IV. JURISDICTIONAL DISPUTES AND WAGE RATES:
A. Subcontractor shall be bound by the "Plan for the Settlement of Jurisdictional Disputes in the
Construction Industry" dated 1 June 1973, or its successor.
B. Subcontractor shall employ his workmen in accordance with the wage rates, terms and conditions
required of the Contractor.
C. Subcontractor agrees to include this clause including this paragraph C. in all lower tier subcon-
tracts issued in connection with this Subcontract.
D. This Paragraph IV shall not be applicable to Supply Agreements, provided the supplier does not
perform any labor on the project site.

2. Subcontractor shall be responsible for the design and
the adequacy of the design of the irrigation system.
Subcontractor's design and installation shall conform
to the Architect's drawings and specifications and all
applicable codes, ordinances, regulations and
requirements of governing authorities. Included are
all heads, piping, sleeves, valves, backflow
preventer, automatic controller and all accessory
materials required for a complete installation.
3. The Subcontract price includes all revisions to the
landscaping work as shown on Drawing L1.1, Revision 1
dated September 24, 1985.
4. All new trees shall measure 1 1/2" to 2" caliper at

repairs required due to settlement of its backfill.

Dear Sir:
Public Works Department has reviewed your plan ( #85288) and approved this
plan per the following comments:
Prior to obtaining the permits indicated below, approval from the Building
Official and Planning Director shall be obtained.
Twenty -four hours prior to beginning the work, the developer's contractor
shall apply for and obtain the following permits:
1. Hauling Permit (Permit Fee: $50.00) - $2,000 bond, certificate of
insurance, and routing map to be provided with the application for
this permit prior to beginning any hauling of fill materials.
2. Curb Cut /Access /Sidewalk Permit (Permit Fee: 25.00) - As part of
the application for the curb cut /access /sidewalk permit, the deve-
loper shall provide the appropriate easement and /or right -of -way
for that portion of the sidewalk built on private property or
within easements other than those designated for sidewalk. The
Public Works Department requires the sidewalk be extended to the
guard rail at the south end of the property. The construction of
curbs and gutters, sidewalks, pavement extensions to the existing
pavement, associated storm drainage, utility relocations and
striping /signing for the public improvements in SR -181 shall be
at the development's expense. Constructing these public amenities
is limited to the front footage of the entire property facing
SR -181. The developer representative shall coordinate in the
construction phase the locations of the sidewalk, curb and gutter
with respect to WSDOT contract #3018 with Randy Muddsley of WSDOT
prior to he construction of the development to verify the loca-
tion /elevation of the gutter and the sidewalk and assure
appropriate location and elevations of the private development and
its associated public amenities are in accordance with future
WSDOT SR -181 overlay /stripping project

The proposed sidewalk curb and gutter system, once constructed,
shall be requested for turnover to the City by the developer
providing the following documents:

3. Private Sanitary Sewer Main (Permit Fee: $25.00) - The first
stretch of 200 feet of sanitary sewer line shall be provided as a
main with a manhole at the bend and replace the cleanout now shown
on the plans.
4. Sanitary Side Sewer Permit (Regular Connection Charge: $170.00)
Special Connection Charges for the sanitary side sewer is waived
by prior construction of the original development.
5. Water Meter Permits (Deposit fee $1,550 for one 1 -1/2 inch water
meter) Due to the participation through the original development
no special assessment is recognized to this redevelopment.
The City staff will provide the 1 -1/2 inch water meter and service
line from the water main to the meter and including the meter box.
The City will charge on a time and material basis and credit or
debit the developer from the deposit fee.
6. Fire Loop /Hydrant Permit (Permit Fee: $25.00) - The development is
required to provide water main extensions per the comprehensive
water plan on file with the City. To date this design has not
been submitted to the City. Upon receipt of 4 sets of the Fire
Loop /Hydrant and public water main extension plans for City review
and obtain approvals, the developer shall, provide this construc-
tion as part of this development. This permit covers the new fire
lines from the main to the sprinkler vault only and shall be per
approved Fire Marshal and Rating Bureau approvals.
A standby charge will be placed on the development for the fire
loop through monthly water billings to the developer at the time
the fire loop becomes operational.
7. Water Main Extension (Permit Fee: $25.00) - Any public main
extensions shall be built to public standards. At the time of
completion the following turnover documents shall be provided to
the City for consideration for turnovers of these public mains
(by the City Council):

application for this permit shall be the City and DOE's Flood Zone
Control permits. Dike requirements shall be per the Flood Zone

sole coordination responsibility of the developer.)
9. Flood Zone Control Permit (Cith (Permit Fee: $50.00) — included
in the application for this permit shall be DOE's Flood Zone
Control Permit, fully executed by the developer.
0. Landscape Irrigation Permit (Permit Fee: $25.00) - If landscaping
is required by the Planning Department or elected by the deve-
loper, landscape irrigation plans shall be submitted (4 sets) to
Public Works for review and approval prior to beginning any
landscape irrigation work for this project.

AGENDA -ITEM IV) A. : DR- 03 -85: METRO EFFLUENT TRANSFER SYSTEM
INTRODUCTION
METRO is undergoing expansion of the Renton Effluent Treatment plant to increase
the plant's solid waste treatment capacity. Construction is already underway at
the plant. Now METRO is applying for permits to construct the pipeline for
carrying the plant's treated water through Tukwila and on to Puget Sound. The
City's applicable permits include a Shoreline Management Substantial Development
Permit which features Board of Architecture Review of the proposal per
TMC18.60.030(2)(A).
The pipeline alignment runs east of the Duwamish River to east of the Foster Golf
Links, then west to Interurban Avenue So. and then north along either the west or
east side of the street. TMC 18.60.030(2)(E) therefore also requires the Board's
review of most of the pipeline along Interurban Avenue So. outside of the shore-
line area.
The scope of the project required that the actual full -size drawings be attached.
Reductions would preclude reasonable review of the details of the plans.
FINDINGS
1. TMC 18.60.050 contains Board of Architecture Review design review guidelines
for the Board to utilize in reaching its decision. The Board may approve,
modify or deny the application based upon these guidelines.
2. An Environmental Impact Statement and Supplement was prepared by METRO for
this project. In response to final detailed design of the project environmen-
tal mitigation measures were stipulated in an interagency agreement between
METRO and the City.
3. The Shoreline Management Act (RCW 90.58) and permit process (WAC 173 -14)
require a substantial development permit for those portions of the project
within 200 feet of the Duwamish and Black Rivers. On February 1, 1985, a per-
mit application was filed with the City. TMC 18.44 and 18.60.030(2)(A) and
the Shoreline Master Plan govern issuance of this permit.
. 4. Installation of the 8 -foot diameter pipeline will . be underground along the
entire route. Above - ground improvements will consist of restoration of
existing conditions, riverbank stabilization (rock rip -rap), replacement of

the Foster Golf Links bridge, some dike construction, and reconstruction of a
portion of Interurban Avenue So. More specifically the improvements will be:
A. Pipeline installation will occur within temporary construction and per-
manent maintenance easements. Normal maintenance facilities for direct
access into the pipeline and air relief valves will be periodically
located along the route.
B. .Once the pipeline installation is completed and tested the construction
site will be restored to its pre- construction condition. This will pre
dominantly consist of landscaping and soil stabilization measures. In
/ the Foster Golf Links area some of the tees, greens, fairways, irrigation
system, drainage system, parking areas, maintenance and entrance areas,
bridge and landscaping will be relocated and reconstructed per the
comprehensive plan for the golf course. The most noticeable improvement
will be replacement of the existing wood suspension pedestrian bridge at
the southeast corner of the golf course. A prestressed concrete bridge
will replace the existing bridge approximately 30 feet south of the
existing location. A dike system will be tied into the access approaches
to the bridge. While this bridge is under construction across the
Duwamish a temporary wood bridge will be constructed to accomodate
construction equipment access.
C. Stabilization of portion of the riverbank will be done to restore the
site and to improve flow of the Duwamish River. Rock rip -rap and gabion
walls will retain the riverbank pursuant to the construction activities
and some dredging in the river.
D. The 20 foot permanent maintenance easement along the pipeline will be
improved with asphalt, gravel and /or grass to facilitate use by vehicles,
pedestrians and golf cars (in the area of the golf course).
E. Interurban Avenue So. will be reconstructed in those areas where the
pipeline is located. The pipeline alignment alternates. along the east
and west sides of the street. Improvement of the street will include
pavement, curbs and gutters, storm drainage, sidewalks, bicycle trails
and street lighting.
CONCLUSIONS
1. TMC 18.60.050(1) and 18.60.060(4)(A),(D),(E) and (F) Relationship of struc-
ture to site:
The significant structure contained in the proposal is the new permanent
bridge across the Duwamish River at the southeast corner of the Foster Golf
Links. Drawings No. 310 and 311 •(attached) show the prestressed concrete
bridge design is a simple, straightforward approach. The net effect will be a
reasonable relationship of the structure to the golf course and river
environment.

5. TMC 18.60.050(5) and 18.60.060(4)
furniture:
Other facilities to be constructed within the permanent pipeline easement or
along Interurban Avenue So. will mostly consist of surface improvements,
except for street lighting. Adequate pedestrian movement and landscaping will
be provided by these improvements.
2. TMC 18.60.050(2) and 18.60.060(4)(A),(B),(D),(E), and (F) Relationship of
structure and site to adjoining area:
Proposed improvements will compatible with the area character along the pipe-
line route and adjacent properties. Some disagreement may exist regarding the
rep of the wood suspension bridge will a smooth prestressed concrete
bridge at the golf course. Since the finish and texture of the new bridge
remains unspecified, resolution of the bridge design with TMC 18.60.050(2) is
difficult. This may be able to be resolved during the public meeting, but a
more visually interesting bridge surface treatment appears appropriate.
3. TMC 18.60.050(3) and TMC18.60.060(4) (B),(C),(D) and (E) Landscape and site
treatment:
Outside of restoring existing vegetation landscaping plans were not submitted.
Existing plans indicate appropriate pedestrian and vehicular access is pro-
vided. Reconstruction of part of Foster Golf Links will conform to the golf
course comprehensive plan, including landscaping. Overall the appropriateness
of landscaping and treatment of the land and riverbanks appears reasonably
assured by staff's administrative review process.
4. TMC 18.60.050(4) and 18.60.060 (4)(A),(D) and (E) Building design:
The new Foster Golf Links bridge design may be too simplistic and visually
uninteresting for the golf course and river environment. When completed the
visual effect could be abrupt and disconcerting to the public. Therefore,
some revisions to the surface treatment of the bridge appear appropriate to
achieve compatibility with the surrounding area.
Miscellaneous structures and street
Street lighting along Interurban Avenue So. is not specified at this time.
Design of the lighting fixtures and /or approach to street lighting can be sub-
sequently reviewed by staff or returned to the Board for review. Due to the
potential visual impact of street lighting, the Board may appropriately retain
review of the final design.
Air relief valves that will be located periodically along the pipeline route
consist of 3i foot square metal boxes. 'These small structures do not signifi-

cantly visually affect adjacent properties, provided an appropriate paint
color is selected. An "earth tone" seems most called for in the golf course
area and along Interurban Avenue So.
6.. Except for the concerns already expressed the proposal conforms to the
Shoreline Master Plan.
PRELIMINARY RECOMMENDATION
Based on the above and submitted plans staff recommends approval of the projects
design subject to:
1. Revision of the Foster Golf Links bridge to a more visually interesting
surface design treatment per review and approval of City staff.
2. Submission of Interurban Avenue So. street lighting design to the Board
of Architecture Review for approval.
3. Submission of landscaping plans for review and approval by City staff.
4. Completion of the interagency agreement between the City and METRO.
5. Air relief valves being painted earth tone colors in the area of Foster
Golf Links and Interurban Avenue So.

N.C. Machinery proposes to construct a new two story office building and related
site improv at 17025 West Valley Highway. Due to the project's location being
within 200 feet of the Green River, a Shoreline Management Substantial Development
Permit pursuant to the State Shoreline Management Act is required. In addition, TMC
(Tukwila Municipal Code) 18.60.030(2)(A) requires Board of Architecture Review (BAR)
review of the development plans.
Findings
1. TMC 18.60.030(2)(A) required Board of Architectural Review of the proposal.
TMC 18.60.050 contains design review guidelines for the Board to utilize in
reaching its decision. The Board may approve, modify, or deny the application.
2. The subject 14 acre site is currently developed with 88,282 square feet of
office, machine shop, warehouse and storage area divided into 4 separate
buildings.
The property is zoned M -1 Light Industry, which permits offices and sales
and rental of heavy machinery and equipment subject to screening requirements.
The assembling of previously prepared metal exceeding one - eighth thickness is
a nonconforming use which occurs on the property.
• 3. The Public Works Department is coordinating required street improvements in
the West Valley Highway right -of -way with the applicant.
4. Except along the riverbank, the property is essentially level. Existing
vegetation is confined to deciduous and evergreen trees along the landward
side of the dike maintenance road and a section of front yard landscaping
along West Valley Highway.
5. The proposed parking and loading spaces meet minimum requirements per TMC
18.56. 280 parking spaces are required, 296 are provided; 3 handicapped
spaces are provided; and one loading space is provided as required.
6. Nonconforming "display" storage areas•will remain along the southeasterly
position of the site fronting on West Valley Highway.

1. TMC 18.60.050(1) Relationship of structure to site:
The proposed structure and additional parking areas are within the low impact
environment. The proposed structure would measure 27 feet 6 inches in height,
which would not exceed the 35 foot height limit and the parking and storage
areas are shown appropriately screened from the river with a solid, minimum
6 -foot high evergreen sight screen. The parking is located between buildings
and in the rear of the site. The location of and the abundant use of inter-
mittent vegetation within the parking areas is well designed and accomplishes
screening. The 8 -foot wide concrete and asphalt walkways within the site and
the sidewalk to be installed by the property owner along West Valley Highway
will facilitate pedestrian movement into and within the site.
2. TMC 18.60.050(2) Relationship of structure and site to adjoining area:
Surrounding development is a mixture of architecture and building materials.
The proposed building material of tilt -up concrete panels and metal spandrel
panels would appear to be compatible with adjacent commercial and industrial
buildings in the immediate area.
Street circulation and its relation to on -site circulation is being addressed
by the Public Works Department. The project is being given special consider-
ation because of the site's frontage on a state hgihway which is being
proposed for expansion with limited access.
The sidewalk leading from the proposed building to an existing building would
cross several driveways. To ensure pedestrian safety, the applicant should
appropriately design or treat the sidewalk so that it is sufficiently different
from internal vehicular circulation.
In addition, pedestrian paths should be installed from the sidewalk along the
highway right -of -way to the office buildings. The remaining pedestrian path-
ways appear to be adequate.
3. •TMC 18.60.050(3) Landscape and site treatment:
The flat character of the site produces little opportunity for grade changes
to increase visual interest. Siting of the building is also limited by the
previous siting of the 4 existing buildings and the existing plan of the site.
Because current development of the.site is severely restricted by its existing
development and because the industrial land use is located adjacent to the
Green River, maximum use of landscaping should be used to enhance the site.

The Green, River is viewed as a major amenity, to be developed so that the
public and the property owner receive maximum benefit and enjoyment from
the shoreline environment. The City would _J_i.ke- the - property - owner_to.__.
dedicate a 20 foot trail easement within the King County dike maintenance
easement along th:e: river.
To enhance this shoreline environment, groves of shade trees are proposed to
be planted at 30 foot intervals, setback approximately 40 feet, along the entire
riverfront. Final approval of the spacing would be from the King County
Hydraulics Division, who maneuvers heavy equipment along the dike maintenance
road.
The use of shade trees, screen trees and solid hedges should effectively hide
and soften the intense use of the site from Christensen Trail users on the
west side of the River as as for the users of the new proposed trail along
the east side of the property.
Because of the great degree of storage of heavy machinery and parts and the
schematic nature of the landscaping plan that has been submitted, final
approval should be subject to a detailed landscape plan including screening
of all storage areas on the site from Green River.
TMC 18.52.020 requires 15 feet of landscaping in the front yard in M -1
districts. In addition, all outdoor storage shall be screened with screens
a minimum eight feet high and not less than sixty percent of the height
of the material stored.
Landscaping of sufficient depth exists along the majority of the development's
front yard. A 95 foot section, however, located in the northernmost section of
the site adjacent to West Valley Highway is not landscaped and is fenced with
chain link facing. Opaque hedge should be planted to screen and landscape
the fence or a 15 foot landscaped area should push back the fence and fullfill
the front yard landscaping requirement.
4. TMC 18.60.050(4) Building Design:
The proposed building materials of tilt up concrete and metal spandrel panels
.will be compatible with existing building materials on the site and adjacent
properties. The fenestration of the building, particularly along the west and
south elevations, will offer . pleasant relief and visual interest in comparison
to the square buildings without fenestration used in abundance throughout
industrial districts in the area.
5. TMC 18.60.050(5) Miscellaneous structures and street furniture:
External lighting and street lighting details were not provided at the time of
writing the staff report. Therefore,. analysis is precluded at this time.
In addition, no furniture has been shown on the plan as being provided in the
shoreline area, which would be a natural amenity and benefit for the office
workers on the site.

Based upon the above, staff recommends the Board of Architectural Review approve
the application as submitted subject to:
1. Submission of exterior illumination and street lighting for review and
approval by the Planning Department pursuant to the criteria of TMC 18.60.050.
2. Planning Department review and approval of the final landscape plan for
conformance to TMC 18.60.050 and particularly 18 .44.130(2)(C) /140(2)(C)(i)(iii)
for the entire site.
3. Access and street right -of -way improvements approved by the Public Works
Department per applicable City ordinances and standards.

Tukwila Municipal Code Section 18.90.020 specifies that any party aggrieved by the
decision of the Planning Commission or Board of Architectural Review may appeal
that decision to the City Council by 'filing a written appeal to the City Clerk

state the reasons for the appeal, and the City Council may affirm, deny, or modify

A. DR- 03 -85: Metro ETS, requesting approval of a 96" buried for -
cemain pipeline and bridges over the Duwamish River.
Mr. Collins submitted a memo dated April 11, 1985, from the Mayor asking
for a continuance of this item.
Terrance Monahan, Metro, 821 Second Avenue, Seattle, WA, requested that the
Board of Architectural Review act upon the item that evening.
Mr. Collins indicated that the interagency agreement needed to be
completed, and landscaping plans submitted, in order for the Board to
review the proposal.
MR. ORRICO MOVED TO CONTINUE APPLICATION DR- 03 -85, METRO ETS, TO THE APRIL
25, 1985, MEETING, AND EFFORTS BE MADE ON BOTH SIDES TO MAKE SURE THAT THIS
ITEM IS ON THE AGENDA FOR THAT MEETING. MR. SOWINSKI SECONDED THE MOTION,
WHICH PASSED UNANIMOUSLY.

TUKWILA PLANNING. COMMISSION
Minutes of the March 28, 1985, Tukwila Planning Commission meeting.
Chairman Knudson called the meeting to order at 8:07 p.m. Other
Commissioners present were Mr. Sowinski, Mr. Coplen, Ms. Avery, and Mr.
Larson. Representing staff were Rick Beeler, Moira Bradshaw and Becky
Kent, Planning Department.
MS. AVER MOVED TO ACCEPT THE MINUTES OF THE JANUARY 24, 1985, PLANNING
COMMISSIIN MEETING. MR. SOWINSKI SECONDED THE MOTION WHICH PASSED
UNANIMOUSLY.
A. 85 -10 -CUP: Profit Freight, requesting approval of a truck termi-
nal at 4477 So. 134th Pl.
Ms. Bradshaw summarized the staff report.
Chairman Knudson opened the public hearing.
Elisabet Springer, 13325 42nd Ave. So., referred to a letter from Edith
Borden rotesting the establishment of a truck terminal in this area
because t didn't agree with light industry, and felt the request should be
denied. Ms. Springer said she felt an environmental impact statement
should b required. She was concerned this would become a 24 -hour opera-
tion and was opposed to the truck terminal operation.
Joanne Puirer, 13405 42nd Ave. So., Seattle, WA 98168, listed the dates
and tim:s she had observed the trucks operating on the site during off
hours o the day. She felt an Environmental Impact Statement should be
required . and if the truck terminal was allowed it would encourage other
truck to minals to locate in the complex.
Dana Cole, 15255 Sunwood Blvd., Tukwila, WA, 98188, asked what the zoning
was in t e area and suggested the City may want to reevaluate the zoning.

Mr. Beeler described the zoning and explained that truck terminals could
only be allowed with approval of a conditional use permit.
Chairman Knudson closed the public hearing.
Ms. Avery asked if there was anyone representing the applicant. The appli-
cant nor a representative were present.
Chairman Knudson asked if there had been any complaints on the other truck
terminals operating on the site. Mr. Beeler stated that complaints
directed towards Profit Freight and a previous operation had been received.
Ms. Poirer indicated she just had a complaint with Profit Freight.
The Commission discussed the environmental review procedure.
MR. SOWINSKI MOVED TO DENY THE REQUEST FOR THE TRUCK TERMINAL. MS. AVERY
SECONDED THE MOTION.
Mr. Larson recommended that the truck terminal use and M -1 zoning be
reviewed. Mr. Beeler explained the process for a Zoning Code revision and
said the "truck terminal" definition revision was on the Planning
Department's work program for 1985.
MOTION PASSED UNANIMOUSLY.
B. 85 -04 -R: 51st Annexation Rezone, requesting rezone of single
family zoned property (RS -7200) to City of Tukwila single family
zone of R- 1 -7.2, on the west side of 51st Ave. So. between So.
161st St. consisting of 3.4 acres. The subject properties bear
the addresses of 16049, 16059, 16209, 16211, 16219, 16;227, 16233,
16239, 16249 51st Avenue South; 4918 South'164th Street, and 4929,
2930 South 161st Street.
Chairman Knudson opened the public hearing.
Ms. Bradshaw summarized the staff report.
Mr. Sowinski stepped down for the duration of this agenda item.
Don McKay, 4812 So. 164th, inquired about any multi - family zoning in the
area of 164th and 49th. Ms. Bradshaw said the area would be zoned single
family.
Chairman Knudson closed the public hearing.
MR. LARSON MOVED TO APPROVE THE ZONING CLASSIFICATION FROM KING COUNTY
RS -7200 TO TUKWILA R -1 -7.2 SINGLE FAMILY RESIDENTIAL FOR THE 13 PARCELS
KNOWN AS THE 51ST AVENUE ANNEXATION. MS. AVERY SECONDED THE MOTION WHICH
PASSED UNANIMOUSLY.

A. 83 -13 -SPE: Diaz School of Gymnastics, requesting approval of a
cooperative parking agreement.
Mr. Beeler summarized the staff report. He informed the Commission that
the cooperative parking agreement had been signed.
The Commission discussed the current and future parking needs and regula-
tions in that area.
MR. COPLEN MOVED TO APPROVE APPLICATION 83 -13 -SPE: DIAZ SCHOOL OF
GYMNASTICS. MR. LARSON SECONDED THE MOTION.
Mr. Coplen withdrew the motion as no action was required.
BOARD OF ARCHITECTURAL REVIEW
A. DR- O1 -84: Sunwood III, requesting approval of plans for 66
multiple family units.
Mr. Beeler recommended continuance of this item.
MR. SOWINSKI MOVED TO TABLE ANY FURTHER ACTION IN THIS ITEM UNTIL
SUFFICIENT INFORMATION IS AVAILABLE. MOTION DIED FOR LACK OF SECOND.
Jerry Kresovich, Hillis Cairncross Clark & Martin, representing the appli-
cant, said they would not object to a continuance to the next meeting if
there was an understanding that this manner be dealt with in an expeditious
manner.
Mr. Beeler said that the April 11, meeting date would be acceptable to
staff.
Ryan Thrower, President of Sunwood Homeowners Association, requesting the
meeting be held no sooner than one month.
Joanne Hernandez, 15224 Sunwood Blvd., Tukwila, WA 98188, requested a con-
tinuance to May.
MR. LARSON MOVED TO CONTINUE TO THE APRIL 25TH MEETING AND TAKE INTO
CONSIDERATION THAT THE COMMISSION GET ALL THE INFORMATION AND MAKE A
DECISION THAT NIGHT. MR. SOWINSKI SECONDED THE MOTION, WHICH PASSED
UNANIMOUSLY.

into the record on the denial of application 85 -10 -CUP, Profit Freight.
Mr. Knudson opened the public hearing for 85 -10 -CUP, Profit Freight.
Mr. Sowinski said he felt the truck terminal use was too intense for the
area and' would 'have an adverse' effect on the single: family neighborhood.
He was concerned with noise, traffic problems and safety.
Mr. Larson stated that it does not conform to TMC 18.64.050. The proposed
use will be materially detrimental to the public welfare and injurious to
the property or improvements in the vicinity.
