The remaining $5,000 for landscaping of the Kaiser. Gateway Corporate Center
Building 2 is no longer necessary due to the withdrawl of the tenant, Purola-
tor Courier. The landscaping on the easterly portion of the building was a
condition of the conditional use permit for Purolator, who is no longer a
prospective tenant.
Please consider this letter a written release for the sum of $5,000 in Account
No. 1391 -119.

The Planning Commission, at its June 26, 1986 meeting, approved your
request for a Conditional Use Permit (CUP) at 12698 Gateway Drive, subject
to the following conditions:
1. Revise landscape plan to show the cotoneaster replaced by an evergreen
shrub along the northeast property line.
Any person aggrieved by the decision of the Planning Commission, may appeal
that decision to the City Council. The appeal shall be made in writing to
the City Clerk within ten days of the Planning Commission decision and
shall state the reasons for the appeal. The City Council shall affirm,
deny or modify the decision of the Planning Commission within ninety days
of the filing of the appeal.
The CUP shall automatically expire one year after the date it was granted,
June 26, 1986, unless a building permit conforming to plans for which the
CUP was granted is obtained within that period of time. The Planning
Commission may grant a single renewal of the CUP if the party seeking the
renewal can demonstrate extraordinary circumstances or conditions not known
or foreseeable, at the time the original application for a CUP was granted,
which would not warrant such a renewal. No hearing is required for a
renewal of a CUP.
The Planning Commission may revoke or modify your CUP for any one or more
of the following grounds:
1. That the approval was obtained by deception, fraud, or other inten-
tional and misleading representations;
2. That the use for which such approval was granted has been abandoned;

3. That the use for which such approval was granted has at any time ceased
for a period of one year or more;
4. That the permit granted is being exercised contrary to the terms or
conditions of such approval or in violation of any statute, resolution,
code, law or regulations; or
5. That the use for which the approval was granted was so exercised as to
be detrimental to the public health or safety.
Any aggrieved party may petition the Planning Commission in writing to ini
tiate revocation or modification proceedings.
The parking requirement for Purolator. Courier would be approximately 90
parking stalls for the daytime employees and 72 spaces for the number' of
units that Purolator owns. This leaves 93.spaces for the remaining tenant
improvements in building #2, which would be a parking ratio of 1.86.
In addition, the application is still lacking notarization of Mr. Cusenza's
signature.

TUKWILA PLANNING COMMISSION
Minutes of the June 26, 1986, Planning Commission meeting.
The meeting was called to order at 8:05 p.m. by Chairman Knudson. Other
commissioners present were Mr. Sowinski, Mr. McKenna, Mr. Orrico, and Mr.
Kirsop. Mr. Larson was ill, and Mr. Coplen was unable to attend.
Representing staff were Brad Collins, Moira Bradshaw, and Kathy Stetson,
Planning Department.
PUBLIC HEARING
A. 86 -24 -CUP: _:. , Purolator Courier', requesting approval of a
Conditional Use Permit for a distribution and processing center
located at 12698 Gateway Drive.
Ms. Bradshaw summarized the staff report, adding a letter from Kevin
Griffin, Purolator Courier, as Exhibit D.
Mr. Knudson opened the public hearing.
Gerald Kirkpatrick, Kaiser Development, 300 Lakeside Drive, Oakland, CA,
stated his willingness to adjust the landscaping and parking as requesting
by the Planning Commission.
MR. ORRICO MOVED TO ADOPT THE FINDINGS AND CONCLUSIONS AS PRESENTED AND
APPROVE THE REQUEST SUBJECT TO THE CONDITION PRESENTED IN THE STAFF REPORT
THAT A SHRUB BE SUBSTITUTED FOR THE PROPOSED COTONEASTER WHICH WOULD
PROVIDE MORE SCREENING. MR. MCKENNA SECONDED THE MOTION, WHICH PASSED
UNANIMOUSLY.
B. 86- 26 -SPE: Nendels, requesting approval of an area increase for a
freestanding sign located at 15801 West Valley Highway.
Ms. Bradshaw summarized the staff report.
Mr. Knudson opened the public meeting.
John Dietrick, 4500 First NW, Seattle, WA, sign contractor, explained the
permit process he followed and his interpretation of how to compute the
area of a sign. He displayed photographs of signs in Tukwila whose areas
have been determined using his method, which were entered into the record

as Exhibits C (Accura and Chuck E. Cheese photos), D (Doubletree and Pay 'n
Save, E (Nendels), and F (Nendels sign as seen from I -405).
Mr. Collins, Tukwila Planning Director, stated that the sign permit had
been approved in error, without receiving Planning Commission approval. A
stop work order had been issued and after conferring with the City
Attorney, it was agreed that the applicant would abide by the Planning
Commission decision. Mr. Collins explained how the sign code has been
interpreted in the past and the discretion exercised by the City.
Mr. Knudson asked if the erection of the stairwell awnings with logos were
considered to be signs.
Mr. Collins stated that they were considered to be signs and the City was
currently working with the Nendels organization to bring this into confor-
mance.
Mr. Dietrick stated his discussions with Tom Hill, former Building
Official, led him to bell ve that he only needed Planning Commission appro-
val for the readerboard se tion of the proposed sign.
John Cheney, architect, Mt. ernon, WA, stated that the total height of the
building including the awning was 43 feet.
Mr. Knudson asked about height estrict ons in the shoreline areas, and the
calculation of height to include ooftop appurtances.
Mr. Collins clarified the height r strictions in the shoreline zone as 35
feet and that rooftop appurtancs wend not included in determining building
height.
Ted Dahl, Nendels Project anager, explained the permit process he under-
went and that he believ d he would be able to obtain approval of the
readerboard at a Plannin Commission meetin4.
Mr. Collins stated tat a readerboard is allowed only after Planning
Commission approval d that the sign face area of the readerboard would be
calculated into the total sign face area allowed." In this case, the sign
face area exceeds the allowable area and the area of \the readerboard would
be in addition to this figure.
Mr. Knudson closed the public hearing.
Mr. Orrico suggested either tabling the discussion to allow staff and the
applicant to submit another plan which included the readerboard, and permit
staff time to present findings and conclusions on the readerboard as well,
or just vote on the issue at hand regarding height and allowable sign face
area.
Mr. Kirsop asked about sign face size and the possibility of adding a
readerboard.

86 -24 -CUP: Purolator Courier
AGENDA ITEM •
INTRODUCTION
The Planning Commission recently reviewed an application by William Singleton,
85 -49 -CUP, for a Conditional Use Permit (CUP) for Purolator Courier. The project
was to be a new facility located on 134th Place. That application has been
withdrawn.
This application is a request for a CUP for a distribution and processing center
for Purolator Courier in Phase I, Building No. 2 of the Kaiser /Gateway Development
on Interurban Avenue.
FINDINGS
1. The site is zoned M -1, Light Industrial, which permits truck terminals as con -
ditional uses per TMC 18.40.040(2).
2. The Planning Commission shall be guided by criteria in TMC 18.64.050 in its
decisionmaking.
3. The proposed Purolator tenant space, 12698 Gateway Drive, will consist of a
2- story, 3,905 square foot office area and approximately 18,045 square feet of
warehouse space.
4. The facility would be used as a distribution point and sorting area for small
air- express packages and letters. The applicant has indicated that . 50
passenger vans and 4 step vans will be used at the space with additional
Econoline rentals from Hertz on occasion. The company will 'employ 100
employees.
The facility receives its parcels at 8:00 p.m. via a semi which unloads and
leaves at approximately 10:00 p.m. Six employees remain on site and sort par-
cels until 12:00 midnight. The primary business hours are from 8:00 to 6:00
p.m., Monday through Friday. The vans are loaded in the morning, dispatched
by 10:00 a.m. and return between 3:00 and 6:00 p.m.
5. The Gateway Corporate Center will eventually have nine buildings with approxi-
mately 493,850 square feet of space to be constructed in three or four phases.

complete development of the site. Access is by two curb cuts onto Interurban
Avenue South. The road linking the two cuts will be a circular drive, Gateway
Drive, which at the southernmost point is intended to intersect with 133rd
Street. This point is proposed for signalization but completion of improve-
ments is pending Washington State Department of Transportation release of
limited access at this point. The Public Works Department is monitoring the
the transportation impacts of the buildout of Kaiser, pending the completion
of the improvements.
6. The proposal has received a Determination of Nonsignificance, issued on June
10, 1986.
CONCLUSIONS
Criteria 18.64.050(1) The proposed use will not be materially detrimental to the
public welfare or injurious to the property or improvements in the vicinity of the
proposed use or in the district in which the subject property is situated.
The surrounding improvements in the vicinity are truck oriented. The Kaiser
Gateway Development will be a light industrial park, to which the proposal would
be well suited. Building No. 2, where the business will be located, abuts the
Tukwila Commerce Park, a similar warehouse /industrial development.
Criteria 18.64.050(2) The proposed use shall meet or exceed the performance stan-
dards that are required in the district it will occupy.
The site plan shows that Building No. 2 exceeds the landscaping, parking and
loading requirements for the district and the proposed use.
Criteria 18.64.050(3) The proposed development shall be compatible generally with
the surrounding land uses in terms of traffic and pedestrian circulation, building
and site design.
Although the Kaiser Gateway project is just beginning to lease, the proposed use
is consistent with the intended use of the development. In addition, several of
the surrounding developments contain uses which are similar such as.T.I.M.E. D.C.,
Hertz Rental and numerous distribution businesses.
The use will occupy a corner space in the building which provides greater access
for the large number of vans and employees which will use the space.
Streets and sidewalks are or will be built to City standards prior to certificates
of occupancy to facilitate the smooth flow of pedestrian and traffic circulation.
Criteria 18.64.050(4) The proposed use shall be in keeping with the goals and
policies of the comprehensive land use policy plan.
Approval of the proposed use would be in keeping with the overall goals and poli-
cies of the comprehensive land use policy plan.

Criteria 18.64.050(5) All measures have been taken to minimize the possible
adverse impacts which the proposed use may have on the area in which it is
located.
The proposed use will have a minimum of 54 vans parked on the site in the parking
lot. The landscape plan shows the minimum fifteen feet of front yard landscaping
plus an additional side yard landscape area with red maples and a ground cover of
cotoneaster. The rear yard is not landscaped and abuts the Tukwila Commerce Park.
The substitution of an evergreen shrub for ground cover, three feet on center, a
minimum of four feet in height, would serve as a barrier and natural screen from .
the parking and van storage area with the building and parking areas of Phase III
buildings located along the waterfront.
RECOMMENDATION
Staff recommends that the Planning Commission adopt the Findings and Conclusions
of the staff report dated June 26, 1986 and approve the application subject to
the following condition.
1. Substitute an evergreen shrub for the cotoneaster along the northeast side.

First of all, my apologies for not being present at your City Council meeting.
Previously scheduled committments have precluded me from attending.
We are in the process of signing a lease with Kidder, Mathews & Segner Inc.
for a 21,000 fm warehouse and distribution location in the Gateway Corporation
Center. Our operation will be located in building #2 of that complex. We are
very pleased to be part of the Gateway project and the Tukwila business
community.
So there will be no confusion as to the intent and scope of our operation,
the following will be a detailed review of our daily functions:
1. Purolator Courier is a small package express overnite company,
both regional and national in scope.
2. We employ 96 people on 2 shifts. The day crew accomplishes our
pick -up and delivery work from 8:00 a.m. to 6:00 p.m. We run
72 units on the road in combinations of E -150 Ford vans & bread
trucks. Our night operations consists of 6 people who sort our
packages for delivery the following day. We have one 28' tractor
trailer which goes to Portland each evening. Our operation closes
for the day at 12:00 midnight.
We realize that there has been some confusion in the past as to who represents
Purolator Courier for the building and facilities functions. Ms. Patricia
Leveall of Kidder, Mathews & Segner Inc., is the only agent currently
authorized to secure a space for our company in any area of Tukwila. We
fully intend to utilize the Gateway Corporate Center for our base of operations.
We look forward to your favorable decision on our conditional use permit and
look forward to joining the Tukwila business community. If you have further
questions or concerns, please do not hesitate to contact me.
