I have had repeated conversations with Mr. Carl Bloss in October and November of 1988 regarding the need to replant. Unfortunately, the fall months (when I originally spoke to Carl) would have been an opportune time to replant and to protect your investment. To refresh your memory, during subdivision construction, grading and fill work extended beyond your property line into the right -of -way. Large trees and a drainage retention area were destroyed on public property. Your revised topographic plans were taken back to the Planning Commission for secondary review. Approval was granted and revised conditions included revegetation of the public property per the Group 4 Landscape Plan dated September 25, 1986, and a guarantee by you of the landscaping for three years. As verbal requests regarding the dead landscaping and the need for replacement have been for naught, I now submit a written request to you to replant per the approved landscape plan. Please have the work done by February 15, 1989. Regretably, the matter will have to be turned over to the City Attorney for enforcement if the trees have not been replaced by that time. Public Works has signed off on the plat and the streets and utilities are ready for dedication. The owner has submitted a bond to cover landscaping. The Planning Commission reviewed this and recommended approval. MOVED BY SIMPSON, SECONDED BY STOKNES, THAT COUNCIL ACCEPT THE FINAL PLAT FOR THE MAPLETREE PARK DEVELOPMENT AND AUTHORIZE THE MAYOR TO SIGN THE FORM. MOTION CARRIED. Councilman Duffie commented that it is really nice to have a single family development coming into the City. The City has received the requests from property owners out- side the City Limits to connect homes on their property to the City sewer system. Councilman Simpson explained that the Utilities Committee has reviewed this and sends it forward with the recommendation to approve. The existing sewer system was built by the City under LID 18 and serves an area outside the City Limits. The City has an obligation to serve the two single—family homes. SOWINSKI SECONDED A MOTION TO RECOMMEND TO THE CITY COUNCIL ADOPTION OF THE SILVERVIEW PRELIMINARY PLAT BASED ON THE STAFF'S FINDINGS AND CONCLUSIONS WITH THE EXCEPTION OF PARAGRAPH ONE OF CONCLUSION NO. 6, AND ADOPTION OF THE CONDITIONS WITH THE EXCEPTION OF NO. 6. Vernon Umetsu, staff representative, reviewed the staff report for the proposal recommending approval of the request. Ann Nichols, representing Segale Business Park, outlined the design request. She entered into the record a landscape design plan as Exhibit 2 and two photos depicting parking as Exhibit 3 and 4. MR. SOWINSKI MOVED AND MR. HAGGERTON SECONDED A MOTION TO APPROVE THE 87 -4 -DR SEGALE 871 BUILDING DESIGN PER STAFF'S FINDINGS AND CONCLUSIONS, SUBJECT TO THE FOLLOWING CONDITIONS WITH THE EXCEPTION OF THE WORD "REDESIGN" IN CONDITION #1 WHICH SHALL BE CHANGED TO "DESIGN ". STAFF REPORT to the Planning Commission BACKGROUND FINDINGS C ... 86 -31 -SUB: Mapletree Park Page 2 On August 4, 1986, the City Council approved the Preliminary Plat (Attachment C) for Mapletree Park, subject to the following conditions: 1. Develop street curbs, gutters, sidewalks, street lights, and fire hydrants to minimum City standards and dedicate to City upon satisfactory completion of improvements. 2. Revise street grades to eliminate slopes in excess of 15 percent. 3. Develop sewer and water in conformance with City Comprehensive Utility Plans and improve to City standards. 4. Indicate significant trees to be saved on working drawings of the site. 5. Show on plat the individual lot sizes and note the smallest mean lot width. During initial filling and grading of site, mud was displaced into the northern portion of the twenty -foot native growth protection easement along the western edge of the property line. Alders were toppled by the dirt and a large cotton- wood in the right -of -way was cut down by workers on the site. The applicant was contacted and the grades, topography, drainage pattern, and landscaping of the western property line was analyzed. A landscaping plan and amended plat were brought before the Planning Commission for approval. On September 25, 1986, after a public hearing the Planning Commission approved the amended plans with the following conditions: 1. The developer immediately marks the trees to be saved, subject to the approval of staff. 1 STAFF REPORT to the Planning Commission DISCUSSION 86 -31 -SUB: Mapletree Park Page 3 The Planning Commission reviews the proposed Final Plat to insure conformance with the approved Preliminary Plat. A Planning Commission recommendation is then forwarded to the City Council along with the title page which has been signed by the City's Finance, Public Works and Planning Directors as well as the Planning Commission Chairman and Secretary. The City Council reviews the plat to ensure appropriate provisions for public health, safety and welfare. Upon approval by the City Council, it is signed by the Mayor, attested to by the City Clerk, and filed with King County. Prior to final approval, the areas of ownership, survey accuracy, and adequacy of improvements are verified. The supplemental title insurance report dated April 23, 1987 vests the site to Schneider Homes, Inc. The land surveyor for the plat, D. K. Roupe with Group Four, has certified on the title page that the plat is technically correct and accurate. However, as of the writing of this report, the Public Works Department has not been able to verify in writing that the subdivider had completed the require- ments of the subdivision code and the standards of their department for the improvements. They will be providing information at the Planning Commission meeting. The applicant has developed the subdivision in accordance with the preliminary plat (Attachments C and B). The required landscaping condition of the amended plat, however, has not been installed. Therefore, a cash set aside for 150 percent of the cost will be submitted to the City for the required improvements, to be installed no later than July 1, 1987. The condition that remains out- standing is a guarantee from the applicant for three -year maintenance of the landscaping. Several options are available to the developer such as a mainten- ance bond, letter of credit, or cash set aside. Prior to final approval by the City Council, some form of guarantee should be made by the applicant. CONCLUSIONS The applicant has submitted a final plat which conforms with the approved pre- liminary plat. However, two issues need to be resolved prior to approval of the final plat: 1) Public Works recommendation regarding the public improvements, and 2) A guarantee for landscape maintenance. A Public Works response should be forthcoming the night of the meeting. Shortly thereafter the posts were reinstalled. I have a concern and a request for you to con- sider. My concern is the fact the post on the east side was broken just above the concrete collar that held the post in its old position when is was removed. A new post should be obtained to replace the broken post. It should be built to our standards and have the same routered lettering. Installing the old broken post is not acceptable. My request is to have the two posts relocated to the south. With the new construction of the houses to the west, and now to the east, a better location for the posts would be at the south end of the pavement on 62nd Avenue. I had a thought that we could compromise with the developer, that if they'd pay for two new posts our City crews could install them in the new loca- tion. At the very least the developer will have to replace the broken post with a new one. We could then install it in the new location. The devel- oper can contact me about where to get a new post (Ballard). Please let me know what you'd like to do. Prior to beginning any portion of this work the developer shall obtain the authorization of the Building Official and the Planning Director. Twenty - four hours before beginning any segment of the work the developer or his representative shall apply for and obtain the following permits: 1. Public Roadway Improvements /Undergroundin /Street Lights with Curb Cut Access /Sidewalks Permit (Permit Fee $25.00 The City requires an additional submittal of undergrounding plans from Puget Power, Pacific Northwest Bell, Group W Cable and Washington Natural Gas. This drawing shall be sent to me for review and approval prior to carrying out the undergrounding and street lighting for this project. The street lighting and undergrounding for the street lighting shall be provided in such a manner to be eligible for turnover to the City as part of the turnovers at the completion of the project. Also, prior to obtaining this permit, the developer shall submit a site plan showing where his proposed curb cuts and access points for the 14 sub- ject lots, for City review and approval. The turnover documents for 63rd Place South and South 151st Place will be provided to the Public Works Department immediately upon completion of this project.The documents are outlined at the end of this letter. The Tukwila City Council is the sole and final authority for acceptance of these streets for turnover and no permit signoffs by City staff con- stitute a final acceptance of the City of these streets as public. Sanitary Side Sewer Permits (Permit Fee, inspection charge only $20.00 per lot -- Lots 1 -14) That portion of the sanitary side sewer put under the proposed public streets will not be charged the hookup fee at this time. When the final building site plan for each lot is reviewed and approved through the City an additional inspection charge, plus the connection charge, will be provided as part of the permit fee. Special assessment fees are waived by prior participation of the past ownership and the development of public sewer mains. 3. Water Meter Permits (Permit fee $650.00 /per lot) This deposit fee of $650.00 covers the cost for the installation of the water meter and service from the proposed public main to and including the meter box by City personnel. City staff is willing to allow the developer to provide portions of this installation with the exception of the actual water meters. City staff shall require the developer to meet all City requirements for the placement and testing of these facilities. If the proposed public main and /or right -of -way for the streets is not secured, for any reason, at the end of the project, then easements for this service line and water meter shall be provided for the operation and maintenance of this facility by City staff prior to use of these services. 4. Proposed Public Storm System (Permit fee $25.00) The public storm system shall be built per APWA standards and City re- quirements and be of concrete pipe with the exception of the 96" reten- tion facility, which shall be a minimum 14 gauge galvanized steel treatment Type I coated. Three copies of a structural engineer stamped shop plan for this retention facility shall be provided for City review and approval prior to carrying out this work. All pipes shall be in Class "B" bedding. The control manhole shall be of concrete and per King County's standards. Turnover of this water storm extension docu- ments are per the requirements at the end of this letter. The Tukwila City Council is the only and final authority for turnover of this as a public facility. 5. Sanitary Sewer Main Extension (Permit fee $25.00) The sanitary sewer mains proposed as public facilities shall be built per the APWA standards and City requirements. The Tukwila City Council is the final authority for acceptance of these mains as public. The turnover documents required at the end of the project are outlined at the end of this letter. Group W4 and Mr. Carl Blass Oct. 27, 1986 page 3 6. Water Main Extensions (Permit fee $25.00) The water main extension shall be per the City's Developer's Extension Manual requirements (attached). Turnover documents allowing for the transfer of these facilities as public are provided at the end of this letter. The City Council is the sole and final authority to accept these facilities as public. No extensions beyond Catch Basin #3 and Inlet 3A will be considered public, but built to private standards with the sole maintenance and repair responsibilities going to the private land owners in the future. At the completion of this project for sanitary sewer mains, storm mains, water mains and street improvements and sidewalks, including street lighting and undergrounding, the following turnover documents are required: 1. Letter of request by the developer for turnover as facilities as public addressed to the Public Works Director. 2. As -built plans. 3. Signed off permits for appropriate facilities built to public standards. 4. Bill of sale. 5. List of materials (water and sewer shall be per City's format). 6. Right -of -way /plat easements with signatory for acceptance of the rights -of -way and easements through the Mayor, City Clerk and City Attorney. Sowinski, McKenna, Knudson, Coplen, Orrico, and Kirsop. Representing staff were Moira Bradshaw and Kathy Stetson. Minutes MR. COPLEN MOVED TO ACCEPT THE MINUTES OF THE SEPTEMBER 11, 1986 MEETING AS PRESENTED. MR. KIRSOP SECONDED THE MOTION, WHICH PASSED UNANIMOUSLY. 86 -31 -SUB: Schneider Homes, Inc., application for a preliminary plat for 14 single - family lots on 4.80 acres in the R -1 -12.0 zone on the south side of S. 151st Street between the extension of 62nd Avenue South and existing 65th Avenue South. Ms. Bradshaw entered into the record, summarized the Staff Report, and explained the proposed revisions to the approved Preliminary Plat. She added Exhibit C - Photographs of existing natural growth protection ease- ment. Carl Bloss, Schneider Homes, 6510 Southcenter Blvd., Tukwila, explained the reasons for Schneider's request to fill in the ditch area. He spoke about the drainage course and the need to maintain 12,000 square feet per lot. Dave Axness, 15185 — 62nd Avenue South, stated his concern with the removal of the natural vegetation, his wish to maintain privacy for the residences adjacent to the site, and his desire not for landscaping but for retention of the existing natural vegetation. He entered Exhibit D into the record, photos of the area from his residence. He stated his feeling that there was little or no time in which to review the new plans. Mr. Axness asked about the sizes of the plants proposed in the landscape plan and whose responsibility it was to maintain them. He expressed his desire for an independent opinion on the adequacy of the landscape plan and for the developer to save as many of the existing significant trees as possible. Mr. Axness requested that the trees to be saved be tagged to more clearly identify them. The Board discussed the drainage issues, the mudwave which had occurred and the possibility and effects of future mudwave occurrences. Ms. Bradshaw entered the Staff Report into the record and summarized it. Burt Lucas, 4435 South 134th Place, gave a brief history of the site and the reasons for the requested increase in sign area. He emphasized the fact that the location is somewhat hidden from view, and also stated his belief that his business would qualify as a freeway interchange service, thereby allowing the sign area increase. Vernon V/„ September 3, 1986 Moira, Had a complaint /inquiry re clearing of Mapletree Park site. David Axness was concerned that "big" trees, that he understood would be saved, were being taken down. Locacted working drawings in Bldg. Dept. and went to site. No violation of approved plan. However, they were taking down 35+ inch cottonwood trees along northwest side of site; thereby removing a lot of buffering from existing SFDU's. The "Native Plant Protection Easement" was also somewhat grubbed in the process of tree removal. What protection/was to be given to plant easement? PS Schnider (sp) representative (Bloss ?) said that the reason that cottonwoods were not inventoried was because consultant was probably told not to record them. Mayor approved taking out of all cottonwoods from plant easement area,(per Bloss). City Attorney Haney read an ordinance of the City of Tukwila, Washington, amending Chapter 16.16 of the Tukwila Municipal Code to adopt the 1985 Edition of the Uniform Fire Code, standards and appendices with certain exceptions and amend- ments, providing for the regulation of flammable liquid, liquefied petroleum gases and explosive storage, setting a bail schedule for offenses under the uniform fire code, setting a fee for permits required by the uniform fire code, providing procedures for appeals and establishing penalties for violation. MOVED BY MORGAN, SECONDED BY SIMPSON, THAT ORDINANCE N0. 1398 BE ADOPTED AS READ.* Council Member Harris said that one of the members of our business community questioned Section 16.16.040 which reads, "The storage of flammable or combustible liquids in outside above ground tanks is prohibited within the City." It needs to be looked at further. Burying tanks makes it difficult to tell if there is a leak until the ground is saturated. Doug Gibbs, Fire Marshal, explained that it is the discretionary power of Council to eliminate above ground storage tanks. Council Member Morgan asked the difference between the cost of installing tanks above ground or underground. She com- mented she would keep the proportionate cost item in the Community Affairs Committee. Doug Gibbs said that danger increases when a tank is installed above ground. There are a lot of reasons why the Fire Department does not want to see tanks above ground. *MOTION CARRIED. Schneider Homes, Inc., is requesting approval of a sub- division for 14 single family lots on 4.8 acres lying at the SW corner of So. 151st and 65th Ave. So. Brad Collins, Planning Director, explained that Schneider Homes met with the Planning Commission on July 24, 1986. After a public hearing the Planning Commission recommended approval subject to five conditions. Their decision was based on the following reasons: (1) Conformance with existing R -1 -12.0 zoning and Comprehensive Plan; (2) Desire for single family units within the City; (3) Desire of City to have well constructed and maintainable streets and utility systems for residents. They recommended that the private roadways be built to City standards and dedicated as public streets. There will be some regrading on the site to meet the street grades. Twenty feet of the property on the west side will be reserved as a native growth easement. There are provisions for planters in the cul -de -sacs. The Fire Department has reviewed them and verified that the large trucks can maneuver the turns as long as there is no parking allowed on the street. Gerald Schneider, applicant, explained when the grading is complete, it will follow the contour of the street. It will be graded to the west where fill is needed to make the lots desireable. They have done a major soils test on the area and found a lot of rock but none that will have to be blasted. There should be no problem with the drainage. This is a request for a simple subdivision, and they plan to build homes ranging from $150,000 to $200,000. This will be an exclusive neighborhood. Gretchen Brunner, Group 4, 19504 - 56th Avenue W., Lynnwood, WA 98036, representing Schneider Homes stated their general agreement with the Staff Report and indicated their willingness to dedicate the street to the City after construction. She requested that the identification of significant trees be indicated on the site plan rather than the plat map as requested in the Staff Report. Der Roupe, Group 4, stated that the developer would be able to achieve the street grades of 15% or less as requested in the Staff Report. Mr. Orrico inquired as to the projected timetable for construction, the size of the homes, and the price range. David Axness, 15185 - 62nd Avenue South, stated his concern with maintain- ing the proposed 20 feet of native growth protection along the trail and the noise and sight barrier it provides. He also asked about the location of the proposed fence along the trail. Mr. Roupe spoke about the size of Lots 10 and 11 and the steepness of Lots 3 and 4. He indicated the use of protective covenants within the homeowners association to protect the vegetation. Mr. Orrico asked about the proposed planters in the cul -de -sac and stated his concern with its possible interference with traffic, street maintenance and emergency vehicles. Mr. Roupe stated that the distance from driveway to planter was approximate- ly 30 feet, an adequate distance to ensure vehicular maneuverability. He also stated that the diameter of the cul -de -sac was approximately 100 feet and the planter was an aesthetic necessity. Nanette Mozika, west of 62nd Avenue, asked about the type of fence pro- posed, the possibility of more public comment during the design review, her concern with the drainage and grading plans, and her desire that as much vegetation as possible be retained in the native protection area for both aesthetic reasons and as a noise barrier. Mr. Schneider stated that the fence would probably be made of cedar and brick and be about six feet high. Mr. Roupe noted that the drainage plan included underground collectors as well as oil and water separators and on -site storm water retention systems. He said they would be working closely with the City's Public Works Depart- ment to conform with all City standards. Mr. Kirsop closed the public hearing. MR. The mud wave intruded upon the native growth protection area up to the filter fence which had been installed to protect the drainage course. In addition, two large cottonwoods not identified on the significant tree survey were cut down. FINDINGS 1. The northern portion of the native growth protection area has relatively little undergrowth and since the destruction of the cottonwoods, no signifi- cant tree growth. 2. A natural wet drainage course does traverse the southernmost section of the protection easement. 3. The applicant, Schneider Homes, has proposed to fill and grade the 20 -foot native growth strip along the west boundary of the site to more naturally conform with the elevations of the subdivision and right -of -way. The cur- rent grading plan shows a 10 -foot change in elevation between the easement and plat. The grade is proposed to slope from the north down to the south where it should level off with the level of the water course. 4. The five -foot fence that has been proposed along the west property line by the developer would remain. A mix of cedars, firs, vine maples, and birch along the fence line in the right -of -way is proposed to replace the cotton- woods. The Public Works and Parks and Recreation Departments have no objec- tion to the proposed plan. CONCLUSIONS A natural drainage course exists in the southernmost corner of the 20 -foot pro- tection easement. Protection and replanting of the area adjacent to the course should be shown on the revised plat and landscape plan. The area should be maintained with an easement and the proposed fence should be placed along the subdivision side of the easement. The previous proposal encompassed Lots 20 and 19, and was denied the requested comprehensive plan amendment and rezone. The subject application, Mapletree Park plat, is limited to Lot 20 and is designed in accordance with the existing R -1 -12.00 zoning. FINDINGS A. The applicant and property owner, Schneider Homes, Inc., is requesting approv- al of a preliminary plat for fourteen (14) single family lots. (Exhibit 1) B. The subject site is Lot 20 of the Interurban Addition, a 4.80 acre site, that is bounded by South 151st Street, 65th Avenue South, Lot 19 of the Interurban Addition and unimproved 62nd Avenue South. C. The property is zoned R -1 -12.0 Single Family Residential, which requires a minimum lot size of 12,000 square feet. The plat map notes that the smallest lot size is 12,000 square feet. D. New streets to be developed as part of the subdivision - 63rd Place South and South 151st Place - would provide private dead end access to only the subdivi- sion lots. E. Sewer and water service will be provided by the City of Tukwila. Existing lines are available in 65th Avenue South and 151st Street. F. The Preliminary plat has been transmitted to the departments and agencies serving the subdivision area. G. According to the Subdivision Code, TMC 17.12.030(7)(a), the Planning Commis- sion shall, after review of the Preliminary Plat, Planning Department recom- mendation, testimony, and exhibits submitted at the public hearing, recommend to the City Council approval, conditional approval or disapproval of the plat. The Planning Commission recommendation shall be made at the public meeting or within fifteen (15) calendar days of the public hearing date, unless the PLANNING COMMISSION STAFF REPORT Mapletree Park Page 2 applicant agrees to waive such time limit. The fifteen day time limit would expire on Friday August 8, 1986. H. The Planning Commission, prior to any approval of a Preliminary Plat, shall specify all minimum street and utility improvements or reasonable conditions deemed necessary to fulfill the purpose of the Subdivision Code. I. The minimum standards for residential subdivision per TMC 17.24 are as follows: (1) 17.24.020 Street Layout - Street layout should provide for the most advantageous development of the subdivision, adjoining areas, and the entire neighborhood. The proposed street layouts would be self- serving and are designed as cul -de -sacs. The grade in the cul -de -sacs appear to exceed the maximum allowable of 15 percent. (2) 17.24.040 Public (Private) Rights -of -Way - The following minimum street widths shall apply unless otherwise approved by the Department of Public Works and authorized by the City Council in approval of the Preliminary Plat. RIGHT -OF -WAY PAVEMENT Local Street 50' 30' Cul -de -Sac: Roadway 40' 26' Turnaround 80' diameter 60' diameter The plat shows a T- shaped street layout with dead end cul -de -sacs. Right -of- way widths are fifty (50) feet with turnaround diameters of approximately one hundred (100) feet. Planters are located in the center of the cul -de -sacs. The Fire Department requires a minimum turning radius of thirty -five (35) feet and no obstructions in turnarounds, and therefore is not in favor of the planters. Planning Department staff feels that the planters provide visual relief and provide an important function in cul -de -sacs, if the minimum re- quired turning radius can be maintained. (3) 17.24.040(2)(3) Right -of -Way Design and Improvement - The design and improvements shall conform to Public Works Standards. (4) 17.24.040(4) Utilities - All utilities designed to serve the subdivision shall be placed underground. Those utilities to be located beneath paved surfaces shall be installed, including all service connections, as ap- proved by the Department of Public Works; such installation shall be completed and approved prior to application of any surface materials. Adequate sewer and water capacity is available to serve the subdivision. (a) Sanitary Sewers: Sanitary sewers shall be provided at no cost to the City and designed in accordance with City standards. PLANNING COMMISSION STAFF REPORT Mapletree Park Page 3 (b) Storm Drainage: An adequate drainage system shall be provided for the proper drainage of all surface water; the amount of runoff shall be determined by the Rational Method. Cross drains shall be pro- vided to accommodate all water flow and shall be of sufficient length to permit full width roadway and required slopes. The dia- meter to be provided shall be determined by Manning's Equation, but in no case shall the inner diameter be less than twelve (12) inches. (c) Water System: The water distribution system including the locations of fire hydrants shall be designed and installed in accordance with City standards. (5) 17.24.040(5) Public Use and Service Areas - Due consideration shall be given by the subdivider to the allocation of adequately sized areas for public service or usage. (a) Easements: Easements may be required for the maintenance and opera- tion of utilities as specified by the Public Works Department. A twenty (20) foot wide native growth protection easement is shown along the west property line of the subject parcel. (b) Community Assets: Due regard shall be shown for all natural fea- tures such as large trees, water courses, historical sites and similar community assets which, if preserved, will add amenity and value to the property. The easement described above provides a small amount of protection for an existing drainage course along the west side of the property. Large trees were identifies on the site as part of the application for Mapletree Village and are located primarily around the perimeter of the site. (6). 17.24.040(6) Blocks (a) Length: Blocks should not be less than three hundred (300) feet nor more than one thousand (1,000) feet in length. Where circumstances warrant, the Planning Commission may required one (1) or more public pathways of not less than six (6) feet nor more than fifteen (15) feet in width dedicated to the City to extend entirely across the width of the block at locations deemed necessary. Block lengths of 250 and 280 feet will be created along South 151st Street. The internal block created by the new street system is approximately 400 feet. (b) Width: Blocks shall be wide enough to allow two (2) tiers of lots, except where abutting a major street or prevented by topographical conditions or size of the property, in which case the Planning Commission may approve a single tier. 65th Avenue and South 151st Street are designated as collector arterials and not as a major street. Topographical features such as the steep grade of approxi- PLANNING COMMISSISN STAFF REPORT Mapletree Park Page 4 mat:ly 58 percent, along the 65th Avenue South property line, the nat ral drainage area and public trail along the 62nd Avenue South pro erty line, and the relatively small size of the site makes block wid hs with two tiers difficult. (7) 17.28.02x(7) Lots (a) Arr ngement: Insofar as practical, side lot lines shall be at right ang es to street lines or radial to curved street lines. Each lot mus have access to a public street. The proposed lots are arranged wit either straight or radial side lot lines. (b) Min mum Size: The size, shape, and orientation of lots shall meet or xceed the minimum area and width requirements of the applicable zon ng classification and shall be appropriate for the type of Be- vel pment and use contemplated. The zoning code requires a minimum lot size of 12,000 square feet and minimum mean lot widths of 50 fee . Actual lot size and minimum mean lot widths will be required on he preliminary plat prior to final approval. (c) Cor er Lots: Corner lots may be required to be platted with addi- tio al width to allow for the additional side yard requirements. The two corner lots in the plat, Lots 1 and 14, are sufficiently wid (102 feet each) to allow for the additional side yard require - men s while maintaining a buildable lot area. (d) Thr ugh Lots: Residential through lots shall be permitted access to onl one (1) of those streets, unless otherwise approved by the Dep rtment of Public Works. Lots 2, 3, 4, 13, 12, 11 and 10 would all be classified as through lots with two front yard setback re- qui ements. The note on the preliminary plat states that access for all of the lots within the subdivision is to the interior roads onl . (e) Property Corners at Intersection: All lot corners at intersections of dedicated public rights -of -way shall have a minimum radius of twe ty -five (25) feet. (8) 17.24.041(8) Other Im'rovements (a) Mon ments: (i) Concrete permanent control monuments shall be established at each and every controlling corner of the subdivision. Interior monuments shall be located as determined by the Department of Public Works. (ii) All other lot corners shall be marked with suitable metal or wood markers. PLANNING COMMISSION STAFF REPORT Mapletree Park Page 5 (2) Street and utilities must be constructed to minimum City standards, including 80 -foot diameter cul -de -sacs, and be dedicated to City upon completion and approval of Public Works Department. Improvement will include street lights and sidewalks. (3) An engineered grading plan for permit application and review will be required. (4) Retaining walls (no rockeries will be in excess of four (4) feet in height) will be designed with assumed hydrostatic pressures and slope surcharge. (5) Stripped vegetation will be removed from the site during site prepara- tion. CONCLUSIONS A. The proposed street layout, while meeting City requirements, does not provide the most advantageous opportunity for development of the adjoining area to the south. That area is of a similar size, zoned R -1 -12.0 and will be restricted to access onto 65th Avenue South with a dead end street. The proposed layout does provide a buffer for proposed lots 10, 11 and 12 along 65th Avenue South by allowing them to access to the interior of the site. The grade of the street will not be allowed to exceed 15 percent. B. The street right -of -way meets the minimum width standards for a local street and exceeds the minimum standards for a cul -de -sac and turnaround. A private street can be difficult for private individuals to maintain, therefore, staff would recommend that the street become a public right -of -way with both the utilities and street improvements turned over to the city. The landscape islands in the center of the cul -de -sacs would be difficult to maintain and would present turning problems for the Fire Department and maintenance prob- lems for the Public Works Department. Staff recommends that maintenance of the islands be required of the property owners in the subdivision covenants. The size, curbs and plant materials could also be designed to minimize inter- ference. (b) Street Signs: The subdivider shall be responsible for the initial ing installation thereof, necessary in the subdivision as required by the Department of Public Works. J. A Determination of Nonsignificance was issued on the project with the follow- ing conditions. (1) Native protection easement must remain open and in its natural state with a fence erected along the west property line prior to final plat approv- al. Maintenance for fence shall be contained in subdivision covenants. PLANNING COMMISSION STAFF REPORT Mapletree Park Page 6 C. A survey should indicate the location of significant trees on site that can be maintained around the perimeter of the site and the individual lots. D. Due to the relatively small size of the parcel and the steep grade and natural drainage course on the east and west sides respectively, the single tier lots could be approved by the Planning Commission. E. The lots appear to meet the zoning code requirements; however, the final plat should contain the area of each lot and a note indicating the smallest mean lot width. F. The applicant upon approval of the preliminary plat would be required within one year after the approval date to file a final plat in conformance with the conditions of the preliminary plat approval and with the requirements of TMC 17.12.040. RECOMMENDATION Staff recommends that the Planning Commission move to adopt the Findings and Conclusions of the staff report dated July 24, 1986, and recommend to the City Council approval of the application subject to the following conditions: 1. Develop street curbs, gutters, sidewalks, street lights, and fire hydrants to minimum City standards and dedicate to City upon satisfactory completion of improvements. 2. Revise street grades to eliminate slopes in excess of 15 percent. 3. Develop sewer and water in conformance with City Comprehensive Utility Plans and improve to City standards. 4.
