Mr. Bloss also noted the locations of various trees which have been saved. Joseph Langer, 15213 - 65th Avenue South, expressed his concern with the drainage course. He also stated his desire that the requirement for 12,000 square foot lot sizes be retained. Mr. Knudson closed the public hearing. The commissioners discussed the zoning requirements, and landscaping loca- tion. MR. COPLEN MOVED TO ADOPT THE FINDINGS AND CONCLUSIONS OF THE STAFF REPORT AND APPROVE THE REVISIONS TO 86 -31 -SUB SUBJECT TO THE FOLLOWING CONDITIONS: 1. CROSS- SECTIONS OF THE FILL AND GRADES OF THE 20 -FOOT STRIP TO BE APPROVED BY STAFF. 2. MAINTENANCE OF AN EASEMENT FROM THE SOUTH PROPERTY LINE ALONG THE WEST PROPERTY LINE FOR 40 FEET TO PROTECT THE NATURAL DRAINAGE COURSE. 3. SUBMITTAL OF A LANDSCAPE PLAN SHOWING A MIX OF FIR, CEDAR, MAPLE AND BIRCH TEN FEET ON CENTER ALONG 62ND AVENUE RIGHT -OF -WAY AND REPLANTING IN THE SOUTHERN PORTION OF THE 20 -FOOT STRIP. 4. A 20 -FOOT EASEMENT AS SHOWN ON THE EXHIBIT RECEIVED ON SEPTEMBER 25, SHOWING THE LOCATION OF THE UTILITY EASEMENT BE IMPLEMENTED. MR. ORRICO SECONDED THE MOTION. MR. ORRICO THEN MOVED TO AMEND THE ORI- GINAL MOTION: 5. THE DEVELOPER GUARANTEE THE LANDSCAPING FOR THREE YEARS. 6. THE DEVELOPER IMMEDIATELY MARK THE TREES TO BE SAVED, SUBJECT TO THE APPROVAL OF STAFF. MR. MCKENNA SECONDED THE AMENDED MOTION, WHICH PASSED UNANIMOUSLY. Ms. Bradshaw entered the Staff Report into the record and summarized it. Burt Lucas, 4435 South 134th Place, gave a brief history of the site and the reasons for the requested increase in sign area. He emphasized the fact that the location is somewhat hidden from view, and also stated his belief that his business would qualify as a freeway interchange service, thereby allowing the sign area increase. The commissioners asked about the size of the proposed sign and stated their belief that this business may not qualify as a freeway interchange business. They asked about hours of operation, who is serviced, building height, sign height, and view from nearby residences. MR. KIRSOP MOVED TO DENY THE REQUEST BASED ON THE FINDINGS AND CONCLUSIONS OF THE STAFF REPORT AND THAT THE CASE HAD NOT BEEN MADE THAT IT QUALIFIES AS A FREEWAY INTERCHANGE BUSINESS. CITY OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT AGENDA ITEM 86- 48 -SPE: World Tire Corporation INTRODUCTION The applicant, Burt Lucas, has applied for a single -face freestanding sign for World Tire Corporation. The sign would be located in the Fostoria Industrial Park which is bounded by 134th Place, 133rd Street, and 42nd Avenue South. FINDINGS 1. The request is for Planning Commission approval of a 25% increase in the sign area of a freestanding sign located in a freeway interchange area per Tukwila Municipal Code (TMC) 19.22.180. 2. The proposed square footage of the single sign face is 125 square feet. Street frontage of the site exceeds 400 square feet; therefore, the maximum allowed without Planning Commission approval would be 100 square feet. 3. The proposed height is 40 feet (Exhibit A). Per (TMC) 19.32.170, Permitted Signs - Height, freestanding signs in industrial zones for the first ten acres is 45 feet. 4. The subject site is zoned M -1 - Light Industry, and encompasses the six existing buildings within the Fostoria Industrial Park. (Exhibit B) 5. The applicant has submitted a letter stating that the site is over ten acres and that the other property owners within the industrial park agree with the proposed sign application (Exhibit C). 6. The site would be permitted one additional freestanding sign because the site meets the following three conditions: A. The site has at least 400 linear feet of frontage on a public street. B. The site has at least two detached commercially occupied buildings, neither of which is accessory to the other. C. The site is occupied by at least two tenants. 7. The applicant has not clearly identified how his business would qualify as a facility which would serve the traveling public. Dependent upon testimony by the applicant before the Planning Commission, the staff would argue that a tire wholesaler would not qualify as a freeway interchange business and would recom- mend denial of the request.
