Dear Mr. Wagner:
Per my discussions with the Planning Department and our City Attorney, The City
has granted the required 10' of landscaping as reflected in your revised site
plans through the Board of Adjustment on the condition of turnover of the
right -of -way immediately thereafter.
This letter represents our signed approval of your site plans for the 10'
landscaping variance through the Board of Adjustment, only. This letter is in
effect upon receipt of the right -of -way previously conditioned by the City of
Tukwila to me.
If you have any questions regarding this matter, please do not hesitate to call

Minutes of the May 16, 1985, Board of Adjustment meeting.
Chairman Goe called the meeting to order at 7:05 p.m. Other Board members
present were Mrs. Regel, Ms. Harris, and Ms. Altemayer. Representing staff
were Rick Beeler, Becky Kent, Planning Department; and Ross Earnst, Public
Works Department.
APPROVAL OF MINUTES
MS. ALTMAYER MOVED TO APPROVE THE APRIL 4, 1985, BOARD OF ADJUSTMENT
MINUTES. MR. GOE SECONDED THE MOTION, WHICH PASSED.
CITY CuUNCIL ACTIONS
It was the consensus of the Board to move this item to the end of the Board
of Adjustment agendas permenently.
PUBLIC HEARING
A. 85 -14 -V: City of Tukwila, requesting a 5 -foot variance from the
landscaping requirements of TMC 18.32.020 in order to widen
Andover Park West south of Tukwila Parkway.
Mr. Beeler summarized the staff report.
The Board inquired about parking, access, the use of the building, and the
road improvement.
Ross Earnst, City Engineer, explained the necessity of the variance and
described the proposed street improvement project.
Chairman Goe opened the public hearing.
The Board discussed landscaping and buffering between the road and
sidewalk. Mrs. Harris asked if there was anything in writing from the
owner agreeing to dedicate the right -of -way.
Eric Wagner, Armada Laugerquist, said they have agreed with dedication of
right -of -way and is shown on the plans, but nothing had been provided in
wri ting.

The Board discussed the impact of the action on the site and adjacent

INTRODUCTION
The Abbot Laboratories building at 301 Tukwila Parkway was recently sold and
issued a building permit for remodeling to retail and office use. The intersec-
tion of Tukwila Parkway and Andover Park West is about to be improved, including
street widening. To facilitate widening of Andover Park West, the City is
requesting a variance from the landscaping requirements on the Abbot Laboratories.
Additional street right -of -way will require reducing the landscaping from 15 feet
to 10 feet.
FINDINGS
1. On April 23, 1985, a building permit was issued for remodeling the Abbot
Laboratories building to an office and retail center to be know as "The
Annex ". The development complied with Zoning Code regulations, including 21
feet of landscaping along Andover Park West.
2. This summer the City and State will be improving Tukwila Parkway between the
"S- Line" and "T- Line" bridges. Improvement of the intersection with Andover
Park West includes widening the east side of this street along The Annex pro-
perty. The addition of a right turn lane and sidewalk will require taking 11
feet of The Annex property. As a sresult the 21 feet of approved landscaping
will be reduced to 10 feet of landscaping.
3. The Annex property owner has been cooperative and amenable to dedicating the
required right -of -way provided approved parking is not reduced or modified.
Landscaping, not parking, is affected by the variance request. The owner is
agreeable to the City seeking the variance.
4. Existing landscaping on the east side of Andover Park West and south of the
subject site is generously more than the 15 -foot zoning Code requirement.
(TMC 18.52.020). Different landscaping designs include lawn and trees or
groundcover, trees and shrubs.
5. The Annex property is essentially level and can accommodate additional parking
and /or another smaller building. The shape of the property is rectangular ,
and the approved building expansion will lie 70 feet from the existing west
property line.
6. In the CBD area there appears to not be similar variances granted in the past.

7. The Board of Adjustment may approve, modify or deny the variance request per
the variance criteria of TMC 18.72.020.
CONCLUSION
1. Criteria TMC 18.72.020(1): "The variance shall not constitute a grant of spe-
cial privilege inconsistent with the limitation upon uses of ther properties
in the vicinity and in the zone in which the property on behalf of which the
application was filed is located."
If the variance is granted the residual landscaping will be unique in the CBD
area. However, the City's current drafting of the Sidewalk Plan will even-
tually implement sidewalk constrtuction which will reduce existing landscaping
to less than Zoning Code requirements. In addition, future potential roadway
improvements in the area, especially at intersections, will impact adjacent
landscaping similar to the subject site.
The City will not be given a "special privilege" in this application, but will
be permitted to improve Andover Park West to accommodate existing and future
traffic in the CBD. When similar improvements become necessary elsewhere in
the area, the City will similarly impact adjacent properties.
2. Criteria TMC 18.72.020(2): "The variance is necessary because of special cir-
cumstances relating to the size, shape, topography, location or surrounding of
the subject property in order to provide it with use rights and privileges
permitted to other properties in the vicinity and in the zone in which the
subject property is located."
Current approved improvements to The Annex property preclude adding one lane
to Andover Park West while not producing a nonconforming landscaping
situation. The needed 11 feet of right -of -way will reduce the approved 15
feet of landscaping to 10 feet of landscaping. This amount of right -of -way is
the minimum necessary to construct a right turn lane and relocate the required
6 foot sidewalk. Construction of these improvements cannot otherwise be
accomplished in the existing space between the existing right -of -way and the
approved Annex parking area.
3. Criteria TMC 18.72.020(3): "The granting of such variance will not be
materially detrimental to the public welfare or injurious to the property or
improvements in the vicinity and in the zone in which the subject property is
situated."
Material detriment or injury to other properties or the public will not occur
as a result of granting the variance. The visual impact will be noticeable to
the extend dependent upon what landscaping the City installs to mitigate the
roadway improvement. Otherwise, a public benefit of decreased traffic
congestion will benefit the entire community.
4. Criteria TMC 18.72.020(4): "The authroization of such variance will not
adversely affect the implementation of the Comprehensive Land Use Policy
Plan."

The improvement of this intersection will increase the efficiency of traffic
circulation while minimizing the impact on the existing environment (Objective
1, p. 72 and Policy 12, p. 74, Comprehensive Land Use Policy Plan).
Therefore, the Plan's implementation is enhanced by the variance.
5. Criteria TMC 18.72.020(5): "The granting of such variance is necessary for
the preservation and enjoyment of a substantial property right of the appli-
cant possessed by the owners of other properties in the same zone or
vicinity."
The variance is necessary for the Annex parking to be installed as approved
without revision to provide for the 15 -foot landscaping requirement. This
would be the same circumstance for other developed properties in the area
where streets may be widened. In this instance the Annex's need for parking
to satisfy the economic constraints of the development is met as priority
right above the need for conforming landscaping.
PRELIMINARY RECOMMENDATION
Based upon the above staff preliminarily recommends that the variance be approved.
NOTICE OF RIGHTS OF APPEAL
Per TMC 18.90.030, anyone aggreived by the decision of the Board of Adjustment may
appeal that decision to King County Superior Court by filing the appropriate
application with the Court within ten days of the Board's decision.

We will not be able to attend the meeting of the Tukwila Board
of Adjustment on May 16, 1985; however, I would like to make
a comment regarding the variance of landscaping requirements.
As I understand it, the owner is requesting a variance of 5 feet
of the required 15 feet of landscaping made necessary by a
right -hand turn lane being constructed on Andover Park West.
I always thought, in the past, that Abbott Labs landscaping
was not in keeping with its neighbors to the south (our
facility and Fatigue Technology).
If the 5 feet in question would have an impact and be than
desirable in the opinion of the Tukwila Board of Adjustments,
then we would be opposed to a variance.
If, on the other hand, it was the opinion of the Tukwila Board
of Adjustments that the removal of 5 feet did not detract from
the overall landscaping effect, than we would not be in
opposition to a variance.

Per past development of this property special connection charges for water
and sewer are not applicable
The Public Works Department has reviewed your plans and approved sheets 1
of 2 and 2 of 2 (Job No. 85004.01 - February 1, 1985) Per the following
comments and conditions:
1. Prior to issuance of any Utility Permits, authorization for release of
these permits shall be provided by the Planning Director and the
Building Official. Also, prior to issuance of any permit, the Fire
Marshal shall have approved the fire loop, sprinkler vault /hydrant/
fire protection plans for the development.
The following permits are released under the understanding as provided
as follows:
The developer has agreed as part of this redevelopment to provide
the City with the necessary right -of -way as described on Exhibit "A"
(attached) upon receipt of the successful waivers now being.applied

for by Public Works through the Planning Department and Board of
Adjustment. The waivers consists of allowing for credit by the
development for variances to landscaping requirements adjacent to
Andover Park West and Tukwila Parkway in those areas where right-
of-way is being given so that the necessary right turn lane on
Andover Park West and sidewalks can be provided for the benefit of
the traveling Public.
Upon obtaining the waiver through the Board of Adjustment, the deve-
loper agrees to provide the necessary right -of -way within 45 calen-
dar days of receiving written notice from the City that this process
is successfully completed. In consideration for the donation of the
right -of -way, the City will build that portion of the sidewalk system
on Andover Park West to and including the curb around the curb radius
only; the development shall be responsible for building, now, as part
of Abbott Labs Construction, the sidewalk along Tukwila Parkway from
the easterly property line to the beginning of the new curb radius in
Tukwila Parkway (see plans). Included in the developments sidewalk
construction shall be removing of any swale curbing that now exist in
Tukwila Parkway and replacing with a vertical curb at the development's
expense.
If the City fails to secure the necessary waivers in the future, the
development shall be required (as part of their sidewalk permit) to
provide a design for a completed sidewalk on Andover Park West
including utility relocations for light standards, hydrants, meters,
etc., and provide a vertical, concrete curb and gutter section per the
City's standard Plans and provide and build a completed concrete
sidewalk all at their own expense. This work shall be included as part
of the normal development process and shall be complete prior to the
City's sign -off of this development. In the mean time, the City shall
expedite as quickly as possible, the waiver process to secure the
necessary variances to allow for the right turn lane and relocated
sidewalk. Your cooperation in this matter is most appreciated.
The following permits shall be applied for and obtained prior to
beginning the construction of the related elements of this project:
1. Curb Cut /Access /Sidewalk Permit - (Permit Fee: $25.00) - The con-
ditions of this permit shall be per the above paragraphs related to
the new right turn lane and sidewalk system and the additional com-
ments as provided. Driveway Aprons, sidewalks, handicapped ramps,
curb and gutters shall be per the City's Standard Plans and per
Ordinance 1233. It should be emphasized that the curb and gutters
on Tukwila Parkway shall be per the City's Standards for vertical
curb and gutter section so that there is a complete separation bet-
ween vehicular and pedestrian travel. The sidewalk shall be 6 feet
in width (this development is neither C -1 or C -2 zoned). Included
in providing the new sidewalk, street lights and hydrants shall be
relocated behind the new walkway. Adjustments to valves, manhole
and vaults shall be provided flush with the elevation of the new
sidewalk. Sanitary sewer manholes shall be adjusted to the new
sidewalk grade and provided with locking manhole cover lids. Since the

City's work will go after your construction, you will build an asphalt
drive to existing curb without apron and match elevation of proposed
new sidewalk (coordinate elevations with INCA).
2. Storm Drain Permit - (Permit Fee: $25.00) - All pipe under paved areas
(from catch basin to catch basin) shall be corrugated metal pipe, mini -
mum Class 14 Galvanized /Aluminum coated or Aluminum. All storm drain
pipe shall be provided with a minimum of 12" of cover throughout and in
Class "B" bedding. No storm line shall be built at a less grade than
0.5%. A control manhole provided and shall be per King County stan-
dards. Included in this design shall be 2' minimum clearance from the
cleanout gate to the end of the inlet pipe. The NOTE under "Chain -200
lbs. capacity" shall be changed to the following: "slack when gate is
down, weld to frame." On sheet 1 of 2, it is anticipated that all side
drains go to external storm plumbing of roof only and not to the inter-
nal structure. Control manhole shall be WSDOT, Type 2.
Per the approved drawing, no new water meter, fire loop and /or sanitary
side sewer are needed per this review. If any of these conditions
changes, Public Works shall be provided with the new plan immediately
for review and approval prior to the construction of these types of
installations
'3. Landscape Irrigation Permit - (Permit Fee: $25.00) - It is the sole
responsibility of the owner or his designers to assure the coordination
of these utility plans to the landscaping design. Requested, if
appropriate, as determined by either the developer or the Planning
Department - is a submittal of 4 sets of Landscape Irrigation Plans to
Public Works for review and approval prior to the construction of any
landscape irrigation sprinkler system. Also included in these plans
will be a DSHS approved backflow prevention device.
The final revised set of plans submitted only included one set for our
review. Prior to issuance of any permits, requested at this time is 5
additional sets of the reviewed plans so that the City has enough
copies for circulation to its inspectors and file.
