VanDusen, Mayor TUKWILA PLANNING COMMISSION Minutes of the June 26, 1986, Planning Commission meeting. The meeting was called to order at 8:05 p.m. by Chairman Knudson. Other commissioners present were Mr. Sowinski, Mr. McKenna, Mr. Orrico, and Mr. Kirsop. Mr. Larson was ill, and Mr. Coplen was unable to attend. Representing staff were Brad Collins, Moira Bradshaw, and Kathy Stetson, Planning Department. PUBLIC HEARING A. 86 -24 -CUP: Purolator Courier, requesting approval of a Conditional Use Permit for a distribution and processing center located at 12698 Gateway Drive. Ms. Bradshaw summarized the staff report, adding a letter from Kevin Griffin, Purolator Courier, as Exhibit D. Mr. Knudson opened the public hearing. Gerald Kirkpatrick, Kaiser Development, 300 Lakeside Drive, Oakland, CA, stated his willingness to adjust the landscaping and parking as requesting by the Planning Commission. Mr. Knudson closed the public hearing. MR. ORRICO MOVED TO ADOPT THE FINDINGS AND CONCLUSIONS AS PRESENTED AND APPROVE THE REQUEST SUBJECT TO THE CONDITION PRESENTED IN THE STAFF REPORT THAT A SHRUB BE SUBSTITUTED FOR THE PROPOSED COTONEASTER WHICH WOULD PROVIDE MORE SCREENING. MR. MCKENNA SECONDED THE MOTION, WHICH PASSED UNANIMOUSLY. B. 86- 26 -SPE: Nendels requesting approval of an area increase for a freestanding sign located at 15801 West Valley Highway. Ms. Bradshaw summarized the staff report. Mr. Knudson opened the public meeting. John Dietrick, 4500 First NW, Seattle, WA, sign contractor, explained the permit process he followed and his interpretation of how to compute the area of a sign. .He displayed photographs of signs in Tukwila whose areas have been determined using his method, which were entered into the record Planning Commission Meeting of June 26, 1986 Meeting Minutes Page 2 ' as Exhibits C (Accura and Chuck E. Cheese photos), D (Doubletree and Pay 'n Save, E (Nendels), and F (Nendels sign as seen from I -405). Mr. Collins, Tukwila Planning Director, stated that the sign permit had been approved in error, without receiving Planning Commission approval. A stop work order had been issued and after conferring with the City Attorney, it was agreed that the applicant would abide by the Planning Commission decision. Mr. Collins explained how the sign code has been interpreted in the past and the discretion exercised by the City. Mr. Knudson asked if the erection of the stairwell awnings with logos were considered to be signs. Mr. Collins stated that they were considered to be signs and the City was currently working with the Nendels organization to bring this into confor- mance. Mr. Dietrick stated his discussions with Tom Hill, former Building Official, led him to believe that he only needed Planning Commission appro- val for the readerboard section of the proposed sign. John Cheney, architect, Mt. Vernon, WA, stated that the total height of the building including the awnings was 43 feet. Mr. Knudson asked about height restrictions in the shoreline areas, and the calculation of height to include rooftop appurtances. Mr. Collins clarified the height restrictions in the shoreline zone as 35 feet and that rooftop appurtances were not included in determining building height. Ted Dahl, Nendels Project Manager, explained the permit process he under- went and that he believed he would be able to obtain approval of the readerboard at a Planning Commission meeting. Mr. Collins stated that a readerboard is allowed only after Planning Commission approval and that the sign face area of the readerboard would be calculated into the total sign face area allowed. In this case, the sign face area exceeds the allowable area and the area of the readerboard would be in addition to this figure. Mr. Knudson closed the public hearing. Mr. Orrico suggested either tabling the discussion to allow staff and the applicant to submit another plan which included the readerboard, and permit staff time to present findings and conclusions on the readerboard as well, or just vote on the issue at hand regarding height and allowable sign face area. Mr. Kirsop asked about sign face size and the possibility of adding a readerboard. Planning Commission C •, The motion was defeated by a vote of 1 to 4. Meeting Minutes Meeting of June 26, 1986 Page 3 Mr. Collins stated that there was no way to legally approve a readerboard in addition to the existing size of the sign. MR. KIRSOP MOVED TO ACCEPT THE AREA OF THE EXISTING SIGN AS 119 SQUARE FEET, TO CONSIDER THE BUILDING HEIGHT AS 35 FEET, AND, THUS, ALLOW THE SIGN TO REMAIN AS IT STANDS, HOWEVER, NO ADDITIONAL READERBOARD WOULD BE PERMITTED. MR. ORRICO SECONDED THE MOTION. MR. MCKENNA MOVED THAT BASED ON THE STAFF'S FINDINGS AND CONCLUSIONS, THE SIGN BE PERMITTED TO REMAIN AT ITS CURRENT HEIGHT AND THAT CONCLUSION #4 BE CHANGED TO STATE THAT THE PERMIT HAD BEEN ISSUED BY THE BUILDING OFFICIAL IN ERROR. MR. ORRICO SECONDED THE MOTION, WHICH PASSED UNANIMOUSLY. PUBLIC MEETINGS A. 86- 25 -DR: Moody Bloomquist, requesting BAR approval of a pro- fessional office building located on Lot 1, Tukwila Short Plat #80 -36, Interurban Avenue South and 57th Avenue South. Ms. Bradshaw summarized the staff report, eliminating Exhibit A, which had not been included in the staff report. Judith Stoloff, 13975 Interurban Avenue South, Tukwila, WA, stated her agreement with all of the staff's recommendations. Nancy O'Brien, Mithun Bowman Emrich Group, 2000 112th NE, Bellevue, WA, presented samples of glass and proposed color scheme, which were entered into the record. MR. ORRICO MOVED TO ADOPT THE FINDINGS AND CONCLUSIONS AS PRESENTED IN THE STAFF REPORT AND APPROVED THE REQUEST SUBJECT TO CONDITIONS 1, 2, AND 4 OF THE STAFF REPORT AND THE COMPLETION OF A BOUNDARY LINE ADJUSTMENT. MR. SOWINSKI SECONDED THE MOTION, WHICH PASSED UNANIMOUSLY. B. 86- 23 -DR: Foster Park, requesting BAR approval of a City Park located on the east side of 51st Avenue South between South 138th and South 139th Streets. Ms. Bradshaw summarized the staff report and added as Exhibit D a map of the area. Jay Stillmaster, 1329 - 51st Avenue South, Seattle, WA, stated his concern with the adequacy of the parking for the proposal, but that he was in favor of the development of the park. Mr. Knudson asked about the number of stalls currently developed. Ms. Bradshaw stated that currently there were 25 stalls and pointed out that with the additional parking planned for the site and off- street parking the total would be 76. Mr. Stillmaster suggested that South 139th Street could be vacated for additional parking. MR. KIRSOP MOVED TO CONTINUE ACTION ON THE ITEM TO THE NEXT MEETING TO ALLOW TIME TO OBTAIN ADDITIONAL INFORMATION ON THE PARKING PLAN. MR. SOWINSKI SECONDED THE MOTION, WHICH PASSED UNANIMOUSLY. C. 86- 22 -DR: United Homes, requesting BAR approval of a manufactured home display and sales center at the northeast corner of Interurban Avenue South and Southcenter Boulevard. Mr. McKenna removed himself from acting on this item and left the council chambers. Ms. Bradshaw summarized the staff report and presented additional infor- mation provided by the proponent concerning colors, lighting, fencing, decking and window treatment. Mr. Knudson asked about the landscape requirements. Mr. Collins indicated that the proponent had requested a residential setting for his sales lot. Mr. Collins entered a letter received from John C. Radovich into the record as Exhibit E. He also stated that the river environment area may need to be improved with landscaping and the dike road, in conjunction with a flood zone control permit. Bruce McCrory, 1810 SW 349th P1, Federal Way, WA, representing the devel- oper, asked about the dike improvement requirements. Mr. Collins stated that King County Surface Water Management may require such. Mr. McCrory explained the proposed landscaping, the site selection process, and the elevations provided as exhibits. He stated that architectural interest is more varied than is presented by the elevations. Mr. Kirsop asked about the movement of the homes in and out of the site and the effects on the landscaping. Mr. McCrory stated that they intended to use potted plants for landscaping in the display area. Mr. Kirsop asked about the ownership of the property. Ms. Bradshaw indicated that there was a 20 -year lease on the property by the applicant. Planning Commission( Meeting of June 26, 1986 Meeting Minutes Page 5 • MR. ORRICO MOVED TO ADOPT THE FINDINGS AND CONCLUSIONS AS PRESENTED IN THE STAFF REPORT AND THE SUPPLEMENTAL MATERIALS PROVIDED AND APPROVE THE REQUEST SUBJECT TO THE SUBMISSION TO STAFF OF A REVISED LANDSCAPE PLAN. MR. KIRSOP SECONDED THE MOTION. Ms. Bradshaw requested clarification of the landscape requirements to be shown. Mr. Orrico amended his motion to read: SUBMISSION OF A REVISED LANDSCAPE PLAN AND TO INCLUDE ONLY NATURAL LANDSCAPE MATERIALS IN DISPLAY AREA. THE MOTION PASSED UNANIMOUSLY. D. 86- 30 -DR: Green River Construction Co., requesting BAR review and approval of an eight (8) foot high screening fence of a storage yard located at the northeast corner of the intersection of Maule Avenue and South 143rd Street. Mr. Knudson removed himself from acting on this item. Mr. Kirsop assumed the chairmanship and Mr. McKenna re- entered the room. Ms. Bradshaw summarized the staff report. Gerry Knudson, 64212 S. 143rd P1, Tukwila, WA, owner of the property, offered an apology for the condition of the storage yard and requested a 5 -foot setback along Maule Avenue due to the temporary nature of the pro- posed fence and the distance from Interurban Avenue. Mr. Orrico asked about the landscaping plan and whether staff had any objections to granting Mr. Knudson's request for a 5 -foot setback. Ms. Bradshaw stated that the requirements of the TMC defined front and side yard setback requirements as well as landscape requirements; setbacks are 25 feet front yard, 12i feet side yard and 15 feet for front yard land- scaping. MR. ORRICO MOVED TO ADOPT THE FINDINGS AND CONCLUSIONS OF THE STAFF REPORT AS PRESENTED AND APPROVE THE REQUEST SUBJECT TO THE CONDITIONS IN THE STAFF REPORT, CHANGING THE SETBACK REQUIREMENTS ON MAULE AVENUE FROM 12 FEET 6 INCHES TO 5 FEET. MCKENNA SECONDED THE MOTION, WHICH PASSED CITY OF TUKWILA PLANNING DIVISION PL ANNING COMMISSION STAFF REPORT AGENDA ITEM, V/ 86- 26 -SPE: Nendels Freestanding Sign INTRODUCTION Nendels Tukwila Associates was issued a sign permit on April 18, 1986 for a freestanding sign. The sign, however, exceeds the maximum sign face and height allowed without Planning Commission approval. Planning Commission approval is therefore being requested after issuance of the permit. FINDINGS 1. The applicant, Nendels Tukwila Associates, is requesting approval of an increase in the sign face and height per TMC 19.32.180. Two different interpretations may be made regarding the area of the sign. The plan indica- tes 119 square feet. However, an interpretation could also be made that the pediments above and below the square descriptive area should also be included, thereby, increasing the sign face area on each side to 175.5 square feet. The proposed sign is 43 feet 9 inches in height. Per TMC 19.32.140(C) no freestanding sign shall be higher than the building which it identifies. The average height of the hotel is 29 feet. 2. Per TMC 19.32.180 area and height restrictions for freestanding signs as prescribed in TMC 19.32.140(c) for Freeway Interchange Businesses may be increased twenty -five (25) percent upon approval of the Planning Commission. 3. Per TMC 19.08.080, a Freeway Interchange Business means a business located within areas designated on Exhibit A of the Sign Code (herein referred to as Exhibit B) within a radius of 1000' from the freeway entry /exit point of intersection with a public street within a commercial zone. The sign shall identify businesses such as eating, lodging or service station facilities, which serve the traveling public. 4. Per TMC 19.32.140(c) a freestanding sign is allowed 100 square feet of sign area with a total of 200 square feet for all sides when the street frontage of the sign's location is over 400 feet. The Building Official, during permit review for the sign, made the more liberal interpretation of the sign's area. Using this interpretation, the applicant is requesting a nineteen (19) percent increase in their sign area. 86- 26 -SPE: Nendels Freest Sign June 26, 1986 Page 2 EXHIBITS A Sign Permit #4296 -S B Sign Elevation 1. Reduce sign height to maximum allowable 36 feet 3 inches. 5. A twenty -five (25) percent increase in height allowance would allow the sign to be 36 feet 3 inches. 6. The location of the motel is at 15801 West Valley Highway and the street frontage of the parcel is over 400 feet. The site is shown on Exhibit B within an interchange. 7. The subject site is approximately 6 acres and is zoned C -2, Regional Retail. CONCLUSIONS 1. The sign meets the definition of a Freeway Interchange sign. 2. The sign application has been processed and permitted, with the understanding that the area is 119 square feet. 3. With the above interpretation, the Planning Commission would be authorized to approve the additional 19 feet of sign area for each side. 4. The height of the proposed sign exceeds the twenty -five percent increase in sign height allowed by the Planning Commission. HOTELS 19.32.190 Signs Mounted on Hotel Building Faces. (A) Each hotel shall be permitted one (1) building face mounted sign on each building face of the hotel, which sign shall contain only the hotel name and /or logo. The area of each• building face mounted sign shall be as provided in Table 1, Section 19.32.140 (A). A hotel may not have more than four (4) build- ing face mounted signs, except as provided in Section 19.32.190 (B).
