the inside of the building. Mr. Keyes indicated that it would not be
feasible becauser the building would have to close down at time of
construction.

The board discussed the depth of the greenbelt along West Valley Highway,
the setbacks, and future expansion of SR 181 and how it will affect the
subject property.

Mr. Beeler summarized the Staff report.
The Board discussed access and distance to the site, and visability.
David Weldy, applicant, explained the limited visibility of the wall -
mounted sign existing on the building, said the purpose of the larger
freestanding sign is because of the obstructions from the road way.
Ms. Altmayer asked what the objection to not building the sign within the
code. Mr. Weldy explained that the manufacturer doesn't make the sign that
meets the sign code.

William Kline, Meyer Sign Co., 512 Minor Avenue, Seattle, WA explained that
the sign manufacturer sets the size of the sign and this is the smallest
sign they produce.
Mr. Weldy withdrew the variance application.
Chairman Goe declared this item void as a result of Mr. Weldy withdrawing
his variance request.
Chairman Goe closed public hearing at 11:00 p.m.
CITY COUNCIL ACTIONS
Mr. Beeler reported on the status of the Metro Effluent Transfer System,
the hiring of a permanent full time inspector, advertisement for an
Associate Planner position, Tukwila Pond Site, Capital Improvement Program,
Urban Form Study, and a possible Long Range Traffic Study.

• Northwest Volvo White Truck Center
Introduction
Last year the facilities at the northeast corner of Interurban Avenue South
(Maule Avenue) and S. 140th Street were improved to house CEC Equipment Company and
Northwest Volvo White Truck Center. Formerly this property contained the Paul
Haggard business which included a freestanding off - premise sign. Removal of this
sign is being pursued by the City. New signage consists of a building mounted sign
and a freestanding sign consisting of one piece of CEC Equipment Company equipment
parked on a concrete pad.
Following CEC Equipment Company's occupancy of the building Northwest Volvo
White Truck Center also moved into part of the building.
Findings
1. CEC Equipment Company was granted a sign permit on March 23; 1984, the existing
48 square foot building mounted sign. The Company was also permitted another
sign consisting of a vehicle parked on the existing concrete pad.
2. Northwest Volvo White Center arranged with CEC Equipment Company to delete the
use of the concrete pad for signage in order to permit the Center to erect its
own freestanding pole sign (Exhibit A). This sign is proposed to be a double
face sign of 200 square feet of sign area (100 square feet per side) and 26
feet in height (Exhibit B).
3. Section 19.32.140(c), Tukwila Municipal Code, (hereinafter referred to as TMC)
permits one freestanding sign on the property. The proposed sign fronts Maule
Avenue, and the property has 346.20 feet of frontage along this right -of -way.
Therefore, this section limits the sign area to a total of 150 square feet
(75 square feet per side). Since the proposed sign exceeds these requirements
by a total of 50 square feet (25 square feet per side) a variance is necessary
per TMC 19.12.060.
4. On February 6, 1985, a sign permit was approved for a 55 square foot building
mounted sign identifying Northwest Volvo White Truck Center.

Conclusions
Variance criteria TMC 19.12.060:
5. The burden of proof that this application meets the requirements of TMC 19.12.060(A)
through (G) rests with the applicant. Written supportive statements are contained
in Exhibit C.
1) "The variance as approved shall not constitute a grant of special privilege
which is inconsistent with the intent of this sign code nor which contravenes
the limitation on use of property specified by the zoning classification in
which this property is located."
Staff:
Per TMC 19.04.020 (A) the purpose of the Sign Code is to minimize "clutter and
distraction." The proposed 83% sign area variance may cause distraction to motorists
along Interurban Avenue South. The large area will be as large or greater than most
of the freestanding signs in the area. Nonconforming and under a request for removal
is the existing Paul Haggard Company pole sign.) Therefore, the variance would appear
to confer a "special privilege" upon the applicant relative to the "...intent of this
sign code..." fostering conforming signs and to other properties in the M -1 zone.
Applicant:
No special privilege is sought. Variance will permit better identification
of a nationally known truck franchise.
2) TMC 19.12.060: "That the variance is necessary because of special circumstances
relating to the size, shape, topography, location or surroundings of the subject
property to provide it with use rights and privileges permitted to other properties
in the vicinity and in the zone in which the subject proeprty is located."
Staff:
Approximately 150 feet of private property (Puget Power) and Maule Avenue separate
the subject sign from Interurban Avenue So. The grade of the Puget Power property is a
few feet above the grade of Interurban Avenue So. and slightly more above the ground
elevation at the proposed sign location. However, the 26 foot sign height more than
compensates for the grade differential and provides unhindered motorist views southbound
and largely unblocked views northbound on Interurban Avenue So. The latter vision is
hindered slightly by the existing Rustic Log Homes sign.
Other businesses along the east side of Interurban Ave. S. immediately south of
the subject site have erected a mixture of freestanding and wall signs. On the Puget
Power property (adjacent to the street) a few pole signs have been located. Many of
these signs appear to not conform to existing sign regulations.

While nonconforming signs exist in the area in terms of sign area, the issue is
whether a conforming sign on the applicant's property will provide sufficient
identification. A visual survey of the area indicates the affirmative. The purpose
of the Sign Code is not to add more nonconforming signage, but to gradually bring signs
into conformance. An applicant does not possess rights to existing nonconforming
signage, but is entitled to sufficient identification.
Applicant:
Distance of the sign from Interurban Avenue demands as large a sign as is reason-
able to permit adequate legibility for speed of traffic.
3) TMC 19.12.060: "That the granting of the variance will not be materially
detrimental to the public welfare or injurious to property or improvements in
the vicinity and in the zone in which the subject property is located."
Staff:
Detriment or injury to the public welfare or other properties will not occur as a
result of granting the variance. However, some support could be given to the allegation
of detriment caused by the unusual distraction to motorists in viewing the large sign
within vision of the adjacent Foster Golf Links.
Applicant:
Proposed sign poses no health hazards or detrimental impact to the property or
buildings.
4) TMC 19.12.060: "That the special conditions and circumstances prompting the
variance request do not result from the actions of the applicant."
Staff:
The location of the property and topography of adjacent Maul Avenue are not of the
applicant's doing. However, these circumstances are not that "special" so as to form
a basis for granting the variance.
Applicant:
Purpose of this variance is to aid in identification of applicant.
TMC 19.12.060: "That the variance as granted represents the least amount of
deviation from prescribed regulations necessary to accomplish the purpose
for which the variance is sought and which is consistent with the stated intent
of this code."
Staff:
Sufficient visibility exists of a conforming sign at the proposel location to
satisfactorily identify the applicant's business. The requested 33% deviation will
contribute to visual clutter and distraction along Interurban Avenue South.

Applicant:
The requested variance would result in a virtually unnoticable deviation due to
the distance of the sign from its viewpoints.
6) TMC 19.12.060: "That granting of the variance shall result in greater convenience
to the public in identifying the business location for which a sign code variance
is sought."
Staff:
The requested increase in sign area is of questionable benefit to the public in
identifying this business. This is highly subjective and largely unmeasurable.
HOwever, a visual survey of the area indicated that the public will have no unusual
trouble identifying the premise via a conforming sign.
Applicant:
This is the primary purpose of the requested variance.
7) TMC 19.12.060: "That the granting of the variance will not constitute a public
nuisance or adversely affect the public safety."
Staff:
The additional sign area may create a distraction to motorists on Interurban Ave.
So., but this is a highly subjective conclusion. There is a very real potential that
the 33% increase in sign area will be very noticeable and thereby distracting to
motorists.
Applicant:
No public nuisance or adverse affect to public will result for this sign.
Preliminary Recommendation
Based upon the above, staff recommends the variance be denied.
