Minutes for the Board of Adjustment meeting for August 7, 1986.
Members present were Mrs. Regel, Joan Hernandez and Curt Nesheim. Repre-
senting staff were Moira Bradshaw, Brad Collins and Kathy Stetson.
The meeting was called to order at 7:00 p.m.
86 - - Sound Utilities - Requesting a variance from TMC 18.52.040, out-
door screening of a contractor's storage yard at 4512 South 131st Place.
Mr. Nesheim opened the public hearing.
Ms. Bradshaw entered the staff's Findings and Conclusions into the record
and summarized the Staff Report.
Nick DeGidio, 1100 Maple Avenue S.W., Renton, representing Sound Utilities
commented on the height of the equipment to be stored, the height of the
proposed fence and the location of the freeway off -ramp.
Mrs. Hernandez asked if the lot was currently vacant and the possibility of
utilizing some kind of natural vegetation as a screen.

Larry Shaw, 4310 South 131st Place, entered a letter into the record as
Exhibit 5 and requested that the Board deny the requested variance because
the view from the freeway off -ramp would have an adverse effect upon
Mr. Shaw's development next door. Mr. Shaw was concerned that a precedent
would be set for the area.

86 -38 -V: Gary Bryan - Requesting a variance from TMC 18.50.020, minimum
mean lot width for a lot at 14410 - 56th Avenue South.
Ms. Bradshaw entered the staff's Findings and Conclusions into the record
and summarized the Staff Report.
Mr. Nesheim opened the public hearing.
Gary Bryan, 3316 - 53rd Avenue N.E., Tacoma, applicant explained the reason
for requesting the variance at this time due to his selling of the property
and the subsequent problems in obtaining title insurance.
Shirley Segal, 5651 South 144th, Tukwila, sited her concern with a possible
precedent set for small lots.
Mr. Bryan indicated that the lot created would meet the minimum lot width
of 7,200 square feet.
Robert Norris, 2416 Alvarado Drive, Bellingham, asked about the property
being a nonconforming lot.
Ms. Bradshaw explained that, as it exists with two houses on one lot of
record, it is a nonconforming lot. It would be less nonconforming to
have the two existing single - family houses each on their own lot of record.

Dear Board Members:
We no not believe a variance of the code is appropriate
in this instance.
The proposed contractor's yard is directly adjacent to our
building which we have developed to high quality standards.
The purpose of such screening is to shield the unsightly
yard and equipment from both adjacent property owners and
passersby. The image of our building from the freeway
would be significantly compromised if a directly adjacent
construction yard was largely visible.
We, therefore, urge your denial of this application.

INTRODUCTION
The Board of Adjustment is being requested to vary the screening requirement
around a contractor's storage yard.
FINDINGS
A. The applicant is proposing to screen three of the four sides of the subject
lot.
B. The applicant is requesting a variance from Tukwila Municipal Code (TMC)
18.52.040(2) Outside Storage: Outdoor storage shall be screened from abut-
ting public streets and from adjacent properties. Such screens shall be a
minimum of eight feet high and not less than sixty percent of the height of
the material stored.
C. The applicant is proposing to locate a contractor's storage yard per TMC
18.40.020(3), which permits storage yards subject to the screening require-
ments of Chapter 18.52 in the M -1 district.
D. The subject property is located north of S. 131st Place, southeast of 44th
Place South and generally east of State Route 599 (Exhibit 1).
E. The applicant is proposing a chain link fence around the four sides of the
property with a black plastic screening material to be used on three sides
(Exhibit 2).
F. Front yard landscaping is being provided as required per TMC 18.52.020.
G. The property is bounded by an office /warehouse facility across 44th Place
and a nonconforming contractor's yard along the applicant's southeast.prop-
erty line. Properties on the other side of 131st Place are undeveloped
and /or residential. As the applicant has stated, State Route 599 bounds the
property along the east side.
H. The Board of Adjustment shall use the criteria of TMC 18.72.020 in its deci-
sionmaking. The applicant has submitted Schedule F in response to the fire
criteria (Exhibit 4).

CONCLUSIONS
A. TMC 18.72.020(1): The variance shall not constitute a grant of special priv-
ilege inconsistent with the limitation upon uses of other properties in the
vicinity and in the zone in which the property on behalf of which the appli-
cation was filed is located.
The City has not to date granted any variances from this section of the code
regarding screening of storage yards. Work on the adjacent storage yard was
started illegally although a building permit has since been submitted and is
currently being processed.
The intent of the requirement is to provide screening from adjacent rights -
of -way. The opaque screen along the SR 599 side would be ineffective
because the state highway is above the subject site. Therefore, a variance
would not be a grant of special privilege.
B. TMC 18.72.070(2): The variance is necessary because of special circumstances
relating to the size, shape, topography, location or surrounding of the sub-
ject property in order to provide it with use rights and privileges permit-
ted to other properties in the vicinity and in the zone in which the subject
property is located.
The variance is being requested because the applicant feels that the eleva-
tion of the adjacent state highway would render a screening material on the
rear fence as ineffective. This is a special circumstance that is unique to
the property. The code requirement would be irrelevant and the variance
appropriate.
C. TMC 18.72.070(3): The granting of such variance will not be materially
detrimental to the public welfare or injurious to the property or improve-
ments in the vicinity and in the zone in which the subject property is
situated.
The granting of the variance would not appear to significantly change the
views of the property from the north side. As the applicant has stated, the
State highway is elevated above the top of the fence line and the vantage
from the right -of -way will be from above. Therefore, staff does not feel
that granting the variance would be detrimental to the public welfare or
injurious to surrounding properties. Partial screening of the yard could be
accomplished with a natural evergreen screen that has a tall average height.
D. TMC 18.72.070(4): The authorization of such variance will not adversely
affect the implementation of the comprehensive land use policy plan.
Granting the variance would not appear to adversely affect implementation of
the Comprehensive Plan.
E. TMC 18.72.070(5): The granting of such variance is necessary for the pres-
ervation and enjoyment of a substantial property right of the applicant
possessed by the owners of other properties in the same zone or vicinity.

A property right of the applicant possessed by the owners of other. proper-
ties in the same zone would perhaps be the right to not screen a storage
yard. The intent of the code is to provide screening of storage yards.
Because of the location of the subject lot and the adjacent right -of -way,
the code's requirement is ineffective. A substitute for a solid fence would
be an evergreen tree that would normally exceed the height of the required
fence and grow to at least eye level of the passing vehicles.
In addition, the code requires that sixty percent of the height of the
stored items be screened. Several large construction vehicles are proposed
to be parked on the site. A height limit of 13.4 feet would be allowed
given the current height of the fence. The Board may wish to grant the
variance and stipulate that the height of any stored items be limited re-
gardless of the surrounding fence due to the adjacent highway and the lack
of screening on the one side.
RECOMMENDATION
Staff recommends that the Board adopt the Findings and Conclusions of the Staff
Report and approve the requested variance, subject to a natural evergreen
screen.
