area of non - conforming legal lot at 5121 South 164th in an R -1 -9.6 district
from 8,700 square feet to 8,300 square feet.
Mr. Beeler summarized the Staff Report.
The Board members asked about the minimum lot size, the history of the
property, and the lot size requirements of King County in the surrounding
area.
Mr. Nesheim opened the public hearing.
Fred Lintow, 16418 - 52nd Avenue South, stated his agreement with the Staff
Report and emphasized that his request would not change the existing use.
He stressed his need for the area for a proposed remodeling project, and
stated that other lots in the area do not meet the minimum lot size re-
quirements.

86 -39 -V: Southland Corporation requesting variances from TMC 18.52.020,
Front and Side Yard Landscape Requirements: 10 feet and 5 feet required, 6
feet and zero feet requested, respectively; from TMC 18.52.030, Special
Landscape Requirements: 10 feet on southwest side required, 8 feet request-
ed; from TMC 18.50.020, Setback Requirements: 20 foot front yard required,
8 feet requested, 10 foot side yards required, zero feet and 8 feet re-
quested, on the lower half of Lots 21, 22, 25 and 26 and Lot 20, Hillman's
Seattle Garden tracts and Lots 2 and 3 Tukwila Short Plat 80 -24 -SS located
at 14211, 14213, 14221 Interurban Avenue South. '
Mr. Beeler summarized the Staff Report.
The Board members asked about access to the site, the steepness of the
slope behind the proposed building, parking, location of the gasoline
island, and clarification of the seven variances requested.
Mr. Nesheim opened the public hearing.
Steve Lawson, 1035 Andover Park West, Tukwila, representing the Southland
Corporation, explained the reasons for wanting to relocate the store, and
stated his feelings that the proposal would lessen the degree of noncon-
formity which currently exists and be a much more aesthetically pleasing
development on the site. He stressed the "Phase II" portion of the site
plan is only an idea, and that Southland would be selling that portion of
the property. Mr. Lawson submitted several additional exhibits:

Mr. Lawson pointed out that the two -foot landscape and building setback
variance requested for the rear of the building is only for 11 linear feet
due to the configuration of the toe of the hill. The remainder of the
building would be in conformity along that side. He explained the reason
for the location of the gasoline island.
Mrs. Altmayer asked about the location of the gasoline island, the curb cut
on South 58th and the difference in size between the old 7 -11 store and the
proposed new one.
Mr. Goe asked about the choice of building placement, the maneuverability
of gasoline tankers within the site, and the possibility of utilizing the
existing underground gasoline storage tanks.

Mrs. Altmayer asked Mr. Beeler if the seven variances being requested were
to be decided separately or as a whole.
Mr. Beeler said that each could be considered separately, or the Board may
wish to decide them as one.
Jim McKinley, 4404 South 164th, stated his opposition to the proposed vari-
ances. He felt that the lot was not of an adequate size for the proposed
development. He was also concerned with the access locations off Inter-
urban and the possibility of heavy traffic congestion.
Mr. Lawson stated that the store will not generate any new traffic along
Interurban, but will be capitalizing on the existing traffic. He pointed
out that the northwest access onto Interurban will be a right- and left -in,
but only a right -out.
Mr. Nesheim closed the public hearing.
Mr. Beeler labeled the additional exhibits entered as follows:

Mr. Goe asked staff for a synopsis of the plans for improving Interurban
Avenue.
Mr. Beeler explained that the City plans call for sidewalks and landscaping
on both sides of the street to create a more aesthetically pleasing area.
He also explained the role of the Board of Architectural Review in the
Interurban Special Review area.
The Board discussed traffic patterns, access, possible congestion, location
of the gasoline island, and hours of operation.

AS ONE ISSUE IN THE DECISION- MAKING PROCESS. MRS. REGEL SECONDED THE
MOTION.
Mrs. Altmayer stated that she felt the motion is determining policy, which
is not property dealt with by a motion.

INTRODUCTION
The Lintows applied for a Boundary Line Adjustment between their property and
the Taimis. Prior to adjusting the boundary line, the Board of Adjustment would
be required to approve the reduction in lot size of an existing nonconforming
lot.
FINDINGS
1. The co- applicants are requesting a variance from TMC 18.50.020: 9,600
required, 8,700 existing, and 8,300 requested.
2. The subject area was annexed into the City in 1960 and was simultaneously
zoned as R- 1 -9.6. (Exhibit A)
3. The two lots involved, Lot A and Lot B (Exhibit B) of the proposed Boundary
Line Adjustment measures 8,700 and 9,400 square feet respectively.
4. Both lots are developed with single - family homes. The proposed boundary
line adjustment would follow the line of an existing fence line. The bound-
ary line is being adjusted to allow the addition to the house addressed as
16418 - 51st Avenue South, and to allow alignment along a fence line and use
area that has existed for 23 years. Exhibit C shows the fence line between
Lot A and Lot B and the patio area of Lot A in the area of adjustment. The
subject area measures 400 square feet.
CONCLUSIONS
1. TMC 18.72.020(1) - The variance shall not constitute a grant of special
privilege inconsistent with the limitation upon uses of other properties in
the vicinity and in the zone in which the property on behalf of which the
application was filed is located.
The King County Assessor's map (Exhibit D) which shows lot size, when com-
pared to the zoning map, does indicate that many lots are nonconforming in
size by hundreds and thousands of feet. It would therefore not appear to be
a grant of special privilege. The limitation upon uses of other properties
is the inability to create lots of less than 9,600 square feet. Granting

the variance would therefore be inconsistent with the limitations imposed on
property owners who are desiring to subdivide their properties. Existing
nonconforming lots however are allowed to be developed and used for single-
family purposes.
2. TMC 18.72.070(2) - The variance is necessary because of special circum-
stances relating to the size, shape, topography, location or surrounding of
the subject property in order to provide it with use rights and privileges
permitted to other properties in the vicinity and in the zone in which the
subject property is located.
The special circumstances which appear to exist in this case is an irreg-
ularly shaped lot whose rear lot line has been misconstrued by the two
adjacent, past, and present property owners. As Exhibit E illustrates, the
Lot B property owner assumed a rear line at the fence and Lot A property
owner, as indicated on the site plan, has a patio built to the fence line.
the variance does not, however, appear necessary to provide it with the use
rights of the R -1 zone, which is to develop a single- family home.
The Lot A property owner wishes to own the 400 - square foot area. Approval
of the variance would facilitate a boundary line adjustment to coincide with
the use patterns which have been established on the property since the erec-
tion of the fence 23 years ago.
3. TMC 18.72.070(3) - The granting of such variance will not be materially
detrimental to the public welfare or injurious to the property or improve-
ments in the vicinity and in the zone in which the subject property is
situated.
The properties have been used as 8,300- and 9,400- square foot lots for the
past 23 years. Improvements as shown on the site plan are existing. There-
fore, it would not appear to be materially detrimental to property or
improvements.
4. TMC 18.72.070(4) - The authorization of such variance will not adversely
affect the implementation of the comprehensive land use policy plan.
A review of the City's Comprehensive Land Use Policy Plan reveals that the
approval of the requested variance does not conflict with the Plan's goals
or policies.
5. TMC 18.72.070(5) - The granting of such variance is necessary for the pres-
ervation and enjoyment of a substantial property right of the applicant
possessed by the owners of other properties in the same zone or vicinity.
As the applicant has indicated in Schedule F, the 400 - square foot area could
legally be claimed by the owners of Lot A (through adverse condemnation). A
quick claim deed process was started by both property owners in February of
1986, but is on hold pending the proposed Boundary Line Adjustment. The
current property owner of Lot A bought the property in 1968, eighteen years
ago. The request by the applicant to reduce the area of lot size even fur-

lines of the two subject lots to coincide with established use of the lots.
RECOMMENDATION
The staff recommends that the Board of Adjustment make a motion to adopt the
Findings and Conclusions of the Staff Report of September 4, 1986, and approve
the requested variance.

AN ORDINANCE OF THE TOWN OF TUKWILA APPLYING A ZONING TO AN
AREA ANNEXED TO THE TOWN OF TUKWILA UNDER ORDINANCE NO. 306
AS AMENDED BY ORDINANCE NO. 312.
WHEREAS, the Tukwila Town Council, acting upon the recommendation
of the Tukwila Planning Commission, extended the Tukwila Comprehensive
Zoning Plan into the area annexed and described in Tukwila Ordinance
No. 306 and amended by Ordinance No. 312 and applied to said area a
zoning of R -M -H, as defined in Tukwila Ordinance No. 298, to that
portion of the area lying north of South 160th Street; and applied
to said area a zoning of R- 1 -9.6, as defined in Tukwila Ordinance
No. 251, to that portion of the said area lying south of South 160th
Street.
NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF TUKWILA
as follows:
SECTION 1. That a zoning of R -M -H, as defined in Tukwila Town
Ordinance No. 298, be applied to that portion of land lying north
of South 160th Street, annexed to Tukwila under Ordinance No. 306,
amended by Ordinance No. 312; and that a zoning of R- 1 -9.6, as
