The Development Review Committee, including representatives from the Public Works, Fire, and Community Development departments, reviewed the subject covenants on July 26, 1990. There were no objections to vacation of the covenants. However, the Public Works Department strongly urges including the following in any release document: The sewer and drainage facilities supporting Heatherwood are part of private systems which are sufficient to serve the project. However, these systems do not meet current City design standards for public infrastructure. Heatherwood developers were given an opportunity to correct this situation by participating in a local improvement district but declined. Heatherwood and other users remain completely responsible for all maintenance and operation costs of their privately owned sewer and drainage systems. The following items summarize my concerns as discussed with your on -site foreman Steve Barden today: 1. The back of garages adjacent to Sunwood do not seem to provide for the approved landscaping width between curb /garage and property line. In some cases the width provided necked down to three feet. 2. Cuts into the hillock along the Sunwood property line need to be protected along the approximately 150 ft. length. 3. Rocks have been emplaced along the entire south property line at approximately 1 :1. This does not seem to provide for the approved landscape plan. 4. Trees may require special structures to be planted as approved. This will be especially true along the eastern perimeter. 5. I did not view the northern or western property line improvements. Developer Actions The City requires plans to show how eastern property line cuts will be protected and landscaping provided, any retaining structures which will be needed (i.e. on southern property line), . and a recognition that project landscaping will be provided as shown on approved plans (i.e. along the southern property line). City Actions The City will take the following actions pursuant to normal procedures and the specific Board of Architectural Review direction to staff regarding the strict implementation of all BAR conditions and approved project designs. A. Approval of the proposed carports will be withheld until plans for eastern perimeter landscaping and cut protection have been approved and demonstrated as feasible (i.e. by staking cross - sections and a field check). No contract has been presented to us. Your representatives have presented a sketch of drainage improvements to the City of Tukwila, which the City has adopted as a part of your proposed total project for Heatherwood. The City has assured us that they consider this will therefore have to be completed before a Certificate of Occupancy will be issued for Heatherwood. Your representative before the City of Tukwila Board of Architec- tural Review on July 27, Mr. Henry Mora, stated again to us and the Board that your company intended to put in these drainage improvements. He also stated that your company would remove a drain line from the rock -lined pit around a now -dead tree which drains into our area, possibly a major contribution to the problem which no one had previously acknowledged. We have now been subjected to nearly a full year of drainage problems due to the rockery and other work on your site. We now face the start of another rainy season of periodic flooding from the blockage. If long - promised drainage improvements are not made very soon, It will again be difficult if not impossible to use equipment in that area due to the boggy conditions. We may then have to insist that the improvements be hand -dug to avoid damage to our landscaping. In any case, we will require that sufficient written guarantees of restoration and liability for contractors' actions on our property be in hand prior to this work being carried out on Sunwood's property; we are responsible as a Board for the protection of the common property of over 170 homeowners. We do not feel that, to this point, your company has shown good faith in taking care of these matters. Our Association has received periodic assurances that improvements would be made and has borne a series of both large and small expenses to try on our part to have these matters resolved, to no result. We intend to separately pursue the reimbursement of these costs from you. Recently, he responded to a resident's call about hearing water running, to find that your concrete contractor had hooked up to an outdoor faucet in Sunwood, and had been u s i n g it a l l day. I f your site is that short of water, a better solution might be to sign the water line easements which you had us prepare for you last winter, at our expense, or have them siphon it out of the pond. Finally, with regard to our common boundary, you should have in hand a copy of our letter to the Tukwila Planning Department regarding the apparent survey discrepancies. On the basis of the comparison of surveys, and your own surveyor's admission that he had advised you some time ago that our survey (by Triad) was the more thorough and therefore probably correct, we hereby state that we believe there is no foundation for your claim of, an encroachment by our fence. We further wish to advise you and the City'that we will consider any improvements which cross the common boundary as surveyed by Triad Associates to be an encroachment onto Sunwood's property. The potential for encroachment should be taken into account in the final negotiations between you and the City on the excava- tion, rockery and /or landscaping proposed between your proposed garages and carports and our property line. We understand that the BAR directed staff to seek our input to that final resolution. We would ask that you advise your inspectors that there may be a question about where the common boundary between the two projects actually Iles, as our common descriptions would - at least on paper - diverge by 11 -12 feet at the southern end. If it appears at any time that the Heatherwood site plan is not "fitting" on the ground as it did on the site plan, this could be an indication that there is a real, property discrepancy. It was noted that Phil Verhalen has announced his resignation from the Planning Commission due his moving out of Tukwila. Representing the staff were Jack Pace, Molly Headley, and Joanne Johnson. APPROVAL OF MINUTES - MR. KIRSOP MOVED AND MR. HAMILTON SECONDED A MOTION TO APPROVE THE JUNE 22, 1989 MINUTES AS PRESENTED. MOTION UNANIMOUSLY APPROVED. 86 -52 -DR - HEATHERWOOD APARTMENTS - Request for approval to modify previous B.A.R. approval to allow construction of 66 carports and 14 garages. Commissioner Knudson excused himself from participating on this agenda item to avoid creating a conflict of interest. Jack Pace, Senior Planner, reviewed the Staff Report and pointed out the area of the request on a site plan. Staff recommendation is approval of the request subject to conditions as stated in the Staff Report. A letter from Mr. Paul Dudley (Attachment "F" of the staff report) was entered into the record as Exhibit "A ". Mr. Henry Mora, R. S. Development, representing the applicant, agreed to the request to put the trees in as requested. Mr. Paul Dudley, President of the Sunwood Homeowners Association expressed a concern with the trees which have now been removed. He expressed further concern by the lack of shrubs as screening, the impact of the ponding that now takes place and which has not been taken care of as indicated by the developer. He was also concerned with the surface and subsurface drainage which runs off into Sunwood; that the land- scaping on the narrow rocky ridge may not survive; and adequate screening from the Heatherwood Parking lot be provided. Molly Headley, Assistant Planner, reviewed the staff report recommending approval with conditions as stated in the staff report. A letter was received by the Planning Department from John Hamilton expressing his opposition to the development. This letter was entered into the record as Exhibit "A ". Planning Commission July 27, 1989 Page 3 Lawrence Shaw, President of Nonmed, owns property to the north of the site under consideration and expressed his concern with the potential impacts a towing and storage yard will have on his operation. He felt it would deter from the niceness of his operation and feels this site is not appropriate for this type of business. Another type of business might be a better blend with existing development. He submitted photos into the record as Exhibit "B" and "C" depicting other uses in the area. Mr. Becker, owner of adjoining property to the south expressed his concern regarding the impacts of this use to the values of surrounding property, lack of quality landscaping, and traffic impacts from ingress and egress from this operation. Ken Chin, architect for the potential owner, assured the Commis- sion that the owner intends to maintain it in a aesthetically pleasing manner, and appropriate screening will be added. He pointed out that 2.5 days is the average storage time for im- pounded vehicles, and traffic flow will be an average of four trips a day by the tow trucks. Melvin Dickey, potential owner of the property, stated that he intends to make it a first class operation, and at his present location, there have been no complaints. He assured the Commission that this is a towing company, not a parts exchange nor a wrecking yard. He suggested that the Commission put a "watch dog" type of control to ensure their intent is carried out. Matt Little, Western Pacific Properties, pointed out that illegal outside storage of 14 - 15 vehicles, which are not screened nor fenced, are currently allowed to go on at a location to the south of this site. Mr. Hamilton felt that in order to adequately review a site design, staff should also include the sign design in the mater- ials supplied to the Planning Commission for their review. Mr. Cagle felt that SERA conditions also be incorporated in the staff report for consideration by the Planning Commission. Mr. Vincent Verrese, 2000 - 112th Avenue, Bellevue, the architect for the project described the sign design, landscaping, ingress and egress features, as well as design of the wall separating the proposal from Tukwila Pond. Joe Miles, Seattle Audubon Society, addressed a number of issues of concern which included adequate screening of Tukwila Pond from the glare, sound and movement created by the business activity. He felt the first choice should be windows looking out at the pond from Burger King and the second choice being a masonry wall. Project Description: The proposed modification would allow construction of garages and carports shown in attachments C through E. There are 12 groups of six stall carports, and 14 garages in a group of 10 and four. All proposed structures will have pitched roofs, with materials and colors to be harmonious with the previously approved buildings. Existing project drawings (Attachment D) will be modified to show carports with pitched roofs. All structures are located adjacent to buildings except the 14 garages and one carport group along the Heatherwood/ Sunwood property line. All other Findings are as described in the previous staff report except for project Background. BACKGROUND This project was initially approved by the Board on November 20, 1986; a building permit was issued; and construction is currently under way. The applicant is proposing additional garages and carports to enhance project quality. After construction started, the Sunwood Condominium Association and Heatherwood began discussing the precise common boundary line location. The maximum deviation would result in the common property line being moved 3.25 ft. toward the Heatherwood project in the southeast corner and 2.04 ft. toward the Sunwood project in the northeast corner. Both parties accept that these discussion will not affect the B.A.R.'s decision. Staff has reviewed the proposed action with Mr. Paul Dudley, Sunwood Condominium Association President, and his consultant. Mr. Dudley has submitted a letter (Attachment F) specifying the Sunwood concerns along their common boundary: a. Install large trees in the northern third, b. Ensure that landscaping in the middle third can thrive in the difficult (rocky) growing conditions, and c. Page 3 The proposed project largely incorporates these recommendations as discussed below. DECISION CRITERIA This project is subject to approval by the Board of Architectural Review pursuant to TMC 18.60.030(2). Discussion of proposed project characteristics with respect to BAR decision criteria has been consolidated due to the minor nature of the modification. 18.60.050; GENERAL REVIEW CRITERIA. (1) Relationship of Structure to Site. (2) Relationship of Structure and Site to Adjoining Area. (3) Landscaping and Site Treatment. (4) Building Design. (5) Miscellaneous Structures and Street Furniture. The pitched roofs and siding style of the proposed one story structures are architecturally harmonious with the approved buildings. The proposed buildings also provide an architectural transition between the Sunwood and Heatherwood projects. Building location nine feet from the property line is consistent with Sunwood carport location within five feet of the common property line. The gray with white trim Heatherwood buildings, do visually contrast with the dark brown Sunwood structures. The proposed buildings will also present a one story blank wall/ mass toward Sunwood. The applicant has agreed to increase shrub density from 60, to 90 plants along the Sunwood border. This increased shrub density, maximized ground cover, and currently proposed trees will virtually eliminate this visual contrast and building mass in three to six years. Shrub height at that time should be four to six feet with well established trees 10 -14 feet tall. The high shrub planting density will provide a visual line of green along the Heatherwood /Sunwood boundary to immediately soften the contrasting colors and wall masses between the two projects, and help screen headlight glare. Page 4 1 CONCLUSIONS 1 Providing pitched carport roofs will be important to the architectural design harmony with the approved Heatherwood structures and for transition with Sunwood buildings. The applicant has agreed to this modification. Quality landscaping will play an important role in providing adequate transition between the Heatherwood/ Sunwood projects. Increased shrub density and along their common boundary, maximizing natural ground cover over bark, and proper plant installation in this rocky difficult area will be essential. The proposed project modification results in a development which would satisfy all review criteria per the previous staff report and the evaluation contained herein, with the recommended changes. RECOMMENDATIONS 1 The Planning Division recommends approval of the proposed modification with the following conditions: 1. Project drawings shall be modified to show pitched carport roofs. 2. The current landscape plan shall be modified to reflect: a. Increased shrub density along the Sunwood/ Heatherwood boundary from 60 plants at 6 ft. spacing, to 90 plants at 4 ft. spacing, as agreed to by the applicant and b. Maximized natural ground cover and minimized barking to enhance plant growth and visual harmony. This should result in 90 percent ground coverage in 3 years. We have reviewed the plans further on the site with our consultant, Mr. Hunt, and have the following comments to offer. We will have some photographs to.submit later, before or at the BAR review of the revisions. It does not appear that the choice of flat or sloped rooflines op the garages will have a practical consequence, though adjacent unit owners will be polled on their aesthetic preference. Our primary concern is likely to remain the need for effective landscaping along the common boundary. Landscaping options should be reviewed closely for both type and maintenance requirements. As you have noted, the Heatherwood developers have not been successful in preserving any of the major trees in this area which were identified for preservation in the original approved plans. Two three -foot diameter Douglas Firs and several smaller maples have now been cut down, and a large maple now stands dead on the site. In addition, the construction by the Heatherwood developers of a rock retaining wall resulted in the loss of a birch tree on our side of the wall, and the blocked drainage is now causing stress on at least one other tree on our side. The drainage problem has still not been solved by R.S. Development. Considering the loss of major trees subsequent to the original approval, we would feel that some substantial amount of replace- ment trees would be required on that basis alone. However, the evidence of the dying trees plus the apparent soil and drainage conditions would indicate that careful consideration is needed for the survival of anything planted in this area. There has been a very substantial amount of earth moving and compaction, plus the blockage of drainage. The resulting surface and subsurface soils conditions could make it difficult for trees to successfully root in after planting. The rockery - protected "wells" for the existing trees were obviously unsuccessful in protecting them from the effects of compaction. In addition, much of the center of the boundary area, adjacent to the small garage and carport closest to the boundary, has been excavated so that . Heatherwood revisions (garages) 7/17/89 - Page Two s/s the remaining soils area is going to be very deeply drained by the cuts on both sides. The balance of the boundary area will be deeply drained on at least one side (East). A large part of the intervening landscaping area is therefore likely to have difficult conditions for the establishment of major landscaping. It will, however, be highly visible to our homeowners, yet largely hidden from Heatherwood tenants. The longer -term incentive for careful maintenance, irrigation and replacement of dead landscaping may therefore be low for Heatherwood's managers. The irregular areas along the wall may also represent a maintenance problem; the crevices and areas along the wall are already supporting weeds and blackberries'. At this time, our preliminary impressions are that there are three areas of different landscaping requirements, dividing the area between the Heatherwood parking and the Sunwood boundary roughly into thirds. The Northerly Third has lost major trees, and exposes Sunwood buildings directly to Heatherwood buildings. New major trees should be proposed for this area, with guarantees of adequate installation and replacement of those which do not survive. The Southerly Third is partly screened by Sunwood carports, above which there are substantial views to the West and Southwest. We would prefer that low landscaping and /or screen fencing be used here to block headlight glare from spilling onto Sunwood residences, but that major trees not be installed. The Middle Third is largely screened by the existing vegetation and ridge of soil and rock, and would present difficult growing conditions for large species. This area should be densely planted with a low - maintenance ground cover or low hedge that can survive drought. You have indicated that the City might request that R.S. Development lower the ridge in this area, rather than retaining their side. Though this might benefit the adjacent lower units in Sunwood, we would point out that the same ridge is retained on our side by a substantial rock wall, which could be endangered by excavation close behind it. We would expect that the City would require adequate assurances of safe procedures and contractor's liability if R.S. Development is to excavate in this area. We hope that this letter provides a basis for constructive discussion and resolution at the BAR review. We would like to thank you again for facilitating our review and comment. The proposed project is subject to BAR review pursuant to TMC 18.60.020(C) and (E) since it is a multi- family complex in an R4 zone dis- trict and is sited north of I -405 and east of I -5. FINDINGS 1. The proposed action is to develop a 66 -unit apartment complex in an R4 zone district as shown in Exhibits A through F. 2. The proposed project contains 42 one - bedroom units and 24 two-bedroom units, for a total of 66 units in 6 three -story buildings; 132 parking spaces; a 520 square -foot, enclosed recreation building with jacuzzi; and over 12,700 square feet of outdoor recreation area, including a minimum 3,300 square - foot children's play area. The applicant has agreed that the above outdoor recreation areas will be generally provided within the main building complex area and in the southwest corner of the parcel. However, revised landscape plans have not yet been received at this writing. 3. The project meets all minimum zoning standards for apartment developments in the R -4 zone district pursuant to Title 18, Tukwila Zoning Code. 4. The project is located on Lot 2, Tukwila Short Plat No. 83 -17 -55 in the SW I of Section 23, Township 23, Range 4. 5. A Mitigated Determination of Nonsignificance was issued on November 5, 1986. The mitigating conditions are shown in Exhibit F. 6. The surrounding land use pattern is typified by 2 -3 story multi- family developments on all sides except to the immediate north where single- family uses dominate. Specifically, Tukwila Estates (apartments) lie immediately to the south, Hampton Heights (apartments) lie immediately to the west, Sunwood (condominium) lies immediately to the east, and a single - family residence sits on a large, single - family zoned lot to the immediate north. TMC 18.60.050(1) - Relationship of Structure to Site The plot and landscaping site plans (Exhibits A and B) show that the pro- posed building setback and landscaping are more than the minimum required by the Zoning Code. The planting of trees and shrubs will soften building walls and parking areas to provide an adequate transitional buffer to ad- jacent uses. The northeast parking area has been curved to the north to reduce the impact of the steep elevation drop to Sunwood and provide addi- tional space for landscaping. 2. TMC 18.60.050(2) - Relationship of Structure and Site to Adjoining Area The site plan (Exhibit A) and building elevations (Exhibit C) show project building design. The proposed buildings are of a similar compatible type with other area structures. 3. TMC 18.60.050(3) - Landscaping and Site Treatment Proposed landscaping and pedestrian paths have been harmoniously designed with the proposed buildings and parking areas. Area vistas to the south would be more accessible to site residents due to the clearing of existing blackberry bushes and planting of lawns. No exterior lighting plans have as yet been submitted. However, the appli- cant has agreed to submit plans which show light fixture design and loca- tion, and which demonstrate that there will be no light spillover onto other properties. 4. TMC 18.60.050(4) - Building Design Exhibit C shows overall building design and facades. These design elements are similar to the adjacent multi - family structures. The three basic build- ing modules (A, B and C) shown in Exhibits D and E have been grouped in sufficiently varied combinations to avoid monotony of design. Overall proj- ect design is further enhanced by a liberal amount of deciduous trees to be planted. The proposed exterior color scheme for all buildings envisions light grey walls, white trim, and slate - colored composition roofs. 5. TMC 18.60.050(5) - Miscellaneous Structures and Street Furniture The accessory recreation building is proposed to have the same exterior design and color scheme as other structures, including a gabled roof. Development. There had been a lack of progress on the resolution of the disputed location of our common boundary, which R.S. Development raised with our Homeowners' Association nine months ago and the blockage of drainage by their construction of a rock wall, which we have been attempting to resolve for some six months. We have just this week received the requested copy of their survey so that we may have our consultant attempt to identify the source of the discre- pancy. We are also sending a formal letter to R.S. Development, at their request, reaffirming our desire that they carry out the drainage improvements as agreed, subject to conditions and specifications which we sent them several months ago. Our Association is concerned about resolving these issues as the Heatherwood project rapidly approaches completion. When we gave your assistant Mr. Umetsu copies of background information on the boundary issue last week (sent earlier to Public Works), we were Informed of the intention of R.S. Development to apply for permits to construct carports in the easterly parking area, adjacent to Sunwood. With the uncertainty of the actual location on the ground of our common boundary with Heatherwood, the Heatherwood site plan might not "fit" on the ground as it shows on the previously approved site plan. We would not want to see perimeter setbacks or landscaping sacrificed to accommodate a discrepancy, nor improvements placed where they may later constitute an encroachment. We feel that the proposal of carports is a major change to the project design and the assumptions under which the original city approvals were given. Earth Consultant's letter of October 12, 1988, addresses the quality of rock as well as the workmanship of this eastern rockery wall. 3. The rock wall on the eastern portion is clearly on our property (see photographs marked Exhibit "B "). In fact, the Sunwood Condominium Association rockery encroaches on our property. This boundary line was measured from Sunwood's own survey markers. Geotechnical Engineers, Geologists it Environmental S►eientists As requested, we visited the subject site on August 19, 1988 to meet with Mr. Patterson and to examine a previously constructed rockery set along the eastern side of the site. Also in attendance was Mr. Fred Hackney of Alpine Rockeries Inc, the rockery contractor. A copy of our Rockery Examination Record is attached for your information and use. Subsequent to this examination, we also met with representatives of the City of Tukwila to discuss the results of our examination and to present a copy of the Association of rockery Contractors (ARC) Standard Rockery Construction Guidelines for this rockery. During this site visit our representative visually examined the completed rockery structure. At that time we noted the rockery had a maximum height of approximately nine feet at one location, but that the majority of the wall was less than six feet in height. This new rockery has been tied into a preexisting rockery built for the adjacent apartment complex and, because of this, it was necessary to construct a transition to generate an appropriate blend of the old and new. It comprises a hard granitic rock of generally tabular, rhomboidal or rectangular pieces with generally a flat -to- flat contact between rocks. The inclination of the face is about 1:6 (horizontal:vertical). It is also evident from our observations that the area behind the majority of this new rockery, particularly in the vicinity of the higher portion of the wall, has been carefully backfilled with additional loose rock for a distance of between about six' (6) to twelve (12) feet, in addition to the approximately one and one -half to four feet of crushed drain rock. This has, in our opinion, considerably enhanced the overall stability of this structure by providing substantial extra mass. This has converted the rockery into more of a buttress than a simple protective rockery. In our opinion, this eastern rockery has been constructed in a competent and professional manner. Construction incorporates sound materials and good construction practice. The rockery is stable and, unless it is disturbed by excavation above or below the wall, should remain so for the lifetime of the project. We do not see any threat to the safety of the adjacent apartment property. We trust this information is sufficient to allow you to complete work on this area of the project. Earthwork at the subject site has been periodically monitored by ECL Due to the site topography, and building construction plan, little fill has been imported. The fill that uas been placed and compacted has been in storm sewer trenches and the western footing excavations for Buildings 1, 2, and 3, particularly Building 3. On January 10, 1989, Mr. Keith Litchfield of Earth Consultants Inc. visited the subject site to observe existing conditions.. All tests were performed in accordance with ASTM Test Designation D -2922 (Nuclear Gauge Method). Representa- tive soil samples were returned to our laboratory for laboratory maximum dry density tests in accordance with ASTM Test Designation D- 1557 -78 (Modified Proctor). Based on our field density testing and site observations, it is our opinion that the structural fill has been placed on competent native soil and compacted in accordance with the recommendations presented in our referenced report. All footing excavations that were examined by representatives of this firm should provide adequate foundation support. West Rockery Although the west rockery construction was not monitored by ECI, it is our opinion that the rockery is founded on and against native soil or rock backflll. This conclusion is based on the following: o review of photographs taken before and after the rockery construction and; o comparisons of the finished grade of adjacent asphalt pavement and that of the rockery base. The rockery is four (4) feet or slightly greater in height. Although construction of rockeries greater than four feet are allowed within King County provided the construction process is monitored and approved by a licensed geotechnicai engineer, we understand that the City of Tukwila prohibits rockery construction over four (4) feet. The rockery was measured at several points along its length and it was found to be greater than four feet by a few inches at some locations. This slight excess in height should not warrant modification to the rockery. We trust this information is sufficient to allow you to proceed with your construction schedule. City staff members have discussed these issues with your contractor and /or construction superintendent, but requested corrective actions have not been taken. These issues are summarized below along with required issue resolving actions and the appropriate City department which should be contacted. 1. Rockeries have been constructed without the required building permit; without using approved rock, required gravel fill and footing drains; and without any indication of how runoff from footing drains will be disposed. The rock used is currently flaking and appears to be very unsuitable. A certificate showing the material is suitable for use in rockeries has not been submitted. 2. Rockeries along the eastern and possibly western property lines exceed the maximum allowable four foot height, are unauthorized, and must be removed per the Public Works letter of October 11, 1988. 3. Rockeries along the western and possibly the eastern property lines have been built on adjacent private property. 4. No significant rockeries were authorized in the Board of Architectural Review's design approval. The unauthorized 9 -11 foot tall rockery along the eastern property line is the subject of a complaint from the adjacent Sunwood Condominium Association. The project has contributed sufficient water to the private storm water system it is using to overload system capacity, and cause muddy runoff overflow into the Tukwila Estates pool. 2. Ponding of runoff is occurring on Sunwood Property at the foot of the eastern retaining wall. This is probably due to the absence of footing drains and an authorized means to dispose of runoff. C Property lines and improvement plans. 1. There are at least three sets of plans filed with different City departments. Each set has different property line descriptions and different project designs. 2. Actual construction is not occurring according to the set of plans in the building permit. 3. Unauthorized fill is being placed. This is especially serious at the eastern Buildings 1, 2 and 3 which look to be sitting on unauthorized fill, being stabilized by an unauthorized rockery, which itself sits on more unauthorized fill. 4. The proposed increase of foundation wall height in Buildings 1, 2, and 3 from two to six feet may result in exceeding maximum building height. 5. The proposed garage spaces are of inadequate width to satisfy Zoning Code standards. APPLICANT ACTIONS REQUIRED TO RESOLVE ISSUES A. Building Division (Duane Griffin. Building Official, 433 -1849) Two full sets of accurate building and utility plans which reflect final project design shall be submitted to the Building Division. Plans shall include, but not be limited to the following: 1. Accurate and consistent property lines and project improvements over all plarsheets; 2. Existing and finished grades; 3. Written, notarized permission from property owners for use of their property as needed (i.e. for drainage, utility lines, rockery construction, etc.); r ^r' Mr. Rubin Salant January 5, 1989 Page 3 4. A stamped geotechnical report demonstrating and certifying the stability of all fill areas and remaining rockeries to support the projected improvement loads; 5. New elevations for buildings 1, 2, and 3. B. Public Works Department (Ross Earnst. Public Works Director. 433 -0179) All rockeries over 4 feet in height shall be removed and all remaining rockeries shall be (rekonstructed to Public Works Department standards. C. Planning Division (Vernon Umetsu. Associate Planner. 433 -1858) Additional B.A.R. approval will be required if project modifications are determined to be significant by the Planning Director. LIMITATIONS UPON FURTHER SIGNIFICANT WORK The City cannot authorize any additional significant work beyond framing Buildings 4, 5, and 6 until the new building and utility plans have been approved and a program for removing or modifying all rockeries to satisfy Public Works Department standards has been mutually agreed upon. Work on Buildings 4, 5, and 6 undertaken prior to approval of new plans shall be at your sole risk in the event that it results in higher costs due to city required project modifications. No additional significant work can be allowed including, but not limited to, additional foundation work. Any project improvements which require B.A.R. approval cannot be authorized until such approval is given, but unaffected work may be allowed to proceed. These pic- tures show the extent of flooding after the first heavy rainstorm on November 3rd - 4th. Virtually the same level exists as of this morning. We would note a number of items from the photo: - The flooding is extending out some distance into the lawn, and seems now to be close to the floor level of the adjacent ground -floor condominium unit in Sunwood. The depth and extent are likely to adversely impact the ability of Sunwood to use and maintain their yard area. - The photo of the ponding to the North indicates that the wall has blocked the natural outlet In that direction, which formerly passed in that direction towards the ravine in the background of that photo. The photo to the South shows the heavily landscaped berm which lI•.es between the ponding and :.he nearest catch basin In Sunwood. Excavation of a drain line through there, as suggested by R.S. Development, would probably remove major trees. One of the two trees uprooted in the rockery construction is also visible in the photo, leaning at a 45- degree angle. - The saltiness of the ponded water next to the wall indicatAA, water is positively draining over from the Heatherwood fill, and is not being drained away by the quarry spell behind the wall. This situation is understandable as, even If the spall were in place per the detail on Sheet C -7 of the approved plans of "Tukwila Estates Apartments" ( Heatherwood), the perforated pipe required as a part of the same "Rockery Detail" was indicated by R.S. Development's own consultant as being absent (Report of Glen Mann, P.E. dated 10/12/88; "Rock Wall Examination Record" - Earnst - Sunwood drainage 11/1V/88 - Page Two "Drainage Provisions "). This cannot apparently now be verified, as we understand that there was no inspection called for prior to the start of the base course of the rockery, as required by Note 4 to the Rockery Detail on Sheet C -7. While I must admit to some frustration that your staff people would not meet with me to exchange information and discuss options, we did subsequently determine that Gencor had engineered a solution to its previously- expressed concerns relating to the Badley property and we were able to carry. through on successful negotiations with Washington Natural Gas and completion of the carefully - engineered tightline which now insures proper drainage of water previously collecting at the southeast end of my client's property. Now an additional problem has emerged: storm and other drain waters which are collected from the Hampton Heights and Salant Investments properties above the Tukwila Apartments, and which now pass through a line to be released midway down my client's property, have increased to the point where they threaten my client's property. Phil Fraser of your staff has indicated to my client's manager (George Ferguson) that he believe we should approach the uphill owners to fund the appropriate work to eliminate this problem. We are most willing to undertake this initiative, but it is criti- cal that we have full cooperation and support from the City as we proceed. To this end, I intend to keep you fully informed of our correspondence and meetings, and ask that you assign an appropriate staff person with whom I might work if the uphill owners are not cooperative. The problem can be resolved with a fairly small investment by these owners but it may require some encouragement from the City to get them on board.
