The conditions of approval are: 1. The reveal shall be 6" wide. 2. The reveal shall be the same color as the copy (white) and extend around the sign. 3. At no time shall the area below the reveal be used as a sign. Per Tukwila Municipal Code 19.12.040, the action of the Board shall be final unless, within 40 days of the Board's action, the applicant or an aggrieved party makes an application to the Superior Court of King County for a writ of certiorari, a writ of prohibition or a writ of mandamus. VanDusen, Mayor BOARD OF ADJUSTMENT Minutes for the Board of Adjustment meeting of October 2, 1986. The meeting was called to order at 7:00 p.m. Members present were Mrs. Hernandez, Mrs. Regel, Mr. Nesheim, Mr. Goe and Ms. Altmayer. Representing staff were Jack Pace and Kathy Stetson. Approval of the minutes was postponed until the end of the evening's meeting. 86 -47 -APP: Kaiser Development, appealing staff's interpretation of the City's Sign Code definition for sign area and background area. Mr. Pace summarized the Staff Report. Mr. Goe asked about the support structure, any existing foliage at the site, the size and location of the "break" in the face of the sign, and the possibility of reducing the size of the skirting. Ms. Altmayer inquired if the skirting should be included in the calculation of the area of the sign face. Ms. Hernandez asked if the sign code limits the size of a sign base. Jerry Kirkpatrick, Kaiser Development, 300 Lakeside Drive, Oakland, CA, explained the need for the sign, the location requested, and the reason for requesting the skirting. Joe Kazenza, Kaiser Development, explained his interpretation of TMC 19.08.040. Mr. Goe asked the size of the reveal as shown in Exhibit 1. (photos) Ms. Altmayer asked about the height of the sign and suggested lowering it and camouflaging the support posts with foliage. Mr. Goe suggested changing the color of the skirting or decreasing its size by insetting the support posts. Mr. Kazenza stated that the structural integrity of the sign would be decreased if the skirting area was inset. He said that a change of color would be acceptable. n s. 1. ! .. The Board discussed other possible changes to the sign including reducing the overall size, various reveal sizes, and color changes. Mr. Nesheim closed the public hearing. The Board discussed the aesthetics of the proposal, interpretations of the sign code, and ways to achieve visual separation of the sign face from the base area. MRS. ALTMAYER MOVED THAT THE APPLICATION BE APPROVED WITH THE FOLLOWING CONDITIONS: 1. A SIX -INCH WIDE REVEAL IN THE POSITION AS SHOWN IN EXHIBIT 1. 2. THE REVEAL PAINTED THE SAME COLOR AS THE LETTERING OF THE SIGN AND GO AROUND ALL SIDES OF THE SIGN BASE. 3. AT NO TIME SHALL THE LOWER PORTION BE USED AS A SIGN. MRS. REGEL SECONDED THE MOTION, WHICH PASSED UNANIMOUSLY. Minutes MRS. REGEL MOVED TO APPROVE THE MINUTES OF THE AUGUST 7, 1986 MEETING AS PRESENTED. MRS. HERNANDEZ SECONDED THE MOTION, WHICH PASSED UNANIMOUSLY. MR. GOE MOVED TO APPROVE THE MINUTES OF THE SEPTEMBER 4, 1986 MEETING AS PRESENTED. MRS. ALTMAYER SECONDED THE MOTION, WHICH PASSED UNANIMOUSLY. Adjournment The meeting was adjourned at 8:10 p.m. Respectfully submitted, Jack Pace Planning Department CI T Y OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT AGENDA ITEM 86 -47 -APP: Kaiser Development INTRODUCTION Kaiser Development Company wants to build a specific freestanding sign at the entrance to Gateway Corporate Center (Interurban Avenue South and South 133rd Street). The Sign Code permits this sign, but Kaiser disagrees with staff's interpretation that the sign area exceeds the code requirements (see Attachment A). Kaiser is appealing staff's interpretation. FINDINGS 1. Freestanding signs are permitted as either temporary real estate or perman- ent signs. Because the proposed sign is to be permanent and to identify Gateway Corporate Center (Attachment B), staff found the sign to be a per- manent freestanding sign. 2. TMC 19.08.210 defines a sign to be: Sign means any medium, including paint on walls, merchandise, or visual communication device, its structure and component parts, which is used or intended to be used to attract attention to the subject matter for advertising or identification purposes. Bulletin boards and reader boards are considered signs. 3. TMC 19.08.040 defines sign area as: Area and background area means the entire face of a sign or panel upon which copy or insignia may be placed. Where separate letters or shapes are used, the sign area shall be that encompassed by drawing lines at the extremities of the shapes to be used. The maximum permitted size of a freestanding sign (for this property) is 100 square feet and a total of 200 square feet for all sides (TMC 19.22.140(C)). 5. Based upon the definitions of sign and sign area , staff found the sign area of the proposed sign to be the entire 160 - square foot face of the sign and a total sign area over 326 square feet (see Attachment B). 6. The applicant believes the sign area should be interpreted "as the zone encompassed by straight lines around the copy or insignia ", or total square feet (Attachment A). 7. The exclusive test of this appeal is whether or not the appeal demonstrates that staff clearly errored in the interpretation of TMC 19.08.040 and 10.08.210. In other words, if reasonable people can see these sections in different ways, then an error is not clearly made. CONCLUSIONS 1. The visual area of the proposed sign (inverted solid rectangle) is substan- tially greater than the same message mounted on a slender pole. Staff viewed the visually more dominant proposal to be a mass which visually constituted a single element, or sign. That mass is as much of a sign as the message itself. BOARD OF ADJUSTMEMT (._.. Because the method used by staff is commonly used in the sign industry and is logical from an aesthetic viewpoint, staff feels an error was not clearly made. The appeal (Attachment A) does not demonstrate that staff so clearly errored. 3. Identification of the Gateway Corporate Center is recognized to be important to Kaiser. Staff exhausted alternatives to the subject code interpretation to accommodate that identification. The issue is not in compliance with the sign code but of adherence to this specific sign design. Therefore, we desire to be heard at the next possible Board of Adjustment hearing. As the developer of Gateway Corporate Center, we desire to install a quality sign to identify our project during construction and leasing phases. The type of sign we want to install is shown on the attached sheet and we believe it meets the intent of the sign ordinance. Section 19.08.040 defines the sign area as the zone encompassed by straight lines around the copy or insignia. This area on our proposed sign consists of the upper 12.5 feet more or less (not to exceed 100 sq. ft.). Section 19.08.210 defines the sign to be the portion intended or used to attract attention. The apron portion of our proposed sign is not designed to attract attention, but to hide the distraction of sign posts and to give a complete and neat appearance to the sign and copy. Section 19.32.140 is concerned with the total sign area. We are in conformance with this portion of the code as each sign area face (two faces) will not exceed 100 square feet each.
