Minutes of the August 8, 1985, Planning Commission meeting.
Chairman Knudson called the meeting to order at 8:00 p.m. Other
Commissioners present were Mr. Orrico, Mr. Mckenna, Mr. Sowinski, and Mr.
Larson. Representing staff was Rick Beeler, Planning Department.
PUBLIC HEARINGS
A. 85 -22 -UUP, 85- 27 -DR: Seattle Rendering Works, requesting an
unclassified use permit for two aerobic bio -tower filters to
replace existing anaerobic filter at 5795 S. 130th Place.
Chairman Knudson reopened the public hearing.
Mr. Beeler explained the changes in the staff report and briefly summarized
the proposal.
John Phillips, 2001 Western Avenue, Suite 555, Seattle, WA, representing
the applicant, explained that PSAPCA monitors odors, and that a scrubber
has been added to eliminate odors.
Chairman Knudson closed the public hearing.
MR. LARSON MOVED TO APPROVE PROPOSAL 85 -22 -UUP AND 85- 27 -DR, ACCEPTING THE
FINDINGS AND CONCLUSIONS OF THE STAFF REPORT, AND STAFF'S RECOMMENDATIONS
AS PREVIOUSLY STATED BY MR. BEELER. MR. SOWINSKI SECONDED THE MOTION.
Mr. Beeler clarified the action was approval of 85 -27 -DR and recommendation
of approval of 85 -22 -UUP. The Commission agreed.
MOTION PASSED UNANIMOUSLY.
BOARD OF ARCHITECTURAL REVIEW
A. DR- 11 -85: Jerome Matthews of Kidder, Matthews and Segner Inc.,
requesting approval of a three - story office building over a one
story parking garage on lot 3, Tukwila Short Plat 78 -2955 located
in the southeast quadrant of the 51st Avenue South and Southcenter
Boulevard intersection.

Chairman Knudson reopened the meeting.
Mr. Beeler explained changes in the staff report and briefly summarized the
proposal. He added to recommended condition #1 "and W.S.D.O.T."
Richard Nichols, David Kehle Architect, reviewed the glazing and revision
to place mirror surface on the inside of the building to reduce reflec-
tivity from 36% to 12 -20% of bronze color glass.
MR. SOWINSKI MOVED TO APPROVE STAFF REVISED RECOMMENDATIONS #1 THROUGH #3
AND ACCEPT THE FINDINGS AND CONCLUSIONS AND CONDITION #4 THAT REFLECTIVITY
OF GLAZING SHALL NOT EXCEED 20 %. MR. MCKENNA SECONDED THE MOTION WHICH
PASSED UNANIMOUSLY.
CITY COUNCIL ACTIONS
Mr. Beeler reviewed the Crestview annexation and Windmark Homes appeal.
OTHER
Mr. Beeler asked the Commission wanted to review the Planning Commission
by -laws. Consensus agreed.
ADJOURNMENT
The Commission adjourned at 8:45 p.m.

Minutes of the July 25, 1985, meeting.
Vice Chairman Kirsop assumed the chairmanship as Chairman Knudson was not
present. He called the meeting to order at 8:00 p.m. Other Commissioners
present were Mr. Larson, Mr. Sowinski, and Mr. Mckenna. Representing staff
were Rick Beeler and Becky Kent, Planning Department, and Mayor Van Dusen.
Mayor Van Dusen expressed his appreciation to the Planning Commissioners
for their volunteer work. He swore in Mr. James Mckenna, newly appointed
Planning Commissioner.
APPROVAL OF MINUTES
MR. SOWINSKI MOVED TO APPROVE THE MINUTES OF THE JUNE 13, 1985, AND JUNE
27, 1985, PLANNING COMMISSION MEETINGS. MR. MCKENNA SECONDED THE MOTION
WHICH PASSED UNANIMOUSLY.
PUBLIC HEARINGS
A. 85- 22 -UUP and 85- 27 -DR: Seattle Rendering Works, requesting
approval of two aerobic bio -tower filters to replace existing
anerobic filter at 5795 S. 130th Place.
Mr. Beeler summarized the staff report, with revisions. He informed the
Commission they would not be able to take official action that evening
because the environmental determination appeal period had not expired.
John Phillips, 2001 Western Ave. Suite 555, Seattle, WA, requested approval
of the unclassified use permit and design review, and indicated that it was
not their intention to replace the system to increase capacity.
Tom Irwin, Ipec USA, PO Box 1607, Vashon, WA, described the nine states of
water treatment and operation of the filters.
The Commission discussed the affects of a power failure on the aerobic bio-
tower filter system.
Mr. Phillips explained how the system would work in the case of a power
outage, and felt the system met all standards of the criteria. He
requested modification to staff's conditions 1, 2 and 3.

August 8, 1985, meeting.

Richard Kehle, 1932 First Ave. Suite 302, Seattle, WA, presented samples of
glass, brick and stucco material proposed for the building. He requested
modifications to condition 4, and said roof top equipment would be
screened. He requested the Board consider approval of the application.
The Board discussed the reflectivity of the glass, and requested different
types of glass with less reflectivity be presented at the next meeting.
Chairman Kirsop continued this item to the August 8, 1985, meeting.
C. DR- 13 -85: Group 5, requesting approval of a 103 unit apartment
complex consisting of 10- apartment buildings and a club house, at
approximately South 137th Street and 139th Street South west of
Interurban Avenue South.
A continuance of this item was requested.
MR. SOWINSKI MOVED TO POSTPONE THIS APPLICATION TO THE AUGUST 8, 1985,
MEETING. MR. LARSON SECONDED THE MOTION, WHICH PASSED
OTHER BUSINESS
A. DR- 12 -85: The Architectural Consultants, requesting approval of
fencing and landscaping along the Green River, as required by the
Board of Architectural Review's condition of approval of this
application at their June 27, 1985, meeting.
MR. LARSON MOVED TO APPROVE THE PHOTINIA PLANT MATERIAL FOR THE ORIGINALLY
PROPOSED IVY ALONG THE CYCLONE FENCE. MR. MCKENNA SECONDED THE MOTION,
WHICH PASSED UNANIMOUSLY.
CITY COUNCIL ACTIONS
Mr. Beeler briefed the Commission on Windmark Homes appeal, Fire
District #1 annexation, Tukwila Pond, Valley View Estates Final EIS, and
McMicken Heights annexation rezone and comprehensive plan amendment.

SHORELINE MANAGEMENT SUBSTANTIAL DEVELOPMENT
PERMIT
Notice is herby given that Pitney Bowes, Inc. who is owner of the below
described property has filed an application for a substantial development
permit for the development of a two story addition to an existing office/
warehouse building located at 116 Andover Park East within SE* of section
23 of township 23 N., Range 4 W.M., in Tukwila, Washington. Said develop-
ment is proposed to be within the Green River and its associated wetlands.
Any person desiring to express his views or to be notified of the action
taken on this application should notify Rick Beeler, Associate Planner, in
writing of his interest within tirty days of the final date of publication
of this notice which is March 31, 1985. Written comments must be received.
by April 31, 1985.

satisfactorilly.

CONSTRUCTION AND AMENDING ORDINANCE
NOS. 1158 and 1217
The CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON does ordain
as follows:
1. Section 1 of Ordinance No. 1158 passed in May, 1980 and
amended by Ordinance No. 1217, passed in June, 1981, is hereby
amended to read as follows:
"Whenever a building permit application is made
for the construction of new multi - residential,
commercial or industrial structures within the
City, the person, partnership, or corporation
seeking such permit shall submit a sidewalk
construction plan for approval by the Directors
of the Departments of Public Works and Planning.
The sidewalk construction plan shall include all
plans and specifications necessary for the
construction of sidewalks adjacent to all edges
of the property adjoining any street or public
right -of -way. A building permit shall not be
issued until after a sidewalk construction plan
is approved by the Director of the Department of
Planning.with the consent of the Director of the
Department of'Public Works.
"No final certificate of occupancy shall be
issued for the subject project until the
sidewalks have been constructed in accordance
with the approved plan or the applicant has made
ccticfactcry alternate arrangements with the
Director of the P12r ^i ^f.; Department of Public
Works, which have been approved by the Director
of the Planning Department.
"Building permit applications for construction of
improvements on property zoned for single - family
residential use shall be excluded from this
requirement except when such sidewalk is built as
a part of an overall development, plat or
subdivision." •
2. Section 4 of Ordinance No. 1158, passed in May, 1980,. and
amended by Ordinance No 1217, passed in June't 1981, is hereby
amended to read as follows:
"A delay, waiver or exception to the requirements
of this Chapter may be granted by the City
"As a condition for granting a delay,' waiver or
exception to the requirements of this. chapter set
forth above, the City Council may require the
applicant to make an agreement which would
provide that such sidewalk improvements would be
constructed at the applicant's sole expense
or to provide for the construction
of said sidewalk improvements by means of
participating in a future local improvement
district, or districts, whichever should occur
sooner."
"In the event a building permit is sought for a
development adjoining any street or other public
right- of- way .does not have an established
finished grade with associated storm drain and
utility systems, including establishment of the
width of said street or right -of -way, the
Director of Public Works is authorized to enter

ORDINANCE NO. 1158
1. Section 1 of Ordinance No. 1158 passed on
1980, is hereby amended to read as follows:
"Whenever a building permit application is made for
the construction of new multi - residential, commercial
or industrial structures within the City, the person,
partnership or corporation seeking such permit shall
submit a sidewalk construction plan for approval by
the directors of the departments of Publid Works
and Planning. The sidewalk construction plan shall
include all plans and specifications necessary for
the construction of sidewalks adjacent to all edges
of the property adjoining any street or public
right -of -way. A building permit• shall not be issued
until after a sidewalk construction plan is approved
by the Director of the Beractment.- e=- Peis -Week
Department of Planning with the consent of the Director
of the Department of Public Works.
"No final certificate of occupancy shall be issued
for the subject project until the sidewalks have •
been constructed in accordance with the approved plan
or the applicant has made satisfactory alternate
arrangements with the Director of the Planning Department.
'3uilding permit applications for construction of'improve-
ments on property zoned for single- family residential •
use shall • be excluded from this requirement except when
such sidewalk is built as a part of an overall develop-
ment, plat or subdivision."
2. Section 4 of Ordinance No. 1155 passed on
1980, is hereby amended to read as follows:
"A delay, waiver or exception to the requirements of
this Chapter may be granted by the City Council upon
request by the applicant. Said request may be granted
if the City Council determines that such construction
is not feasible because of unique topographical
considerations, City Public Works Development Plans
or would render a hardship on the applicant. In the
.event any person desires to file such a request
for delay, waiver or exception, such request'must
be considered by the City Council at least thirty (30)
days before the requested building permit is issued.

AN ORDINANCE OF THE CITY OF TUKWILA, 'WASHINGTON,
RELATING TO THE INSTALLATION, MAINTENANCE AND
REPAIR OF SIDEWALKS AND ADDING TO TUKWILA MUNICIPAL
CODE TITLE 11 AND REPEALING ORDINANCE-NO. 1025.
WHEREAS, it is hereby deemed necessary in the interest of the
public safety, welfare, and convenience to establish.requirements for the
construction of sidewalks for industrial, commercial and residential properties.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
•
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Sidewalks for new construction.
A. • Whenever a building permit application is made for the
construction of new multi - residential, commercial, or industrial structures.
within the City, the person, partnership, or corporation seeking such permit
shall submit.a sidewalk construction plan for approval the Director of the
Department of Public Works. The sidewalk construction plans shall include
all plans and specifications necessary for the construction of sidewalks
adjacent to all edges of the property adjoining any street or other public
right -of -way. A building permit shall not be issued until after a sidewalk •
construction plan is approved by the Director•of the Department of Public Works.
B. Building permit applications for construction of improvements
on properties zoned for single family residential use shall be excluded from
this requirement except when such sidewalk is built as a part of an overall
development, plat, or subdivision.
Section 2. Existing streets or arterials.
It is recognized that there exists in the City, arterials•and
streets which do not have sidewalks. In furtherance of the intent of this
ordinance and subject to the limitations and exceptions provided in other
sections herein, it shall be condition of the issuance of a building permit
for the following construction activities that sidewalks conformina to stand-
ards and guidelines prepared by the Department of Public Works shall' be installed
along the entire street frontage of the property:
A. Substantial remodeling to buildings or structures adjacent
to a business or arterial street and neither zoned nor actually used as a
single family residence. For purposes of.this chapter, "Substantial Re-
modeling" means construction which increases the floor area of an existing
building or structure by at least 20% or any alteration or repairs including
interior, plumbing, electrical and structural made within a 12 month period,
which together exceeds 25 of the value of the previously existing building
or structure.
Section 3. Standards of Construction.
A. All sidewalks required to be constructed under the provisions
of this section shall be of portland cement concrete and sidewalks shall •
otherwise conform to standard specifications and plans for municipal public
works construction, commonly known as APl,'A Standards. All sidewalks required
to be constructed pursuant to the provisions of this section shall be 6 feet
in width for a•rter.ial streets; provided, however, that in C -1 and C -2 zones,
sidewalks shall be 8 feet )gin width. All other sidewalks shall be a minimum
of 5 feet.
B. No fi( hydrants shall be installedthin the borders of
any sidewalk. Fire hydrants.may be located between the curb and sidewalk.
Section 4. Delays,. Waivers or Exceptions.
A delay, waiver, or exception to the requirements of this ordinance
may be granted by the city council upon request by the applicant. Said request
may be granted if the city council determines that such construction is not •
feasible because of unique topographical considerations, city public work
development plans or would render a hardship on the applicant.
• In the event any person desires to file such a request for delay, .
waiver, or - exception, such request must be considered by, the city council at
least 30 days before the requested building permit is issued.
'Section 5. Severability.
If any section, subsection, provision or clause of this ordinance
or its application to any person or circumstance is held invalid by a court
of competent jurisdiction, the remainder of this ordinance or the applications
of the provisions to other persons and circumstances shall not be affected.
Section 6. Repealer.
Ordinance f1025 is hereby repealed.
