The meeting was called to order at 7:00 p.m. Members present were Mrs. Regel, Mr. Nesheim, Mrs. Altmayer and Mrs. Hernandez. MRS. ALTMAYER MOVED AND MRS. REGEL SECONDED TO EXCUSE MR. GOE. Representing planning staff were Jack Pace and Moira Carr Bradshaw. Approval of the minutes was moved to the end of the meeting. Mr. Nesheim opened the Public Hearing. 86 -51 -V: National Health Labs - Corporate Property Investors requesting a variance from TMC 18.50.020, 50 -foot front yard setback required, 48 -foot setback requested for a 7,500 square foot addition to existing building at 18251 Cascade Avenue South. Ms. Bradshaw summarized the Staff Report. David White of Croonquist Architects, 1322 - 6th Avenue, Seattle, WA 98101, presented reasons for the requested variance. The overhang in the addition is six feet total. Four feet was thought to be too narrow to provide weather protection and unacceptable from an appearance standpoint. MRS. ALTMAYER MOVED AND MRS. REGEL SECONDED THAT CRITERION #1 HAD BEEN MET. MRS. ALTMAYER AND MRS. REGEL VOTED YES AND MRS. HERNANDEZ AND MR. NESHEIM VOTED NO. Discussion ensued regarding Criterion #1. MRS. Mr. Nesheim called the meeting to order and opened the public hearing. 86 -54 -V: Bicentennial Park - The City of Tukwila requesting a variance from TMC 18.50.020, 50 -foot front yard setback required, 10 -foot setback re- quested for a new restroom to be located at 550 Strander Boulevard. Mr. Pace presented the Staff Report. Don Williams, Parks and Recreation Director for the City of Tukwila, pre- sented rationale for the request and stated that the approximate size of the park is one acre and is very narrow in shape. The Parks and Recreation Department will be installing a sidewalk along Strander into the park. Reasons for the proposed location were as follows: 1. Proximity to sewer line - cost. 2. Not to locate in center of large open area. 3. Visible to pathway. ALTMAYER MOVED, MRS. REGEL SECONDED THAT CRITERION #1 HAD BEEN MET, WITH THE FINDING THAT THE PARK IS AN ANOMALY TO A CM ZONE AND THEREFORE GRANTING THE VARIANCE WOULD NOT BE CONVEYING A PRIVILEGE. AGENDA ITEM CITY OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT 86 -54 -V: Bicentennial Park INTRODUCTION The City Parks and Recreation Department is proposing to build a restroom at Bicentennial Park located at 550 Strander Boulevard. The site is currently vacant and is landscaped in grass. The applicant is requesting a 45 -foot variance from the 50 -foot front yard set- back requirement in the C -M zone (TMC 18.50.020). After the Board of Adjustment makes their determination regarding the variance request, the proposal will be reviewed by the Board of Architectural Review for shoreline compliance on Novem- ber 20, 1986. FINDINGS 1. The proposed restroom will be set back 50 feet from Strander Boulevard Improvements. 2. The right -of -way for Strander Boulevard extends 45 feet into what is con- sidered Bicentennial Park. 3. Street improvements planner for 1991 at Strander Boulevard include channel - ization and signal modification. These street improvements will occur within the existing improved street. 4. As shown by Exhibit B, the right -of -way for Strander Boulevard becomes narrower west of this site. CONCLUSIONS For a variance to be approved, the Board of Adjustment must conclude that all of the following criteria have been met (TMC 18.72.020). 1. TMC 18.72.020(1) - The variance shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and in the zone in which the property on behalf of which the application was filed is located. The C -M zone standard for the front yard setback was intended for the large commercial buildings and not for uses such as a park restroom that is 12' x BOARD OF ADJUSTMENT 86 -54 -V: Bicentennial Park Staff Report Page 2 23' and 14' in height. Due to the large open area of the park and the small size of the restroom this variance would not constitute a grant of special privilege. North of the site and along Christensen Road are buildings which do not now meet the setback requirement. 2. TMC 18.72.020(2) - The variance is necessary because of special circum- stances relating to the size, shape, topography, location or surrounding of the subject property in order to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located. The applicant has noted that normally the curb of the street or inside edge of the sidewalk is the edge of the right -of -way. In this case the edge of the street right -of -way is approximately 40' into the park area. If the variance is granted, the restroom will be placed 50' from the curb which will be 5' from the right -of -way line, but well within the site considered park area. 3. TMC 18.72.020(3) - The granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improve- ments in the vicinity and in the zone in which the subject property is situated. The applicant has stated that "the development of a permanent restroom as opposed to 'Porta- Potties' will improve the health and safety concerns for the park as well as improving the aesthetics. The net result will be in- creased enjoyment and recreation opportunities." City engineering staff have concluded that the proposed location of the new restroom will not have any negative impact on future street improvements being considered for Strander Boulevard. 4. TMC 18.72.020(4) - The authorization of such variance will not adversely affect the implementation of the comprehensive land use policy plan. The proposed variance will not have a negative impact on shoreline policies in the Comprehensive Plan; rather, it will help to better utilize the land along the shoreline. 5. TMC 18.72.020(5) - The granting of such variance is necessary for the pres- ervation and enjoyment of a substantial property right of the applicant possessed by the owners of other properties in the same zone or vicinity. As noted in the response to Item 1, the setback as required in this case would provide a far greater amount of setback from the road area than is typically required. The granting of the variance will not negatively impact any other business and will help to maintain a large open area within Bicentennial Park. 6. Due to the extremely wide right -of -way next to the park, the applicant has shown how the proposed restroom location complies with the five variance criteria.
