VanDusen, Mayor March 10, 1986 The Board of Architectural Review (BAR) approved your modified landscape plan at 401 Baker Boulevard, subject to two conditions at its February 27, 1986 meeting. The two conditions were as follows: 1. If approved by Union Pacific, installation of a five (5) foot landscape strip with an evergreen shrub planted two (2) feet on center along the west property line from the existing spur rail to the front property line. 2. Improve the existing front yard landscaping strip by adding additional oak trees thirty (30) feet on center. A ten (10) day appeal period follows the decision of the Board. Any aggrieved party may file an appeal in writing to the City Clerk stating reasons for the appeal. The City Council shall then affirm, deny, or modify the Board's decision. I have had an opportunity to speak with Mr. Weber of Union Pacific, who confirmed that the main line north of Strander Boulevard is proposed and is being analyzed by the railroad for abandonment. he requested that I call him back the week of March 10, when he might have a more definite answer on the railroad's plans. If the railroad does decide to abandon the track, you could provide the City with a letter of credit for 150% of the esti- mated cost of landscaping the five (5) foot strip until it is possible to actually landscape. Planning Commission Meeting Minutes (` February 27, 1986 Page 4 Ms. Bradshaw summarized the staff report. The meeting adjourned at 10:05 p.m. Tukwila Planning Commission Moira Carr Bradshaw Secretary Don Miles, 15828 S.E. 24th Street, Bellevue, WA, Engineer, indicated that the railroad would not allow anything 27 feet from the centerline of the track. He reviewed the landscaping on site. He also stated that Union Pacific is actively reviewing abandoning the main line north of Strander Boulevard. MR. COPLEN MOVED TO APPROVE APPLICATION 86 -5 -DR, ACCEPTING STAFF'S FINDINGS AND CONCLUSIONS AS AMENDED, WITH THE FOLLOWING CONDITIONS. 1. CITY OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT 86 -5 -DR: ALVIN PEARL AGENDA ITEM, Introduction The City of Tukwila received a business license application for Seattle Ski and Sports Warehouse at 401 Baker Boulevard. (Exhibit A) A review of the subject property revealed that the site was nonconforming as to landscaping and parking. The pro- perty owner, Alvin Pearl, is requesting the BAR to approve a modified landscape plan. Findings 1. The proposed tenant, Seattle Ski and Sports Warehouse, is a distributor of sporting equipment at wholesale prices, wholesale to the public sales of the same, and a mail order warehousing and distribution facility. 2. The former occupant of the building was Joslyn Manufacturing and Supply Company whose business involved the wholesale sales of Pole Line Hardware. Because the proposed tenant will be involved in sales to the general public and in essence acting as a retailer, there would be a change of use. 3. Per TMC 18.70.080, Nonconforming parking lots, if a change of use takes place, or an addition is proposed, which requires an increase in the parking area by an increment greater than one hundred percent, the requirements of Chapter 18.56 shall be complied with for the entire parking area. 4. Per TMC 18.70.090, Nonconforming landscape areas, at such time as a change is proposed for a use, or structure, and associated premises, which does not comply with the landscape requirements of this title, a landscape plan which substantially conforms to the requirements of this title shall be submitted to the Board of Architectural Review for approval. The BAR may modify the stan- dards imposed by this title when, in their judgment, the existing and proposed additional landscaping and screening materials together will adequately screen or buffer possible use incompatibilities, soften the barren appearance of parking or storage areas, and /or adequately enhance the premises appropriate to the use district and location of the site. 5. The structure was built in 1963 with a total square footage of 17,809. A site plan of the existing conditions shows eight parking stalls and a six (6) foot landscape strip along the front property line plus additional landscaping adjacent to front of the building. (Exhibit F) 6. The applicant has submitted a revised site plan showing a total of forty -seven (47) parking stalls. The proposed number of stalls would exceed the required 86 -5 -DR: Alvin Pea( February 27, 1986 Page 2 number of forty -five (45) for a commercial /office use of the entire building. (Exhibit C) 7. Per TMC 18.52 (Landscape Requirements) in the CM (Industrial Park) zone, a total of fifteen (15) feet front yard landscaping and five (5) feet side yard landscaping is required. The applicant has requested approval of a revised landscape proposal and plan (Exhibit B and D) which shows a new five (5) foot landscape strip along the east property line. The west property line is currently used by Union Pacific for an easement and is paved to the railroad tracks. 8. The applicant is asking the BAR to approve front yard landscaping of six feet instead of the required fifteen and no side yard landscaping along the west property line in lieu of the required five (5) feet. 9. The landscaping of surrounding properties is varied. The front yards of 402, 405 and 410 Baker and 150 Andover Park West appear to be nonconforming and average about ten (10) feet. (Exhibit I) 10. The applicant could install a five (5) foot wide landscaping strip from the spur rail to the front property line outside of the railroad easement. This would require the elimination of two (2) of the proposed stalls, removal of existing asphalt and installation of curbing to protect the proposed landscape area. 11. Conformance in the front yard is limited due to the existing parking stalls along the front. The existing twenty (20) foot driveway is necessary for a two way traffic pattern. An alternative is to create a one way pattern east to west of seventeen (17) feet, which would free up an additional three (3) feet. This would require removal of existing asphalt and curbing and the installation of a new curb. Conclusions 1. Because the two (2) parallel stalls are in excess of the requirement and the five (5) feet of landscaping can be accommodated outside the railroad easement, a revision along the west side would seem reasonable. The addition of landscaping along this side of the site would provide a buffer and screen the rail lines. 2. An additional three (3) feet of front yard landscaping would not appear to qualitatively increase the buffering or visual effect of the existing landscaping strip. The front yard is currently improved with ivy and two oaks of a substantial caliper. Additional oaks thirty five feet on center along the front would adequately enhance the premises.
