blasting within 300 feet of Grantee's facilities without Grantee's

7. Relocation of Easement. The grant of this Easement is

In order to facilitate future development or use of the subject
or adjoining properties by Grantor, its successors or assigns, the
Grantor, and its successors and assigns retain the right to have all
or any parts of the above - described right -of -way parcels, and any of
Grantee's improvements thereon, relocated at any time as follows:
A. Grantor, or its successors or assigns shall first
notify the Grantee of the requested relocation by the
mailing of notice to the Grantee, at its last known
address.
D . Within ninety (90) days of such notice, Grantee
• rees to relocate said easement and improvements
thereon to the new location, and to restore the old
easement location to its original condition, all at
Grantor's sole cost and expense.
S. Release of Property from Easement. Grantee agrees that at any
time it is requested by Grantor, its heirs, successors or assigns,
Grantee will, within sixty (60) days execute a release and termination
of this Easement from any portion of the property described in Exhibit
"A" which is not occupied by the right -of -way or Grantees facilities;
and Grantee additionally agrees that at any time it is requested by
Grantee, its heirs, successors or assigns, It will take from Grantor
a specific easement specifically describing the right -of -way on any
parcel of the property described on Exhibit "A ", and release and
terminate that parcel from this Easement.
9. Agreement by Grantee. It is understood and agreed that by
installing any or its facilities in the right -of -way or by exercising
any of its rights hereunder, Grantee accepts each h a and every term and
bound of this Easement and agrees to be by same.
10. Successors and Asians. The rights and obligations of the

herein as "Segale") mutually agree as follows:
BACKGROUND AND PURPOSE OF AGREEMENT
Segale, a married man, is the owner and develor—r
as his separate property of "3egale Business Park lying
south of and adjacent to South 180th Street (being a portion
of Section 35, Township 24 North, Range 4 E.W.11.,
1 . 1 ukwila, King County. Washington), as depicted on drawing
entitled "Segale Business Park Utilities Layout', dated
July 1973, prepared by Meriwether-Leaciman Associate.;,
which drawing is attached hereto as Exhibit ° A . and in-
corporated Js part of this agreement. The location of
Street Nei" as shown on said drawing, is established (sev-
eral. industries have been constructed or are now in the
orocess of construction aljacent thereto). South 180th
Street and Southcentcr Parkway are existing public roads
which lie along the perimeter of the business park. The
locations of other streets within the buriness park. is
shown on said drawing. are approximations only, and are

temporary 8 -inch water line has been installed by Segnlc•
on "A" Street as an interim measure pending replacement a;•
a permanent 12 -inch line. See Exhibits "d -1" and "d -2"
attached hereto and made a part hereof. The purpose of
this agreement is to set forth the conditions under
which the District will provide water service to Seg i:e
Eusiness Park and industries becoming situated therein.
TERMS OF AGREEMENT.
1. District will endeavor to obtain funding
from the Economic Dev:lopnent Administration (EDA) for the
installation of a permanent facility to serve the wa *er
needs of said business park, said permanent installation
to be constructed in accordance with the District's stan-
dards then obtaining. Serale will assist District, as re-
quired, in connection with the application for said grant
and any hearing scheduled in connection therewith, and
District will keep Segal. advised'as to its progress to-
ward obtaining said funding.
2. If and when said funding is received from
the EDA. District will utilise said funds for thn instal -

ror the installation of a parturient water facility on other
streets within Segalo Business. Park, as depicted on Exhibit
"A" hereto. See Exhibits "0-1" and ".1-2" attached hereto.
Segalo will pay the full cost of said permanent installation
of watermains within Segalo Duniness Park to the extant
FAA funds appropriated therefore are insufficient. Fed -
eral funds may be sufficidnt to cover the cost of bring-
ing the water to the property (i.e., • 16 -inch main run-
ning approximately South 194th Street and 56th Avenue
South to an easement which is approximately 186th Street
South, and involving a co.nection at South 194th Street
to an existing 18 -inch main of the District). If fcleral
funds are not granted, Segale at his election shall do
ono of the following:
A. Connect to the Tukwila main at South 180th
Street, adjacent to his property. but he shall be re-
4uired to pay for bringing water from that point to his
;property and for the connection to the Tukwila line (at
South 180th Street).
B. Connect with existing 8-inch line at South -
center Parkway at South 1G4th Street and permit eith• r

C. Install a line from the District main at
about 193rd Street to Sogale Business Park. A 16 -inch
line will be required for this purpose.
Segale shall have at his option, the right of
doing either of the options listed Above, "A' through "C ",
by forming a Utility Local improvement District (per
.(CW 57.16.060 et seq) as to part or all of the Develop-
ment, whether within or without the Industrial Park. The
additional cost for lines exceeding 12 inches which are
required by the'District, shall be the sole responsibility
of the District.
3.In the event of no Federal funding, Segale,
in addition to the obligations set forth herein, shall pay
for the full cost of the installation of 12 -inch water
,lines (permanent) within the Segal. Business larks or an
;alternative option availa'Xe is, that Segale shall have the
'right to petition to form a Utility Local Improvement
aistrict (per RCW 57.16.0:.0 et seq.) within the Park,
to pay for the full cost of the installation of 12 -inch
water lines (permanent)within the Segal. Business Park.
The additional cost for l :nes exceeding 12 inches within
the Sogale Business Park rhall be the sole responsibility
of the District. The installation described in this para-

S. Segale shall pay for • 10 -inch motor, unless

when permanent 12 -inch mains are constructed (in their
initial phase), or sooner if the District needs or re-

being used by Segale.
9. The furnishi:g of water to the temporary
line(s) along !A" Street which is (are) presently connected
to the Tukwila system, shall be limited to the period
ending August 31, 1974, unless such period is extended
by the City of Tukwila. The furnishing of water either
through temporary or permanent mains is conditioned among
other things upon Segale's performing all of the terms
required of him by this ec,reement. Water service shall
be at going rates.
10. This agreement shall inure as to its bene-
fits and burdens to the parties hereto and their respective

shall be recorded in order to put prospective or future
purchasers of the Segale property on notice of their
rights and obligations.
