OFFICE OF THE CITY ATTORNEY 010.005 JEH /ko 11/1/85 CITY OF TUKWILA WASHINGTON ORDINANCE NO AN ORDINANCE OF THE CITY OF TUJKWILA, WASHINGTON, AMENDING THE OFFICIAL ZONING MAP OF THE CITY ADOPTED BY ORDINANCE NO. 1247 BY ESTABLISHING A ZONING CLASSIFICATION ON CERTAIN PROPERTY RECENTLY ANNEXED TO THE CITY AND COMMONLY KNOWN AS THE 51ST AVENUE SOUTH BETWEEN SOUTH 164TH AND SOUTH 166TH ANNEXATION. WHEREAS, the real property commonly known as the 51st Avenue South between South 164th and South 166th Annexation and more particularly described hereinafter, was annexed to the City of Tukwila by Ordinance No. 1365, passed by the City Council on October 7, 1985, and WHEREAS, the Tukwila Planning Commission at a public hearing held on October 24, 1985, considered a final zoning classification for the subject property and adopted findings, conclusions and a recommendation to the City Council that the property be zoned R- 1-7.2 and, WHEREAS, the City Council reviewed the recommendation of the Planning Commission at public meetings held on November 12 and 18, 1985, adopted findings and conclusions, and determined to establish the final zoning classification for the property as provided for herein, and WHEREAS, the City's SEPA Responsible Official has determined that there is no significant adverse environmental impact as a result of the final zoning classification, now, therefore, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Zoning Established. The Official Zoning Map of the City of Tukwila, as adopted by Ordinance No. 1247 of the City, is hereby amended by establishing the zoning classification of R- 1-7.2 for the newly annexed real property commonly known as the 51st Avenue South between South 164th and South 166th Annexation, and more particularly described as follows: Starting at the intersection of south 164th street and the westerly boundary of the City of Tukwila, southerly along said boundary to the north intersection of south 166th street, thence westerly 175.24 feet, thence northerly to the north boundary of the City of Tukwila at south 164th street, to point of origin. Situate in the County of King, State of Washington. Section 2. Duties of Planning Director. The Planning Director is hereby directed to effectuate the necessary amendments to the Official Zoning Map of the City of Tukwila as authorized herein. Section 3. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after the date of publication. BOARD OF ARCHITECTURAL REVIEW A. 85- 41 -DR: Leonard Rivero, requesting approval of a structure at 14800 Interurban Avenue South. Ms. Bradshaw distributed Exhibit E, photographs taken of the site, to the Board and summarized the staff report. Leonard Carlos Rivero, applicant, said he was prepared to abide by all recommendations made. He questioned the recommendation of the 40' setback requirement. Mr. Collins described the future Interurban Avenue improvements and the setback requirement that was from a design point of view. Byron Sneva, Public Works Director, gave further details on the planned improvements for Interurban Avenue. Mr. Rivero indicated that he would be willing to comply with the Building Department requirements and location of the structure. Mr. Kirsop asked how long the structure had been there. Mr. Rivero said since December, 1984. Mr. Kirsop asked about other structures on the site. Mr. Collins said the City was working with Mr. Rivero for compliance of the other buildings, and no applications had been received on those. Mr. Kirsop asked what was the intended use of the structure. Mr. Rivero said a hobby shop /workshop and that no painting would be done. Mr. Kirsop asked if it would be a commercial use. TUKWI P ,0 G COMMISSION / Rick Beeler Associate Planner RB /blk CITY OF TUKWILA PLANNING DIVISION PLANNING COMMISSION STAFF REPORT 85 -23 -R: 51st STREET ANNEXATION AGENDA ITEM . • BETWEEN 164th AND 166th STREETS Zoning Amendment INTRODUCTION The proposed area of annexation encompasses ten (10) lots and generally includes the first 175 feet lying west of 51st Avenue South between 164th Street and South 166th Street. The proposal is to change the zoning from the King County classifi- cation of RS -7200 (Single Family Residential), to the Tukwila classification of R -1 -7.2 (Single Family Residential). FINDINGS A. After meeting with the initiators of the Notice of Intent to Annex, the City Council recorded in its minutes of June 3, 1985 that the City accepted the proposed annexation, require the assumption of existing City indebtedness for the golf course, and authorized the circulation of a petition. B. Effects of the proposal on properties zoned with King County RS -7200 (Single Family Residential) being changed to Tukwila R -1 -7.2 (Single Family Residential) would be as follows: Permitted Uses This change in zoning will change the treatment of, as well as decrease, the number of permitted uses that were formerly allowed under the King County RS -7200 zone. Tukwila's R -1 districts permit only single family units and public parks and playgrounds, not including golf courses, amusement parks or commerial recreation and would permit the following as Conditional Uses: Conditional Uses - Churches (not permitted in converted residential buildings or structures in this district) and community center buildings - Public schools, preschool, elementary, junior high schools, and private . schools with curricula equivalerit to public, elementary or junior high schools Page -2- Planning Commission 85 -23 -R: 51st STREET ANNEXATION June 24, 1985 - Public libraries - Public museums or art galleries - Fire and police stations - Public utility stations or substations - Transit shelter stations - Water towers In contrast to the uses listed above, the former King County RS -7200 permitted, in addition to single family units, townhouses, and individual mobile homes, and the following nonresidential uses: -Art galleries and museums, when located in a public park or on a private school site - Churches, provided they meet certain conditions - Golf courses, private or public, including clubhouses, accessory driving range, pitch and putt courses, provided they meet additional conditions - Schools, elementary, junior high and high, and junior colleges, public, private or parochial; provided they follow specific conditions - Libraries, publicly operated Except for golf courses, townhouses, and individual mobile homes which would not be permitted after the proposed rezone, the nonresidential uses listed above as permitted in King County would require a Conditional Use Permit in Tukwila. The purpose of a Conditional Use process and permit is for public review of unusual or unique types of land uses relative to their impact on the neighborhood and land uses in the vicinity. The proposed Tukwila R -1 -7.2 zone would also eliminate some of the accessory residential uses permitted by the County. The most significant being the following: - Accessory living quarters - Accessory dwellings - Foster family day care home, twenty -four hours -Day nurseries, for a maximum of twelve children under certain conditions Minimum lot size Minimum lot width Front Yard Side Yard Rear Yard Height Page -3- Planning Commission 85 -23 -R: 51st STREET ANNEXATION June 24, 1985 Height, Setback and Yard Requirements There will be slight changes in height, setback and yard regulations. As the table below outlines, Tukwila's R -1 -7.2 district is less restrictive in lot width by 10 feet and more restrictive in front and rear yard setbacks, 10 and 5 feet respectively. Effects of Proposal: Exhibit A shows the subject properties and their dimensions. Each lot meets the minimum lot area requirement of 7200 square feet. Nine of the ten lots are developed with single family structures. The remaining lot is undeve- loped. Any nonconformance in setback or yard requirements would be grandfathered in; however, the property owner would be prevented from future expansion that would increase any degree of nonconformance. 0. Stability of the District: With the adoption of Ordinance 1349 on June 3, 1985, the City Council approved R -1 -7.2 Zoning for the previous 51st Street Annexation which generally lies north of the subject are, between 160th and 164th Streets. Additional R -1 -7.2 zoning is anticipated for the McMicken Heights Annexation area based on the recommendation of the Planning Commission. The east, south and west boun- daries are developed with single family uses and with King County RS -7200 or Tukwila R -1 -9.6 single family residential zones. The surrounding neighborhood including the subject area represent a stable single family neighborhood. (Exhibits A & B). The proposed R -1 -7.2 classification maintains and reinforces the character and conditions of the subject area and its surrounding neighborhood. The proposed rezone from King County RS -7200 to Tukwila R -1 -7.2 maintains the low- density residential designation and therefore is in accordance with Tukwila's Comprehensive Plan. F. A Declaration of Nonsignificance was issued for the proposed zoning amendment. CONCLUSIONS A. Classifying the properties with R -1 -7.2 would facilitate a smooth transition for the proposed annexation area from King County into Tukwila and would bring the area into conformance with the City's zoning ordinance TMC 18. B. No major change in land use and potential future development would result due to the proposed rezone. C. The proposed zoning classifications of R -1 -7.2 is in conformance with the City's Comprehensive Land Use designation of Low Density Residential for the area. D. The proposed zoning reclassificaiton is in conformance with the City's Comprehensive Land Use Policy Plan and in general will serve the public interest. Specifically, the proposed reclassification is consistent with the following goals and policies of the Plan: General Goals Goal 1, p. 12 - "...through the regulation of land use and community growth, promote the health, safety and general welfare of the public." Goal 3, p. - "...encourage planned expansion of the corporate boundaries of Tukwila while providing adequate service levels and improvements to all areas within corporate limits." The proposed zoning amendment is necessary for the regulation of land use, and in particular, for the classification and regulation of the area proposed for annexation into the City. The reclassification would pro- mote the general welfare of the public and would expedite service of the newly annexed area. Examples of services would include building permits, inspections, and the general regulation of land,use via the municipal code. Residence Goal 1, p. 17 - "Preserve the pleasantness and integrity of viable single family areas." The proposed Tukwila classification of R -1 -7.2 most closely compares with the existing King County classification of RS -7200 in regards to use, ::::• Page -5- Planning Commission 85 -23 -R: 51st STREET ANNEXATION June 24, 1985 E. The proposed amendment has been supported by maps, showing the subject area and its relationship to surrounding areas. The proposed zoning is consistent and compatible with adjacent zoning and development. SUMMARY The Planning Commission may wish to recommend approval of the zoning reclassifica- tion from King County RS -7200 to Tukwila R -1 -7.2 (Single Family Residential) for the ten lots known as the 51st Annexation between 164th and 166th Streets.
