REAL PROPERTY FOR STREET PURPOSE
HODGSON-SHEEHAN VENTURE, a joint venture composed of
two venturers, (i) CALIFORNIA VENTURE COMPANY, a Washington
general partnership, the partners of which are ROBERT J.
SHEEHAN and PAULINE L. SHEEHAN, husband and wife, PAUL E.
SHEEHAN and VERLEN P. SHEEHAN, husband and wife and (ii)
EDGAR J. HODGSON and MAUDE B. HODGSON, husband and wife,
being the Owner ( "Owner ") in fee simple of the land des-
cribed in the Short Plat ( "this Short Plat ") to which this
Dedication is attached, made a part of and incorporated by
the reference therein, DOES HEREBY FOREVER DEDICATE to the
use of the public for the purpose of a street, more parti-
cularly an extension in width of the existing South 134th
Street of the City of Tukwila, Washington, the following des-
cribed portion of the land described in this Short Plat:
The southwesterly fifteen (15) feet of Lot 4,
City of Tukwila Short Plat No. 81- 39 -SS, recorded
under King County Recording No. 8204280545, adja-
cent to and measured northerly along South 134th
Street of the City of Tukwila a distance of 220.0
feet from the southeasterly boundary of said Lot
4.
This Dedication is made with the understanding of the
Owner that:
1. In the event such extension in width of South
134th Street should be ordered by the City of Tukwila pur-
suant to the creation of a local improvement district, then
the determination of benefit received and calculation of the
assessment for the real property described in this Short
Plat shall be adjusted to account for the real property
herein dedicated for such extension.
2. In the event such extension should be so ordered,
the Owner shall defend and save harmless the City of Tukwila
as to any loss, damage or delay suffered by the City as a
result of any protest to the formulation of such improvement
district, filed by or on behalf of the then owner of the
real property described in this Short Plat.
3. Nothing herein shall be considered as limiting the
right of the Owner, pursuant to the provisions and proce-
dures of RCW 35.44.080, to object to the amount of the assess-
ment then proposed to be levied against the real property
described in this Short Plat.
4. Nothing herein shall be considered as in any way
limiting the authority of the City of Tukwila to determine
the necessity for public improvements nor the manner or
method of providing the cost of their construction.
5. Should the existing improvements, as displayed on
Lot 2 of the short subdivision made pursuant to this Short
Plat, be razed during the five year period subsequent to the
filing of the Short Plat with the King County Department of
Records and Elections, and should a new improvement there-
after be constructed on said Lot within the same period, the
required front yard set back of the new improvement shall be
the lesser of (i) the distance as measured to the present
location of the southwesterly wall of such existing improve-
ment, or (ii) the distance as measured pursuant to the
front yard set back requirement of the ordinance in effect
at the time of such construction.

Thank you for agreeing upon such short notice to meet with me this afternoon between 31:00 p.m.
and 3:30 p.m.
I represent California Avenue Company, a Washington general partnership, which presently is
. vested with the fee simple title to Lots 1 and 3 of the three lots included within the 1egd1 description for
. City of Tukwila Short Plat No. 87 -4 -SS. Herewith please find a copy of that Short Plat as approved by
the City on April 21, 1988 and as recorded on April 27, 1988 (just 2 days over 10 years ago!)
Lot 2 of the three Lots is owned by Pacific Northwest Ironworkers and Employers Apprenticeship
& Training Trust. My client is selling Lot 3 to Pacific Northwest Ironworkers. The sale is scheduled to
close tomorrow, April 30, 1998.
When the subject short plat was cleared, the private access easement (referred to in the last 2 •
paragraphs of the Short Plat page 3) was necessary because Lot 3 otherwise would have been landlocked.
With the purchase of Lot 3 by the Pacific Northwest Ironworkers, that will not be the case. The •
purchaser will then own both Lots 2 and 3 and, therefore access will be available via Lot 2.
Both my client and Pacific Northwest Ironworkers desire to delete the private access easement.
My 'question to you is whether or not this may be accomplished by private agreement of the parties, 1
through duly recorded, or must we clear the prospective agreement through the City of Tukwila? •

I regret troubling you over this matter. In one sense,
my clients are no longer directly involved. At the same
time, they are indirectly interested in light of a recent
offer made for the acquiring of the 10 -foot strip within Lot
3 but adjacent to Lot 2 of the above recorded Short Plat.
Of course, the conveyance of such a strip is contingent upon
a boundary line adjustment. This recently was discussed by
the Sheehans with Ms. Bradshaw.
The inquiry concerns the 15 -foot strip, which, by the
Short Plat filing, was intended to be dedicated for street
purposes. A written dedication was included with the appli-
cation as originally filed on December 4, 1987. It was not
included with the Short Plat as recorded with the King County
Recording Office on April 27, 1988.
You will note that page two of the original filing was
utilized for the recorded set. That page included a reference
to the "attached dedication" and expressly was "made a part
hereof and incoporated herein by this reference ".
I suspect that it simply was inadvertently left out of
the final filing.
I suppose there are at least two or three alternatives
available. One would be to file an "amended" version of the
April 27, 1988 filing, nevertheless including the missing
page.
Another approach would be to ignore the filing but at
the same time provide the present owners of Lot 2 with the

benefit of the setback provision found at paragraph 5 of the
dedication page. That paragraph was intended to allow for
placing a new building at a distance no farther away from
South 134th than the structure existing at the time of the
recording of the Short Plat.
As you have suggested, it may well be that setback is
not a concern of the owners Lot 2. They indeed may be more
interested in having more room for their parking.
The City may also want the page recorded to display
more particularly what was contemplated by the designation
on the survey map.
From the point of view of my clients, the inclusion of
the dedication page and the option of the present owners to
utilize paragraph 5 of that page, possibly would eliminate
the need of the new owners to acquire the proposed 10 -foot
strip. While my clients are willing to accommodate the
existing owners of Lot 2, they nevertheless would prefer to
retain the footage.
1 will be happy for your thoughts when you have the

Attached please find the revised legal description for your short plat. It
has been reviewed by the Tukwila Public Works Department which can approve
the technical nature of the legal description. However, the legal should
be accompanied by a drawing. Once the drawing has been received, Public
Works can approve the accuracy and extent of both the description and
sketch. King County quarter - section maps are not an adequate center of
reference for this.
Once the Public Works Department has approved your drawing with the legal
description, the City of Tukwila can give final approval to the short plat
and it can be recorded with King County. I will telephone you to let you
know when the drawing and legal description have been approved.
In order to expedite this process, please also send me the recording fees
at the same time that you send the drawing for review. Upon City of Tuk-
wila approval of both drawing and legal description, the boundary line
adjustment will be recorded with the King County Department of Records and
Elections. The cost of recordation is a basic $26 fee plus $5 for the
first page and $1 for each subsequent page (including drawing). You are
required to submit to the City of Tukwila a check made out to the "King
County Recorder" for the appropriate amount. The Tukwila City Clerk will

Mr. Paul E. Sheehan, the President of Farwest Paint Manufacturing
Co. I hope that the enclosures will be a large step forward in
finalizing the matter.
I am enclosing copies of a proposed Grant of Right of Access
and of the proposed page of the application which will reflect
the legal descriptions both before and after the short subdivision.
The Grant of Right of Access is to add an extra 10 feet
of the vacated South 133rd to the 30 feet which by law attached
to the property to the south of the street and owned by the
Hodgson - Sheehan Venture, the applicant for the short subdivision.
The California Avenue Company, a partnership composed of Mr. and
Mrs. Robert J. Sheehan and of Mr.: and Mrs. Paul E. Sheehan, is
the owner of the 10 feet.
Please review this instrument and also please run it by
your engineering department. I believe that it is properly
drafted, but of course I'll be glad for any suggestions you or
the department may have.
That 10 feet becomes a part of the new legal description,
• thus including the right of access as a part of the property
being subdivided. It is reflected as the last item of the new
legal.

foot strip is made subject to a like right of access as that
provided by the Grant of Right of Access. Thus, there is a
combined 40 foot right of access, the minimum required by
Section 17.28.050 of the Subdivision Code, dealing with
"private access roads."
The right of access as to the 30 foot strip presented
an interesting question or two. Normally, an owner of real
property cannot create an easement for himself in the property
owned by him. There is, in effect, a merger of the fee interest
and the intended easement interest. Thus, it would not be
useful to prepare a separate instrument, similar to the that
of the Grant of Right of Access as to the 10 foot strip, run-
ning from the Venture to itself.
The problem I assume is solved by including the 30 foot
right of access as a charge to the 30 foot strip, both in the
same description included with the short division application.
Again, I will be happy for your thoughts and that of your
engineering department.
On hearing from you, I will make any requested change
and then arrange for signing of the instruments and other
documents involved. Then on delivery to you, we hopefully
will be on the way "home".

The condition for final approval of the referenced short plats
removed the requirement for dedication of right -of -way for a street
from 51st Avenue South to the Tukwila city limits at South 166th
Street. A cul -de -sac is included on a 300 foot street extension
to serve eight lots with the possibility of two more lots using
that road.
The City Engineer will not recommend issuance of curb cut permit
to allow the cul -de -sac street access to South 166th Street in
Tukwila. We had requested that the County require a through
street and still feel that is a valid requirement for access to
those properties. Also, the design of the drainage system will
require that catch basins be located so that surface water from
the new street does not enter the City on the street surface.
The City requests a review of the conditions for final approval of
the subject plats and a new determination of the conditions for
final approval.

Prior to formalizing the application for the short plat
at the Farwest plant site, I would like you to review two or
three of the pages which are planned for inclusion with the
application.
The primary concern is that of the form of the
dedication of the fifteen foot strip for furture widening of
South 134th Street. I have planned the Dedication as a
separate attachment and have incorporated it as a part of
the Declaration at page 2 of the application for the short
subdivision. Please note the contemplated asterisk
additions to that page.
At this time, the fifteen foot strip is not shown on
the surveyer's sketch on page three of the application. If
necessary that could be added to the sketch but necessarily
would have to carry a reference to the page on which the
dedication is made.
The first four numbered paragraphs of the Dedication
could be eliminated if we can be assured that a future
street widening project will be at the sole expense of the
City and not a subject of a local improvement district.
The fifth numbered paragraph of the Dedication is for
the purpose of assuring the owners of the prospective Lot 2

that for a reasonable time, which we deem at least five
years, they would be able to raze the existing improvement
and construct a new one with no less advantageous set back
line than that where the existing building now is situated.
I perhaps should add that Mr. Hanken, the attorney for
one of the venturers, Mr. and Mrs. Hodgson, has not had an
opportunity to review the enclosures with care. I must
therefore reserve for him the right to question what I have
prepared.

First of all, let me thank you for your courtesy and
assistance in the course of two or three phone calls made
during the past week or so. It has been most helpful to me.
I also now accept your suggestion of having the several
representatives of the pertinent departments review the
forthcoming Short Plat Application. We naturally are
anxious to have the actual application go through with a
minimum of difficulty. The suggestions of the department
representatives will be very helpful in that regard.
I now am providing you with a copy of the survey which
is anticipated to be included with the Short Plat
Application. You also will find an excerpt from the King
County Assessor's map for the subject area.
The existing Short Plat consists of two parcels, "A"
and "B ". Parcel "A" consists of the three tracts that are
numbered 1, 2 and 3 on the survey sketch. Parcel "B" is so
identified on the sketch and also has the reference of
"Adjustment No. 84- 35BLA, K.C. Rec. No. 8501240853."
The Hodgson - Sheehan venture has the ownership of the
existing parcel "A" and intends to short plat that parcel
into the further three tracts numbered 1, 2 and 3.
The City of Tukwila records will display that
Hodgson- Sheehan venture, through the effort of Farwest Paint
Manufacturing Co., recently constructed a building on the
proposed tract 1. I have displayed that (in rough) on the

Assessor's map and I feel confident that the set back and
other requirements for the placement of this building are
fully in compliance with the Tukwila Ordinances.
I suspect that the obvious access of proposed tracts 1
and 2 to South 134th Street will fully satisfy the
requirements of Section 17.08.070, entitled "Required
Improvements," of the Subdivision Code of the City.
Proposed tract 3 requires a bit more care in assuring
compliance with that Section.
Referring to the excerpt from the Assessor's map, I can
acurately advise you that the 200' x 60' strip to the
northwest of proposed tract 1 (lying southeasterly of the
tract upon which the older Farwest building is located) is
owned by California Avenue Co., a partnership of Messrs.
Robert and Paul Sheehan, the principals of Farwest, and
their wives.
Farwest has been using, and continues to use, the
easterly and westerly extensions of the 200' strip for the
uses and purposes of the Farwest enterprise.
In satisfaction of Section 17.08.070 as to proposed
tract 3, California Avenue Co. would be quite willing to
execute a perpetual easement over and across the 200' strip
for the various improvements identified at paragraph 1 of
that Section. The easement of course would be for the
benefit of tract 3. We assume that such an easement,
together with the presumed availability of the easterly and
westerly extensions of that 200' strip for like
improvements, will satisfy the requisites of the Section.
Assuming your committee will be in agreement with what
we have above suggested, then we would only need their
thoughts and recommendations in possible limitation of the
drafted grant of easement.
California Avenue Co. would intend on providing the
full 60' width of the 200' strip (excepting the area of the
new building extension thereon) for the purpose of vehicular
ingress and egress to tract 3. While perhaps not absolutely
necessary, it would be nice if we could restrict, within the
200' strip, the location and width of the easements for
water, sewage, etc. I would appreciate the suggestions of
your committee in that regard.

DEDICATION OF PORTION OF SHORT PLAT
REAL PROPERTY FOR STREET PURPOSE
HODGSON - SHEEHAN VENTURE,. a joint venture composed of
two venturers, (i) CALIFORNIA VENTURE COMPANY, a Washington
general partnership, the partners of which are ROBERT J.
SHEEHAN and PAULINE L. SHEEHAN, husband and wife, PAUL E.
SHEEHAN and VERLEN P. SHEEHAN, husband and wife and (ii)
EDGAR J. HODGSON and MAUDE B. HODGSON, husband and wife,
being the Owner ( "Owner ") in fee simple of the land des-
cribed in the Short Plat ( "this Short Plat ") to which this
Dedication is attached, made a part of and incorporated by
the reference therein, DOES HEREBY FOREVER DEDICATE to the
use of the public for the purpose of a street, more parti-
cularly an extension in width of the existing South 134th
Street of the City of Tukwila, Washington, the following des-
cribed portion of the land described in this Short Plat:
The southwesterly fifteen (15) feet of Lot 4,
City of Tukwila Short Plat No. 81- 39 -SS, recorded
under King County Recording No. 8204280545, adja-
cent to and measured northerly along South 134th
Street of the City of Tukwila a distance of 220.0
feet from the southeasterly boundary of said Lot
4.
This Dedication is made with the understanding of the
Owner that:
1. In the event such extension in width of South
134th Street should be ordered by the City of Tukwila pur-
suant to the creation of a local improvement district, then
the determination of benefit received and calculation of the
assessment for the real property described in this Short
Plat shall be adjusted to account for the real property
herein dedicated for such extension.
2. In the event such extension should be so ordered,
the Owner shall defend and save harmless the City of Tukwila
as to any loss, damage or delay suffered by the City as a
result of any protest to the formulation of such improvement
district, filed by or on behalf of the then owner of the
real property described in this Short Plat.
3. Nothing herein shall be considered as limiting the
right of the Owner, pursuant to the provisions and proce-
dures of RCW 35.44.080, to object to the amount of the 'assess-
ment then proposed to be levied against the real property
described in this Short Plat.
4. Nothing herein shall be considered as in any way
limiting the authority of the City of Tukwila to determine
the necessity for public improvements nor the manner or
method of providing the cost of their construction.
5. Should the existing improvements, as displayed on
Lot 2 of the short subdivision made pursuant to this Short
Plat, be razed during the five year period subsequent to the
filing of the Short Plat with the King County Department of
Records and Elections, and should a new improvement there-
after be constructed on said Lot within the same period, the
required front yard set back of the new improvement shall be
the lesser of (i) the distance as measured to the present
location of the southwesterly wall of such existing improve-
ment, or (ii) the distance as measured pursuant to the
front yard set back requirement of the ordinance in effect
at the time of such construction.
