Repre- senting staff were Moira Bradshaw, Brad Collins and Kathy Stetson. The meeting was called to order at 7:00 p.m. 86 -36 -V: Sound Utilities - Requesting a variance from TMC 18.52.040, out- door screening of a contractor's storage yard at 4512 South 131st Place. Mr. Nesheim opened the public hearing. Ms. Bradshaw entered the staff's Findings and Conclusions into the record and summarized the Staff Report. Nick DeGidio, 1100 Maple Avenue S.W., Renton, representing Sound Utilities commented on the height of the equipment to be stored, the height of the proposed fence and the location of the freeway off -ramp. Mrs. Hernandez asked if the lot was currently vacant and the possibility of utilizing some kind of natural vegetation as a screen. Mr. Nesheim closed the public hearing. MRS. Mr. Shaw was concerned that a precedent would be set for the area. Mr. Nesheim closed the public hearing. MRS. Ms. Bradshaw entered the staff's Findings and Conclusions into the record and summarized the Staff Report. Mr. Nesheim opened the public hearing. Gary Bryan, 3316 - 53rd Avenue N.E., Tacoma, applicant explained the reason for requesting the variance at this time due to his selling of the property and the subsequent problems in obtaining title insurance. Shirley Segal, 5651 South 144th, Tukwila, sited her concern with a possible precedent set for small lots. Mr. Bryan indicated that the lot created would meet the minimum lot width of 7,200 square feet. Robert Norris, 2416 Alvarado Drive, Bellingham, asked about the property being a nonconforming lot. Ms. Bradshaw explained that, as it exists with two houses on one lot of record, it is a nonconforming lot. It would be less nonconforming to have the two existing single - family houses each on their own lot of record. Mr. Nesheim closed the public hearing. MRS. Mr. Nesheim opened the public hearing. Ms. Bradshaw entered the Staff's Findings and Conclusions into the record and summarized the Staff Report. James McKinley, 4404 South 164th Street, presented diagrams and site plans indicating his property and neighboring properties and their respective setbacks. He also explained the necessity of the size of the carport and the type of construction buttressing needed to stabilize the structure. He entered Exhibit 8A into the record: a petition from surrounding property owners in support of allowing the variance. Mr. Nesheim expressed his concern with the precedent set for future home improvements if this variance is granted. Mr. Collins asked about alternative methods of construction. Mr. Nesheim closed the public hearing. MRS. HERNANDEZ MOVED TO ACCEPT THE STAFF'S FINDINGS AND CONCLUSIONS THAT CRITERIA ONE HAD BEEN MET. The motion died for lack of a second. MRS. The meeting was called to order by Vice- Chairman Nesheim at 7:10 p.m. Members present were Ms. Regel, Mr. Goe and Mr. Nesheim. Staff members present were Brad Collins, Moira Bradshaw and Kathy Stetson, Planning Department and Jim Haney, City Attorney. Mr. Nesheim indicated that a letter of resignation from Ms. Harris had been received. He also stated that Ms. Altmayer had indicated that she would be arriving late. MR. GOE MOVED TO ADOPT THE MINUTES AS PRESENTED. MS. REGEL SECONDED THE MOTION, WHICH PASSED UNANIMOUSLY. A discussion on the Rules of Procedure ensued. Mr. Haney suggested some possible changes or interpretations which would allow Board members some discretion for continuing a public hearing or meeting. Mr. Nesheim inquired about the use of "executive session." Mr. Haney ex- plained the use of "executive session." Ms. Altmayer arrived at 7:45 p.m. Mr. Nesheim read the following into the record as a suggested new Article V, Section I: "The Board shall hear all applications no later than sixty days after filing of an application and shall decide all applications no later than forty -five days after the public hearing." MR. GOE MOVED TO ADOPT THE. NEW SECTION AS READ INTO THE RECORD BY MR. NESHEIM AS ARTICLE V, SECT. 2, AND RENUMBER THE REMAINING SECTIONS AS NEEDED. MS. Ms. Bradshaw read the paragraphs into the record as follows: "The Tukwila Board of Adjustment (hereinafter referred to as the Board) shall be governed by the provisions of RCW'35A.63.110, Tukwila ordinances #860 and #871, the Tukwila Zoning Ordinances (Title 18 of the Tukwila Municipal Code as amended), and the rules of procedures set forth herein, as adopted by the Board. No rule herein shall be changed or waived without the affirmative vote of three members of the Board." "In the event a Board member is absent from three consecutive meetings and unless excused by a majority vote of the members pre- sent, the Board shall declare that particular position vacant and shall so notify the appointing authority." The applicant, Gary Bryan, purchased Lot 8, Block , 5, Hillman's Seattle Garden Tract prior to 1969 at which time the lot was developed with a single- family unit addressed as. 14416 - 56th Avenue South. In 1969 the applicant was issued a building permit by the City of Tukwila for a second single - family home addressed as 14410 - 56th Avenue South on the same lot. The applicant has applied for a short plat to divide the one lot into two lots; however, Lot 2 of the proposed short plat (86- 29 -SS) does not meet the minimum mean lot width of 50 feet for R -1 zones (Exhibit 1). FINDINGS A. The applicant is..requesting a variance., from Tukwila Municipal Code •(TMC) 18.50.020, Minimum Mean Lot Width - 50 feet required,.38.5 feet provided - for proposed Lot 2 of Tukwila Short Plat 86- 29 -SS. B. Proposed Lots 1 and:2 would both meet the minimum lot size requirement of 7,200 square feet :and the minimum side yard requirement :of 10% of lot width adjacent to the proposed new lot line. C. The existing house on proposed Lot 2 has a .nonconforming front ; yard of 10 feet (30 feet required). The existing home on proposed Lot 1 a non- conforming north side yard of 1.35 feet (5.2 feet required).. D .. The Board of Adjustment shall use the criteria of TMC 18.72.020 in its deci- sion making. A. TMC 18.72.020(1): The variance shall not constitute a grant of special priv- ilege inconsistent with the limitation upon uses of other properties in the vicinity and in the zone in which the property on behalf of which the appli- cation was filed is located. PLANNING COMMISSION 86 -38 -V: Gary Bryan STAFF REPORT Page 2 Property owners in platting property would normally be limited to a minimum lot width of 50 feet. The applicant's lot has already been developed and therefore the limitations exceeded. By granting a variance, the City would be lessening the degree of nonconformity and allowing separate ownership for the two single - family dwellings. B. TMC 18.72.070(2): The variance is necessary because of special circumstances relating to the size, shape, topography, location or surrounding of the subject property in order to provide it with use rights and privileges per- mitted to other properties in the vicinity and in the zone in which the subject property is located. The applicant was issued a building permit that essentially allowed two single - family units on one lot of record. At the time of construction the City required minimum mean lot widths of 50 feet. The variance is being requested to allow separate ownership of the two units through the 'creation of two lots of record. The building permit issued to the applicant and the location of the structure prohibits a logical lot line which would comply with the 50 -foot requirement. The current zoning code TMC 18.12.030(1) specifically prohibits more than one dwelling per lot. Therefore the re- quested variance would lessen the degree of nonconformity. C. TMC 18.72.070(3): The granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improve- ments in the vicinity and in the zone in which the subject property is situated. The granting of the variance would not be materially detrimental because the structures are existing. The variance is being requested to allow the crea- tion of a lot line between the two dwellings to allow separate ownership. O. TMC 18.72.070(4): The authorization of such variance will not adversely affect the implementation of the comprehensive land use policy plan. The authorization of the variance would not adversely affect the implementa- tion of the comprehensive plan. E. TMC 18.72.070(5): The granting of such variance is necessary for the pres- ervation and enjoyment of a substantial property right of the applicant possessed by the owners of other properties in the same zone or vicinity. A mean lot width of less than 50 feet is not possessed by the owners of other properties in the area. However, a financial property right of most single - family home owners is the ability to purchase or sell lot and home. Without a lot of record, the applicant is denied a substantial property right possessed by the other property owners in the area.
