The Committee will meet Wednesday, May 1, 1985, at 2:00 p.m. in City Hall Conference Room
#3 to discuss the following application:
Application 85- 19 -SS: Mario A. Segale Short Plat
Segale Business Park owns the property, except for two tax lots, between the Green
River and Southcenter Parkway and S. 180th St. A boundary line adjustment was approved
on April 18, 1985 (85- 09 -BLA) to adjust property lines per existing buildings. Now a
portion of the property is requested to be short platted into four lots with access
directly or indirectly to Southcenter Parkway.
The M -2 zoning of the property requires the following per Section 18.50, Zoning Code:
1. 25 -foot front yard setback.
2. 5 -foot rear yard setback.
A survey of the property indicates that the existing building on proposed lot 1 complies
with the zoning Code.
Section 17.08.070.1, Subdivision Ordinance, requires the followin g be available for a
short plat;
1. Adequate water supply.
2. Adequate method of sewage disposal.
3. Storm drainage improvements and storm sewers.
4. Fire hydrants.
5. Access
6. Deed, dedication, and /or easements.
Water District #75 serves the property. A private sewer system provides sanitary sewer
service. Adequate storm drainage exists, as do fire hydrants. Access to the revised

Dear- Mr. Segale:
As you know, the City of Tukwila adopted a new Subdivision Code on May 2, 1977.
Among the provisions of this new code, the following ones directly affect Segale
Business Park:
1. 17.04.030 SCOPE: This states that the code applies to division of land
for sale, lease, or gift.
2. 17.16.010 PURPOSE: This states the purpose of a binding site improve-
ment plan is to accommodate the division of land for purpose of lease
and construction.
3. 17.16.020 SCOPE: This states that not more than one principal building
can be constructed on a lot of record.
I've listed the above subdivision code subsections since I feel they are the most
relevent to Segale Business Park. What it means is'that it does not allow the
city administration to issue any further building permits to Segale Business Park
until a binding site improvement plan is applied for, approved by the Short Sub-
division Committee (Fire Chief, Public Works Director, and Community Development
Director), and than have a Certificate of Segregation issued by the City. (SEE,
Sections 17.16.060 and 17.16.070).
The other alternative is to apply for a full subdivision which would take 4 - 6
months to process as opposed to no more than 20 days for the binding site plan.
This binding site plan concept was put in by the City at the encouragement of
the business community.
At the time of issuance of your last building permit, I informed Bruce Solly of
your office that the City could not issue any further building permits until a

binding site improvement plan was completed. That permit was applied for July
27, 1977 and issued August 27, 1977. I authorized release of that permit in
spite of the Subdivision Code due to contractual agreements you had with future
occupants of the building and the fact the building was in the planning stages
at the time of the adoption of the code. Also, .about a month ago, I had lunch
with Mr. Solly and asked if a binding site plan was being applied for. He
indicated I should communicate directly with you on the subject.
I would like to resolve this potential problem well ahead of the time you want
to apply for another building permit to avoid any hardships to Segale Business
Park. I suggest we arrange a meeting as soon as possible to resolve the matter.
Due to the seriousness of the situation, I have discussed the matter with Mayor
Bauch. He has agreed to also help settle the situation.
Please advise me of when you want to get together. In any case, we cannot issue
further building permits on Segale Business Park until compliance with the Sub-
division Code is accomplished.

Per. Bruce Solly of the Segale Business Park has recently requested that
staff inform him of the effect that the new Subdivision Code (Ordinance
#1014) has on the Segale property.
Presently, the Segale property consists of three tax lots: #18, #36 and
#55. What is commonly known as the Segale Business Park straddles tax
lots #55 and #18. These two lots comprise approximately 80 acres. A
hand - sketched map is included herewith to help you locate these lots.
If Mr. Segale desires to divide his existing lets further for purpose of
sale, he obviously will either have to short plat or "long" plat consis-
tent with either Section 17.08 or 17.12 of the Subdivision Code.
However, if the division of land is for purposes of lease or construction
for purposes of lease, then the Binding Site Improvement Plan procedures,
Section 17.16, would normally apply.
With Segale, a question arises. That is, is his development already controlled
under an approved and "binding" site plan? And if so, is his business park
development exempted from the B.S.I.P. requirements of the Subdivision Code?
A strict application of the Subdivision Code would require a B.S.I.P, to be
filed with the City prior to construction of any new structure for lease on
either of the tax lots, (SEE, Section 17.16.020 Scope). This is based on the
fact that any new structure would create more than one principal building on
the lot of record. However ,back in 1973 when Segale obtained a Shoreline
permit from the City, he prepared an EIS which depicted a site plan upon which
impacts were extrapolated. Although he has subsequently developed somewhat
consistent with this site plan, it is not, in the view of this office, a
"binding" site plan, (.SEE, Gary's memo to me dated 24 May 1977). Therefore,

The purpose of the Subdivision Code is well expressed in Section
17.04.020 and the Code's scope includes not only the division of
land for sale but for lease or gift as well. Section 17.04.040
(15) purposely defines "lease" in a general manner and so as to
include only those leases which affect the use of land through
construction of improvements. The Binding Site Improvement Plan
established under Chapter 17.16, provides for developments such
as the Segale Business Park while ensuring that the goal of the
'Subdivision Code, as well as its standards, are not subverted.
With respect to the assertion that Segale Business Park has fulfilled
the intent of the B.S.I.P. through other and heretofore permit proce-
dures , • I offer the following comments.

A. Shoreline toaster Permit:
The drawings and text which provided the basis for approval .do
not address the requirements of the B.S.I.P. The permit and
its conditions, moreover, do fulfill the literal requirements
of the B.S.I.P. 'The Shoreline 'Master Permit', granted under
the purview of the Shoreline Management Act, cannot be considered
as implicit fulfillment of subdivision requirements.
B. Utility Permits:
Permits issued by the Public Works Department regarding roadway
and utility construction merely authorizes such to be constructed
in accordance with construction standards but do 'not allow review
of where the improvements will be located.
Chapter 17.16 spells out the concerns of the City regarding develop-
ments such as the Segale Business Park and provides an expedient and
simple manner in which to fulfill the letter aqd spirit of the Sub-
division Code. While the portion of Segale Business Park already
developed may appear to be superfluos on a B.S.I.P.,.such a require -
ment is necessary to fulfill the mandate of the 1 aw and woul d appear
to be quite simple to do. The provision of a B.S.I.P. allows municipal
review of the overall development-scheme rather than fractional accep-
tance of whatever is done. Such is a general purpose of the Subdi\'s

After a review of our files on the Segale Business Park development and consulta-
tion with the Public Works Department, it is the opinion of this office that a
binding site plan is currently not in effect on the Segale property. Therefore,
a binding site improvement plan would be necessary before further construction
on the land.
The shoreline "master permit ", granted under the purview of the Shoreline Manage-
ment Act, cannot be considered as fulfillment of subdivision requirements. In
addition, permits issued by the Public Works Department relative to roadway and
utility construction merely authorize these improvements to be constructed in
accordance with standards of the City, but do not allow review of where these
improvements will be located.
Chapter 17.16 (of the new subdivision ordinance) spells out the concerns of the
City with regards to subdivision /construction for purposes of lease. This same
section provides for the filing of a Binding Site Improvement Plan (B.S.I.P.), an
expedient and simple procedure through which the requirements of the subdivision
code may be met. While the B.S.I.P. process allows for municipal review of the
overall roadway and utility networks, it allows the developer to subsequently
divide his land into leaseholds as he sees fit.
In effect, then, the subdivision ordinance requires that a B.S.I.P. be filed on
the Segale property before further construction can occur.
