, 5105 S. 136th Place felt development of the sloped portion of the property may create a cliff, resulting in a slide or create a dangerous situation for children in the area. Louise Strander, P.O. KIRSOP SECONDED A MOTION TO DESIGNATE C -2 ZONING FOR THE ENTIRE PROPERTY, AND ACCEPT THE STAFF'S FINDINGS AND CONCLUSIONS WITH THE EXCEPTION OF CONCLUSION #2. THE MOTION PASSED WITH LARSON, KNUDSON, HAGGERTON, AND KIRSOP VOTING YES AND MR. SOWINSKI VOTING NO. 87- 1 -SPE: NORMED Request for approval for the location of a freestanding sign. Mr. Jack Pace, staff representative, briefly reviewed the request. MR. KNUDSON MOVED AND MR. HAGGERTON SECONDED A MOTION TO APPROVE THE STAFF'S FINDINGS AND CONCLUSIONS AND APPROVE THE REQUEST FOR A SHARED DIRECTIONAL SIGN WITH THE FOLLOWING CONDITIONS: 1. The sign be redesigned with a masonry base. 2. The existing landscaping be modified in conjunction with the shared directional sign. 3. The shared directional sign location be moved to the right of the vision clearance line as shown on Attachment B. MR. SOWINSKI AMENDED THE MOTION TO INCLUDE, THE DIMENSION OF SIGN SHALL BE CONSISTENT WITH ATTACHMENT "C ". MR. KIRSOP SECONDED THE AMENDMENT. THE AMENDMENT PASSED UNANIMOUSLY. A VOTE WAS TAKEN, AND THE AMENDED MOTION PASSED UNANIMOUSLY. DIRECTOR'S REPORT Mr. Pace informed the Commission of the status of the Tukwila Pond development. He also noted the status on Fire District #1 Annexation, the Sign Code revision process, as well as other issues which will be coming before the Commission in the future.
