The boundaries in relation to the subject project are fairly clear on the above permit, if you would like to check you file copy. The current discussion involves a repair because the train trestle crossing the Black River on which the Sprint line was located burned. I do not believe the repair is exempted via WAC 173 -14 -040 because they are proposing to relocate the line to another crossing, either via an existing METRO pipeline crossing (see Alternative 2) or buried in a straight line following its current direction (see Alternative 1). Utilities are a permitted use in the low- and high- impact environments of the Green River under Tukwila's Shoreline Program. Tukwila does not however iden- tify the Black River in its Shoreline Program and therefore we do not have regulations for the subject area. I do not know why this is the case. 1 have told the applicant he needs to contact the City of Renton for the south half of their project. U.S. Spring apparently does not have a shoreline permit with Renton. Since Tukwila's program does not cover the Black River, my thought is that we do not have regulatory authority over the subject revision. However, because it is part of a project /permit which is issued, I would like to issue one. I called Jeanette McKague of Renton Building and Zoning. She informed me that the north shore is designated "natural" and the south shore is "urban" of the Black River. The north shore in this area is however in Tukwila. Please call me with your thoughts and questions. I have not heard from any tribes at this time. Water Quality We recommend that precautions and appropriate mitigation measures should be taken in order to minimize adverse environment impacts on the Green River and its associated wetlands. If yes, explain. This project is part of a 23,000 -mile nationwide telecommunication network being constructed by U.S. Sprint. Construction of the net- work is scheduled for completion within 2 to 3 years. 8. Field surveys, reviews of existing literature, and contacts with government agencies have been conducted to obtain environmental information for the proposed project. Cultural resources specialists performed an assessment of the Washington State alignment and repeater stations for the U.S. Sprint Fiber Optic Cable project. The work was undertaken in consultation with staff of the State Office of Archeology and Historic Preserva- tion (OAHP) as well as representatives of several Indian Tribes. In additon to consultations, the assessment included a search of records on known cultural resources sites, a review of listings in the National Register of Historic Places, and a vehicular reconnaissance and on -foot survey of the project alignment. The work resulted in a report entitled, "Cultural Resources Survey for the U.S. Sprint Fiber Optic Cable Project, Eugene, Oregon to Seattle, Washington" (Heritage Research Associates, April 1987). This report, which includes an appendix containing confidential site forms and maps, has been filed with OAHP. Addendum reports on surveys of project reroutes also have been prepared and filed at OAHP. 9. The purpose of this project is to make available a high quality long distance voice and data communication transmission system to the Pacific Northwest. Fiber optics utilizes laser technology and digi- tal transmission. Project construction will utilize plowing, trenching, boring, and bridge attachment. A crawler will be used for direct burial of a 3/4- inch diameter fiber optic cable or a 3/4 inch fiber optic cable encased within a 1 -3/4 inch diameter plowable conduit. A backhoe or trencher will excavate a 1 -foot wide trench for placement of the cable or encasement of the cable in either a 2 -inch diameter PVC con- duit or a 2 -inch diameter PVC conduit encased in 3 -1/2 Bag pea gravel mix or both. The boring process for fiber optic cable placement involves boring machine installation of a 4 -inch diameter Black iron pipe to contain a PVC conduit which encases the 3/4 inch fiber optic cable. The shoreline management area crossings involved within the subject permits will be made by encasing the 3/4 inch fiber optic cable inside a 4 -inch diameter galvanized iron pipe and attaching to existing bridges. Post - construction contours will match in -situ contours. When required by the governing body, extracted materials will be disposed of in an area designated by the governing body. Replacement fill, when required by the governing body, will be of a type and from a source designated and /or approved by the governing body. See Table 1. See Table 2. ` . 12. Location of the proposal. Give sufficient information for a person to understand the precise location of your proposed project, including a street address, if any, and section, township, and range, if known. Air There is a slight chance of construction - related erosion occurring at the Duwamish River crossing (MP 11.8). The cable route lies along a railroad bed with an adjacent shoulder slope of approximately 45 percent. The grade at the other site is relatively flat and therefore not susceptible to erosion. g. About what percent of the site will be covered with impervious surfaces after project con- struction (for example, asphalt or buildings)? Not applicable. h. Proposed measures to reduce or control erosion, or other impacts to the earth, if any: Construction techniques will be used that minimize the amount of disturbance of the adjacent roadbeds and railroad beds and thus reduce the chance of construction related erosion. a. What types of emissions to the air would result from the proposal (i.e., dust, automobile odors, industrial wood smoke) during construc- tion and when the project is completed? If any, generally describe and give approximate quantities if known. Project construction will result in short - term, temporary emissions from gas- and diesel- powered construction equipment. Short -term, temporary increases in airborne dust will also occur during project construc- tion. The project will not create emissions or odor once construction has been completed. b. Opportunities for swimming and boating exist at these loca- tions as well. b. Would the proposed project displace any exist- ing recreational uses? If so, describe. None. c. Proposed measures to reduce or control impacts on recreation, including recreation opportun- ities to be provided by the project or appli- cant, if any: No significant impacts are anticipated, therefore no mitigation is required. Results of the assessment in King County indicate that most of the cable route follows a railroad right - of-way where previous dis- turbance has resulted in a very low probabi- lity of intact cultural deposits. The Burlington Northern and Union Pacific (former Milwaukee Road) railroad lines are located immediately adjacent to the crossings at MP 11.8 and 12.0. f. SUPPLEMENTAL SHEET FOR ALL PROJECT AND NON PROJECT PROPOSALS The objectives and the alternative means of reaching the objectives for a proposal will be helpful in reviewing the aforegoing items of the Environmental Checklist. This infor- mation provides a general overall perspective of the proposed action in the context of the environmental information provided and the submitted plans, documents, supportive infor- mation, studies, etc. 1) What are the objective(s) of the proposal? The purpose of the U.S. Sprint Fiber Optic Cable Project is to make available a high - quality long distance voice and data com- munication transmission system to the Pacific Northwest. Fiber optics utilizes laser tech- nology and digital transmission. 2) What are the alternative means of accom- plishing these objectives? Alternatives to the proposed project include No Action, routing the cable along alternate existing road /utility rights -of -way, and routing the cable outside of existing road/ utility rights -of -way. 3) Please compare the alternative means and indicate the preferred course of action: If no action were taken, U.S. Sprint would not install its fiber optic cable and ancillary facilities in this area of the Pacific Northwest. While the no- action alternative would preclude environmental impacts associated with project construction, it would prevent U.S. Sprint from completing its telecommunications network. Use of an alternative existing right-of-way such as Interstate 5 is not feasible because the Federal Highway Administration prohibits longitudinal encroachment in the rights -of -way or median strips of federal highways. Use of Evaluation for Agency Use Only other existing rights -of -way could be con- sidered by U.S. Sprint, but could add signi- ficantly to environmental impacts and /or costs of project completion. Routing alternatives outside of existing road/ utility rights-of-way were considered imprac- tical. The environmental impacts of such routing would be much greater than those resulting from the use of previously disturbed corridors. Additionally, construction in undisturbed areas would necessitate building or upgrading access. As with the alternative discussed above, an action of this type would add significantly to the environmental impacts and costs of project completion. It was determined that the only practical alternative was to route the proposed cable along existing transportation and utility corridors to minimize environmental effects of project construction. U.S. Sprint's preferred route, which follows existing road, railroad, and utility rights -of - way, accomplishes this objective. 4) Does the proposal conflict with policies of the Tukwila Comprehensive Land Use Policy Plan? The right, privilege, authoity and franchise to construct, operate, maintain, replace and remove such communication equipment as may, from time to time, be required consisting of underground cables, wires, conduits, manholes, drains, splicing boxes, surface location markers and other facilities for similar uses, in, upon, over, under, along, across and through the franchise area for the purpose of operating as a carrier of long distance telecommunications traffic. Definitions. 1.1 Where used in this franchise (the "Franchise "), the following terms shall mean: 1.1.1 US Sprint means US Sprint Communications Company, a New York general partnership, and its respective successors and assigns. 1 . 1 .2 "City" means the City of Tu. iln a municipal corporation of the State of m m ou ng t ma. and its respective successors and assigns. 1.1.3 "Franchise Area" means: any, every and all of the roads, streets, avenues, alleys, highways, grounds and public places of the City as now laid out, platted, dedicated or improved; and any, every and all roads, streets, avenues, alleys, highways, grounds and public places that may hereafter be laid nut, platted, dedicated or improved within the present limits of the City and as such limits may be hereafter extended. 1.1.4 "Facilities" means poles (with or without crossarms), wires, lines, conduits, cables, communication and signal lines, braces, guys, anchors, vaults and all necessary or convenient facilities and appurtenances thereto, whether the same be located over or under ground. 1.1.5 "Ordinance" means Ordinance No. which sets forth the terms and conditions of this Franchise. Section 2. Facilities within Franchise Area. 2.1 The City does hereby grant to US Sprint the right, privilege, authority and franchise to: 1 2.1.1 Set, erect, bury, construct, support, attach, connect and stretch Facilities between, maintain, repair, replace, operate and use Facilities, in, upon, over, under, along, across and through the Franchise Area for purposes of all operations as may he required to operate as a carrier of long distance telecommunications traffic. Section 3. Noninterference of Facilities. 3.1 US Sprint's Facilities shall be maintained within the Franchise Area so as not to unreasonably interfere with the free passage of traffic and in accordance with the laws of the State of Washington. Whenever it shall he necessary for US Sprint, in the exercise of its rights under this Franchise, to make any excavation in the Franchise Area, US Sprint shall, upon completion of such excavation, restore the surface of the Franchise Area, as nearly as practicable, to the same condition it was in prior to such excavation. Section 4. Relocation of Facilities. 4.1 Whenever any person or entity, other than the City, requires the relocation of US Sprint's Facilities to accommodate the work of such person or entity within the Franchise Area; or, whenever the City requires the relocation of US Sprint's Facilities within the Franchise Area for the benefit of any person or entity other than the City, then US Sprint shall have the right as a condition of such relocation to require such person or entity to: 4.1.1 make payment to US Sprint, at a time and upon terms acceptable to US Sprint, for any and all costs and expenses incurred by US Sprint in the relocation of US Sprint's Facilities; and 4.1.2 indemnify and save US Sprint harmless from any and all claims and demands made against it on account of injury or damage to the person or property of another arising out of or in conjunction with the relocation of US Sprint's Facilities, to the extent such injury or damage is caused by the negligence of the person or entity requesting the relocation of US Sprint's Facilities or the negligence of the agents, servants or employees of the person or entity requesting the relocation of US Sprint's Facilities. 4.2 Whenever the City causes the grading or widening of the Franchise Area (for purposes other than those described in Section 4.1) and such grading or widening requires the relocation of US Sprint's then existing Facilities within the Franchise Area, the City shall: 4.2.1 Provide US Sprint, within a reasonable time prior to the commencement of such grading or widening, written notice requesting such relocation; and 4.2.2 Provide US Sprint with reasonable plans and specifications for such grading or widening. After receipt of such notice and such plans and specifications, US Sprint shall relocate such Facilities within the Franchise Area at no charge to the City. If the City requires the subsequent relocation of any Facilities within five (5) years from the date of relocation of such Facilities pursuant to this Section 4.2, the City shall bear the entire cost of subsequent relocation. 4.3 Any condition or requirement imposed by the City upon any person or entity, other than US Sprint (including, without limitation, any condition or requirement imposed pursuant to any contract or in conjunction with approvals or permits for zoning, landuse, construction or development) which requires the relocation of US Sprint's Facilities shall be a required relocation for purposes of Section 4.1. 2 Nothing in this Section 4 "Relocation of Facilities" shall require US Sprint to bear any cost or expense in connection with the location or relocation of any Facilities then existing under benefit of easement or such other prior rights. Section 5. Indemnification. 5.1 US Sprint shall indemnify and save the City harmless from any and all claims and demands made against it on account of injury or damage to the person or property of another, to the extent such injury or damage is caused by the negligence of US Sprint or its agents, servants or employees in exercising the rights granted US Sprint in this Franchise; provided, however, that in the event any such claim or demand be presented to or filed with the City, the City shall promptly notify US Sprint thereof, and US Sprint shall have the right, at its election and at its sole cost and expense, to settle and compromise such claim or demand, provided further, that in the event any suit or action is begun against the City based upon any such claim or demand, the City shall likewise promptly notify US Sprint thereof, and US Sprint shall have the right, at its election and its sole cost and expense, to settle and compromise such suit or action, or defend the same at its sole cost and expense, by attorneys of its own election. Section 6. Insurance and Indemnity. 6.1 US Sprint shall comply with all regulations of the City regarding insurance and indemnifications for contracts with the City as they may apply. 6.1.1 US Sprint shall expressly agree to indemnify, defend and save the City harmless from all liabilities, claims, demands or expenses on account of or arising out of any injury or loss resulting from the exercise of this permit. 6.1.2 US Sprint shall save the City harmless from any losses, expenses or lost revenues incurred by US Sprint, other than the reasonable cost of repair, as a result of negligent injury or damage to US Sprint's property by the City. Section 7. Default. 7.1 If US Sprint shall fail to comply with the provisions of this Franchise, the City may serve upon US Sprint a written order to so comply within sixty (60) days from the date such order is received by US Sprint. If US Sprint is not in compliance with this Franchise after expiration of said Sixty (60) day period, the City may, by ordinance, declare an immediate forfeiture of this Franchise, provided, however, if any failure to comply with this Franchise by US Sprint cannot be corrected with due diligence within said sixty (60) day period (US Sprint's obligation to comply and to proceed with due diligence heing subject to unavoidable delays and events beyond its control), then the time within which US Sprint may so comply shall he extended for such time as may he reasonably necessary and so long as US Sprint commences promptly and diligently to effect such compliance. Section 8. Nonexclusive Franchise. 8.1 This Franchise is not and shall not be deemed to he an exclusive franchise. This Franchise shall not in any 3 manner prohibit the City from granting other and further franchises over, upon, and along the Franchise Area which do not interfere with US Sprint's rights under this Franchise. This Franchise shall not prohibit or prevent the City from using the Franchise Area or affect the jurisdiction of the City over the same or any part thereof. Section 9. Franchise Term. 9.1 This Franchise is and shall remain in full force and effect for a period of thirty (30) years from and after the affective date of the Ordinance, provided, however, US Sprint shall have no rights under this Franchise nor shall US Sprint be bound by the terms and conditions of this Franchise unless US Sprint shall, within sixty (60) days after the effective date of the Ordinance, file with the City its written acceptance of the Ordinance. Section 10. Assignment. 10.1 US Sprint shall have the right to assign its rights, benefits and privileges in and under this Franchise. Any assignee shall, within thirty (30) days of the date of any assignment, file written notice of the assignment with the City together with its written acceptance of all terms and conditions of this Franchise. Notwithstanding the foregoing, US Sprint shall have the right, without such notice or such written acceptance, to mortgage its rights, benefits and privileges in and under this Franchise to the Trustee for its bondholders. Section 11. Miscellaneous. 11.1 If any term, provision, condition or portion of this Franchise shall be held to be invalid, such invalidity shall not affect the validity of the remaining portions of this Franchise which shall continue in full force and effect. The headings of sections and paragraphs of this Franchise are for convenience of reference only and are not intended to restrict, affect or be of provisions of such sections or paragraphs. 11.2 This Franchise may be amended only by written instrument, signed by both parties, which specifically states that it is an amendment to this franchise and is approved and executed in accordance with the laws of the State of Washington. Without limiting the generality of the foregoing, this Franchise (including, without limitation, Section 5.1 above) shall govern and supersede and shall not be changed, modified, deleted, added to, supplemented or otherwise amended by any permit, approval, license, agreement or other document required by or obtained from the City in conjunction with the exercise (or failure to exercise) by US Sprint of any and all rights, benefits, privileges, obligations or duties in and under this Franchise, unless such permit, approval, license, agreement or other document specifically: 11.2.1 references this Franchise; and 11.2.2 states that it supersedes this Franchise to the extent it contains terms and conditions which change, modify, delete, add to, supplement or otherwise amend the terms and conditions of this Franchise. In the event of any conflict or inconsistency between the provisions of this Franchise and the provisions of any such permit, approval, license, agreement or other document, the provisions of this Franchise shall control. 4 Section 12. U.S. Sprint Communications Company is constructing a fiber optic cable system between Seattle, Washington and Eugene, Oregon. The purpose of this project is to make available a high quality long distance voice and data communication transmission system to the Pacific Northwest. Fiber optics utilizes laser technology and digital transmission. Project construction will utilize plowing, trenching, boring, and bridge attachment. A crawler will be used for direct burial of a 3/4 inch diameter fiber optic cable or a 3/4 inch diameter fiber optic cable encased within a 1 -3/4 inch diameter plowable conduit. A backhoe or trencher will excavate a one foot wide trench for placement of the cable or encasement of the cable in either a 2 inch diameter P.V.C. conduit or a 2 inch diameter P.V.C. conduit encased in a 3 -1/2 Bag pea gravel mix or both. The boring process for fiber optic cable placement involves boring machine installation of a 4 inch diameter Black Iron Pipe to contain a P.V.C. conduit which encases the 3/4 inch fiber optic cable. The water crossings involved within the subject permits will be made by encasing the 3/4 inch fiber optic cable inside a 4 inch diameter galvanized iron pipe and attaching it to existing bridges. Post - construction contours will match in situ contours. When required by the governing body, extracted materials will be disposed of in an area designated by the governing body. Replacement fill, when required by the governing body, will be of a type and from a source designated and /or approved by the governing body.
